  • A Response to the Deadly Consequences of Nuclear War

    You may ask, how can we respond to something so overwhelming, so huge, so threatening that there is nowhere to hide except in denial? We’ve been trying that for almost 70 years. The numbers of weapons are down, their accuracy and lethality are up. It is time to try something new.

    We now know that Nuclear Winter, ozone layer destruction, phytoplankton reduction and other effects of a nuclear exchange would threaten health and life  everywhere on Earth in addition to the warring peoples. The people of the world are held hostage to the passions of the nine nuclear-weapons nations. We are no longer talking about deterring a potential adversary; we are talking about poisoning or ending Life on Earth. This new knowledge potentially adds billions of people to those already determined to abolish nuclear weapons.

    After the disaster of Fukushima, several nations, including Germany, abandoned nuclear generation because of its dangers. But thirteen nations are now constructing new power reactors. The problem is that the refinement of nuclear reactor fuel, if carried further, becomes weapons grade highly enriched uranium. The operation of nuclear plants results in the byproduct of plutonium, which also can be used to make a bomb.

    Since 1970 the Non Proliferation Treaty (NPT) has succeeded in slowing the  proliferation of nuclear weapons. The original deal was that the nuclear weapons states (NWS)  would work at abolishing their weapons, while the nuclear-weapons-free states (NWFS) would refrain from obtaining them. However, the weapons-free states are growing increasingly impatient with the deal, as they realize that they are endangered and that the nuclear weapons states are making little progress toward abolition.

    The Role of the U.S.

    Since 9/11/01 the U.S. has been following a policy of expanding its influence  through military bases around the world, particularly in Central Asia,  Africa and the Pacific. This process is greatly aided by the presence of our vast stockpile of nuclear warheads and far-reaching delivery systems, a fearful “deterrent” to any potential resistance. .

    At the same time, the manufacture and maintenance of nuclear warheads and the missiles, planes and submarines to deliver them anywhere in the world has grown into a huge business. Estimated at $50 billion a year, this business, including Air Force bases, nuclear laboratories, manufacturing plants and other facilities,  employs people in almost every Congressional District. The corporations that manufacture and manage these facilities spend millions a year in campaign contributions and lobbyists persuading our Representatives in Congress not to cut the budget from any part of this huge “defense” conglomerate.

    For other nations of the Nuclear Nine, the possession of nuclear weapons supplements their limited conventional forces when compared to those of a potential enemy. They will resist relinquishing their nuclear weapons, unless there is a reduction in all military forces. But it can be managed.

    Slicing Through the Gordian Knot

    In 1996 the World Court of Justice considered nuclear weapons and concluded that their use was illegal, except as the last resort of an endangered nation. We now know that any use of these weapons threatens Life on Earth. It would be useful if the nuclear-weapons-free nations could persuade the Court to label the manufacture, maintenance, support and any and all preparations for the use of nuclear weapons to be criminal activities. It seems obvious that any activity that threatens the indiscriminate incineration or poisoning of human beings is a Crime Against Humanity. For the millions involved in this work, or profiting from it, it is high time that they face the criminal nature of their employment, management, study or investment. This potential suicide of the human race cannot be disguised as a military deterrent, a patriotic duty or an acceptable activity for any reason. It is a crime beyond all measure. It must be stopped!

    There is now a draft convention for the abolition of nuclear weapons at the United Nations, similar to those that ended chemical and germ warfare. As the step-by-step disarmament process has resulted in the current “modernization” of existing weapons, it is time  to take another approach. The more than 180 nuclear-weapons-free nations should move to finalize this convention with or without the NWS participation. In the final analysis, if the nuclear nations continue to resist abolition, they may be subject to sanctions of the NWFN.

    There is no time to hesitate on the abolition of these weapons. As more nations get nuclear plants, refined uranium fuel and basic technology, the Non Proliferation Treaty will lose its force and the number of nations having nuclear weapons will increase.

    As the United States developed nuclear weapons, is the only nation to have used them, and has one of the greatest stockpiles of warheads, it is important that we take the lead in their abolition. We have an election every two years for all of our Representatives in Congress and a third of our Senators. Can we not demand that all of these elected officials Pledge in their campaigns to Oppose any funding for any part of our nuclear weapons and delivery systems? Can we not ask all those who fund these elections to abstain from funding candidates who will not take the Pledge of Opposition? Can we not disinvest in those corporations that are active in the nuclear weapons business and support the self-perpetuating nuclear weapons lobbies in Washington?

    The choice is clear. Either we exert ourselves to achieve and enforce a Convention to Abolish Nuclear Weapons, or we leave to our children the awsome possibility that they will be poisoned by fallout or incinerated by these criminal weapons.

  • Nuclear Abolition: New Opportunities and Old Obstacles

    At the end of last year, the airwaves and internet were filled with chatter about the ancient Mayan calendar which was predicting the end of the world or a similar catastrophe.  Some scholars argued that the Mayan prophecy related not to an impending disaster but to the end of a 5000 year cycle which would usher in a period of new consciousness and transformation.  While our planet seems to have dodged a bullet and survived the more gloomy interpretations of the ancient prophecy,  the Mayans may have been on to something as it appears we are actually seeing the breakup of a certain kind of world consciousness  regarding nuclear weapons this year and it’s all for the good.

    New initiatives for nuclear disarmament are springing up in both conventional and unconventional forums.   Norway stepped up to the plate in February and convened an unprecedented international meeting to address the humanitarian consequences of nuclear war.  In Oslo, 127 nations, plus UN agencies, NGOs, and the International Red Cross participated in a debate and discussion of the catastrophic potential of nuclear weapons.  Two nuclear weapons states, India and Pakistan attended.

    The five recognized nuclear weapons states under the Non-Proliferation Treaty, who also happen to wield the veto as permanent members of the Security Council (the P5) the US, UK, Russia, China and France, refused to attend.  They spoke in one voice, as I learned on a conference call with Rose Gottemoeller, US Acting Under Secretary for Arms Control and International Security, who told us that the US decision not to attend the conference “was made in consultation with the P5. They all agreed not to attend” because “Oslo would divert discussion and energy from a practical step by step approach and non-proliferation work.  The most effective way to honor the NPT.”  Other P5 spokespeople characterized the Oslo initiative as a “distraction.” Of course it was a distraction from the P5 preferred methods of business as usual in the ossified and stalled NPT process, as well as in the procedurally stymied Conference on Disarmament in Geneva which has been paralyzed for 17 years because of lack of consensus,  required by its rules to move forward on disarmament agreements—a recipe for nuclear weapons forever—with regular new breakout threats by nuclear proliferators.

    Oslo was an end run around those institutions. Taking its model from the Ottawa Process that wound up with a treaty to ban landmines, working outside of the usual institutional fora, it held an electrifying new kind of discussion as testimony was heard about the devastating impacts of what would occur during a nuclear war and the humanitarian consequences, examining the need to ban the bomb.  Prior to the Oslo meeting, more than 500 members of ICAN, a vibrant new campaign, met to work for negotiations to begin on a treaty to abolish nuclear weapons. At Oslo, the nations pledged to follow up with another meeting in Mexico.

    Right before Oslo, The Middle Powers Initiative, working to influence friendly middle powers to put pressure on the P5 for more rapid progress for nuclear disarmament, held a Framework Forum for a Nuclear Weapons Free World in Berlin, hosted by the German government, under the new leadership of Tad Akiba, former Mayor of Hiroshima who oversaw the burgeoning Mayors for Peace Campaign grow to a network of some 5300 mayors in more than 150 countries calling for a treaty to eliminate nuclear weapons.  At that meeting, we were urged to organize Civil Society’s support for a new initiative promoted by the UN General Assembly’s First Committee establishment of a Geneva Working Group to meet for three weeks this summer to “develop proposals for taking forward multilateral negotiations on the achievement and maintenance of a world free of nuclear weapons.” And then in New York this September, for the first time ever, Heads of State will meet at a global summit devoted to nuclear disarmament!

    Furthermore, thanks to the tireless organizing of the Parliamentarians for Non-Proliferation and Nuclear Disarmament,, nearly 1000 parliamentarians from approximately 150 parliaments, meeting at  the Inter Parliamentary Union (IPU) in Ecuador last month chose the topic “Towards a Nuclear-Weapons-Free World: The Contribution of Parliaments”  as a focus this year under their Peace and International Security work.  IPU, which includes most of the nuclear weapons states in its 160 parliaments enables parliamentarians to engage on core issues for humanity.   That they chose the issue of nuclear weapons ahead of seven other proposals indicates the rising interest and consciousness for nuclear abolition around the world.

    And just before this meeting, Abolition 2000, the global network formed in 1995, at the NPT Review and Extension Conference, which produced a model nuclear weapons convention, now  promoted by UN Secretary General Ban Ki Moon in his five point proposal for nuclear disarmament,  held its annual meeting in Edinburg Scotland, supported by the Scottish Campaign for Nuclear Disarmament, which is urging that after the referendum on Scottish independence from England, that England’s Trident nuclear submarine base at Faslane be closed, and that Scotland no longer house the British nuclear arsenal.  The network joined with Scottish activists at Glasgow and Faslane supporting their call to “Scrap Trident: Let Scotland lead the way to a nuclear free world.”

    Despite these welcome harbingers of a change in planetary consciousness in favor of nuclear abolition, we cannot ignore recent obstacles, setbacks and hardened positions in the old patriarchal and warlike paradigm. Disappointingly the Obama administration is proposing deep cuts in funding for nuclear non-proliferation programs so it can boost spending to modernize its massive stockpile of nuclear weapons adding another $500 million to the already bloated weapons budget, which includes spending for three new bomb factories at Oak Ridge, Los Alamos and Kansas City with programs for weapons modernization and new missiles, planes and submarines to deliver a nuclear attack which will come to more than $184 billion over the next ten years.

    In the provocative US military “pivot” to Asia, war games with South Korea for the first time simulated a nuclear attack where the US flew stealth bombers capable of carrying nuclear weapons over South Korea and sent two guided-missile destroyers off the coast of South Korea, announcing plans to deploy an advanced missile defense system to Guam in the next few weeks two years ahead of schedule.

    This engendered an aggressive response from North Korea which moved a medium-range missile to its east coast and threatened to launch a nuclear attack on the US.  The US put a pause on what it had called its step-by-step plan that laid out the sequence and publicity plans for US shows of force during annual war games with South Korea.  But ominously, the New York Times reported on April 4, 2013, that the US and South Korea “are entering the final stretch of long-stalled negotiations over another highly delicate nuclear issue: South Korea’s own request for American permission to enrich uranium and reprocess spent nuclear fuel. Which raises another key obstacle to the surge of sentiment for moving boldly towards nuclear disarmament.
    How can we tell Iran not to enrich uranium when we are negotiating that issue with South Korea as well as with Saudi Arabia?

    If we are serious about nuclear abolition we cannot keep spreading nuclear bomb factories around the world in the form of “peaceful” nuclear power. That is why this new negotiating possibilities outside the NPT are so promising. In order to ban nuclear weapons we are not bound to provide an “inalienable right” to so-called “peaceful nuclear power, as guaranteed by the Article IV promise of the NPT.

    The tragic events at Fukushima, have caused a time-out in the so-called nuclear renaissance that expected a massive increase of nuclear power worldwide.  Just last week, we learned that all of Fukushima’s holding ponds for the toxic radiated water that is used to prevent a meltdown of the stored radioactive fuel rods by cooling them with a constant flow of water, the radioactive trash produced by the operation of nuclear power plants, are all leaking into the earth. We have not yet absorbed the full catastrophic consequences of Fukushima which is still perilously poised to spew more poisons into the air, water and soil; poisons which are traveling around the world. And as the Japanese people rose up to develop plans to phase out nuclear power, members of the Japanese military, acknowledging the significance of nuclear plants as military technology, succeeded in getting the parliament to amend Japan’s 1955 Atomic Energy Basic Law last year, adding “national security” to people’s health and wealth as reasons for Japan’s use of the nuclear power.

    We were warned from the beginning of the atomic age that nuclear power was a recipe for proliferation. President Truman’s 1946 Acheson-Lilienthal Report on policy for the future of nuclear weapons, concluded that “the development of atomic energy for peaceful purposes and the development of atomic energy for bombs are in much of their course interchangeable and interdependent” and that only central control by a global authority controlling all nuclear materials, starting at uranium mines could block the proliferation of nuclear weapons.[i] Nevertheless, President Eisenhower, seeking to counter public revulsion at the normalization of nuclear war in US military policy, was advised by the Defense Department’s Psychological Strategy Board that “the atomic bomb will be accepted far more readily if at the same time atomic energy is being used for constructive ends.”[ii]  Hence his Atoms for Peace speech at the UN in 1953, in which he promised that the US would devote “its entire heart and mind to find the way by which the miraculous inventiveness of man shall not be dedicated to his death, but consecrated to his life” [iii] by spreading the peaceful benefits of atomic power across the globe.

    The fallout from the 1954 Bravo test of a hydrogen bomb contaminating 236 Marshall Islanders and 23 Japanese fisherman aboard the Lucky Dragon and irradiating tuna sold in Japan resulted in an eruption of rage against the atomic bombings which were forbidden to be discussed after 1945 by a ban instituted by US occupation authorities.  For damage control, the US NSC recommended that the US wage a “vigorous offensive on the non-war uses of atomic energy,” offering to build Japan an experimental nuclear reactor and recruiting a former Japanese war criminal, Shoriki Matsutaro, who ran the Yomiuri Shimbun newspaper and Nippon TV network to shill for nuclear power by getting him released from prison without trial. The benefits of nuclear power were aggressively marketed as miraculous technology that would power vehicles, light cities, heal the sick.  The US made agreements with 37 nations to build atomic reactors and enticed reluctant Westinghouse and General Electric to do so by passing the Price Anderson act limiting their liability at tax-payer expense. Today there is a cap of $12 billion for damages from a nuclear accident. Chernobyl cost $350 billion and Fukushima estimates are as high as one trillion dollars.[iv]

    Ironically, Barack Obama is still peddling the same snake oil. During the Seoul Nuclear Security Summit,  designed to lock down and safeguard nuclear materials worldwide, Obama extolled the peaceful benefits of nuclear power while urging “ nations to join us in seeking a future where we harness the awesome power of the atom to build and not to destroy. When we enhance nuclear security, we’re in a stronger position to harness safe, clean nuclear energy. When we develop new, safer approaches to nuclear energy, we reduce the risk of nuclear terrorism and proliferation.”

    The Good News:  We don’t need nuclear power with all its potential for nuclear proliferation

    Following Fukushima, Germany, Switzerland, Italy, Spain and Japan have announced their intention to phase out nuclear power.

    • Kuwait pulled out of a contract to build 4 reactors.
    • Venezuela froze all nuclear development projects.
    • Mexico dropped plans to build 10 reactors.[v]
    • Bulgaria and the Philipines also dropped plans to build new reactors.
    • Quebec will shut down its one reactor.
    • Spain is closing down another.
    • Belgium shut down two reactors because of cracks.

    New research and reports are affirming the possibilities for shifting the global energy paradigm. Scientific American reported a plan in 2009 to power 100% of the planet by 2030 with only solar, wind and water renewables.

    The World Wildlife Fund (WWF) also issued a 2010 Report 100% Renewable Energy by 2050.[vi]

    The UN Intergovernmental Panel on Climate Change predicted that the world could meet 80% of its energy needs from renewables by 2050.

    In 2009 the International Renewable Energy Agency (IRENA), was launched and now has 187 member states.[vii]

    We mustn’t buy into the propaganda that clean safe energy is decades away or too costly. We need to be vigilant in providing the ample evidence in its favor to counter the corporate forces arguing that it’s not ready, it’s years away, its’ too expensive—arguments made by companies in the business of producing dirty fuel.

    Here’s what Franklin Delano Roosevelt had to say about similar forces in 1936

    We had to struggle with the old enemies of peace–business and financial monopoly, speculation, reckless banking, class antagonism, sectionalism, war profiteering. They had begun to consider the Government of the United States as a mere appendage to their own affairs. We know now that Government by organized money is just as dangerous as Government by organized mob.[viii]

    These are the enormous forces we must overcome.  The eco-philosopher Joanna Macy, describes these times as ”the great turning”.  In shifting the energy paradigm we would essentially be turning away from “the industrial growth society to a life-sustaining civilization”, foregoing a failed economic model which “ measures its performance in terms of ever-increasing corporate profits–in other words by how fast materials can be extracted from Earth and turned into consumer products, weapons, and waste.”[ix]  Relying on the inexhaustible abundance of the sun, wind, tides, and heat of the earth for our energy needs, freely available to all, will diminish the competitive, industrial, consumer society that is threatening our planetary survival.  By ending our dependence on the old structures, beginning with the compelling urgency to transform the way we meet our energy needs, we may finally be able to put an end to war as well.

  • Joint Statement on the humanitarian impact of nuclear weapons

    This statement was delivered by South Africa on behalf of 74 countries at the Non-Proliferation Treaty PrepCom in Geneva, Switzerland.

    I am taking the floor on behalf of the following States Parties to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT), namely Algeria, Argentina, Austria, Bangladesh, Belarus, Bosnia and Herzegovina, Botswana, Brazil, Cambodia, Chile, Colombia, Costa Rica, Côte D’Ivoire, Cyprus, Denmark, Djibouti, Ecuador, Egypt, El Salvador, Ethiopia, Georgia, Ghana, Grenada, Guatemala, Holy See, Honduras, Iceland, Indonesia, Iran, Ireland, Jordan, Kazakhstan, Kenya, Kuwait, Lebanon, Lesotho, Liechtenstein, Luxembourg, Malaysia, Maldives, Malta, Mauritius, Mexico, Morocco, Mozambique, Namibia, Nepal, New Zealand, Nicaragua, Niger, Nigeria, Norway, Palau, Panama, Papua New Guinea, Peru, Philippines, Qatar, Samoa, Singapore, Swaziland, Switzerland, Tanzania, Thailand, Tonga, Trinidad and Tobago, Tunisia, Uganda, Ukraine, Uruguay, Yemen, Zambia and my own country South Africa.

    Our countries are deeply concerned about the catastrophic humanitarian consequences of nuclear weapons. While this has been known since nuclear weapons were first developed and is reflected in various UN resolutions and multilateral instruments, it has not been at the core of nuclear disarmament and nuclear non-proliferation deliberations for many years.  Although it constitutes the raison d’être of the NPT, which cautions against the “devastation that would be visited upon all mankind by a nuclear war and the consequent need to make every effort to avert the danger of such a war and to take measures to safeguard the security of peoples”, this issue has consistently been ignored in the discourse on nuclear weapons.

    Yet, past experience from the use and testing of nuclear weapons has amply demonstrated the unacceptable harm caused by the immense, uncontrollable destructive capability and indiscriminate nature of these weapons. The effects of a nuclear weapon detonation are not constrained by national borders – it is therefore an issue of deep concern to all.  Beyond the immediate death and destruction caused by a detonation, socio-economic development will be impeded, the environment will be destroyed, and future generations will be robbed of their health, food, water and other vital resources.

    In recent years, the humanitarian impact of nuclear weapons has increasingly been recognised as a fundamental and global concern that must be at the core of all deliberations on nuclear disarmament and nuclear non-proliferation. This issue is now firmly established on the global agenda: The 2010 Review Conference of the NPT expressed “deep concern at the catastrophic humanitarian consequences of any use of nuclear weapons”.  Similarly, the 2011 resolution of the Council of Delegates of the International Red Cross and Red Crescent Movement emphasised the incalculable human suffering associated with any use of nuclear weapons, and the implications for international humanitarian law.

    The March 2013 Conference on the Humanitarian Impact of Nuclear Weapons held in Oslo presented a platform to engage in a fact-based discussion on the impact of a nuclear weapon detonation. The broad participation at the Conference reflects the recognition that the catastrophic effects of a detonation are of concern and relevance to all.  A key message from experts and international organisations is that no State or international body could address the immediate humanitarian emergency caused by a nuclear weapon detonation or provide adequate assistance to victims.  We warmly welcome Mexico’s announcement of a follow-up Conference to further broaden and deepen understanding of this matter and the resolve of the international community to address the humanitarian impact of nuclear weapons.

    It is in the interest of the very survival of humanity that nuclear weapons are never used again, under any circumstances. The catastrophic effects of a nuclear weapon detonation, whether by accident, miscalculation or design, cannot be adequately addressed.  All efforts must be exerted to eliminate this threat.  The only way to guarantee that nuclear weapons will never be used again is through their total elimination.  It is a shared responsibility of all States to prevent the use of nuclear weapons, to prevent their vertical and horizontal proliferation and to achieve nuclear disarmament, including through fulfilling the objectives of the NPT and achieving its universality.  The full implementation of the 2010 Action Plan and previous outcomes aimed at achieving the objectives of the NPT must therefore not be postponed any further.

    Addressing the humanitarian impact of nuclear weapons is an absolute necessity. As an element that underpins the NPT, it is essential that the humanitarian consequences inform our work and actions during the current Review Cycle and beyond.

    This is an issue that affects not only governments, but each and every citizen of our interconnected world.  By raising awareness about the catastrophic humanitarian consequences of nuclear weapons, civil society has a crucial role to play, side-by-side with governments, as we fulfil our responsibilities.  We owe it to future generations to work together to rid our world of the threat posed by nuclear weapons.

  • Good Faith

    new paper by Judge Christopher G. Weeramantry looks deeply at the concept of good faith, an extremely important concept included in Article VI of the NPT and a central principle of international law. Judge Weeramantry, who served as Vice President of the International Court of Justice when it ruled on the illegality of the use or threat of use of nuclear weapons in 1996, is uniquely qualified to address this topic.

    The Court reinforced the importance of good faith in 1996 when it pronounced: “There exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.”

    According to Weeramantry, “No higher legal pronouncement on a question of international law is possible than the unanimous opinion of the world’s highest court. No greater issue can come to a court than one involving the survival of humanity. No more all-embracing and respected concept exists in international law than the concept of good faith. The obligation spelled out by the Court straddled all these aspects of fundamental importance.”

    Modernization of nuclear weapons and delivery systems, comprehensively detailed in Reaching Critical Will’s report Still Assuring Destruction Forever, brings front and center the concept of good faith. Weeramantry does not mince words when he identifies these modernization programs as breach of good faith. He asks readers to consider whether “there has been not merely a violation of good faith but an actual manifestation of bad faith in this matter.”

    This breach of good faith through modernization programs is a shameful endless circle, with one country’s actions prompting the other nuclear powers to do likewise, escalating the level of departures from the duty of good faith. Such action has also, according to Weeramantry, prompted non-nuclear powers to seek to acquire nuclear weapons.

    In the context of the NPT, good faith would start with an immediate halt to the modernization of nuclear weapons and delivery systems. Good faith efforts must continue until the obligation of nuclear disarmament is achieved. As Judge Weeramantry concludes, “There can be no basis for the disregard or incomplete performance of an obligation so deeply ingrained in international law, so clearly undertaken by the nuclear powers, so carefully pronounced by the International Court of Justice and so definitely determining whether humanity will flourish or perish.”

    David KriegerThe United States and North Korea are playing a dangerous game of Nuclear Roulette.  The US is taking actions that threaten North Korea, such as conducting war games with US ally South Korea, including practice bombing runs that send nuclear-capable B-2 bombers from Missouri to the Korean Peninsula.  The North Koreans, in turn, are blustering, declaring they are in a state of war with South Korea, which technically is true since a truce and not a peace agreement ended the Korean War in 1953.  North Korean leaders have also cancelled the “hot line” with Seoul and are threatening nuclear attacks on the US, its troops and its allies.

    North Korea withdrew from the Non-Proliferation Treaty in 2003 and has since tested nuclear devices on three occasions (2006, 2009 and earlier this year).  It has also tested medium- and long-range missiles and is developing capabilities to threaten the US and its allies with nuclear weapons.  The US has responded to the North Korean tests by holding talks with other countries in Northeast Asia and putting increasingly stringent sanctions on North Korea.  The US also continues to regularly test its long-range, nuclear-capable missiles from Vandenberg Air Force Base in California.  Tensions in Northeast Asia continue to rise.

    Nuclear threats are an integral part of nuclear deterrence.  For nuclear deterrence to work effectively, it is necessary for an opponent to believe a nuclear threat is real.  When the US joins South Korea in playing war games with nuclear-capable aircraft on the Korean Peninsula, the message of threat is clear to the North Korean leaders.  Equally clear is the message from North Korea to the US with its nuclear tests and bluster: North Korea has a nuclear capability that could cause unacceptable harm to the US, its troops and its allies.

    From an objective perspective, each country has the capability to cause the other (or its troops or allies) horrific damage.  While they are pounding on their chests and demonstrating that they are in fact crazy enough to use nuclear weapons, they are engaged in a drama that hopes to dissuade the other side from actually doing so.  Both countries should take note of this.

    The dangerous game of Nuclear Roulette is built into the nuclear deterrence paradigm.  Each time the hammer of the gun is cocked and the gun is pointed at the other side’s head, the barrel of the opponent’s gun is also pointed at one’s own head.  An accident or miscalculation during a time of tension could trigger a nuclear holocaust.

    Yes, of course the United States is the stronger of the two countries and would fare better, perhaps far better, in a nuclear war, but that isn’t good enough.  Yes, North Korea could be destroyed as a functioning country, but at what cost?  In addition to the terrible cost in lives of North Koreans, the US and its allies would also pay a heavy price: first, in the deaths of US troops stationed in the Northeast Asian region; second, in the deaths and devastation of US allies, South Korea and Japan, and possibly of the US itself; and third, in the loss of stature and credibility of the US for having engaged in nuclear warfare that destroyed the lives of potentially millions of innocent North Koreans.

    Nuclear Roulette has no winners.  It is a game that no country should be playing.  But the leaders of countries with nuclear weapons tend to believe these weapons make their own country more secure.  They do not.  They risk everything we hold dear, all we love, and they undermine our collective sense of decency.  The only way out of the Nuclear Roulette dilemma is to unload the gun and assure that it cannot be used again by any side.

    We can do far better than we are doing.  For the short term, the US should stop conducting provocative war games in the region and instead offer some diplomatic carrots rather than sticks.  The US would go far to defuse a dangerous situation by again offering to support North Korea in providing food and energy for its people.  For the longer term, the US should lead the way forward by using its convening power to commence negotiations for a new treaty, a global Nuclear Weapons Convention, to achieve the phased, verifiable, irreversible and transparent elimination of nuclear weapons.

  • Outlawing Nuclear Weapons: Time for a New International Treaty?

    David KriegerIs it time for a new international treaty that would outlaw nuclear weapons?  The short answer to this question is, Yes, it is time.  Actually, it is past time.  The critical question, however, is not whether we need a new international treaty.  We do.  The critical question is: How do we achieve the political will among the nuclear weapon states to begin negotiations for a new international treaty to outlaw and eliminate all nuclear weapons?

    The Non-Proliferation Treaty (NPT) Is Failing

    The NPT has reciprocal obligations.  The nuclear weapon states seek to hold the line against proliferation of nuclear weapons to other countries.  In return, the non-nuclear weapon states rely upon Article VI of the NPT to level the playing field.  Article VI contains three obligations:

    “Each of the Parties to the Treaty undertakes to pursue negotiations in good faith on effective measures relating to cessation of the nuclear arms race at an early date and to nuclear disarmament, and on a treaty on general and complete disarmament under strict and effective international control.”

    None of these obligations have been fulfilled.  Negotiations in good faith have not been pursued on any of the three obligations.

    It has been 42 years since the treaty entered into force, and the nuclear arms race continues.  All of the NPT nuclear weapon states are modernizing their arsenals.  They have not negotiated in good faith to end the nuclear arms race at an early date.

    Nor have the NPT nuclear weapon states negotiated in good faith to achieve nuclear disarmament.  They have not acted with a sense of urgency to achieve the goal of nuclear disarmament in all its aspects.  They have not made a commitment to zero nuclear weapons.

    Finally, the NPT nuclear weapon states have not negotiated in good faith on a treaty on general and complete disarmament under strict and effective international control.  Since the NPT entered into force in 1970, there have been no negotiations on general and complete disarmament.

    The NPT nuclear weapon states seem perfectly comfortable with their failure to fulfill their obligations under Article VI of the NPT.  Given this lack of political will to achieve any of the three Article VI obligations, the prospects for a new international treaty are dim if states continue with business as usual.  That is why the Nuclear Age Peace Foundation called for bold action by the non-nuclear weapon states in its Briefing Paper for the 2012 Preparatory Committee Meeting for the 2015 Non-Proliferation Treaty Review Conference.  The Briefing Paper concluded:

    “It is necessary to ensure that nuclear weapons will not be used again as instruments of war, risking the destruction of civilization, nuclear famine and the extinction of most or all humans and other forms of complex life.  Exposing the dangers of launch-on-warning nuclear policies and the dysfunctional and counterproductive nature of nuclear deterrence theory is essential for awaking policy makers and the public to the imperative goal of achieving a world free of nuclear weapons.  It is a goal that demands boldness by all who seek a sustainable future for humanity and the planet.  The non-nuclear weapon states that are parties to the Non-Proliferation Treaty have both the right and the responsibility to assert leadership in assuring that the nuclear weapon states fulfill their obligations for good faith negotiations for complete nuclear disarmament.”

    The Premises of Bold Action

    Bold action by the non-nuclear weapon states would be based upon the following premises:

      1. The NPT nuclear weapon states have failed to fulfill their obligations under Article VI; this failure poses serious risks of future proliferation.

     

      1. The understanding that even a regional nuclear war would have global consequences (e.g., nuclear famine modeling).

     

      1. The risks of nuclear war, by accident or design, have not gone away.  Stanford Professor Emeritus Martin Hellman, an expert in risk analysis, estimates that a child born today has a one-in-six chance of dying due to a nuclear weapon in his or her 80-year expected lifetime.

     

      1. The understanding that humans and their systems are not infallible (e.g. Chernobyl and Fukushima).

     

      1. The understanding that deterrence is only a theory that could fail catastrophically (see the Santa Barbara Declaration at  /?p=356).

     

      1. Continued reliance upon nuclear weapons is a threat to civilization and the future of complex life on the planet.

     

    1. There needs to be a sense of urgency to eliminate the risks posed by nuclear weapons, nuclear proliferation and nuclear terrorism.

     

    What Would Constitute Bold Action?

     

    The non-nuclear weapon states need to demonstrate to the nuclear weapon states that they are serious about the need for a new international treaty, which would be the means to fulfill the NPT Article VI obligations.  UN General Assembly Resolutions are not getting the job done.  They are not being taken seriously by the nuclear weapon states; nor are exhortations by the UN Secretary-General and other world leaders.  Bold action by non-nuclear weapon states, in descending order of severity, could include these options:

     

     

      1. Announcing a boycott of the 2015 NPT Review Conference if the nuclear weapon states have not commenced negotiations for a Nuclear Weapons Convention or Framework Agreement prior to 2015.

     

      1. Commencing legal action against the NPT nuclear weapon states, individually and/or collectively, for breach of their NPT Article VI obligations.

     

      1. Withdrawal from the NPT as a protest against its continuing two-tier structure of nuclear haves and have-nots.

     

    1. Declaring the NPT null and void as a result of the failure of the nuclear weapon states to act in good faith in fulfilling their Article VI obligations.

     

    Conclusion

    At the outset, I posed this question: How do we achieve the political will among the nuclear weapon states to begin negotiations for a new international treaty to outlaw and eliminate all nuclear weapons?  The answer is that the non-nuclear weapon states must unite and pressure the nuclear weapon states by bold action.

     

    Fifty years after the Cuban Missile Crisis and more than 20 years after the end of the Cold War, we are approaching a critical time in the Nuclear Age.  Our technological genius threatens our human future.  Too much time has passed and too little has been accomplished toward achieving a world free of nuclear weapons.

     

    Bold action is needed to move the nuclear weapon states to fulfill their obligations under Article VI of the NPT.  I favor the first two actions listed above: a boycott and legal action.  I fear that, unless such actions are taken soon by non-nuclear weapon states to pressure the nuclear weapon states to act in good faith, the likelihood is that business as usual will continue, and states will end up choosing the more extreme remedies of the third and fourth actions listed above: withdrawal from the NPT or deeming it null and void.  Should this be the case, we will lose the only existing treaty that obligates its members to nuclear disarmament and also the likelihood of achieving a new international treaty to ban and eliminate nuclear weapons.

  • Third P5 Conference: Implementing the NPT

    Following is the text of a joint statement issued by China, France, Great Britain, Russia, and the United States of America at the conclusion of the Third P5 Conference: Implementing the NPT June 27-29, 2012 in Washington, DC.

    The five Nuclear Nonproliferation Treaty (NPT) nuclear-weapon states, or P5, met in Washington on June 27-29, 2012, in the wake of the 2009 London and 2011 Paris P5 conferences to review progress towards fulfilling the commitments made at the 2010 NPT Review Conference, and to continue discussions on issues related to all three pillars of the NPT nonproliferation, the peaceful uses of nuclear energy and disarmament, including confidence-building, transparency, and verification experiences.

    The P5 reaffirmed their commitment to the shared goal of nuclear disarmament and emphasized the importance of working together in implementing the 2010 NPT Review Conference Action Plan. The P5 reviewed significant developments in the context of the NPT since the 2011 Paris P5 Conference. In particular, the P5 reviewed the outcome of the 2012 Preparatory Committee for the 2015 NPT Review Conference, continued their discussion of how to report on their relevant activities, and shared views, across all three pillars of the NPT, on objectives for the 2013 Preparatory Committee and the intersessional period. The 2012 PrepCom outcome included issuance of a P5 statement comprehensively addressing issues in all three pillars (NPT/CONF.2015/PC.I/12).

    The P5 continued their previous discussions on the issues of transparency, mutual confidence, and verification, and considered proposals for a standard reporting form. The P5 recognize the importance of establishing a firm foundation for mutual confidence and further disarmament efforts, and the P5 will continue their discussions in multiple ways within the P5, with a view to reporting to the 2014 PrepCom, consistent with their commitments under Actions 5, 20, and 21 of the 2010 RevCon final document.

    Participants received a briefing from the United States on U.S. activities at the Nevada National Security Site. This was offered with a view to demonstrate ideas for additional approaches to transparency.

    Another unilateral measure was a tour of the U.S. Nuclear Risk Reduction Center located at the U.S. Department of State, where the P5 representatives have observed how the United States maintains a communications center to simultaneously implement notification regimes, including under the New Strategic Arms Reduction Treaty (New START), Hague Code of Conduct Against Ballistic Missile Proliferation (HCOC), and Organization for Security and Co-operation in Europe (OSCE) Vienna Document.

    The P5 agreed on the work plan for a P5 working group led by China, assigned to develop a glossary of definitions for key nuclear terms that will increase P5 mutual understanding and facilitate further P5 discussions on nuclear matters.

    The P5 again shared information on their respective bilateral and multilateral experiences in verification, including information on the P5 expert level meeting hosted by the UK in April, at which the UK shared the outcomes and lessons from the UK-Norway Initiative disarmament verification research project. The P5 heard presentations on lessons learned from New START Treaty implementation, were given an overview of U.S.-UK verification work, and agreed to consider attending a follow-up P5 briefing on this work to be hosted by the United States.

    As a further follow-up to the 2010 NPT Review Conference, the P5 shared their views on how to discourage abuse of the NPT withdrawal provision (Article X), and how to respond to notifications made consistent with the provisions of that article. The discussion included modalities under which NPT States Party could respond collectively and individually to a notification of withdrawal, including through arrangements regarding the disposition of equipment and materials acquired or derived under safeguards during NPT membership. The P5 agreed that states remain responsible under international law for violations of the Treaty committed prior to withdrawal.

    The P5 underlined the fundamental importance of an effective International Atomic Energy Agency (IAEA) safeguards system in preventing nuclear proliferation and facilitating cooperation in the peaceful uses of nuclear energy. The P5 discussed concrete proposals for strengthening IAEA safeguards, including through promoting the universal adoption of the Additional Protocol; and the reinforcement of the IAEAs resources and capabilities for effective safeguards implementation, including verification of declarations by States.

    The P5 reiterated their commitment to promote and ensure the swift entry into force of the Comprehensive Nuclear-Test-Ban Treaty (CTBT) and its universalization. The P5 reviewed progress in developing the CTBTs verification regime in all its aspects and efforts towards entry into force. Ways to enhance the momentum for completing the verification regime, including the on-site inspection component, were explored. The P5 called upon all States to uphold their national moratoria on nuclear weapons-test explosions or any other nuclear explosion, and to refrain from acts that would defeat the object and purpose of the Treaty pending its entry into force. The moratoria, though important, are not substitutes for legally binding obligations under the CTBT.

    The P5 discussed ways to advance a mutual goal of achieving a legally binding, verifiable international ban on the production of fissile material for use in nuclear weapons. The P5 reiterated their support for the immediate start of negotiations on a treaty encompassing such a ban in the Conference on Disarmament (CD), building on CD/1864, and exchanged perspectives on ways to break the current impasse in the CD, including by continuing their efforts with other relevant partners to promote such negotiations within the CD.

    The P5 remain concerned about serious challenges to the non-proliferation regime and in this connection, recalled their joint statement of May 3 at the Preparatory Committee of the NPT.

    An exchange of views on how to support a successful conference in 2012 on a Middle East zone free of weapons of mass destruction was continued.

    The P5 agreed to continue to meet at all appropriate levels on nuclear issues to further promote dialogue and mutual confidence. The P5 will follow on their discussions and hold a fourth P5 conference in the context of the next NPT Preparatory Committee.

    Mr. Chairman, distinguished delegates, ladies and gentlemen,

    Two years ago in New York our predecessors asked ironically if, at the age of 65, nuclear weapons had reached the time for compulsory retirement. Today, on the verge of them turning 67, we ask you to declare them not only out of business, but also deprived of any retirement scheme.

    We are young, but we are not naive.

    We are young, but we are not unaware of the world around us.

    We are here, representing the youth movement for nuclear non-proliferation and disarmament, urging you to comply with your commitments towards your citizens and to start immediate negotiations for a decisive nuclear weapons convention.

    We all know the destructive power of nuclear weapons, as they have been used and tested too often in the past.

    The presence of nuclear weapons in this world leaves us with two possible futures: in the best case scenario, states continue to own weapons that will never be used. In the worst case scenario, these weapons could be used at all times. We reject both futures, for nuclear weapons should simply not exist.

    Mr. Chairman, the very first resolution of the UN General Assembly established the objective to prohibit the possession of nuclear weapons as a top priority of the international community. Then the Cold War broke out and the two superpowers developed the concept of nuclear deterrence. It is not surprising that the resulting military doctrine was called MAD. The Cold War is now over and deterrence is an outdated justification for the existence of such weapons.

    Today, we feel the danger and risk of nuclear weapons more than ever. The source of our fears and frustrations lies in the same events that have recently challenged the goals of the NPT.

    We, the youth, fear an arms race in several regions of the world and the unchecked proliferation of nuclear weapons.

    We, the youth, sit frustrated as we continue to witness the lack of political will and trust needed to confront these obstacles.

    It is crucial to build trust among states by prioritizing the elimination of rapidly deployable nuclear weapons. These weapons can destroy entire cities or countries in a few hours. Increasing trust would mean that states tempted to build new weapons would be universally accountable to the international community.

    There is a man who has used nuclear weapons and is now engaging against them. His name is Robert Green, he is a former Commander of the Royal Navy and now one of the staunchest advocates of nuclear abolition. We can all learn from his experience.
    There are also those who have survived the use of these terrible weapons. They are the victims and witnesses of the only weapons that could destroy our planet. Hibakushas bring on their dignified fight against them, well aware of their risks. They are a living warning against the worst form of death conceived by humankind, and to ignore them is to ignore the worst risk that humanity could face.

    We live in the world of the Third Industrial Revolution, with an increasing power of communication and online interaction. As a result, we are all linked to each other.

    How do you justify the existence, development and maintenance of these weapons in a world where your children and grandchildren do not see the difference between an Asian and European boy, between an American and an African girl? And how do you justify them in a world hit by the worst economic crisis since 1929, where youth unemployment is increasingly designing our instable future?
    Representatives of the world’s nations, how do you justify maintaining nuclear weapons in such a context? Is this the world that you want to hand down to younger generations?

    We, as young people, care a lot about the future of this planet. We are aware that differences of cultures, religions, and political constraints persist. But we will not give up our fight against nuclear weapons.

    Do not ignore our concern! Remember your humanity, and forget the rest.
