  • Real Fireworks, or Just Bombs Again?

    As Interdependence Day approaches, the United States humbly admitted error in bombing a wedding party in Afghanistan, killing around 40 people and injuring more than 60. Bombs and rockets in our country symbolize a celebration of freedom, but in other parts of the world, these explosions are all too real, bringing carnage, death and grueling efforts to survive destruction of homes and livelihood.

    This error, undoubtedly labeled ‘collateral damage’, stands next to a smattering of misguided bombs which have inadvertently and regrettably killed hundreds of civilians in numerous countries over the past few years. As reported by the BBC, during the current Bush administration’s war on terror in Afghanistan, U.S. planes accidentally killed four Canadians in April, bombed the town of Hazar Qadam in January, fired at a caravan of tribal elders en route to the inauguration ceremony for Hamid Karzai and last October hit a residential area in Kabul rather than the intended helicopter at the airport. Oops.

    For the pilots and American citizens, these mistakes are akin to losses while playing a video game. From afar, with targets merely illuminated points on a screen, the people who die are unreal, just numbers and statistics. When we kill by remote control, our hands are theoretically clean. The computer won’t show blood and won’t cry; it’s a machine, an abstraction.

    The people affected by our ubiquitous blunders, however, are terribly real, as is their pain. In February of 1991, during the Gulf War, U.S. planes bombed a women’s and children’s shelter in Baghdad called al-Amiriya. Hundreds of civilians died as a result of the two bombs hitting this supposed-safe haven. The U.S. apologized after realizing what happened, but still continues to bomb the country, even in the past week.

    The rhetoric about a “new war” with Iraq is a farce. We are already at war informally with them. Friday June 28th we dropped bombs in the South of Iraq. Wednesday the 26th of June as well. On Thursday the 20th of June four people in Iraq were killed when U.S. planes bombed them. Eighteen people were wounded when bombs fell on Iraq on the 25th of May. And another four were killed when we bombed Iraq on February 6th. I’d imagine that Iraqis feel attacked and besieged as bombs continue to fall in an undeclared, ongoing, indefinite war that inevitably targets civilians.

    When I tell people this, they invariably say, “Where’d you hear this? Why didn’t I know about it?” It’s in the news, alright, but it’s just hard to find. These statistics get buried in the middle of stories about deposing Saddam Hussein and vilifying his evil acts.

    “But Saddam kills his own people!” He did this in the 1980’s as well when he was our friend. We just turned a blind eye then. Besides, we kill our own people, executing hundreds of people since the death penalty was reinstated in 1976. The crime of a state murdering its own civilians looks different when it’s on our own soil.

    Incidentally, these bombs that rain down on Iraq are illegal under international law. They were not approved by Congress nor by the United Nations. The United States justifies dropping bombs as we unlawfully patrol Iraqi borders enforcing the bogus “no fly zones.” Iraqis have become sadly accustomed to the noisy air raid sirens.

    You cannot achieve peace through war. The United States cannot continue to be proud guardians of weapons of mass destruction and deify their usage, apologize for their errors and claim that we are the land of the free and the home of the brave. Do these mistakes which take innocent lives make us safer or prove our strength or our liberty? Is it righteous or noble to kill unarmed guests at a wedding? Moreover, to what end are we still bombing Afghanistan – has it brought us closer to capturing Osama bin Laden? Has enough justice not been rendered on the citizens of Afghanistan to make up for the loss of lives on September 11th?

    We are not alone on this small planet, a fact that ought to be in the hearts and minds of all Americans as the nationally celebrated holiday approaches. We drive automobiles made in Japan, drink coffee from South America, wear clothes made in Southeast Asia, buy oil from the Middle East and Africa and import furniture from Sweden. Even our fireworks are made in China!

    On July 4th, millions of American children will be lighting sparklers and tracing their names in the night sky. They should also trace the names of any of the thousands of displaced Afghani children, due to the bombings, who are still refugees on the border of Afghanistan and Pakistan. They should trace the names of the Iraqi children who are their same-age counterparts, held captive under the sanctions and threatened almost daily by U.S. bombs. On Interdependence Day, each and every one of us is affected by an errant bomb.

  • For a lasting peace in Iraq

    When elephants fight, it’s the grass that suffers. Two nations like the United States and Iraq have unlimited potential for rendering irreversible damage to each other, to the environment and to the innocent people who get trampled underfoot in the stampede of war.

    As a pacifist, I do not endorse violence.

    But let’s imagine for a moment that I went along with the idea that removing President Saddam Hussein from power in Iraq was a good idea, that this action would decrease the cycle of violence in the world, and that it were a decent and honourable thing to do.

    Imagine that we got rid of Saddam. Then what?

    There are still 23 million people living in Iraq, so long as we did not kill a significant number of them in dethroning the infamous leader of the Ba’ath party. Among the Iraqis left standing are young men and women who have grown up in a decidedly anti-American environment, who have been nutritionally deprived since conscious memory and who are living daily with the threat of future bombings which have dotted the landscape, virtually escaping Western media reports for the past eleven years.

    Are we naive to think that this same underdeveloped population that has endured hellishly hot summers, putrid water and abominable health conditions will now embrace American presence and show gratitude for our reinvigorated military effort against them?

    Imagine for a moment that we stopped finger-pointing and blaming Saddam for starving his people for the past eleven years. Imagine that we stopped blaming a recalcitrant Sanctions Committee and policy making team from the State Department. Imagine that we viewed the humanitarian crisis in Iraq simply as people in need. The unending, maddening seclusion maintained by the world community could then be addressed.

    What will we do for these civilian Iraqis with whom we have no argument, the unseen innocent survivors of an eleven-year siege?

    A lasting peace plan in Iraq would have to begin by addressing the immediate needs of the average Iraqi people — their access to potable water, their educational infrastructure, healthcare system, their agriculture and oil industries — as well as their access to interstate and international travel. Restrictions on travelling to and from Iraq must be amended so that a dialogue may begin between Iraqis and other cultures throughout the world, starting with study abroad and student exchange programmes.

    In Iraq, doctors need vaccines, syringes with needles, X-ray film and blood bags. Teachers need books and pencils. Children need shoes and a happy childhood. Nursing mothers need proper nutrition to provide a healthy start for young lives. Iraqis need a wider array of food options and nutritional intake other than the lentils and rice available under the oil-for-food programme.

    Iraq needs an infusion of currency, a way to pay its citizens who desire to work, achieve and fulfil the demands of providing for their families. Immediately, Iraq needs a plan to rebuild its infrastructure — the water and sewage treatment plants and electrical facilities so that air conditioning and ceiling fans function when the temperature is 140 degrees.

    We must accept responsibility for the life-altering consequences of our policies on people who should not have been targeted.

    The world community, led by the United Nations, must apologise formally and publicly to the families who have lost loved ones as a result of the sanctions and no-fly-zone bombing campaigns in the North and south of Iraq. We must offer our sincerest condolences for our complicity in the crimes that killed more than half a million children.

    Unless we do this, the civilian Iraqis who are not the enemy will have every justification for taking every opportunity to avenge the egregious wrongs done against them.

    Gandhi tells a story about a wise man meditating by a river. A scorpion in a tree repeatedly falls into the water, and the wise man rescues him each time. And each time, the scorpion stings him. Another man sees this drama played out several times and approaches the wise man, asking why he continues to save the scorpion and risk being stung every time? “It is his nature to sting,” says the wise man. “I am a human. It is my nature to save.”

    Iraq needs no new war, no more bombs. They need simple human-to-human outreach. That is the right thing to do.

  • Facing the Children of Iraq

    Despite the reports from every United Nations organization dealing with health, agriculture and children, the United States has maintained unwavering support for continuing the economic embargo on Iraq. On my first visit to Iraq in July and August, I traveled with Chicago-based Voices in the Wilderness to experience the effects on the people of Iraq who are suffering needlessly at the hands of our government. As many people know, travel to Iraq is illegal and those undertaking the trip do so at the risk of twelve years in prison and over one million dollars in fines. For me, to meet teachers, students, families, doctors, patients, mothers and ordinary people whose lives have been irreversibly altered as a result of the mean-spirited policies of my government, the risk is worth it.

    Before I left I had viewed the excellent documentary by John Pilger and had participated in the cross-country educational Remembering Omran Bus Tour, named for a shepherd boy from a farming community near Najaf who was killed in May 2000 by coalition bombs. I had already taken a public stand against the sanctions through written articles as well as in my classroom where I teach high school classes on nonviolence. Having returned from Iraq after seeing for myself the squalor that children play, learn and live in, seeing for myself the pathetic conditions of health care and education, and seeing the indomitable spirit of the Iraqi people, I realize that I know nothing. I know nothing about patience, about hopefulness and hopelessness, about just getting by, and about forgiveness. I realize that we Americans have so much privilege, time, and resources and that our lives have gone on since the Gulf War. We are able to forget about the Iraqi people because our media does not present us with images from families who boil sewer water for tea, with images from inside a morgue where babies are kept in flimsy boxes until their families can come pick them up, with images from car accidents on hot asphalt roads caused by blowouts because the people can’t afford new tires.

    I realize that I know nothing about life under siege. Voices in the Wilderness founder Kathy Kelly describes our world as a train: some people travel first class, riding with comfort and ease, some people travel in cramped third class conditions, and some people are under the train, and the people of Iraq are under the US foreign policy train which is rolling full speed ahead toward annihilation. To stop this runaway policy of genocide, I can figuratively lay myself down on the tracks. I can lay down the stories of the people I know from Iraq. I can lay down the stories whose raw truth can compel more Americans, more young people like me, to get involved.

    Every day since I returned I have thought about a mother and her twelve-year-old son and sitting at his beside while she cried uncontrollably. He was unconscious, a victim of leukemia caused by toxic exposure to depleted uranium. I gave her some tissues and sat with her as long as I could before our delegation continued on to other sweltering rooms filled with sick kids and their helpless mothers. It was at the Saddam Teaching Hospital that I realized kids cry in the same language and that inconsolable mothers worldwide feel the burden of responsibility when their kids won’t get well. The situation in Iraq is compounded because of the crippling lack of medicine and hospital supplies, like refined oxygen. We witnessed some men unloading industrial oxygen tanks into a hospital hallway which were to be used on even the most fragile babies because refined oxygen is unavailable.

    During my time in Iraq, I thought about why my country has made it illegal for me to visit the cradle of civilization. My only explanation is so that we cannot see the soul-wrenching, pervasive damage our government has perpetrated there. I wondered if people in my government feel any shame for what they have done to ravage these ancient sites in this beautiful country. The foundation for disrespecting pre-existing cultures is nothing new for my country, though, and I was struck by the similarity of how millions of Native Americans were killed by European diseases and uprooted from their native lands in the name of Western progress.

    Yet as I stood at the convergence of the Tigris and Euphrates where they become the Shatt al-Arab, I felt so privileged to be in a place very few Americans will ever see. I felt the timelessness of Iraq and the historical and religious significance which lies within the boundaries. Standing on the top of the ziggurat at Ur and holding seashells which still rest there from the “Great Flood”, I knew the infinite importance of Iraq. And I saw the hurt in our guide’s eyes as as I watched him pull a piece of shrapnel out of the side of the ziggurat where it stuck after a coalition bomb struck a few hundred yards from this temple.

    Americans largely misunderstand the Arab culture. I encountered a country full of generous and hospitable people, welcoming me into their homes even though my country still bombs them many times each month. Yet anti-Arab attitudes promote such discrimination and racism in our country, attitudes fostered by movies and media which portray them as terrorists and suicide bombers. Iraqis especially are shown as hating Americans, burning our flag and cursing our democratic and freedom-loving nation. The Iraqis I met all said that they understand that the American people have good hearts and that we are not our government or military. Can the average American say that about the people of Iraq, or do we equate an entire nation of 23 million people with one leader? In addition to lifting the economic sanctions, we need to eliminate the institutionalized hatred of Iraqis which enables the good people of America to sit by and let our government destroy a beautiful nation.

    Iraq does not need to be bombed another time, and it does not need smarter sanctions. The economic embargo needs to be lifted because it violates the United Nations Convention on the Rights of the Child, specifically Article 24 which pertains to healthcare for children, including prenatal care for expectant mothers. Each month nearly 5,000 children die as a result of sanctions, according to the World Health Organization, and 1 in 10 children will not live to see their first birthdays. Prior to sanctions, citizens of Iraq enjoyed quality comprehensive healthcare, but today over 90 percent of pregnant women are severely anemic.

    Additionally, in the past eleven years under sanctions, the international community has rendered the Geneva Convention protocol protecting victims of armed conflicts ineffective because of the intentional, preconceived and flagrant human rights abuses perpetrated in Iraq by the United Nations sanctions supported by our government. This protocol exists to protect not just Westernized countries, but all humans. I live every day knowing that policies of my government dispassionately kill Iraqis, and as a U.S. citizen I bear responsibility for their enduring consequences. We as Americans are guilty of genocide in the cradle of civilization through our inaction and inattention to the needless suffering that has transpired over the last eleven years; we must hold ourselves and our government accountable and mobilize to create more just policies toward Iraq.

  • Ventura Activist Sets Off on Mission to Iraq

    Ventura resident Leah Wells was one of five Americans who flew to Baghdad on Thursday, hoping to focus attention on the effects of an economic embargo on Iraqis and ultimately to change U.S. foreign policy.

    “The purpose of the trip is to try and put pressure on our government to lift the sanctions,” Wells said Thursday from Chicago before leaving the country. “People can make a difference.”

    Iraq has been under United Nations sanctions since it invaded Kuwait in 1990 and was defeated by forces led by the United States seven months later.

    Wells, 25, is part of a delegation representing the Chicago-based U.S. Voices in the Wilderness, a human rights group that has led dozens of missions into Iraq to deliver medical equipment and gather information.

    “The World Health Organization has reported that over a half-million children and 1 million people overall have died since 1990 as a result of the sanctions,” Wells said. “Women are too malnourished to breast-feed. Children are dying of malnutrition.”

    Wells said many Americans are unaware of the effect the U.N. embargo has had on Iraqis.

    “The humanitarian crisis in Iraq is virtually unreported,” Wells said. “The air strikes were in the news, but the day-to-day suffering of the Iraqi people isn’t well-known.”

    Although this is her first trip to Iraq, Wells said other people who have made the journey have described vast residential tracts with open sewage lines, no electricity, and schools without textbooks.

    The delegation was carrying two duffel bags stuffed with medical journals and supplies, which she said would be invaluable to medical professionals starved for up-to-date information.

    “It’s not just an economic embargo,” she said. “It’s an intellectual embargo as well.”

    A peace activist and a teacher at St. Bonaventure High School in Ventura, Wells teaches a class on nonviolence that covers the situation in Iraq. She said many of her students support her venture.

    “Once the students find out what’s going on, I don’t have to convince them,” she said. “They see it.”

    Wells said she isn’t concerned about repercussions from the trip, which violates the embargo against Iraq.

    “We risk up to 12 years in prison and over $1 million in fines for each delegation we send,” she said. “This is the 38th delegation we’ve sent over and it hasn’t happened yet.”

  • Human Rights in the 21st Century

    The people of Iraq have been denied basic human rights since the Economic Sanctions were imposed in August of 1990, and the international community has done little but watch and wait. The United States and United Kingdom have bilaterally acted to deny the innocent people in Iraq clean water, electricity, materials to rebuild their devastated national infrastructure after the Gulf War, and most importantly, food. Every United Nations organization pertaining to health, agriculture and children has reported on the detrimental effects of the sanctions on the most compromised populations, the children, the sick and the elderly.

    To address the issue of human rights, the international community must take a stand on the situation in Iraq. Many countries have already violated the sanctions, like France, Russia, Ireland and Syria, showing that support for the sanctions is crumbling. The international community must show the backbone to support human rights because the concept of human rights transcends ideologies, religions, and national borders. If ever there were a case for taking a strong stand in favor of human rights, Iraq is it. How can countries investigate the egregious violations of human rights in this isolated country when travel and communications with its residents is in all cases ill-advised and in some cases illegal? How can the international community ignore the World Health Organization’s reports that over half a million children have died, and more than one million total, as a direct result of the sanctions?

    Is this the policy we choose to set as a standard for supporting human rights in the twenty-first century?

  • U.S. Military Action Undermines the Rule of Law

    When it was first announced by President Clinton that the United States would launch a military strike against Iraq, I wondered about the legality of this attack under international law. I carefully read President Clinton’s speech announcing the attack, and found a reference to a UN Security Council resolution that condemned Iraq’s defiance of the UN inspection team by a vote of 15 to zero. Upon review of the resolution, however, I found that it contained no authorization for the use of force against Iraq. Nor did any previous Security Council resolution, except for the 1991 resolution authorizing the removal of Iraqi forces from Kuwait, an issue clearly not relevant to the current situation.

    President Clinton announced that the purpose of the military action was “to attack Iraq’s nuclear, chemical and biological weapons and its military capacity to threaten its neighbors.” Clinton and his security advisors, who he announced were unanimous in their recommendation to attack, were responding to a report filed by Richard Butler, the head of the UN inspection team in Iraq.

    But this is what the Washington Post wrote about Butler’s report, “Butler’s conclusions were welcome in Washington, which helped orchestrate the terms of the Australian diplomat’s report. Sources in New York and Washington said Clinton officials played a direct role in shaping Butler’s text during multiple conversations with him Monday at secure facilities in the U.S. mission to the United Nations.”

    The article in the Washington Post also pointed out that a “companion report” by the International Atomic Energy Agency expressed “broad satisfaction with Iraq’s cooperation.”

    What this suggests is that there were reasonable differences of opinion about Iraq’s cooperation with the UN, and that there was improper collusion between Richard Butler, the head of the UN inspection team who is supposed to act in a neutral manner, and U.S. officials. If this is true, Butler was clearly acting in an improper manner and bears some of the responsibility for the military action against Iraq. If it is true, Kofi Annan should act immediately to fire Butler.

    President Clinton justified the attack as being necessary “to protect the national interest of the United States, and indeed the interests of people throughout the Middle East and around the world.” This justification raises many questions. What was the “national interest” that was being protected? How was it determined? Should any country have the right to attack another country in the name of national interest without proper authority under international law?

    The behavior of President Clinton and his “security team” sends the wrong message to the international community. It is a similar message to the one they sent when they attacked a pharmaceutical plant in Sudan, which they unconvincingly claimed was a chemical weapons factory.

    The message we are sending to the world is that we are the big boys on the block, and we are willing to throw our weight around regardless of the law. The Russian Duma referred to our attack in a nearly unanimous vote as “international terrorism.” This does not bode well for our future relations with the Russians.

    The Pakistani Parliament unanimously characterized the military action against Iraq as “an attaack on humanity and the Islamic world.” This does not bode well for our relations with other Islamic nations.

    Of the many consequences of our attack against Iraq, I believe the most serious is our undermining of the rule of law. For any use of force against Iraq, we should have had express authority from the UN Security Council, which in all of its resolutions on this matter indicated clearly that it would “remain actively seized of the matter.” By choosing not to do so, we once again demonstrated our willingness to defy international law for vague reasons of national interest.

    The bottom line is that our attack against Iraq was bullyism, and undermines international law. It did not serve the interests of the United States, nor of the world. Kofi Annan had it right when he said, “This is a sad day for the United Nations and for the world.”

    The Security Council,

    Recalling all its previous relevant resolutions on the situation in Iraq, in particular its resolution 1154 (1998) of 2 March 1998 and 1194 (1998) of 9 September 1998,

    Noting with alarm the decision of Iraq on 31 October 1998 to cease cooperation with the United Nations Special Commission, and its continued restrictions on the work of the International Atomic Energy Agency (IAEA),

    Noting the letters from the Deputy Executive Chairman of the Special Commission of 31 October 1998 (S/1998/1023) and from the Executive Chairman of the Special Commission of 2 November 1998 (S/1998/1032) to the President of the Security Council, which reported to the Council the decision by Iraq and described the implications of that decision for the work of the Special Commission, and noting also the letter from the Director General of the IAEA of 3 November 1998 (S/1998/1033, annex) which described the implications of the decision for the work of the IAEA,

    Determined to ensure immediate and full compliance by Iraq without conditions or restrictions with its obligations under resolution 687 (1991) of 3 April 1991 and the other relevant resolutions,

    Recalling that the effective operation of the Special Commission and the IAEA is essential for the implementation of resolution 687 (1991),

    Reaffirming its readiness to consider, in a comprehensive review, Iraq’s compliance with its obligations under all relevant resolutions once Iraq has rescinded its above-mentioned decision and its decision of 5 August 1998 and demonstrated that it is prepared to fulfil all its obligations, including in particular on disarmament issues, by resuming full cooperation with the Special Commission and the IAEA consistent with the Memorandum of Understanding signed by the Deputy Prime Minister of Iraq and the Secretary-General on 23 February 1998 (S/1998/166), endorsed by the Council in resolution 1154 (1998),

    Reiterating the commitment of all Member States to the sovereignty, territorial integrity and political independence of Kuwait and Iraq,

    Acting under Chapter VII of the Charter of the United Nations,

    1. Condemns the decision by Iraq of 31 October 1998 to cease cooperation with the Special Commission as a flagrant violation of resolution 687 (1991) and other relevant resolutions;

    2. Demands that Iraq rescind immediately and unconditionally the decision of 31 October 1998, as well as the decision of 5 August 1998, to suspend cooperation with the Special Commission and to maintain restrictions on the work of the IAEA, and that Iraq provide immediate, complete and unconditional cooperation with the Special Commission and the IAEA;

    3. Reaffirms its full support for the Special Commission and the IAEA in their efforts to ensure the implementation of their mandates under the relevant resolutions of the Council;

    4. Expresses its full support for the Secretary-General in his efforts to seek full implementation of the Memorandum of Understanding of 23 February 1998;

    5. Reaffirms its intention to act in accordance with the relevant provisions of resolution 687 (1991) on the duration of the prohibitions referred to in that resolution, and notes that by its failure so far to comply with its relevant obligations Iraq has delayed the moment when the Council can do so;

    6. Decides, in accordance with its primary responsibility under the Charter for the maintenance of international peace and security, to remain actively seized of the matter.

  • Resolution 715 (1991) on Iraq

    Adopted by the Security Council at its 3012th meeting

    The Security Council,

    Recalling its resolutions 687 (1991) of 3 April 1991 and 707 (1991) of 15 August 1991, and its other resolutions on this matter,

    Recalling in particular that under resolution 687 (1991) the Secretary-General and the Director General of the International Atomic Energy Agency (IAEA) were requested to develop plans for future ongoing monitoring and verification, and to submit them to the Security Council for approval,

    Taking note of the report and note of the Secretary-General (S/22871/Rev.1 and S/22872/Rev.1), transmitting the plans submitted by the Secretary-General and the Director General of the International Atomic Energy Agency,

    Acting under Chapter VII of the Charter of the United Nations,

    1. Approves, in accordance with the provisions of resolutions 687 (1991), 707 (1991) and the present resolution, the plans submitted by the Secretary-General and the Director General of the International Atomic Energy Agency (S/22871/Rev.1 and S/22872/Rev.1);

    2. Decides that the Special Commission shall carry out the plan submitted by the Secretary-General (S/22871/Rev.1), as well as continuing to discharge its other responsibilities under resolutions 687 (1991), 699 (1991) and 707 (1991) and performing such other functions as are conferred upon it under the present resolution;

    3. Requests the Director General of the International Atomic Energy Agency to carry out, with the assistance and cooperation of the Special Commission, the plan submitted by him (S/22872/Rev.1) and to continue to discharge his other responsibilities under resolutions 687 (1991), 699 (1991) and 707 (1991);

    4. Decides that the Special Commission, in the exercise of its responsibilities as a subsidiary organ of the Security Council, shall:

    (a) Continue to have the responsibility for designating additional locations for inspection and overflights;

    (b) Continue to render assistance and cooperation to the Director General of the International Atomic Energy Agency, by providing him by mutual agreement with the necessary special expertise and logistical, informational and other operational support for the carrying out of the plan submitted by him;

    (c) Perform such other functions, in cooperation in the nuclear field with the Director General of the International Atomic Energy Agency, as may be necessary to coordinate activities under the plans approved by the present resolution, including making use of commonly available services and information to the fullest extent possible, in order to achieve maximum efficiency and optimum use of resources;

    5. Demands that Iraq meet unconditionally all its obligations under the plans approved by the present resolution and cooperate fully with the Special Commission and the Director General of the International Atomic Energy Agency in carrying out the plans;

    6. Decides to encourage the maximum assistance, in cash and in kind, from all Member States to support the Special Commission and the Director General of the International Atomic Energy Agency in carrying out their activities under the plans approved by the present resolution, without prejudice to Iraq’s liability for the full costs of such activities;

    7. Requests the Committee established under resolution 661 (1990), the Special Commission and the Director General of the International Atomic Energy Agency to develop in cooperation a mechanism for monitoring any future sales or supplies by other countries to Iraq of items relevant to the implementation of section C of resolution 687 (1991) and other relevant resolutions, including the present resolution and the plans approved hereunder;

    8. Requests the Secretary-General and the Director General of the International Atomic Energy Agency to submit to the Security Council reports on the implementation of the plans approved by the present resolution, when requested by the Security Council and in any event at least every six months after the adoption of this resolution;

    9. Decides to remain seized of the matter.

    The Security Council,

    Recalling its resolutions 660 (1990) of 2 August 1990, 661 (1990) of 6 August 1990, 662 (1990) of 9 August 1990, 664 (1990) of 18 August 1990, 665 (1990) of 25 August 1990, 666 (1990) of 13 September 1990, 667 (1990) of 16 September 1990, 669 (1990) of 24 September 1990, 670 (1990) of 25 September 1990, 674 (1990) of 29 October 1990, 677 (1990) of 28 November 1990, 678 (1990) of 29 November 1990 and 686 (1991) of 2 March 1991,

    Welcoming the restoration to Kuwait of its sovereignty, independence and territorial integrity and the return of its legitimate Government,

    Affirming the commitment of all Member States to the sovereignty, territorial integrity and political independence of Kuwait and Iraq, and noting the intention expressed by the Member States cooperating with Kuwait under paragraph 2 of resolution 678 (1990) to bring their military presence in Iraq to an end as soon as possible consistent with paragraph 8 of resolution 686 (1991),

    Reaffirming the need to be assured of Iraq’s peaceful intentions in the light of its unlawful invasion and occupation of Kuwait.

    Taking note of the letter sent by the Minister for Foreign Affairs of Iraq on 27 February 1991 and those sent pursuant to resolution 686 (1991),

    Noting that Iraq and Kuwait, as independent sovereign States, signed at Baghdad on 4 October 1963 “Agreed Minutes Between the State of Kuwait and the Republic of Iraq Regarding the Restoration of Friendly Relations, Recognition and Related Matters”, thereby recognizing formally the boundary between Iraq and Kuwait and the allocation of islands, which were registered with the United Nations in accordance with Article 102 of the Charter of the United Nations and in which Iraq recognized the independence and complete sovereignty of the State of Kuwait within its borders as specified and accepted in the letter of the Prime Minister of Iraq dated 21 July 1932, and as accepted by the Ruler of Kuwait in his letter dated 10 August 1932,

    Conscious of the need for demarcation of the said boundary,

    Conscious also of the statements by Iraq threatening to use weapons in violation of its obligations under the Geneva Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or Other Gases, and of Bacteriological Methods of Warfare, signed at Geneva on 17 June 1925, and of its prior use of chemical weapons and affirming that grave consequences would follow any further use by Iraq of such weapons,

    Recalling that Iraq has subscribed to the Declaration adopted by all States participating in the Conference of States Parties to the 1925 Geneva Protocol and Other Interested States, held in Paris from 7 to 11 January 1989, establishing the objective of universal elimination of chemical and biological weapons,

    Recalling also that Iraq has signed the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin weapons and on Their Destruction, of 10 April 1972,

    Noting the importance of Iraq ratifying this Convention,

    Noting moreover the importance of all States adhering to this Convention and encouraging its forthcoming Review Conference to reinforce the authority, efficiency and universal scope of the convention,

    Stressing the importance of an early conclusion by the Conference on Disarmament of its work on a Convention on the Universal Prohibition of Chemical Weapons and of universal adherence thereto,

    Aware of the use by Iraq of ballistic missiles in unprovoked attacks and therefore of the need to take specific measures in regard to such missiles located in Iraq,

    Concerned by the reports in the hands of Member States that Iraq has attempted to acquire materials for a nuclear-weapons programme contrary to its obligations under the Treaty on the Non-Proliferation of Nuclear Weapons of 1 July 1968,

    Recalling the objective of the establishment of a nuclear- weapons-free zone in the region of the Middle East,

    Conscious of the threat that all weapons of mass destruction pose to peace and security in the area and of the need to work towards the establishment in the Middle East of a zone free of such weapons,

    Conscious also of the objective of achieving balanced and comprehensive control of armaments in the region,

    Conscious further of the importance of achieving the objectives noted above using all available means, including a dialogue among the States of the region,

    Noting that resolution 686 (1991) marked the lifting of the measures imposed by resolution 661 (1990) in so far as they applied to Kuwait,

    Noting that despite the progress being made in fulfilling the obligations of resolution 686 (1991), many Kuwaiti and third country nationals are still not accounted for and property remains unreturned,

    Recalling the International Convention against the Taking of Hostages, opened for signature at New York on 18 December 1979, which categorizes all acts of taking hostages as manifestations of international terrorism,

    Deploring threats made by Iraq during the recent conflict to make use of terrorism against targets outside Iraq and the taking of hostages by Iraq,

    Taking note with grave concern of the reports of the Secretary-General of 20 March 1991 and 28 March 1991, and conscious of the necessity to meet urgently the humanitarian needs in Kuwait and Iraq,

    Bearing in mind its objective of restoring international peace and security in the area as set out in recent resolutions of the Security Council,

    Conscious of the need to take the following measures acting under Chapter VII of the Charter,

    1. Affirms all thirteen resolutions noted above, except as expressly changed below to achieve the goals of this resolution, including a formal cease-fire:

    A
    2. Demands that Iraq and Kuwait respect the inviolability of the international boundary and the allocation of islands set out in the “Agreed Minutes Between the State of Kuwait and the Republic of Iraq Regarding the Restoration of Friendly Relations, Recognition and Related Matters”, signed by them in the exercise of their sovereignty at Baghdad on 4 October 1963 and registered with the United Nations and published by the United Nations in document 7063, United Nations, Treaty Series, 1964;

    3. Calls upon the Secretary-General to lend his assistance to make arrangements with Iraq and Kuwait to demarcate the boundary between Iraq and Kuwait, drawing on appropriate material, including the map transmitted by Security Council document S/22412 and to report back to the Security Council within one month;

    4. Decides to guarantee the inviolability of the above-mentioned international boundary and to take as appropriate all necessary measures to that end in accordance with the Charter of the United Nations;

    B
    5. Requests the Secretary-General, after consulting with Iraq and Kuwait, to submit within three days to the Security Council for its approval a plan for the immediate deployment of a United Nations observer unit to monitor the Khor Abdullah and a demilitarized zone, which is hereby established, extending ten kilometres into Iraq and five kilometres into Kuwait from the boundary referred to in the “Agreed Minutes Between the State of Kuwait and the Republic of Iraq Regarding the Restoration of Friendly Relations, Recognition and Related Matters” of 4 October 1963; to deter violations of the boundary through its presence in and surveillance of the demilitarized zone; to observe any hostile or potentially hostile action mounted from the territory of one State to the other; and for the Secretary-General to report regularly to the Security Council on the operations of the unit, and immediately if there are serious violations of the zone or potential threats to peace;

    6. Notes that as soon as the Secretary-General notifies the Security Council of the completion of the deployment of the United Nations observer unit, the conditions will be established for the Member States cooperating with Kuwait in accordance with resolution 678 (1990) to bring their military presence in Iraq to an end consistent with resolution 686 (1991);

    C
    7. Invites Iraq to reaffirm unconditionally its obligations under the Geneva Protocol for the Prohibition of the Use in War of Asphyxiating Poisonous or Other Gases, and of Bacteriological Methods of Warfare, signed at Geneva on 17 June 1925, and to ratify the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction, of 10 April 1972;

    8. Decides that shall unconditionally accept the destruction, removal, or rendering harmless, under international supervision, of:

    1. All chemical and biological weapons and all stocks of agents and all related subsystems and components and all research, development, support and manufacturing facilities;
    2. All ballistic missiles with a range greater than 150 kilometres and related major parts, and repair and production facilities;

    9. Decides, for the implementation of paragraph 8 above, the following:

    1. Iraq shall submit to the Secretary-General, within fifteen days of the adoption of the present resolution, a declaration of the locations, amounts and types of all items specified in paragraph 8 and agree to urgent, on-site inspection as specified below;
    2. The Secretary-General, in consultation with the appropriate Governments and, where appropriate, with the Director-General of the World Health Organization, within forty-five days of the passage of the present resolution, shall develop, and submit to the Council for approval, a plan calling for the completion of the following acts within forty-five days of such approval:
      1. The forming of a Special Commission, which shall carry out immediate on-site inspection of Iraq’s biological, chemical and missile capabilities, based on Iraq’s declarations and the designation of any additional locations by the Special Commission itself;
      2. The yielding by Iraq of possession to the Special Commission for destruction, removal or rendering harmless, taking into account the requirements of public safety, of all items specified under paragraph 8 (a) above, including items at the additional locations designated by the Special Commission under paragraph 9 (b) (i) above and the destruction by Iraq, under the supervision of the Special Commission, of all its missile capabilities, including launchers, as specified under paragraph 8 (b) above;
      3. The provision by the Special Commission of the assistance and cooperation to the Director-General of the International Atomic Energy Agency required in paragraphs 12 and 13 below;

    10. Decides that Iraq shall unconditionally undertake not to use, develop, construct or acquire any of the items specified in paragraphs 8 and 9 above and requests the Secretary-General, in consultation with the Special Commission, to develop a plan for the future ongoing monitoring and verification of Iraq’s compliance with this paragraph. to be submitted to the Security Council for approval within one hundred and twenty days of the passage of this resolution;

    11. Invites Iraq to reaffirm unconditionally its obligations under the Treaty on the Non-Proliferation of Nuclear Weapons of 1 July 1968;

    12. Decides that Iraq shall unconditionally agree not to acquire or develop nuclear weapons or nuclear-weapons-usable material or any subsystems or components or any research, development, support or manufacturing facilities related to the above; to submit to the Secretary-General and the Director-General of the International Atomic Energy Agency within fifteen days of the adoption of the present resolution a declaration of the locations, amounts, and types of all items specified above; to place all of its nuclear-weapons-usable materials under the exclusive control, for custody and removal, of the International Atomic Energy Agency, with the assistance and cooperation of the Special Commission as provided for in the plan of the Secretary-General discussed in paragraph 9 (b) above; to accept, in accordance with the arrangements provided for in paragraph 13 below, urgent on-site inspection and the destruction, removal or rendering harmless as appropriate of all items specified above; and to accept the plan discussed in paragraph 13 below for the future ongoing monitoring and verification of its compliance with these undertakings;

    13. Requests the Director-General of the International Atomic Energy Agency, through the Secretary-General, with the assistance and cooperation of the Special Commission as provided for in the plan of the Secretary-General in paragraph 9 (b) above, to carry out immediate on-site inspection of Iraq’s nuclear capabilities based on Iraq’s declarations and the designation of any additional locations by the Special Commission; to develop a plan for submission to the Security Council within forty-five days calling for the destruction, removal, or rendering harmless as appropriate of all items listed in paragraph 12 above; to carry out the plan within forty-five days following approval by the Security Council; and to develop a plan, taking into account the rights and obligations of Iraq under the Treaty on the Non-Proliferation of Nuclear Weapons of 1 July 1968, for the future ongoing monitoring and verification of Iraq’s compliance with paragraph 12 above, including an inventory of all nuclear material in Iraq subject to the Agency’s verification and inspections of the International Atomic Energy Agency to confirm that the Agency’s safeguards cover all relevant nuclear activities in Iraq, to be submitted to the Security Council for approval within one hundred and twenty days of the passage of the present resolution;

    14. Takes note that the actions to be taken by Iraq in paragraphs 8, 9, 10, 11, 12 and 13 of the present resolution represent steps towards the goal of establishing in the Middle East a zone free from weapons of mass destruction and all missiles for their delivery and the objective of a global ban on chemical weapons:

    D
    15. Requests the Secretary-General to report to the Security Council on the steps taken to facilitate the return of all Kuwaiti property seized by Iraq, including a list of any property that Kuwait claims has not been returned or which has not been returned intact;

    E
    16. Reaffirms that Iraq, without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms, is liable under international law for any direct loss, damage, including environmental damage and the depletion of natural resources, or injury to foreign Governments, nationals and corporations, as a result of Iraq’s unlawful invasion and occupation of Kuwait;

    17. Decides that all Iraqi statements made since 2 August 1990 repudiating its foreign debt are null and void, and demands that Iraq adhere scrupulously to all of its obligations concerning servicing and repayment of its foreign debt;

    18. Decides also to create a fund to pay compensation for claims that fall within paragraph 16 above and to establish a Commission that will administer the fund;

    19. Directs the Secretary-General to develop and present to the Security Council for decision, no later than thirty days following the adoption of the present resolution, recommendations for the fund to meet the requirement for the programme to implement the decisions in paragraphs 16, 17 and 18 above, including: administration of the fund; mechanisms for determining the appropriate level of Iraq’s contribution to the fund based on a percentage of the value of the exports of petroleum and petroleum products from Iraq not to exceed a figure to be suggested to the Council by the Secretary-General, taking into account the requirements of the people of Iraq, Iraq’s payment capacity as assessed in conjunction with the international financial institutions taking into consideration external debt service, and the needs of the Iraqi economy; arrangements for ensuring that payments are made to the fund; the process by which funds will be allocated and claims paid; appropriate procedures for evaluating losses, listing claims and verifying their validity and resolving disputed claims in respect of Iraq’s liability as specified in paragraph 16 above; and the composition of the Commission designated above.

    F
    20. Decides, effective immediately, that the prohibitions against the sale or supply to Iraq of commodities or products, other than medicine and health supplies, and prohibitions against financial transactions related thereto contained in resolution 661 (1990) shall not apply to foodstuffs notified to the Security Council Committee established by resolution 661 (1990) concerning the situation between Iraq and Kuwait or, with the approval of that Committee, under the simplified and accelerated “no-objection” procedure, to materials and supplies for essential civilian needs as identified in the report of the Secretary-General dated 20 March 19919, and in any further findings of humanitarian need by the Committee;

    21. Decides that the Security Council shall review the provisions of paragraph 20 above every sixty days in the light of the policies and practices of the Government of Iraq, including the implementation of all relevant resolutions of the Security Council, for the purpose of determining whether to reduce or lift the prohibitions referred to therein;

    22. Decides that upon the approval by the Security Council of the programme called for in paragraph 19 above and upon Council agreement that Iraq has completed all actions contemplated in paragraphs 8, 9, 10, 11, 12 and 13 above, the prohibitions against the import of commodities and products originating in Iraq and the prohibitions against financial transactions related thereto contained in resolution 661 (1990) shall have no further force or effect;

    23. Decides that, pending action by the Security Council Committee established by resolution 661 (1990) shall be empowered to approve, when required to assure adequate financial resources on the part of Iraq to carry out the activities under paragraph 20 above, exceptions to the prohibition against the import of commodities and products originating in Iraq;

    24. Decides that, in accordance with resolution 661 (1990) and subsequent related resolutions and until a further decision is taken by the Security Council, all States shall continue to prevent the scale or supply, or the promotion or facilitation of such sale or supply, to Iraq by their nationals, or from their territories or using their flag vessels or aircraft, of:

    1. Arms and related matérial of all types, specifically including the sale or transfer through other means of all forms of conventional military equipment, including for paramilitary forces, and spare parts and components and their means of production, for such equipment;
    2. Items specified and defined in paragraphs 8 and 12 above not otherwise covered above;
    3. Technology under licensing or other transfer arrangements used in the production, utilization or stockpiling of items specified in subparagraphs (a) and (b) above;
    4. Personnel or materials for training or technical support services relating to the design, development, manufacture, use, maintenance or support of items specified in subparagraphs (a) and (b) above;

    25. Calls upon all States and international organizations to act strictly in accordance with paragraph 24 above, notwithstanding the existence of any contracts, agreements, licenses of any other arrangements;

    26. Requests the Secretary-General, in consultation with appropriate Governments, to develop within sixty days, for the approval of the security Council, guidelines to facilitate full international implementation of paragraphs 24 and 25 above and paragraph 27 below, and to make them available to all States and to establish a procedure for updating these guidelines periodically;

    27. Calls upon all States to maintain such national controls and procedures and to take such other actions consistent with the guidelines to be established by the Security Council under paragraph 26 above as may be necessary to ensure compliance with the terms of paragraph 24 above, and calls upon international organizations to take all appropriate steps to assist in ensuring such full compliance;

    28. Agrees to review its decisions in paragraphs 22,23,24 and 25 above, except for the items specified and defined in paragraphs 8 and 12 above, on a regular basis and in any case one hundred and twenty days following passage of the present resolution, taking into account Iraq’s compliance with the resolution and general progress towards the control of armaments in the region;

    29. Decides that all States, including Iraq, shall take the necessary measures to ensure that no claim shall lie at the instance of the Government of Iraq, or of any person or body in Iraq, or of any person claiming through or for the benefit of any such person or body, in connection with any contract or other transaction where its performance was affected by reason of the measures taken by the Security Council in resolution 661 (1990) and related resolutions;

    G
    30. Decides that, in furtherance of its commitment to facilitate the repatriation of all Kuwaiti and third country nationals, Iraq shall extend all necessary cooperation to the International Committee of the Red Cross, providing lists of such persons, facilitating the access of the International Committee of the Red Cross to all such persons wherever located or detained and facilitating the search by the International Committee of the Red Cross for those Kuwaiti and third country nationals still unaccounted for;

    31. Invites the International Committee of the Red Cross to keep the Secretary-General apprised as appropriate of all activities undertaken in connection with facilitating the repatriation or return of all Kuwaiti and third country nationals or their remains present in Iraq on or after 2 August 1990;

    H
    32. Requires Iraq to inform the Security Council that it will not commit or support any act of international terrorism or allow any organization directed towards commission of such acts to operate within its territory and to condemn unequivocally and renounce all acts, methods and practices of terrorism;

    I
    33. Declares that, upon official notification by Iraq to the Secretary-General and to the Security Council of its acceptance of the provisions above, a formal cease-fire is effective between Iraq and Kuwait and the Member States cooperating with Kuwait in accordance with resolution 678 (1990);

    34. Decides to remain seized of the matter and to take such further steps as may be required for the implementation of the present resolution and to secure peace and security in the area.
