    Tell us about your professional journey working on nuclear issues.

    I got started in this field in Washington D.C. while working as a Presidential Management Fellow. I’d received my Master’s in Public Administration and my Juris Doctorate degree. It was then that a mentor at the Pentagon in the International Law office asked me to a meeting where he was giving legal advice on strategic arms reduction.

    It was my first exposure to anything about weapons of mass destruction and I was fascinated. I’d heard that if you wanted to work on arms control and nonproliferation for a U.S. delegation, you had to go to the Arms Control and Disarmament Agency, or ACDA.

    So I joined ACDA and began working with a delegation that was negotiating a conventional weapons treaty. There weren’t a lot of women on that delegation and there certainly were not a lot of women of color. I was the only one in a substantive position in a room with more than 20 countries negotiating the treaty.

    During my years at ACDA, I received my Master’s in International and Comparative Law. When I left ACDA, I worked on a few congressional commissions before returning to school to get my Ph.D. at the University of Virginia. After completing my dissertation, I joined the Ford Foundation and was there between 2005 and 2009. It was in January 2009 that I received a call to meet with then Senator Clinton who offered me a job as an Ambassador.

    You have led delegations to Nuclear Security Summits and you were the U.S. Representative to the G7 Global Partnership Against the Spread of Weapons and Mass Destruction. What was it like leading delegations and maneuvering in male-dominated international spaces like the Nuclear Security Summits?

    When I started as an Ambassador in 2009, (it was a new position called Coordinator of Threat Reduction Programs that carried the level of Ambassador), there were a number of women experts that Secretary Clinton had brought into the field of WMD within the State Department. There is still more work to be done in this arena and the field is still very lacking in people of color. Unfortunately, when I left government in January 2017, there weren’t as many women represented in U.S. leadership roles on issues of WMD as when I arrived in 2009.

    As far as how I maneuvered, I didn’t have a specific strategy. I just went to work every day and did my thing. I recognized the situation, but it wasn’t always on my mind. There were certainly times when I would feel it more than others. Generally, if you’re the different one in the room, you’re going to wonder about what you say and whether you’re making sense. You’re likely to second-guess yourself more than if you’re a person from the dominant culture or you’re a man in the room. I think men will say things and not worry if it makes sense or if they embarrass themselves – they just keep moving. Women tend to hesitate more before speaking and question whether they’re making sense. That kind of stuff just happens when you’re different, but you deal with it and keep going.

    Many times, I made myself worry more than I needed to. I finally realized that I was worried about things that nobody else was even considering. I carried this burden of, Oh my God – I said something five hours ago, and I’m still not sure if I made the right statement. You realize how much society has made women and people of color feel that we’re not as good and we’re not as competent, even when we clearly are.

    How have you seen gender and/or race impact the conversation or rhetoric used in formal talks such as chemical, biological and nuclear negotiations?

    I wrote a blog focused on diversifying the voices and perspectives of nuclear nonproliferation. Interestingly, I received push back from someone saying, “This doesn’t really matter. All that really matters is that you have certain positions that you take.” It totally passed by the fact that there may be perspectives that could be reflected within policy that we still have yet to understand because we’ve never had significant voices of people of color or women in policy development. We don’t know if we might have taken a different position on things or adopted a different policy. Even if the end result is the same, the path may differ, resulting in better or different kinds of relationships with countries afterwards. I say this because I think people can hide behind the fact that nuclear is a ‘hard security issue’ and say that diverse perspectives don’t matter, but I don’t know if we’ve ever had a real chance to see them.

    With President Trump’s handling of the North Korea situation, from the very beginning it was very much a masculine approach. In terms of the rhetoric – the things that were said, the way they were said – it was like two young boys attacking each other. This was a clear indication of a process that was not productive and only stopped when they started acting more mature. The process might have been different had there been women involved.

    Having said that, what do you see as the biggest barriers to having more women engaged in these issues?

    Well I think it’s having a gender lens. I’ve gone to events in Washington and was pleased to see many young women there from think-tanks, research institutions, and NGOs. Not so much from government. I think the biggest barrier will be whether that can be translated into women moving up the ranks, staying in the field and at the table as they mature in this field. This relies on women staying engaged, but a high percentage of women at events will likely not stay. This is partly because they may not be interested, or they may have children and face challenges to get back in the field. Then there’s the other side – will the established culture be one that makes women feel comfortable and one where they can make a difference? Will there be opportunities for them? Is it going to remain a field where the predominant white male culture ensures that it stays that way? During the Obama Administration, particularly the first four years, you saw a lot of women (“a lot” is relative) but now you see that progress moving backwards.

    Certainly, you’re picking up that torch, with the Women of Color Advancing Peace, Security and Conflict Transformation (WCAPS), the organization you founded in December 2017. Why did you start WCAPS and what makes it so unique and important?

    I’m thrilled to finally be able to do this work. There is such a need for hearing the voices of women of color in areas of peace and security, including nonproliferation issues. There’s a lot I can do to support that.

    WCAPS is focusing on three areas: empowering young women – that’s the first thing. The second thing is strengthening the voices of women already in the field and giving them more exposure. The third is addressing the culture that limits the involvement of women, especially women of color.

    Our mentorship program is a big part of empowering younger women. We also do podcasts and spotlights on women of color to give voice to women who are in this field. This also helps to empower young women because they get to see other women of color who are actually doing the work and are successful. These are women they would otherwise not hear about.

    To address the culture, I host events with NGOs focused on really getting out there and letting other people, such as white men, see that there are women who work in this field and should be valued. Those events work to bring this discussion to NGOs that are still generally identified as “White Male Yale.” I hosted a conversation looking at women of color and peace and security and asking how can we redefine national security. I’m pleased with the way some think tanks and NGOs are making room for these discussions. It’s critical to bring these conversations to those who may not typically be having them.

    How might your professional journey have been different, or had doors opened for you a bit more easily, if you had been able to have women of color as your mentors?

    I’m a pretty driven person. Though I didn’t have the luxury of having women of color in my field that I could look up to, there were women of color in other fields that I saw as role models. There were also white men who were role models. I’ve been told by young people of color, not just women, that they shy away from this field because they don’t see people like themselves. They ask, “Why am I doing this when I should be working on civil rights?” or “I should be working on reducing police brutality.” There are things that might be closer to home for women and for people of color. If they’re committing to this field, it’s important to see that there are others in it who look like them.

    That’s one of the reasons why one-third of my work is dedicated to helping people see and hear from women who are working on these issues. Folks can visit WCAP’s “Pioneers” page and read about the first African American or first Asian American Ambassador. This way, young women who I can’t reach directly can still be inspired.

    There are many women who speak about applying a gender lens to nuclear issues or peace and security. Do you employ a gender and/or a race lens to your work?

    I have two answers to that. I’m African-American and I’m also a woman. I grew up in the Bronx without much money and so I have a very different background from many people I work with. I am very conscious of who I am. When I approach an issue, I bring my identity with me. I don’t consciously say I’m going to apply a gender lens or a person of color lens because that’s naturally how I see things. I think that term applies more to people who need to actively incorporate that lens. For me, “gender lens” means that you’re looking at something and saying, how would this impact women differently than men. Or maybe suggesting we need to bring women in to include perspectives that are not just male.

    You’ve been very intentional about working with youth. How do you view your role in supporting younger women looking to become meaningful change makers?

    I feel very fortunate to have gotten where I am from where I started. I know that, particularly in my area of work, there aren’t a lot of women of color. There are, however, many women of color out there doing great things, but they’re just not getting attention. I feel it’s my responsibility to be a role model to young people, and to bring to the attention of young people, other women doing great work out there that go unseen. The mentorship program is very important, especially because I hear from women all the time that they don’t see people like themselves reflected professionally. For me it’s all about that.

    We’re at such a speed change in U.S. policy regarding how we treat other countries, how we’re perceived by other countries and what we’re doing domestically. We’re making a lot of mistakes that are going to take a long time to fix. In addition to wanting to be a role model, I feel it’s our responsibility, as older Americans, to do what we can to make the right environment for the next generations. America is still great, but we have a lot of things we need to fix. Moving forward, we can be more realistic about who we really are as a country and stop trying to believe we’re so perfect. It’s okay not to have all the answers and its okay not to be the best in the world. You’re never going to fix yourself if you don’t know what your problems are.

    This administration has done the exact opposite of what they said they would do. They were talking about “Let’s make America great again” and I think what they’ve shown is that America has always been great in some ways and has never been great in others. However, some people aren’t ready to hear it.

    What were your keys to success?

    Being open to new opportunities, being persistent, not giving up, believing in myself, being respectful to others, and being open but intentional at the same time. I’ve always said to myself, what is the next thing I want to achieve and how will I get there? Many things have happened that I wasn’t anticipating that have turned out great, but even then, I put myself in a position where things can happen, and I can see the unexpected as opportunities. Balancing the need to have direction with the need to be open to opportunities, and to be able to take those opportunities without being afraid to do so – that is key.


    Bonnie Jenkins brings a world of experience to the field of Peace and Security. She is an expert on arms control and nonproliferation of weapons of mass destruction. She served for nine years as legal adviser to U.S. ambassadors and delegations negotiating arms control and nonproliferation treaties during her time as a legal adviser in the Office of General Counsel at the U.S. Arms Control and Disarmament Agency. She has been a legal adviser on the Comprehensive Nuclear Test Ban Treaty (CTBT), the Chemical Weapons Convention, and the Conventional Forces in Europe Treaty, among others. She has also served as U.S. legal adviser on relevant treaty implementing bodies, such as the CTBT Organization (CTBTO), and the Organization for the Prohibition of Chemical Weapons (OPCW). She also has over 20 years of military experience, serving as an Air Force Reserves Officer before joining the Naval Reserves, rising to the role of Lieutenant Commander and serving her last post at the U.S. Central Command.

    Today Bonnie Jenkins is beginning a new venture as the Founder and President of the Women of Color Advancing Peace, Security and Conflict Transformation (WCAPS).     Mr. Chairman, distinguished delegates, ladies and gentlemen,

    Two years ago in New York our predecessors asked ironically if, at the age of 65, nuclear weapons had reached the time for compulsory retirement. Today, on the verge of them turning 67, we ask you to declare them not only out of business, but also deprived of any retirement scheme.

    We are young, but we are not naive.

    We are young, but we are not unaware of the world around us.

    We are here, representing the youth movement for nuclear non-proliferation and disarmament, urging you to comply with your commitments towards your citizens and to start immediate negotiations for a decisive nuclear weapons convention.

    We all know the destructive power of nuclear weapons, as they have been used and tested too often in the past.

    The presence of nuclear weapons in this world leaves us with two possible futures: in the best case scenario, states continue to own weapons that will never be used. In the worst case scenario, these weapons could be used at all times. We reject both futures, for nuclear weapons should simply not exist.

    Mr. Chairman, the very first resolution of the UN General Assembly established the objective to prohibit the possession of nuclear weapons as a top priority of the international community. Then the Cold War broke out and the two superpowers developed the concept of nuclear deterrence. It is not surprising that the resulting military doctrine was called MAD. The Cold War is now over and deterrence is an outdated justification for the existence of such weapons.

    Today, we feel the danger and risk of nuclear weapons more than ever. The source of our fears and frustrations lies in the same events that have recently challenged the goals of the NPT.

    We, the youth, fear an arms race in several regions of the world and the unchecked proliferation of nuclear weapons.

    We, the youth, sit frustrated as we continue to witness the lack of political will and trust needed to confront these obstacles.

    It is crucial to build trust among states by prioritizing the elimination of rapidly deployable nuclear weapons. These weapons can destroy entire cities or countries in a few hours. Increasing trust would mean that states tempted to build new weapons would be universally accountable to the international community.

    There is a man who has used nuclear weapons and is now engaging against them. His name is Robert Green, he is a former Commander of the Royal Navy and now one of the staunchest advocates of nuclear abolition. We can all learn from his experience.
    There are also those who have survived the use of these terrible weapons. They are the victims and witnesses of the only weapons that could destroy our planet. Hibakushas bring on their dignified fight against them, well aware of their risks. They are a living warning against the worst form of death conceived by humankind, and to ignore them is to ignore the worst risk that humanity could face.

    We live in the world of the Third Industrial Revolution, with an increasing power of communication and online interaction. As a result, we are all linked to each other.

    How do you justify the existence, development and maintenance of these weapons in a world where your children and grandchildren do not see the difference between an Asian and European boy, between an American and an African girl? And how do you justify them in a world hit by the worst economic crisis since 1929, where youth unemployment is increasingly designing our instable future?
    Representatives of the world’s nations, how do you justify maintaining nuclear weapons in such a context? Is this the world that you want to hand down to younger generations?

    We, as young people, care a lot about the future of this planet. We are aware that differences of cultures, religions, and political constraints persist. But we will not give up our fight against nuclear weapons.

    Do not ignore our concern! Remember your humanity, and forget the rest.

  • Nuclear Disarmament’s Midnight Hour

    Gareth EvansLast month, the Doomsday Clock’s hands were moved a minute closer to midnight by the Bulletin of the Atomic Scientists, the respected global organization that for decades has tracked the risk of a nuclear-weapons catastrophe, whether caused by accident or design, state or terrorist, fission bomb or dirty radiological bomb.


    Few around the world seemed to be listening. The story – as others like it since the end of the Cold War ­– came and went within a half-day’s news cycle. But the Scientists’ argument was sobering, and demands attention. Progress since 2007 – when the Clock’s hands were last set at five minutes to midnight – has stalled, and political leadership has gone missing on all of the critical issues: disarmament, non-proliferation, and key building blocks needed for both.


    On disarmament, the balloon has well and truly deflated. The New START treaty, signed by the United States and Russia in 2010, reduced the number of deployed strategic weapons, but left both sides’ actual stockpiles intact, their high-alert status undisturbed,  weapons-modernization programs in place, disagreements about missile defense and conventional-arms imbalances unresolved – and talks on further draw-downs going nowhere.


    With no further movement by the US and Russia, which together hold 95% of the world’s total of more than 20,000 nuclear weapons, no other nuclear-armed state has felt pressure to reduce its own stocks significantly, and some – China, India, and Pakistan – have been increasing them.


    The 2010 Non-Proliferation Treaty (NPT) Review Conference was a modest success, mainly because it did not collapse in disarray, as had the previous one in 2005. But it could not agree on measures to strengthen the regime; its push for talks on a nuclear-weapons-free zone in the Middle East has so far gathered no momentum; North Korea is no closer to being put back in its NPT box; and Iran is closer than ever to jumping out of it, with consequences that would ricochet around the region – and the global economy – if it makes that decision.


    Despite President Barack Obama’s good intentions, the US Senate is no closer to ratifying the Comprehensive Nuclear-Test-Ban Treaty, while China, India, and Pakistan, among others, take shelter behind that inaction, with a fragile voluntary moratorium the only obstacle to resumed testing. And negotiations on another crucial building block for both disarmament and non-proliferation – a treaty to ban further production of weapons-grade fissile material – remain at an impasse.


    The only half-way good news is that progress continues on a third building block: ensuring that weapons-usable materials, and weapons themselves, currently stored in multiple locations in 32 countries, do not fall into the hands of rogue states or terrorists. At the end of March, South Korean President Lee Myung-bak will host a follow-up meeting to Obama’s successful Nuclear Security Summit in 2010, which brought together 47 government leaders to agree on a comprehensive program aimed at securing all such materials within four years. High on the agenda will be the security implications of nuclear safety: the Fukushima catastrophe showed that nuclear-power plants may be vulnerable not only to natural disaster, but also to terrorist sabotage.


    But nuclear security is only one small part of what must be done to eliminate nuclear threats once and for all, and summit fatigue will make it difficult to sustain key world leaders’ commitment to meeting for so narrow a purpose. New thinking is urgently needed on how to recover the momentum of just two years ago.


    To achieve that requires meeting three conditions. First, political leaders and civil-society leaders must restate, ad nauseam if necessary, the case for “global zero” – a world without nuclear weapons – and map a credible step-by-step path for getting there.


    Second, new mechanisms are needed to energize policymakers and publics. One is to develop and promote a draft Nuclear Weapons Convention as a framework for action. Another is a “State of Play” report card that pulls no punches in assessing which states are meeting their disarmament and non-proliferation commitments, and which are not (the Nuclear Materials Security Index, just published by Senator Sam Nunn’s Nuclear Threat Initiative, is one example). Advocacy-focused leadership networks, such as those now operating in Europe and the Asia-Pacific region, comprising well-known former leaders and other senior figures, could also help.


    Third, sustaining high-level policy attention to the entire nuclear agenda requires an institutional setting. The Nuclear Security Summit’s focus is too narrow for this role; the International Atomic Energy Agency’s formal mandate is too restricted; the NPT Review Conference meets too irregularly; and the United Nations Security Council’s membership is too limited. The best forum for norm-building may prove to be the G-20, whose members embrace both North and South, account for most of the world’s population, GDP, and all but a handful of its nuclear weapons, and whose heads of government meet regularly.


    With its foreign ministers meeting in Mexico this month to discuss broader global governance issues, the G-20 is beginning to move beyond a narrow economic focus. That is to be welcomed. Economic destruction causes immense and intolerable human misery. But there are only two global threats that, if mishandled, can destroy life on this planet as we know it. And nuclear weapons can kill us a lot faster than CO2 can.

  • Two First Steps on Nuclear Weapons

    Yesterday, President Obama presided over the United Nations Security Council meeting that passed a resolution seeking to strengthen the international commitment to limiting the spread of nuclear weapons. A week ago, he announced that the United States will not deploy — at least, not in the foreseeable future — a missile defense site in Central Europe, including powerful radar in the Czech Republic and interceptor missiles in Poland.

    Is there a link between the two events? I believe there is. Yet initial comments by many political figures and journalists have for the most part ignored this key relationship.

    Instead, many are asserting that canceling the Eastern European missile defense was simply a concession to Russia, which must now reciprocate with a concession of its own. But President Dmitri Medvedev of Russia had already said last November that if the United States made changes to its missile defense plans, his nation would refrain from countermeasures like deploying its own missiles. Soon after President Obama’s decision was announced, this position was reaffirmed.

    Many of President Obama’s critics in the United States insist that he “caved in” to Russian pressure, virtually leaving America’s NATO allies to fend for themselves. There is nothing behind this argument other than the old stereotype of “bad Russia,” a Russia that is always wrong.

    Consider the merits of the case. Russia’s leaders have been saying for some time that the fear of Iran developing effective long-range missiles in the near future was not grounded in fact. Now, after a thorough review by intelligence and defense officials, the United States government has come to the same conclusion, holding that Tehran is perhaps at least five years or even a decade away from such capacity.

    The initial reaction by some politicians and commentators in Poland and the Czech Republic is no less odd. They seem to enjoy the role of a spoiler in relations between other countries and Russia. Voices of realism and caution are routinely rejected, and the opinion of their own citizens, who by and large have no use for radars and missiles, is brushed aside.

    In Russia, President Obama’s decision has been well received. It also met with support in Europe, with Chancellor Angela Merkel of Germany and President Nicolas Sarkozy of France lauding it. The Polish prime minister, Donald Tusk, called it “a chance to strengthen European security.” Indeed, if the president’s decision is followed by further serious steps, it will provide an opportunity for us to strengthen global security as well as reach a new level of cooperation in ridding the world of nuclear danger.

    At their meeting in Moscow in early July, Presidents Obama and Medvedev reaffirmed the relationship between strategic offensive weapons and missile defense. The two nations continue arms reduction talks and, judging by cautious diplomatic statements, they seem to be on course to complete them by Dec. 5, when the first Strategic Arms Reduction Treaty — which I signed with President George H. W. Bush in 1991 — is due to expire.

    This week’s United Nations meeting marks the next stage of progress. It is vital that other nations come away from the meeting believing that America and Russia are moving toward verifiable nuclear arms reductions, and that by the time the Nuclear Nonproliferation Treaty review conference is held at the United Nations next May, they will have made progress toward the eventual elimination of nuclear weapons.

    Unless they show the world they are serious, the two major nuclear powers will be accused, again and again, of not keeping their word and told that if it is acceptable for 5 or 10 countries to have nuclear weapons as their “ultimate security guarantee,” why should it not be the case for 20 or 30 others?

    It is vital that the two presidents themselves monitor the negotiations closely, sometimes plunging into minute details. I know from experience how difficult it is to deal with such technical details on top of constant political pressures, but it is necessary to avoid misunderstandings that could undermine trust.

    Some questions that will need to be clarified are evident now. The American secretary of defense, Robert Gates, has said that the SM-3 missiles that are to be used under the new missile-defense plan could later be perfected to intercept long-range intercontinental missiles. Yet he has also raised the possibility of cooperating with Russia on missile defense. To me, these two ideas seem incompatible. The sooner such issues are cleared up the better.

    As I see it, there is only one way to move forward: Washington should agree to the Russian proposal for a joint assessment of missile threats. Let the experts from both countries have a frank discussion that would reveal which threats are real and must be dealt with, and which are imaginary. This would help to avoid misguided projects like the Polish-Czech missile shield, and could help move us from a state of mutual deterrence to a goal of minimum nuclear sufficiency for self-defense.

    This is a big agenda. Realistically, it would take two or three years of intense negotiation. But Russia and the United States must set big tasks for themselves. What is needed is nothing less than a change in the strategic relationship between the two major nuclear powers — in their own interests and in the cause of world peace.

  • Speedy Ratification of the Treaty Banning Cluster Weapons

    In a remarkable combination of civil society pressure and leadership from a small number of progressive States, a strong ban on the use, manufacture, and stocking of cluster bombs was signed in Oslo, Norway on 3 December 2008. However, all bright sunlight casts a dark shadow, and in this case the shadow is the fact that the major makers and users of cluster munitions were deliberately not there: Brazil, China, India, Israel, Pakistan, Russia, USA.

    Yet as arms negotiations go, the cluster bomb ban has been swift. They began in Oslo, Norway in February 2007 and were thus often called the “Oslo Process.” The negotiations were a justified reaction to their wide use by Israel in Lebanon during the July-August 2006 conflict. The UN Mine Action Coordination Centre (UNMACC) working in southern Lebanon reported that their density there is higher than in Kosovo and Iraq, especially in built up areas, posing a constant threat to hundreds of thousands of people, as well as to UN peacemakers. It is estimated that one million cluster bombs were fired on south Lebanon during the 34 days of war, many during the last two days of war when a ceasefire was a real possibility. The Hezbollah militia also shot off rockets with cluster bombs into northern Israel.

    Cluster munitions are warheads that scatter scores of smaller bombs. Many of these sub-munitions fail to detonate on impact, leaving them scattered on the ground, ready to kill and maim when disturbed or handled. Reports from humanitarian organizations and mine-clearing groups have shown that civilians make up the vast majority of the victims of cluster bombs, especially children attracted by their small size and often bright colors.

    The failure rate of cluster munitions is high, ranging from 30 to 80 per cent. But “failure” may be the wrong word. They may, in fact, be designed to kill later. The large number of unexploded cluster bombs means that farm lands and forests cannot be used or used with great danger. Most people killed and wounded by cluster bombs in the 21 conflicts where they have been used are civilians, often young. Such persons often suffer severe injuries such as loss of limbs and loss of sight. It is difficult to resume work or schooling.

    Discussions of a ban on cluster weapons had begun in 1979 during the negotiations in Geneva leading to the Convention on Prohibition on the Use of Certain Conventional Weapons which may be Deemed to be Excessively Injurious or to have Indiscriminate Effects — the “1980 Inhumane Weapons Convention” to its friends.

    The indiscriminate impact of cluster bombs was raised with the support of the Swedish government by the representative of the Quaker United Nations Office in Geneva and myself. My NGO text of August 1979 for the citizens of the world on “Anti-Personnel Fragmentation Weapons” called for a ban based on the 1868 St Petersburg Declaration and recommended that “permanent verification and dispute-settlement procedures be established which may investigate all charges of the use of prohibited weapons whether in inter-State or internal conflicts, and that such a permanent body include a consultative committee of experts who could begin their work without a prior resolution of the UN Security Council.”

    I was thanked for my efforts but left to understand that world citizens are not in the field of real politics and that I would do better to stick to pushing for a ban on napalm — photos of its use in Vietnam being still in the memory of many delegates. Governments always have difficulty focusing on more than one weapon at a time. Likewise for public pressure to build, there needs to be some stark visual reminders to draw attention and to evoke compassion.

    Although cluster munitions were widely used in the Vietnam-Indochina war, they never received the media and thus the public attention of napalm. (1) The United Nations Institute for Disarmament Research recently published a study on the continued destructive impact of cluster bombs in Laos noting that “The Lao People’s Democratic Republic has the dubious distinction of being the most heavily bombed country in the world” (2). Cluster-bomb land clearance is still going on while the 1963-1973 war in Laos has largely faded from broader public memory.

    The wide use by NATO forces in the Kosovo conflict again drew attention to the use of cluster bombs and unexploded ordnance. The ironic gap between the humanitarian aims given for the war and the continued killing by cluster bombs after the war was too wide not to be noticed. However, the difficulties of UN administration of Kosovo and of negotiating a “final status” soon overshadowed all other concerns. Likewise the use of cluster bombs in Iraq is overshadowed by the continuing conflict, sectarian violence, the role of the USA and Iran, and what shape Iraq will take after the withdrawal of US troops.

    Thus, it was the indiscriminate use of cluster bombs against Lebanon in a particularly senseless and inconclusive war that has finally led to sustained efforts for a ban. Cluster weapons were again used by both Georgia and Russia in the 5 days of the August 2008 conflict— a use which was totally unnecessary from a strategic point of view. This use in the Georgia-Russia- South Ossetia conflict proves that as long as such weapons are available to the military, they will be used with little thought of their consequence.

    The ban on cluster bombs follows closely the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction which came into force in March 1999 and has been now ratified by 152 States. Many of the same NGOs active on anti-personnel mines were also the motors of the efforts on cluster bombs — a combination of disarmament, humanitarian, and human rights groups.

    States signed the treaty on 3 December in Oslo where the negotiations began. If the momentum can be kept up, parliaments should ratify the treaty quickly, and it could come into force by mid-2009. It is important for supporters to contact members of parliament indicating approval of the ban and asking for swift ratification. A more difficult task will be to convince those States addicted to cluster bombs— the Outlaw Seven: Brazil, China, India, Israel, Pakistan, Russia, USA. The ban may discourage their use by these States and the USA has a recent export ban on the sale of most cluster weapons, but a signature by them would be an important sign of respect for international agreements and world law. Pressure must be kept up for speedy ratification and for signature on those States outside the law.

    Nuclear Weapons and Future Justice

    Future justice requires that the inhabitants of the future be treated justly and equitably. This implies that our current social, economic and political relations, both nationally and internationally, become more just and equitable. It also adds an explicit focus on the longer term consequences of these relations. The decisions taken in the present must be made with a view to their effect upon future generations.

    Many indigenous peoples lived with an ethic of considering present impacts on the “seventh generation.” Modern societies have been far less respectful of those who will follow us on the planet, as the expanding population of the planet combined with our greed for natural resources and the power of our technologies has exponentially increased the human impact upon the Earth and upon future generations.

    We need an ethic that expands our concept of justice to generations yet unborn. We need to recognize and appreciate the extent to which our decisions and acts in the present have serious, potentially irreversible, consequences for the future. In the 1990s, The Cousteau Society, led by respected ocean explorer Jacques Cousteau, developed and promoted a Bill of Rights for Future Generations. Its five articles are:

    Article 1. Future generations have a right to an uncontaminated and undamaged Earth and to its enjoyment as the ground of human history, of culture, and of the social bonds that make each generation and individual a member of one human family.
    Article 2. Each generation, sharing in the estate and heritage of the Earth, has a duty as trustee for future generations to prevent irreversible and irreparable harm to life on Earth and to human freedom and dignity.
    Article 3. It is, therefore, the paramount responsibility of each generation to maintain a constantly vigilant and prudential assessment of technological disturbances and modifications adversely affecting life on Earth, the balance of nature, and the evolution of mankind in order to protect the rights of future generations.
    Article 4. All appropriate measures, including education, research, and legislation, shall be taken to guarantee these rights and to ensure that they not be sacrificed for present expediencies and conveniences.
    Article 5. Governments, non-governmental organizations, and individuals are urged, therefore, imaginatively to implement these principles, as if in the very presence of those future generations whose rights we seek to establish and perpetuate.

    To enforce such a set of rights for future generations, we need to create a criminal conceptualization that designates the worst offenses against these rights as crimes against future generations, the worst crimes being those that would foreclose the future altogether or that would make life on the planet untenable. Two areas of human activity that would clearly fit into this category of foreclosing the future are nuclear war and climate change. Both have the potential to destroy human life on our planet, along with much other life.

    Responsibilities towards Future Generations

    Rights cannot exist in a vacuum. Along with rights, there must be concomitant responsibilities, including responsibilities to assure the rights of future generations. On November 12, 1997, the United Nations Educational, Scientific and Cultural Organization (UNESCO) solemnly proclaimed the UNESCO Declaration on the Responsibilities of Current Generations towards Future Generations. The Declaration was composed of 12 Articles covering a full range of responsibilities towards future generations. The two Articles most closely related to preserving a human future and a future for life on the planet are Articles 3 and 4.

    Article 3 – Maintenance and perpetuation of humankind – The present generations should strive to ensure the maintenance and perpetuation of humankind with due respect for the dignity of the human person. Consequently, the nature and form of human life must not be undermined in any way whatsoever.

    Article 4 – Preservation of life on Earth – The present generations have the responsibility to bequeath to future generations an Earth which will not one day be irreversibly damaged by human activity. Each generation inheriting the Earth temporarily should take care to use natural resources reasonably and ensure that life is not prejudiced by harmful modifications of the ecosystems and that scientific and technological progress in all fields does not harm life on Earth.

    The Declaration calls for “intergenerational solidarity.” Such solidarity with future generations requires that current generations take responsibility for assuring that the policies of those in power today will not lead to foreclosing the future for generations yet to be born. Thus, the importance of conceptualizing crimes against future generations cannot be evaded by the people of the present. A strong example of such crimes can be found in the example of policies promoting the possession, threat or use of nuclear weapons. Such policies constitute assaults upon future generations, as well as upon present life on the planet.

    Nuclear Weapons and International Law

    In the record of human history, survival chances have been enhanced by affiliation with the tribe and later with the nation-state. Such affiliations have provided a defense against the aggression of other groups. Violent conflicts between tribes and later nations have given rise to the pattern of warfare that has characterized human behavior from its earliest history. Technological innovations in warfare, such as the stirrup, crossbow, machinegun, airplane and submarine have given advantage to one side or another.

    What characterizes the Nuclear Age is the innovation of a form of weaponry that makes possible the destruction of the species. Nuclear weapons, which are weapons of indiscriminate mass destruction, have the capacity to foreclose the future of human life on the planet. The philosopher John Somerville coined a new term for the potential of nuclear weapons – omnicide, meaning the death of all. He reasoned that humans had moved from suicide, to genocide, to the potential of omnicide. The threat or use of nuclear weapons constitutes the ultimate crime against the future, the crime of omnicide, including the destruction of the human species.

    In 1996, the International Court of Justice issued an Advisory Opinion on the legality of the threat or use of nuclear weapons. The Court found, “The destructive power of nuclear weapons cannot be contained in either space or time. They have the potential to destroy all civilization and the entire ecosystem of the planet.” It further found that “the use of nuclear weapons would be a serious danger to future generations.” Even setting aside the blast effects of nuclear weapons, the Court found, “Ionizing radiation has the potential to damage the future environment, food and marine ecosystem, and to cause genetic defects and illness in future generations.”

    The Court unanimously concluded that any threat or use of nuclear weapons that violated international humanitarian law would be illegal. This meant that there could be no legal threat or use of nuclear weapons that was indiscriminate as between civilians and combatants, that caused unnecessary suffering, or that was disproportionate to a prior attack. Despite the fact that there could be virtually no threat or use of nuclear weapons that did not violate international humanitarian law, the Court also found on a split vote that “in view of the current state of international law, and of the elements of fact at its disposal, the Court cannot conclude definitively whether the threat or use of nuclear weapons would be lawful or unlawful in an extreme circumstance of self-defense, in which the very survival of a State would be at stake.”

    In light of the above conclusions, the Court found unanimously, “There exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.” Thus, the Court was clear in reaffirming the obligation to nuclear disarmament in Article VI of the Nuclear Non-Proliferation Treaty. Although this aspect of the Court’s opinion does not specifically refer to the rights of future generations, adherence by the nuclear weapons states to “nuclear disarmament in all its aspects” would eliminate the possibility of nuclear weapons foreclosing the future by eliminating the weapons. Unfortunately, the political leaders of the nuclear weapons states have not fulfilled their obligations under international law.

    Nuclear Weapons Possession as Criminal Behavior

    Today there are nine states in the world that possess nuclear weapons: the US, Russia, UK, France, China, Israel, India, Pakistan and North Korea. If we know that nuclear war could foreclose the future and would be a crime against future generations, does that make the possession of nuclear weapons by these states a crime against the future? Arguably, possession alone, without use or threat of use, is not a crime. But to take the inquiry one step deeper, is it possible that there can be possession without at least the implicit threat of use? In order to eliminate the possibility of threat or use of nuclear weapons, a state at a minimum would need to have a policy of “No First Use,” and would have to separate its warheads from delivery vehicles so that there could not be an inadvertent use of the weapons. While this would be better nuclear policy than one that left open the possibility of first use, it would not eliminate the possibility of a second use of the weapons, which would escalate a nuclear war, kill great numbers of innocent civilians, impact the health of children of the victims and even place the future of humanity at risk. Thus, the conclusion seems inescapable that the possessionof nuclear weapons by a state undermines future justice and constitutes a continuing crime against future generations.

    Individual Accountability for Criminal Acts

    The possession of nuclear weapons can be viewed as a crime of state, and this crime would apply to the nine states in possession of nuclear weapons. But beyond state criminal activity, there should also be culpability for the crime against the future by the leading state and military officials that support and promote nuclear weapons possession, as well as policies that make nuclear war more likely and total nuclear disarmament less likely. In addition, corporations, corporate executives and scientists who contribute to the maintenance and improvement of nuclear weapons should also be considered culpable for committing a crime against future generations.

    It is fundamental to criminal law that individuals have culpability for crimes, and that individual accountability not be covered over by state or corporate culpability. At the Nuremburg Tribunals following World War II, the principle was upheld that all individuals who commit crimes under international law are responsible for such acts, and this is true even if they are high government officials and domestic law does not hold such acts to be crimes. Along with responsibility goes individual accountability for crimes against future generations.

    The Need for a Taboo against Nuclear Arms

    In the present global environment, the possession of nuclear weapons is not viewed as a crime against future generations or even broadly as a crime against the present, but rather as a normative behavior of powerful states. There is a strong need to change this general orientation toward nuclear weapons through education about their dangers and their capacity to foreclose the future. One of the best reasons to eliminate nuclear weapons is that they have the potential to eliminate the human species, now or in the future. So long as nuclear weapons exist and are held in the arsenals of some countries, the danger of the use of these weapons under some conditions, by accident or design, cannot be entirely excluded. In addition, the existence of these weapons in the arsenals of some states creates pressures for other states to acquire such weaponry.

    It is essential to establish a norm that the possession of nuclear weapons is a crime against future generations, a crime that can only be prevented by the total elimination of these weapons. A taboo must be established that puts nuclear weapons in the same category of unacceptable behaviors as cannibalism, incest, slavery and torture, a taboo that ostracizes those who contribute to maintaining these weapons and who set up obstacles to their elimination.

    Signs of Hope

    1. The vast majority of states in the world support a world free of nuclear weapons.
    2. The vast majority of US and Russian citizens support a world free of nuclear weapons.
    3. More than 2100 mayors in some 125 countries throughout the world support the Mayors for Peace 2020 Campaign to Ban Nuclear Weapons by the year 2020.
    4. More than half the world, virtually the entire southern hemisphere, is covered by nuclear weapons-free zones.
    5. Former high-level US policy makers, including former Secretaries of State Henry Kissinger and George Shultz, former Secretary of Defense William Perry and former chair of the Senate Armed Services Committee Sam Nunn, have spoken out in favor a world free of nuclear weapons.
    6. Norway’s government pension fund has set a powerful example by divesting from companies providing components for nuclear weapons.
    7. Legal measures to return to the International Court of Justice are being taken to challenge the lack of progress on nuclear disarmament obligations.
    8. University students are showing increased concern for university involvement in nuclear weapons research and development.
    9. Leading scientists, including the late Nobel Laureates Hans Bethe and Joseph Rotblat, are calling upon scientists in all countries to cease working on nuclear weapons and other weapons of mass destruction.
    10. UK Minister of Defense Des Browne has proposed a conference of the five principal nuclear weapons states to address the technical challenges of verifying nuclear disarmament.

    Providing Hope with Teeth

    While these signs of hope hold promise, far more needs to be done to establish a taboo against the possession, threat and use of nuclear weapons that will result in a world free of nuclear weapons. Organizations such as the World Future Council need to take a leadership role in promoting the concept of future justice and crimes against future generations, identifying those particular crimes, such as nuclear war and the antecedent possession, threat or use of nuclear weapons, which are capable of foreclosing the future.

    Those of us alive on the planet now are the trustees for future generations. We have the responsibility to assist in passing the world on intact to the next generation. We must act in intergenerational solidarity with those who are not yet present. In the words of the Cousteau Society’s Bill of Right for Future Generations, we must act “as if in the very presence of those future generations whose rights we seek to establish and perpetuate.”

    Among the tools needed to succeed in passing the world on intact to future generations is the identification of crimes against future generations to underpin the establishment of taboos against such crimes. Also needed is a system of accountability to ostracize and otherwise punish individuals, regardless of their office, who are engaged in the preparation or commission of such crimes. The possession, threat or use of nuclear weapons is unquestionably among the most serious of these crimes. Future justice is not a possibility in a world without a future.

  • A Treaty to Abolish Nuclear Weapons

    Although few people are aware of it, there has been considerable progress over the past decade toward a treaty to abolish nuclear weapons.

    For many years, there had been a substantial gap between the pledges to eliminate nuclear weapons made by the signatories to the nuclear Nonproliferation Treaty of 1968 and the reality of their behavior. To remedy this situation, in 1996 the New York-based Lawyers’ Committee on Nuclear Policy—the U.S. affiliate of the International Association of Lawyers Against Nuclear Arms—began to coordinate the drafting of a Model Nuclear Weapons Convention. Formulated along the lines of the Chemical Weapons Convention, which entered into force in 1997, this model nuclear convention was designed to serve as an international treaty that prohibits and eliminates nuclear weapons.

    Although the late 1990s proved a difficult time for nuclear arms control and disarmament measures, the Lawyers’ Committee on Nuclear Policy, joined by International Physicians for the Prevention of Nuclear War and the International Network of Engineers Against Proliferation, continued its efforts. Consequently, in 2007, these organizations released a new model treaty, revised to reflect changes in world conditions, as well as an explanatory book, Securing Our Survival.

    In 1997, like its predecessor, this updated convention for nuclear abolition was circulated within the United Nations, this time at the request of Costa Rica and Malaysia. In addition, it was presented at a number of international conclaves, including a March 2008 meeting of non-nuclear governments in Dublin, sponsored by the Middle Powers Initiative and by the government of Ireland.

    Although the Western nuclear weapons states and Russia have opposed a nuclear abolition treaty, the idea has begun to gain traction. The Wall Street Journal op-eds by George Shultz, William Perry, Henry Kissinger, and Sam Nunn have once again placed nuclear abolition on the political agenda. Speaking in February 2008, the U.N. High Representative for Disarmament Affairs, Sergio Duarte, condemned the great powers’ “refusal to negotiate or discuss even the outlines of a nuclear-weapons convention” as “contrary to the cause of disarmament.” Opinion surveys have reported widespread popular support for nuclear abolition in numerous nations—including the United States, where about 70 percent of respondents back the signing of an international treaty to reduce and eliminate all nuclear weapons.

    Of course, it’s only fair to ask if there really exists the political will to bring such a treaty to fruition. Although Barack Obama has endorsed the goal of nuclear abolition, neither of his current opponents for the U.S. presidency has followed his example or seems likely to do so. John McCain is a thoroughgoing hawk, while Hillary Clinton—though publicly supporting some degree of nuclear weapons reduction—has recently issued the kind of “massive retaliation” threats unheard of since the days of John Foster Dulles.

    Furthermore, the American public is remarkably ignorant of nuclear realities. Writing in the Foreword to a recent book, Nuclear Disorder or Cooperative Security, published by the Lawyers Committee on Nuclear Policy, the Western States Legal Foundation, and the Reaching Critical Will project of the Women’s International League for Peace and Freedom (www.wmdreport.org), Zia Mian, a Princeton physicist, points to a number of disturbing facts about contemporary U.S. public opinion. For example, more Americans (55%) mistakenly believe that Iran has nuclear weapons than know that Britain (52%), India (51%), Israel (48%), and France (38%) actually have these weapons.

    Although the United States possesses over 5,700 operationally deployed nuclear warheads, more than half of U.S. respondents to an opinion survey thought that the number was 200 weapons or fewer. Thus, even though most Americans have displayed a healthy distaste for nuclear weapons and nuclear war, their ability to separate fact from fiction might well be questioned when it comes to nuclear issues.

    Fortunately, there are many organizations working to better educate the public on nuclear dangers. In addition to the groups already mentioned, these include Peace Action, Physicians for Social Responsibility, the Federation of American Scientists, Faithful Security, and the Nuclear Age Peace Foundation. And important knowledge can also be gleaned from that venerable source of nuclear expertise, The Bulletin of the Atomic Scientists.

    But there remains a considerable distance to go before a treaty to abolish nuclear weapons becomes international law.

  • Opening Remarks for the Washington, DC Think Outside the Bomb Conference

    Welcome to the Second annual Washington, DC Think Outside the Bomb, conference. Before going forward, I would like to thank American University’s Nuclear Studies Institute and Americans for Informed Democracy. Without their help, this event would not be possible.

    My introduction to nuclear weapons issues came from American University’s Nuclear Studies Institute. As an undergraduate student, I was fortunate enough to travel to Japan to see the effects of the atomic bombs on Hiroshima and Nagasaki. Even after 60 years the physical and emotional scars on the people of Japan have not dissipated. It was a life-changing experience for me and ultimately has led me here today. I hope many of you have the opportunity to travel to Japan.

    Before going ahead with the conference, I’d like to talk for a moment about what this conference is and why now more than ever there is a need for a new generation of peace leaders.

    I am an American born after 1978. According to pop culture and statistical studies, we are known as Millennials or Generation Y. We are considered socially progressive and politically active. However, my generation does not consider global nuclear disarmament a priority. I believe the reason for this is that we are the first generation to come of age in a post-Cold War society. We are the first post-Cold War Americans.

    At the end of the Cold War there was a common belief that the nuclear threat would subside. Rather than work towards the elimination of nuclear weapons, the Clinton Administration missed an opportunity to make sweeping changes and instead, to a large extent, reaffirmed antiquated Cold War policy already in place. The existence of nuclear weapons continued, but the public’s attention towards them waned.

    Unlike those who came before, my “post-Cold War Generation” was not exposed to a strong public outcry for the abolition of nuclear weapons. We also did not experience the nuclear arms race first hand. We did not live with the fear of duck and cover drills, nuclear testing, the Cuban missile crisis, and an unprecedented nuclear arms build up.

    The current generation of young people is a “post-Cold War Generation” that has been incorrectly taught that nuclear weapons are acceptable if possessed by responsible people. Instead of disarmament, they have embraced nonproliferation.

    There is a small window of opportunity before this generation takes seats of power in federal government and decide nuclear policy. Now more than ever, it is critical that young people learn about the dangers of nuclear weapons and the need for US leadership toward nuclear disarmament.

    In 2005 the Nuclear Age Peace Foundation responded to this growing need by bringing together 50 young leaders in the nuclear field to Santa Barbara, California for the first national Think Outside the Bomb Conference. That August, the Think Outside the Bomb Participants created a Statement of Principles that guides the work of the young people in the network.

    Those principles are as follows:

    • Inspired by the need for a new generation of leaders working toward a nuclear-free world, Think Outside the Bomb is a group of young people;
    • Aware of the historical context and the current urgency to address the devastating effects of the nuclear complex;
    • Recognizing the need to develop connections between the nuclear complex and global, environmental, racial, economic and social justice;
    • Emphasizing the importance of the right to self-determination of all indigenous peoples, who have been among the most affected by the nuclear complex;
    • Drawing attention to the need to redefine security in terms of human and environmental needs;
    • Underlining the need to move beyond military force as the principal means of solving conflict and instead resolve conflict by nonviolent means;
    • Understanding the devastation caused by nuclear weapons and memorializing the many victims of bomb production at every step – from uranium mining to design, to production, to testing, to use and threat of use; and
    • Reaffirming our humanity through mutual respect, nonviolence and consensus-building.

  • Lecture at Princeton University

    Let me begin by saying how delighted I am to have been invited to give this address by a School named after Woodrow Wilson, the great pioneer of multilateralism and advocate of world peace, who argued, among other things, for agreed international limits on deadly weapons.

    Princeton is indissolubly linked with the memory of Albert Einstein and many other great scientists who played a role in making this country the first nuclear power. That makes it an especially appropriate setting for my address this evening, because my main theme is the danger of nuclear weapons, and the urgent need to confront that danger by preventing proliferation and promoting disarmament, both at once. I shall argue that these two objectives — disarmament and non-proliferation — are inextricably linked, and that to achieve progress on either front we must also advance on the other.

    Almost everyone in today’s world feels insecure, but not everyone feels insecure about the same thing. Different threats seem more urgent to people in different parts of the world.

    Probably the largest number would give priority to economic and social threats, including poverty, environmental degradation and infectious disease.

    Others might stress inter-State conflict; yet others internal conflict, including civil war. Many people – especially but not only in the developed world — would now put terrorism at the top of their list.

    In truth, all these threats are interconnected, and all cut across national frontiers. We need common global strategies to deal with all of them — and indeed, Governments are coming together to work out and implement such strategies, in the UN and elsewhere. The one area where there is a total lack of any common strategy is the one that may well present the greatest danger of all: the area of nuclear weapons.

    Why do I consider it the greatest danger? For three reasons:

    First, nuclear weapons present a unique existential threat to all humanity.

    Secondly, the nuclear non-proliferation regime now faces a major crisis of confidence. North Korea has withdrawn from the Nuclear Non-Proliferation Treaty (NPT), while India, Israel, and Pakistan have never joined it. There are, at least, serious questions about the nature of Iran’s nuclear programme. And this, in turn, raises questions about the legitimacy, and credibility, of the case-by-case approach to non-proliferation that the existing nuclear powers have adopted.

    Thirdly, the rise of terrorism, with the danger that nuclear weapons might be acquired by terrorists, greatly increases the danger that they will be used.

    Yet, despite the grave, all-encompassing nature of this threat, the Governments of the world are addressing it selectively, not comprehensively.

    In one way, that’s understandable. The very idea of global self-annihilation is unbearable to think about. But, that is no excuse. We must try to imagine the human and environmental consequences of a nuclear bomb exploding in one, or even in several, major world cities — or indeed of an all-out confrontation between two nuclear-armed States.

    In focusing on nuclear weapons, I am not seeking to minimize the problem of chemical and biological ones, which are also weapons of mass destruction, and are banned under international treaties. Indeed, perhaps the most important, under-addressed threat relating to terrorism — one which acutely requires new thinking — is the threat of terrorists using a biological weapon.

    But, nuclear weapons are the most dangerous. Even a single bomb can destroy an entire city, as we know from the terrible example of Hiroshima and Nagasaki, and today, there are bombs many times as powerful as those. These weapons pose a unique threat to humanity as a whole.

    Forty years ago, understanding that this danger must be avoided at all costs, nearly all States in the world came together and forged a grand bargain, embodied in the NPT.

    In essence, that treaty was a contract between the recognized nuclear-weapon States at that time and the rest of the international community. The nuclear-weapon States undertook to negotiate in good faith on nuclear disarmament, to prevent proliferation, and to facilitate the peaceful use of nuclear energy, while separately declaring that they would refrain from threatening non-nuclear-weapon States with nuclear weapons. In return, the rest committed themselves not to acquire or manufacture nuclear weapons, and to place all their nuclear activities under the verification of the International Atomic Energy Agency (IAEA). Thus, the treaty was designed both to prevent proliferation and to advance disarmament, while assuring the right of all States, under specified conditions, to use nuclear energy for peaceful purposes.

    From 1970 — when it entered into force — until quite recently, the NPT was widely seen as a cornerstone of global security. It had confounded the dire predictions of its critics. Nuclear weapons did not — and still have not — spread to dozens of States, as John F. Kennedy and others predicted in the 1960s. In fact, more States have given up their ambitions for nuclear weapons than have acquired them.

    And yet, in recent years, the NPT has come under withering criticism — because the international community has been unable to agree how to apply it to specific crises in South Asia, the Korean peninsula and the Middle East; and because a few States parties to the treaty are allegedly pursuing their own nuclear-weapons capabilities.

    Twice in 2005, Governments had a chance to strengthen the Treaty’s foundations — first at the Review conference in May, then at the World Summit in September. Both times they fai— essentially because they couldn’t agree whether non-proliferation or disarmament should come first.

    The advocates of “non-proliferation first” — mainly nuclear-weapon States and their supporters — believe the main danger arises not from nuclear weapons as such, but from the character of those who possess them, and therefore, from the spread of nuclear weapons to new States and to non-state actors (so called “horizontal proliferation”). The nuclear-weapon States say they have carried out significant disarmament since the end of the cold war, but that their responsibility for international peace and security requires them to maintain a nuclear deterrent.

    “Disarmament first” advocates, on the other hand, say that the world is most imperilled by existing nuclear arsenals and their continual improvement (so called “vertical proliferation”). Many non-nuclear-weapon States accuse the nuclear-weapon States of retreating from commitments they made in 1995 (when the NPT was extended indefinitely) and reiterated as recently as the year 2000. For these countries, the NPT “grand bargain” has become a swindle. They note that the UN Security Council has often described the proliferation of weapons of mass destruction as a threat to international peace and security, but has never declared that nuclear weapons in and of themselves are such a threat. They see no serious movement towards nuclear disarmament, and claim that the lack of such movement presages a permanent “apartheid” between nuclear “haves” and “have-nots”.

    Both sides in this debate feel that the existence of four additional States with nuclear weapons, outside the NPT, serves only to sharpen their argument.

    The debate echoes a much older argument: are weapons a cause or a symptom of conflict? I believe both debates are sterile, counterproductive, and based on false dichotomies.

    Arms build-ups can give rise to threats leading to conflict; and political conflicts can motivate the acquisition of arms. Efforts are needed both to reduce arms and to reduce conflict. Likewise, efforts are needed to achieve both disarmament and non-proliferation.

    Yet, each side waits for the other to move. The result is that “mutually assured destruction” has been replaced by mutually assured paralysis. This sends a terrible signal of disunity and waning respect for the Treaty’s authority. It creates a vacuum that can be exploited.

    I said earlier this year that we are “sleepwalking towards disaster”. In truth, it is worse than that — we are asleep at the controls of a fast-moving aircraft. Unless we wake up and take control, the outcome is all too predictable.

    An aircraft, of course, can remain airborne only if both wings are in working order. We cannot choose between non-proliferation and disarmament. We must tackle both tasks with the urgency they demand.

    Allow me to offer my thoughts to each side in turn.

    To those who insist on disarmament first, I say this:

    — Proliferation is not a threat only, or even mainly, to those who already have nuclear weapons. The more fingers there are on nuclear triggers, and the more those fingers belong to leaders of unstable States — or, even worse, non-State actors — the greater the threat to all humankind.

    — Lack of progress on disarmament is no excuse for not addressing the dangers of proliferation. No State should imagine that, by pushing ahead with a nuclear-weapon programme, it can pose as a defender of the NPT; still less that it will persuade others to disarm.

    — I know some influential States, which themselves have scrupulously respected the Treaty, feel strongly that the nuclear-weapon States have not lived up to their disarmament obligations. But, they must be careful not to let their resentment put them on the side of the proliferators. They should state clearly that acquiring prohibited weapons never serves the cause of their elimination. Proliferation only makes disarmament even harder to achieve.

    — I urge all States to give credit where it is due. Acknowledge disarmament whenever it does occur. Applaud the moves which nuclear-weapon States have made, whether unilaterally or through negotiation, to reduce nuclear arsenals or prevent their expansion. Recognize that the nuclear-weapon States have virtually stopped producing new fissile material for weapons, and are maintaining moratoria on nuclear tests.

    — Likewise, support even small steps to contain proliferation, such as efforts to improve export controls on goods needed to make weapons of mass destruction, as mandated by Security Council resolution 1540.

    — And please support the efforts of the Director-General of the IAEA and others to find ways of guaranteeing that all States have access to fuel and services for their civilian nuclear programmes without spreading sensitive technology. Countries must be able to meet their growing energy needs through such programmes, but we cannot afford a world where more and more countries develop the most sensitive phases of the nuclear fuel cycle themselves.

    — Finally, do not encourage, or allow, any State to make its compliance with initiatives to eliminate nuclear weapons, or halt their proliferation, conditional on concessions from other States on other issues. The preservation of human life on this planet is too important to be used as a hostage.

    To those who insist on non-proliferation first, I say this:

    —True, there has been some progress on nuclear disarmament since the end of the cold war. Some States have removed many nuclear weapons from deployment, and eliminated whole classes of nuclear delivery systems. The US and Russia have agreed to limit the number of strategic nuclear weapons they deploy, and have removed non-strategic ones from ships and submarines; the US Congress refused to fund the so called “bunker-buster” bomb; most nuclear test sites have been closed; and there are national moratoria on nuclear tests, while three nuclear-weapon States — France, Russia and the UK — have ratified the Comprehensive Nuclear-Test-Ban Treaty.

    — Yet, stockpiles remain alarmingly high: 27,000 nuclear weapons reportedly remain in service, of which about 12,000 are actively deployed.

    — Some States seem to believe they need fewer weapons, but smaller and more useable ones — and even to have embraced the notion of using such weapons in conflict. All of the NPT nuclear-weapon States are modernizing their nuclear arsenals or their delivery systems. They should not imagine that this will be accepted as compatible with the NPT. Everyone will see it for what it is: a euphemism for nuclear re-armament.

    — Nor is it clear how these States propose to deal with the four nuclear-weapon-capable States outside the NPT. They warn against a nuclear domino effect, if this or that country is allowed to acquire a nuclear capability, but they do not seem to know how to prevent it, or how to respond to it once it has happened. Surely they should at least consider attempting a “reverse domino effect”, in which systematic and sustained reductions in nuclear arsenals would devalue the currency of nuclear weapons, and encourage others to follow suit.

    — Instead, by clinging to and modernizing their own arsenals, even when there is no obvious threat to their national security that nuclear weapons could deter, nuclear-weapon States encourage others — particularly those that do face real threats in their own reg— to regard nuclear weapons as essential, both to their security and to their status. It would be much easier to confront proliferators, if the very existence of nuclear weapons were universally acknowledged as dangerous and ultimately illegitimate.

    — Similarly, States that wish to discourage others from undertaking nuclear or missile tests could argue their case much more convincingly if they themselves moved quickly to bring the Comprehensive Nuclear-Test-Ban Treaty into force, halt their own missile testing, and negotiate a robust multilateral instrument regulating missiles. Such steps would do more than anything else to advance the cause of non-proliferation.

    — Important Powers such as Argentina, Brazil, Germany and Japan have shown, by refusing to develop them, that nuclear weapons are not essential to either security or status. South Africa destroyed its arsenal and joined the NPT. Belarus, Ukraine and Kazakhstan gave up nuclear weapons from the former Soviet nuclear arsenal. And Libya has abandoned its nuclear and chemical weapons programmes. The nuclear weapon States have applauded all these examples. They should follow them.

    — Finally, Governments and civil society in many countries are increasingly questioning the relevance of the cold war doctrine of nuclear deterrence — the rationale used by all States that possess nuclear weap— in an age of growing threats from non-State actors. Do we not need, instead, to develop agreed strategies for preventing proliferation?

    — For all these reasons, I call on all the States with nuclear weapons to develop concrete plans — with specific timetables — for implementing their disarmament commitments. And I urge them to make a joint declaration of intent to achieve the progressive elimination of all nuclear weapons, under strict and effective international control.

    In short, my friends, the only way forward is to make progress on both fronts — non-proliferation and disarmament — at once. And we will not achieve this unless at the same time we deal effectively with the threat of terrorism, as well as the threats, both real and rhetorical, which drive particular States or regimes to seek security, however misguidedly, by developing or acquiring nuclear weapons.

    It is a complex and daunting task, which calls for leadership, for the establishment of trust, for dialogue and negotiation. But first of all, we need a renewed debate, which must be inclusive, must respect the norms of international negotiations, and must reaffirm the multilateral approach — Woodrow Wilson’s approach, firmly grounded in international institutions, treaties, rules, and norms of appropriate behaviour.

    Let me conclude by appealing to young people everywhere, since there are — I am glad to see — so many of them here today.

    My dear young friends, you are already admirably engaged in the struggle for global development, for human rights and to protect the environment. Please bring your energy and imagination to this debate. Help us to seize control of the rogue aircraft on which humanity has embarked, and bring it to a safe landing before it is too late.

  • Does the Nuclear Non-Proliferation Treaty Have a Future?

    This May, the United Nations will be holding a review conference on the Nuclear Non-Proliferation Treaty (NPT), a key nuclear arms control and disarmament agreement to which 188 countries are now parties.

    Originally proposed by the U.S. and Soviet governments, the NPT was signed at the United Nations in 1968 and went into force in 1970. Under its provisions, non-nuclear nations agreed to renounce the development of nuclear weapons and nuclear-armed nations agreed to divest themselves of their nuclear weapons through good faith negotiations for nuclear disarmament. In this fashion, nations on both sides of the Cold War divide signaled their intention to halt the nuclear arms race and move toward a nuclear-free world.

    For decades, there was substantial progress along these lines. Non-nuclear nations refrained from building nuclear weapons. And the nuclear powers signed a series of important nuclear arms control and disarmament treaties: the Anti-Ballistic Missile (ABM) Treaty; two Strategic Arms Limitation Treaties; the Intermediate Nuclear Forces Treaty; two Strategic Arms Reduction Treaties; and the Comprehensive Test Ban Treaty. At times, they even reduced their nuclear forces unilaterally. As a result, by the late 1990s, no additional nations belonged to the nuclear club, while the number of nuclear weapons deployed by the nuclear nations or in their stockpiles declined dramatically.

    Starting in 1998, however, the nuclear arms race began to revive. Determined to place their nations within the ranks of the nuclear powers, the governments of India and Pakistan exploded their first nuclear weapons that year. Since then, they have engaged in dangerous and mutually threatening nuclear buildups. Other non-nuclear nations, including North Korea, took the first steps toward going nuclear, though the extent of their progress along these lines remains uncertain.

    The nuclear powers also began to abandon their NPT commitments. In 1999, the U.S. Senate stunned much of the world, including U.S. allies, by rejecting ratification of the Comprehensive Test Ban Treaty. Taking office in 2001, the administration of George W. Bush withdrew the United States from the ABM Treaty, opposed ratification of the Comprehensive Test Ban Treaty, began deployment of a missile defense system, pressed for the development of new U.S. nuclear weapons, and abandoned negotiations for nuclear disarmament. Responding sharply to U.S. withdrawal from the ABM Treaty and U.S. plans for missile defense, the Russian government announced its intention to deploy a new generation of nuclear missiles. And China might not be far behind.

    Why has there been a reversal of earlier progress toward a nuclear-free world?

    A key factor behind the turnabout is the decline of popular pressure for nuclear disarmament.

    Rival nations–and before their existence, rival territories–have always gravitated toward military buildups. This is based on the assumption–what might be called the “old thinking”–that national security is best achieved through military strength. Not surprisingly, then, in a world of competing and sometimes hostile nations, governments are tempted to develop nuclear weapons to secure what they consider their “national interests.” Thus, beginning during World War II and continuing during the Cold War, a growing number of rival governments commenced developing powerful nuclear arsenals.

    Fortunately, however, the nuclear arms race of the Cold War era inspired widespread public resistance–resistance that took the form of mass movements for nuclear disarmament, feisty antinuclear marches and rallies, and public critiques of nuclear weapons by religious bodies, scientists, and cultural leaders. Polls found public opinion strongly opposed to nuclear buildups and nuclear wars. As a result, governments were pushed, often reluctantly, into agreements for nuclear arms control and disarmament.

    But, since the end of the Cold War, the mass nuclear disarmament movements of the past have declined dramatically and public concern about nuclear weapons has dwindled. Furthermore, much of the lingering public concern has been manipulated by cynical government officials to bolster their own policies—as when the Bush administration exaggerated the Iraqi government’s readiness to wage nuclear war in order to justify its invasion of Iraq. Thus, freed of the constraint of popular pressure for international nuclear disarmament, governments gradually jettisoned their NPT commitments.

    The situation, however, may be changing once more. Just as the nuclear arms race of the Cold War era inspired massive popular protest, the reviving nuclear arms race of recent years is beginning to generate substantial public opposition.

    Much of this public opposition is crystallizing around the May 2005 NPT review conference at the United Nations, where nuclear and non-nuclear nations almost certainly will condemn one another for reneging on their treaty commitments. United for Peace and Justice (the major peace coalition in the United States), along with Abolition 2000 (a group focused on the nuclear issue), is laying plans for a nuclear abolition march and rally in New York City on May 1, the day before the review conference convenes. Noting that the NPT is “in serious disarray,” the organizers of these events have called for “a massive demonstration” to “demand global nuclear disarmament and an end to nuclear excuses for war.” Large antinuclear meetings and other related events are taking shape in numerous American cities, with prominent speakers drawn from political, academic, and cultural life.

    International organizations are also focusing their efforts on the NPT review conference. Stressing the importance of the gathering, the Nobel Peace Prize-winning International Physicians for the Prevention of Nuclear War is mobilizing for it as part of a Campaign for a Nuclear-Weapons-Free 21st Century. Mayors for Peace, an organization of top municipal officials from more than 600 cities around the world, has become particularly active in pressing the case for nuclear abolition. Headed by Hiroshima’s mayor, Tadatoshi Akiba, Mayors for Peace will be sending a substantial delegation to the NPT review conference for this purpose.

    Thus, at this time of widespread uncertainty about the future of the NPT–and, more broadly, about the future of nuclear arms control and disarmament–there are signs that popular pressure is developing to put the world back on track toward nuclear disarmament. Whether this pressure will prove powerful enough to save the NPT remains to be seen. But there is certainly movement on this front. Fortunately, in the most dangerous of circumstances, people have a tendency to rise to the occasion.
