Chair and Distinguished Representatives,

Kiribati is concerned that the Nuclear Weapon States are still maintaining and upgrading their weapons both quantitatively and qualitatively in violation of their Article VI obligations. These states have ignored the decisions contained in the historic 1996 Advisory Opinion of the ICJ, including the court’s recognition that “there is an obligation to pursue in good faith and to conclude negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.”

The persistent collective decision by the NWS to ignore their Article VI obligation is placing serious constraints on the Treaty.

In this regard, we would like to remind all States Parties about the 64-point action plan from the 2010 NPT Review Conference. In particular, we want to recall Action 5 and agree with other States Parties on the necessity for the Nuclear Weapon States to present national reports that address information on how they are dismantling their nuclear weapons and actions related to fulfilling their obligations to pursue negotiations in good faith. This should be an agenda item for the NPT Review Conference.

Chair and Distinguished Representatives,

We remain highly concerned that a certain NWS is preparing to resume nuclear tests.

We remember that tests ravaged communities and divided families during the height of the Cold War, especially in the Pacific region.

As a state that has suffered from immense humanitarian and environmental consequences of testing, we are calling for explicit references to the humanitarian consequences of both the use and testing of nuclear weapons in the outcome doc. The international community must reflect that it is also the 80th anniversary of the first nuclear test conducted at the Trinity Site in New Mexico.

For us, it is clear that the use and testing of nuclear weapons violate the core principles of international humanitarian law.

Chair and Distinguished Representatives,

We believe the legacy of nuclear testing is not theoretical—it is a living reality for the survivors and their families.

In this regard, we recall that the vast majority of States voted in favor of our resolution on addressing the legacy of nuclear weapons in the UN General Assembly. Thus, we contend that States Parties should request an agenda item on nuclear legacy issues, including victim assistance and environmental remediation, at the Review Conference and during the next review cycle.

It is time for us to take action.

On April 30th, Christian Ciobanu, our Director of Policy and Advocacy, delivered a statement on behalf of the Republic of Kiribati at the 2024 Humanity at the Crossroads Conference in Vienna. Please find the video remarks and transcript below.

Christian serves as an Advisor on the Treaty on the Prohibition of Nuclear Weapons (TPNW) to the Permanent Mission of Kiribati, where he works extensively with the Co-Chairs of the Intersessional Informal Working Group on Articles 6 and 7 of the TPNW. Christian is also the Coordinator of our youth initiative, Reverse the Trend (RTT).

As a small island Pacific State, we share concerns about the possible negative consequences and impact of autonomous Weapons Systems on Global Security and Regional and international stability, including the risk of an emerging arms race, lowering the threshold for conflict and proliferation, including to non-state actors, as stated in the resolution. Thus, we welcome our colleagues from EOAS who adopted a communication calling for Urgent negotiations of a legally binding instrument to regulate Autonomous Weapons Systems, as well as additional colleagues who also called for such a system instrument.

We contend that a new treaty is the only way for Humanity to be safe from these weapons. A new legally binding instrument should underscore the need for all states to comply at all times with international law, including international humanitarian law, international human rights law, and the UN Charter. This new treaty should contain an unambiguous definition of what is an autonomous weapon. In this regard, we agree with the definition presented by the International Committee of the Red Cross in its submission to the UN Secretary-General. Chair, given the current geopolitical situations across the world, we must safeguard the lives of civilians.

We cannot have uncontrollable weapons which cause indiscriminate harm and cannot differentiate between civilians and non-civilians. As a result, the treaty should address a series of prohibitions that include autonomous weapons which have artificial intelligence and hinder human users from understanding and predicting the system’s behaviors. We cannot allow any type of weapons that can potentially harm civilians. We welcome the forthcoming outcome document and look forward to further developments. Finally, we would like to thank Austria for initiating the beginnings of this dialogue at this historic conference. Thank you.

The nuclear age began in 1945, with the United States developing three atomic bombs that year, using one in a nuclear test, called Trinity, in New Mexico, and two more in attacks on the Japanese cities of Hiroshima and Nagasaki. Since that time, many other countries acquired nuclear weapons and currently, nine countries posess them across three continents. The nuclear weapons development programs all involved testing of both atomic and hydrogen bombs. Over 2000 nuclear tests took place around the world, causing devastating humanitarian consequences. Many of the affected communities have been left to fend for themselves in face of physical and mental health impacts, and loss of land, culture, and sustainable practices.

Kiribati and Kazakhstan, two countries affected by Soviet and United Kingdom/United States nuclear testing programs, respectively, have been spearheading the fight for nuclear justice. As part of the 78th United Nations General Assembly (UNGA), they have tabled a resolution entitled “Addressing the Legacy of Nuclear Weapons: Providing Victim Assistance and Environmental Remediation to Member States Affected by the Use or Testing of Nuclear Weapons.” The resolution seeks to utilize the framework of multilateral treaties to promote victim assistance and environmental assessment and remediation, requests support for affected states, and promotes public awareness and education around the International Day Against Nuclear Tests. It is currently under consideration by the First Committee of UNGA.

The Nuclear Age Peace Foundation is proud to support the work of the Republics of Kazakhstan and Kiribati. Our Policy and Advocacy Coordinator, Christian N. Ciobanu, serves as the TPNW Advisor for the Mission of Kiribati and has been deeply involved in every step of this effort. We see the issue of supporting victims of nuclear use and testing as intimately connected to nuclear abolition itself. It is about righting the historical wrongs, but also making sure that such harm and suffering never happen again.
