  • U.S. Nuclear Policy: Taking the Wrong Road

    David KriegerOn September 21, 2014, the International Day of Peace, The New York Times published an article by William Broad and David Sanger, “U.S. Ramping Up Major Renewal in Nuclear Arms.”  The authors reported that a recent federal study put the price tag for modernizing the U.S. nuclear arsenal at “up to a trillion dollars” over the next three decades.  It appears that Washington’s military and nuclear hawks have beaten down a president who, early in his first term of office, announced with conviction, “America’s commitment to seek the peace and security of a world without nuclear weapons.”

    Many U.S. military leaders, rather than analyzing and questioning the effectiveness of nuclear deterrence to provide security, are acting as cheerleaders for it.  Rear Admiral Joe Tofalo, director of the Navy’s Undersea Warfare Division, recently pontificated, “For the foreseeable future, certainly for our and our children’s and our grandchildren’s lifetimes, the United States will require a safe, secure and effective strategic nuclear deterrent.  The ballistic nuclear submarine forces are and will continue to be a critical part of that deterrent….”  He went on to argue that all legs of the nuclear triad – bombers, intercontinental ballistic missiles and submarine launched ballistic missiles – would be needed to “provide a strong deterrent against different classes of adversary threat.”

    Admiral Tofalo was backed up by Admiral Cecil Haney, commander of the U.S. Strategic Command, who argued, “In a world where our traditional adversaries are modernizing, emerging adversaries are maturing and non-state actors remain elusive and dangerous, we must get 21st century deterrence right…the reality is that an effective modernized nuclear deterrent force is needed now more than ever.”

    All this emphasis on modernizing the nuclear deterrent force may be good for business, but ignores two important facts.  First, nuclear deterrence is only a hypothesis about human behavior that has not been and cannot be proven to work.  Second, it ignores the obligations of the U.S. and other nuclear-armed states to pursue negotiations in good faith for an end to the nuclear arms race and for nuclear disarmament.

    The U.S. and other nuclear-armed countries are gambling that nuclear deterrence will be foolproof rather than a game of chance, like nuclear roulette.  Rather than providing security for the American people, nuclear deterrence is a calculated risk, similar to loading a large metaphorical six-chamber gun with a nuclear bullet and pointing the gun at humanity’s head.

    The only foolproof way to assure that nuclear weapons won’t be used, by accident or design, is to abolish them.  This is what the generals and admirals should be pressing to achieve.  Negotiations in good faith for abolishing nuclear weapons are required by the Nuclear Non-Proliferation Treaty and by customary international law.  Since these obligations have not been fulfilled in 44 years, one courageous country, the Republic of the Marshall Islands, has brought lawsuits against the nine nuclear-armed countries, seeking the International Court of Justice to order their compliance.  They have also brought a lawsuit specifically against the U.S. in U.S. Federal Court.

    Rather than showing leadership by fulfilling its obligations for ending the nuclear arms race and for nuclear disarmament, the U.S. conducted a Minuteman III intercontinental ballistic missile test on September 23, just days after the International Day of Peace and days before the International Day for the Total Elimination of Nuclear Weapons on September 26.  Such displays of arrogance, together with U.S. plans to spend some $1 trillion on modernizing its nuclear arsenal over the next three decades, suggest that if the people don’t demand it, we may have nuclear weapons forever, with tragic consequences.

  • Pressure on the Nuclear Nine

    Re “India’s Role in the Nuclear Race” (editorial, July 6):

    New York Times logoWhile India tries to squeeze into the Nuclear Suppliers Group, the world’s nine nuclear-armed countries — including India — are being sued by the Marshall Islands in the International Court of Justice for their continuing possession and modernization of nuclear weapons. The lawsuits allege that India and the others are in continuous violation of customary international law by failing to negotiate in good faith for nuclear disarmament.

    As the International Court of Justice unanimously declared in 1996, “There exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.”

    Your suggestion that India negotiate with Pakistan and China for an end to that region’s nuclear arms race would be a good start to fulfilling its existing international legal obligations. But good-faith negotiations must also go beyond India’s immediate rivals to include all nine nuclear-armed countries.

    India’s pursuit of Nuclear Suppliers Group membership is not merely a question of trade and commerce. It is a question of whether known nuclear proliferators will be rewarded or held accountable under international law.

  • Nuclear Disarmament: Letter in the New York Times

    This letter to the editor was printed in the November 15, 2012, edition of The New York Times.


    To the Editor:


    We share with your editorial (“The Foreign Policy Agenda,” Nov. 12) the view that one of President Obama’s “singular contributions has been his vision of a world without nuclear weapons.” We would go further and suggest that realizing this vision would ensure Mr. Obama a legacy of honor, not only for America, but also for the world.


    Your editorial adds a caveat that nuclear disarmament “is a lofty goal that won’t be achieved in his second term, or maybe for years after that.” We dissent from this bit of conventional wisdom that almost always accompanies the affirmation of the goal, nearly taking back what was so grandly proposed.


    In our view, there has rarely been a better time to initiate a negotiated process of phased nuclear disarmament, and there is no reason that such a process should be stretched out over a long period. We are at one of those few times in international history with no acute conflict between major states.


    In our view, the United States should prepare proposals for nuclear disarmament and convene an international conference of the nine nuclear-weapon states. Nothing could do more to restore America’s claim to world leadership. At the very least, President Obama would belatedly show that his 2009 Nobel Peace Prize was not wrongly awarded.

  • Answering Bolton and Yoo: New START Will Strengthen U.S. National Security

    Two staunch ideologues who served in the George W. Bush administration, John Bolton and John Yoo, ask rhetorically in a New York Times opinion piece, “Why Rush to Cut Nukes?”  Bolton, a recess appointment as United Nations Ambassador under Bush II, never met an arms limitation agreement that he supported.  Yoo, the lawyer who wrote memos supporting the legality of water boarding under international law (not a very favorable prospect for captured U.S. soldiers), worked in Bush II’s Justice Department.  Bolton and Yoo can find no good reason to support the New START agreement with the Russians, arguing that without amendments it will weaken “our national defense.”  

    Let me answer the question posed in the title of their article.  The Senate should support and ratify this treaty because it will strengthen U.S. national security by:

    • reducing the size of the bloated nuclear arsenals in both countries, creating a new lower level from which to make further reductions;
    • reinstating verification procedures that ended with the expiration of the first START agreement in December 2009;
    • building confidence in the Russians that we stand behind our agreements; and
    • sending a signal to the rest of the world that we are taking steps to fulfill our legal commitment under the Nuclear Non-Proliferation Treaty to achieve nuclear disarmament.

    The downsides of failing to ratify the treaty would be to remove restraints on the size of the Russian arsenal, forego inspection and verification of the Russian arsenal, undermine Russian confidence in U.S. commitments, and encourage further nuclear proliferation by other countries thereby increasing the possibilities of nuclear terrorism. Further, if the treaty is not ratified before the new Congress is seated in January 2011, its future ratification will be far more difficult.

    What do Bolton and Yoo say they want?  First, to remove language in the treaty’s preamble, which is not legally binding, that says there is an “interrelationship” between nuclear weapons and defensive systems.  That language only recognizes a reality.  Of course, there is a relationship between missiles and missile defenses.  Second, they don’t want the U.S. to be limited in putting conventional weapons on formerly nuclear launch systems.  But that is a price, and a fair one, that each side will pay for lowering the other side’s nuclear capabilities.  Third, they want a Congressional act for the financing, testing and development of new U.S. warhead designs before the treaty is ratified.  In other words, they want guarantees that the U.S. nuclear arsenal will be modernized.  They seek long-term reliance on the U.S. nuclear threat, but this means that U.S. citizens will also remain under nuclear threat for the long-term.

    Bolton and Yoo are an interesting pair.  The first would lop ten floors off the United Nations, the second do away with the laws of war when they aren’t convenient.  Do they deserve their own opinions?  Of course.  Do their opinions make any sense?  Only in the context of the American exceptionalism and militarism that were the trademarks of the Bush II administration and have done so much to weaken the spirit, values and resources of the country while continuing to haunt us in our aggressive wars in Iraq and Afghanistan.  

    One must wonder what possessed the New York Times to publish their rantings.  Additionally, using the word “Nukes” in the title suggests somehow that nuclear weapons are cute enough to have nicknames and not a serious threat to the very existence of civilization.  That Bolton and Yoo could rise to high positions in our country is a sad commentary on the country, but perhaps understandable in the context of the Bush II administration’s persistent flouting of international law.  That the New York Times would find sufficient merit in their discredited opinions to publish their article is an even sadder commentary on the editorial integrity of one of the country’s most respected newspapers.

  • A World Free of Nuclear Weapons

    To the Editor:

    Re “New and Unnecessary” (editorial, Oct. 13):

    A big decision about nuclear weapons facing the next president will be “to build or not to build,” but there’s more to this story.

    The new president will need to decide whether to keep thousands of American nuclear weapons on hair-trigger alert, ready to be fired at a moment’s notice, or to eliminate this potentially catastrophic cold war posture.

    He must decide whether to retain the option of environmentally devastating nuclear testing, or to encourage the Senate to ratify the Comprehensive Test Ban Treaty. He must decide whether to perpetuate the system of nuclear haves and have-nots, or to commence good-faith negotiations to achieve the phased, verifiable and irreversible elimination of nuclear weapons worldwide.

    The next president must, for the sake of humanity’s future, make a world free of nuclear weapons an urgent priority and assure the United States’ leadership to realize this goal.
