  • An Open Letter to College and University Presidents

    David KriegerYou are in a unique position of leadership to influence today’s youth to achieve a better tomorrow for America and the world.  I am writing to enlist your help in educating young people to understand the survival challenges that face humanity in the 21st century.

    Education is driven by values.  Young people must learn to live with reverence for life, as did Albert Schweitzer, and to support equitable and nonviolent solutions to social problems, as did Gandhi and Martin Luther King, Jr.  Young people must be imbued with compassion, commitment and courage.  They must learn to use their imaginations to find creative and cooperative solutions to the great issues of our time.  And they must find joy in the process and take time to celebrate the miracle of living on the only planet we know of in the universe that supports life.

    Since the onset of the Nuclear Age our powerful technologies, developed by human ingenuity, have put our societies and humanity itself at grave risk.

    Albert Einstein observed, “The unleashed power of the atom has changed everything save our modes of thinking and thus we drift toward unparalleled catastrophe.”  We need all elements of society, and especially college and university students who are inheriting our world and the responsibility for its stewardship, to take steps to avert such catastrophe.

    Today, we are confronted not only by the ongoing peril of nuclear devastation, but also by the threats posed by climate change, pollution of the oceans and atmosphere, poverty, hunger, homelessness, war and other forms of violence, often senseless violence.  All of these threats are caused by human behavior and are subject to human solutions.

    Some young people are largely ignorant of these threats.  Others are apathetic.  Still others are despairing and alienated.  In this sense, they reflect the larger society.

    Young people need to be better educated on the critical survival issues that confront humanity.  They need to realize that, with social action, change is possible and there is hope for a more decent future.  With action comes hope, and with hope comes action.  It is a reinforcing cycle of change.

    We cannot wait for young people to become the leaders of tomorrow.  They must step up and fill the leadership vacuum that currently exists in solving the urgent threats of our time.  This will require education in the humanities, focused training for putting positive values into practice, and for developing the skills needed to influence the course of events in our interconnected world.

    They must come to understand that all great global threats can only be solved globally.  No single country, no matter how powerful, can diffuse these threats acting alone.  Thus, young people must form bonds across borders.

    Today’s young people have far worthier challenges than to become cogs in corporate machines.  They have the opportunity and the choice to change the world to make it more just and peaceful, a world in which all people can live with dignity and recognition of the basic human rights set forth in the Universal Declaration of Human Rights.  This must be complemented with a Universal Declaration of Human Responsibilities.

    Your leadership as a college or university president can influence today’s students to walk the path toward a far more decent tomorrow.  I urge you to add this to your list of responsibilities and to make your college or university a part of the solution to humanity’s most challenging problems.

    One way to begin the process would be to institute a required class for all students on “Global Survival 101,” which would cover all the great issues that confront humanity in the 21st century.  It would raise the following questions: What are the great threats that currently confront humanity?  What can be done about them?  How will each student make a difference in creating a better tomorrow?

    We also have a Peace Leadership Program at the Nuclear Age Peace Foundation, which provides peace leadership trainings.  A curriculum has been developed and tested at the University of San Diego and other college campuses.  You can find out more about this program at www.wagingpeace.org.

    If there are ways in which you are already addressing the issues I’ve raised in this letter or plan to do so going forward, I would be very happy to know of such initiatives.

  • When Will They Ever Learn? The American People and Support for War

    When it comes to war, the American public is remarkably fickle.

    Lawrence WittnerThe responses of Americans to the Iraq and Afghanistan wars provide telling examples.  In 2003, according to opinion polls, 72 percent of Americans thought going to war in Iraq was the right decision.  By early 2013, support for that decision had declined to 41 percent.  Similarly, in October 2001, when U.S. military action began in Afghanistan, it was backed by 90 percent of the American public.  By December 2013, public approval of the Afghanistan war had dropped to only 17 percent.

    In fact, this collapse of public support for once-popular wars is a long-term phenomenon.  Although World War I preceded public opinion polling, observers reported considerable enthusiasm for U.S. entry into that conflict in April 1917.  But, after the war, the enthusiasm melted away.  In 1937, when pollsters asked Americans whether the United States should participate in another war like the World War, 95 percent of the respondents said “No.”

    And so it went.  When President Truman dispatched U.S. troops to Korea in June 1950, 78 percent of Americans polled expressed their approval.  By February 1952, according to polls, 50 percent of Americans believed that U.S. entry into the Korean War had been a mistake.  The same phenomenon occurred in connection with the Vietnam War.  In August 1965, when Americans were asked if the U.S. government had made “a mistake in sending troops to fight in Vietnam,” 61 percent of them said “No.”  But by August 1968, support for the war had fallen to 35 percent, and by May 1971 it had dropped to 28 percent.

    Of all America’s wars over the past century, only World War II has retained mass public approval.  And this was a very unusual war – one involving a devastating military attack upon American soil, fiendish foes determined to conquer and enslave the world, and a clear-cut, total victory.

    In almost all cases, though, Americans turned against wars they once supported.  How should one explain this pattern of disillusionment?

    The major reason appears to be the immense cost of war — in lives and resources.  During the Korean and Vietnam wars, as the body bags and crippled veterans began coming back to the United States in large numbers, public support for the wars dwindled considerably.  Although the Afghanistan and Iraq wars produced fewer American casualties, the economic costs have been immense.  Two recent scholarly studies have estimated that these two wars will ultimately cost American taxpayers from $4 trillion to $6 trillion.  As a result, most of the U.S. government’s spending no longer goes for education, health care, parks, and infrastructure, but to cover the costs of war.  It is hardly surprising that many Americans have turned sour on these conflicts.

    But if the heavy burden of wars has disillusioned many Americans, why are they so easily suckered into supporting new ones?

    A key reason seems to be that that powerful, opinion-molding institutions – the mass communications media, government, political parties, and even education – are controlled, more or less, by what President Eisenhower called “the military-industrial complex.”  And, at the outset of a conflict, these institutions are usually capable of getting flags waving, bands playing, and crowds cheering for war.

    But it is also true that much of the American public is very gullible and, at least initially, quite ready to rally ‘round the flag.  Certainly, many Americans are very nationalistic and resonate to super-patriotic appeals.  A mainstay of U.S. political rhetoric is the sacrosanct claim that America is “the greatest nation in the world” – a very useful motivator of U.S. military action against other countries.  And this heady brew is topped off with considerable reverence for guns and U.S. soldiers.  (“Let’s hear the applause for Our Heroes!”)

    Of course, there is also an important American peace constituency, which has formed long-term peace organizations, including Peace Action, Physicians for Social Responsibility, the Fellowship of Reconciliation, the Women’s International League for Peace and Freedom, and other antiwar groups.  This peace constituency, often driven by moral and political ideals, provides the key force behind the opposition to U.S. wars in their early stages.  But it is counterbalanced by staunch military enthusiasts, ready to applaud wars to the last surviving American.  The shifting force in U.S. public opinion is the large number of people who rally ‘round the flag at the beginning of a war and, then, gradually, become fed up with the conflict.

    And so a cyclical process ensues.  Benjamin Franklin recognized it as early as the eighteenth century, when he penned a short poem for  A Pocket Almanack For the Year 1744:

    War begets Poverty,
    Poverty Peace;
    Peace makes Riches flow,
    (Fate ne’er doth cease.)
    Riches produce Pride,
    Pride is War’s Ground;
    War begets Poverty &c.
    The World goes round.

    There would certainly be less disillusionment, as well as a great savings in lives and resources, if more Americans recognized the terrible costs of war before they rushed to embrace it.  But a clearer understanding of war and its consequences will probably be necessary to convince Americans to break out of the cycle in which they seem trapped.

  • Mandela and Gandhi

    Nelson Rohihlahla Mandela (1918-2013) and Mahatma Gandhi (1869-1948) were two of human history’s greatest leaders in the struggle against governmental oppression. They are also remembered as great ethical teachers. Their lives had many similarities; but there were also differences.

    Similarities:

    Both Mandela and Gandhi were born into politically influential families. Gandhi’s father, and also his grandfather, were Dewans (prime ministers) of the Indian state of Porbandar. Mandela’s great-grandfather was the ruler of the Thembu peoples in the Eastern Cape Province of South Africa. When Mandela’s father died, his mother brought the young boy to the palace of the Thembu people’s Regent, Chief Jogintaba Dalindyebo, who became the boy’s guardian. He treated Mandela as a son and gave him an outstanding education.

    Both Mandela and Gandhi studied law. Both were astute political tacticians, and both struggled against governmental injustice in South Africa. Both were completely fearless. Both had iron wills and amazing stubbornness. Both spent long periods in prison as a consequence of their opposition to injustice.

    Both Mandela and Gandhi are remembered for their strong belief in truth and fairness, and for their efforts to achieve unity and harmony among conflicting factions. Both treated their political opponents with kindness and politeness.

    When Gandhi began to practice law South Africa, in his first case, he was able to solve a conflict by proposing a compromise that satisfied both parties. Of this result he said, ”My joy was boundless. I had learnt the true practice of law. I had learnt to find out the better side of human nature and to enter men’s hearts. I realized that the true function of a lawyer was to unite parties riven asunder.”

    Mandela is also remembered as a great champion of reconciliation. Wikipedia describes his period as President of South Africa in the following words:

    “Presiding over the transition from apartheid minority rule to a multicultural democracy, Mandela saw national reconciliation as the primary task of his presidency. Having seen other post-colonial African economies damaged by the departure of white elites, Mandela worked to reassure South Africa’s white population that they were protected and represented in “The Rainbow Nation”. Mandela attempted to create the broadest possible coalition in his cabinet, with de Klerk as first Deputy President while other National Party officials became ministers for Agriculture, Energy, Environment, and Minerals and Energy, and Buthelezi was named Minister for Home Affairs…” Mandela also introduced, and presided over, a Truth and Reconciliation Commission.

    Both Gandhi and Mandela believed strongly in the power of truth. Gandhi called this principle “Satyagraha”, and he called his autobiography “The Story of My Experiments With Truth”.

    Mandela’s realization of the power of truth came during the Rivonia Trial (1963-1964), where he was accused of plotting to overthrow the government of South Africa by violence, and his life was at stake. Remembering this event, Mandela wrote: “In a way I had never quite comprehended before, I realized the role I could play in court and the possibilities before me as a defendant. I was the symbol of justice in the court of the oppressor, the representative of the great ideals of freedom, fairness and democracy in a society that dishonored those virtues. I realized then and there that I could carry on the fight even in the fortress of the enemy.”

    During his defense statement, Mandela said: “I have fought against white domination and I have fought against black domination. I have cherished the ideal of a democratic and free society in which all persons will live together with equal opportunities. It is an ideal which I hope to live for and see realized. But my Lord, if it needs to be, it is an ideal for which I am prepared to die.”

    Although the prosecutor demanded the death penalty, Mandela was sentenced to lifelong imprisonment. His defense statement became widely known throughout the world, and he became the era’s most famous prisoner of conscience. The South African apartheid regime was universally condemned by the international community, and while still in prison, Mandela was given numerous honors, including an honorary doctorate in Lesotho, the Jawaharlal Nehru Award for International Understanding and Freedom of the City of Glasgow. “Free Mandela” concerts were held in England and the UN Security Council demanded his release.

    Finally, as it became increasingly clear that the South African apartheid regime was untenable, Mandela was released in February 1990. He spoke to an enormous and wild cheering crowd of supporters, who had waited four hours to hear him. Four years later, he was elected President of South Africa. He was awarded 250 major honors, including the Nobel Peace Prize, which he shared with de Klerk.

    Both Mandela and Gandhi are considered to be the fathers of their countries. Gandhi is called “Mahatma”, which means “Great Soul”, but he was also known by the affectionate name “Bapu”, which means “father”. Mandela was affectionately called “Tata”, which also means “father”.

    Differences:

    The greatest difference between Mandela and Gandhi concerns non-violence. While Mandela believed that violent protest could sometimes be necessary in the face of governmental violence, Gandhi firmly rejected this idea. He did so partly because of his experience as a lawyer. In carrying out non-violent protests against governmental injustice, Gandhi was making a case before the jury of international public opinion. He thought that he had a better chance of succeeding if he was very clearly in the right.

    Furthermore, to the insidious argument that “the end justifies the means”, Gandhi answered firmly: ”They say that ‘means are after all means’. I would say that ‘means are after all everything’. As the means, so the end. Indeed, the Creator has given us limited power over means, none over end… The means may be likened to a seed, and the end to a tree; and there is the same inviolable connection between the means and the end as there is between the seed and the tree. Means and end are convertible terms in my philosophy of life.”

    What can we learn from Mandela and Gandhi?

    Today, as never before, governmental injustice, crime and folly are threatening the future of humankind. If our children and grandchildren are to have a future, each of us must work with dedication for truly democratic government, for a just and effective system of international law, for abolition of the institution of war, for abolition of nuclear weapons, for the reform of our economic system, for stabilization of the global population, and for protection of the global environment against climate change and other dangers. This is not the responsibility of a few people. It is everyone’s responsibility. The courage, wisdom and dedication of Mandela and Gandhi can give us inspiration as we approach the great tasks that history has given to our generation.

  • The Titanic as an Allegory

    The Titanic

    On April 15, 1912, almost exactly 100 years ago, the RMS Titanic sank on her maiden voyage, after colliding with an iceberg in the North Atlantic. She carried 2,223 passengers, among whom were some of the wealthiest people in the world, accommodated in unbelievable luxury in the upper parts of the ship. Available for the pleasure of the first class passengers were a gymnasium, swimming pool, libraries, luxurious restaurants and opulent cabins. Meanwhile, below, crammed on the lower decks below the water line, were about a thousand emigrants from England, Ireland and Scandinavia, seeking a new life in North America. The Titanic carried only lifeboats enough for 1178 people, but the ship had so many advanced safety features that it was thought to be unsinkable.

    Why does the story of the Titanic fascinate us? Why was an enormously expensive film made about it? Why has a cruse ship recently retraced the Titanic’s route? I think that the reason for our fascination with the story of the Titanic is that it serves as a symbol for the present state of modern society. We are all in the great modern ship together. On top are the enormously rich, enjoying a life of unprecedented luxury, below the poor. But rich and poor alike are in the same boat, headed for disaster – surrounded by the miracles of our technology, but headed for a disastrous collision with environmental forces, the forces of nature that we have neglected in our pride and arrogance.

    The ancient Greeks were very conscious of the sin of pride – “hubris”, and it played a large role in their religion and literature. What the Greeks meant can be seen by looking in Wikipedia where the following words appear:

    “Hubris means extreme pride or arrogance. Hubris often indicates a loss of contact with reality, and an overestimation of one’s own competence or capabilities, especially when the person exhibiting it is in a position of power…. The word is also used to describe actions of those who challenged the gods or their laws, especially in Greek tragedy, resulting in the protagonist’s fall. ”

    “…loss of contact with reality, and overestimation of one’s own competence or capabilities, especially when the person exhibiting it is in a position of power…”? Can we recognize this today? I think that we can.

  • Avoiding Needless Wars, Part 10: Iran

    Martin HellmanThe interim agreement to freeze Iran’s nuclear program has been praised by some as a diplomatic breakthrough and condemned by others as a prelude to nuclear disaster. A full appraisal must wait until we see what the follow-on agreements, if any, look like. In the meantime, here’s my take:

    1. The only alternative to negotiations is a military strike powerful and sustained enough to not only destroy Iran’s current nuclear program but also to prevent its resurrection. Such actions are impossible in the current political climate — and probably in any environment.

    Domestically, Americans are tired of wars, and our budget is already highly stressed. Internationally, we’ve developed a reputation as a bull in a china shop, so an American attack would be met with howls of indignation. It also would reinvigorate terrorism against Israel as Iran totally unleashed Hezbollah and Hamas.

    A strike which prevented Iran from ever developing a nuclear weapons would not be surgical or short lived and might be impossible. At a minimum, it would require hundreds of thousands of American “boots on the ground” for years on end, and cost trillions of dollars. It probably would cost tens of thousands of American lives and hundreds of thousands of Iranian lives.

    Even with that level of effort, an American invasion probably would fail to achieve its objective since Iran would be a more powerful adversary than either Iraq or Afghanistan, both of which have failed to produce anything that might be called an American victory.

    In 2010, TIME magazine explained why then Secretary of Defense Robert Gates advised against attacking Iran: “Military action, Gates warned, would solve nothing; in fact it would be more likely to drive Iran to acquire nuclear weapons.”

    Gates’ warning was echoed last year by former vice chairman of the Joint Chiefs of Staff, Gen. James Cartwright: “If they [the Iranians] have the intent, all the weapons in the world are not going to change that. … They can slow it down. They can delay it, some estimate two to five years. But that does not take away the intellectual capital.”

    Also last year, Yuval Diskin, a former head of Israel’s internal security agency, Shin Bet, warned that, contrary to its intention, attacking Iran might accelerate its nuclear program.

    While a military strike is the only alternative to negotiations, the above arguments show that it is not a viable option. Diplomacy is our only real option, so the question becomes how to practice it most effectively.

    2. Given that diplomacy is our only viable option, we need to recognize that our past negotiating position – and the one Israel’s Prime Minister Netanyahu is demanding be reinstated – is a non-starter.

    There’s no way Iran will dismantle its centrifuges and the rest of its nuclear program based on American promises of sanctions relief, especially when those promises might be rescinded by a new administration in 2015, over-ridden by Congress, or nullified by an Israeli attack.

    Our broken promises to Gaddafi add to Iran’s mistrust. In 2003, when he gave up his nuclear weapons program, President Bush promised that this good behavior would be rewarded. Yet, in 2011, our airstrikes played a key role in toppling and murdering Gaddafi.

    Iran also mistrusts us because we aided Saddam Hussein during the Iran-Iraq War, even though we knew he was using chemical weapons – an action we later used as part of our tortured logic for deposing him.

    For diplomacy to work, we will have to prove that we have experienced a fundamental change of heart with respect to Iran and are prepared to follow through on the promises we make.

    3. Iran appears to be only months away from being able to make at least a crude nuclear weapon. While there’s plenty of blame to go around, Israel and the US need to stop putting all of the onus on Iran and recognize that we, too, played a part in creating the current mess.

    Repeatedly threatening to attack Iran, including with nuclear weapons (a possibility threatened in President Obama’s 2010 Nuclear Posture Review) would have made even the most rational Iranian leaders seek a deterrent. And their leadership over the last 30 years has often been far from rational. Fortunately, the current leadership appears more reasonable, and that’s an opening we need to test. If, instead, we maintain a bellicose posture, we will pull the rug out from under the moderates and empower the hardliners in Iran. Former CIA analyst Paul Pillar recently warned that American and Israeli hawks who mistrust diplomacy may be intentionally trying to strengthen hard-liners in Iran since they, too, oppose diplomacy.

    While our intention was to halt nuclear proliferation, we have actually encouraged it – particularly in Iran and North Korea – with our militarized approach to foreign affairs.

    I don’t like leaving Iran so close to having a nuclear capability, but the alternatives appear  far worse. It’s time to admit that our Iranian policy thus far has been a disaster and try something new – real diplomacy.

  • Are Nuclear Weapons Really the U.S.’s Instruments of Peace?

    David KriegerThere are serious problems with communications in a society when mainstream media sources, such as the Washington Post, will publish articles touting nuclear weapons as instruments of peace and ignore serious rebuttals.  The Post recently published an op-ed, “Nuclear weapons are the U.S.’s instruments of peace,” by Robert Spalding, a Military Fellow at the Council on Foreign Relations.  The title really speaks for itself.  The article can be read here.

    I sent a response to the Washington Post in the form of a letter to the editor, but it was not published by them.  My letter, which is under their 200-word limit, sought to point out some of the fallacies in Mr. Spalding’s op-ed.  Here it is:

    “Robert Spalding’s enchantment with nuclear weapons would keep the US prepared to refight the Cold War for decades.  But nuclear weapons do not make the U.S. more secure.  Rather, they make us targets, and they spur nuclear proliferation.   A major nuclear war would destroy civilization and possibly all complex life on the planet.  A regional nuclear exchange between India and Pakistan using 50 Hiroshima-size nuclear weapons each on the other side’s cities would put enough soot into the stratosphere to block warming sunlight, shorten growing seasons, cause crop failures and result in a billion deaths worldwide.

    “Nuclear deterrence is not foolproof because we humans, despite our best efforts, are fallible, as convincingly demonstrated at Fukushima.  Spalding is dead wrong.  It is not only through strength that peace can be obtained; it is also through diplomacy, cooperation, international law and a generosity of spirit in our foreign policy.  Nuclear weapons are illegal, immoral and ultimately uncontrollable.  They are a path not to peace, but to catastrophe.  In our own interests, the US should lead in negotiating their elimination from the planet.”

    Nuclear weapons place at risk everyone we love and everything we treasure.  They have no place in a civilized society, and US leaders should be doing all they can to fulfill our obligation under the Non-Proliferation Treaty to pursue negotiations for their total elimination from the planet.  But this will not happen if the mainstream media provides a one-sided view that “nuclear weapons are the U.S.’s instruments of peace.”  They are hardly that, and our continued reliance upon them will encourage nuclear proliferation and eventually result in nuclear war by accident or design.

  • NAPF Congratulates Organization for the Prohibition of Chemical Weapons

    The Nuclear Age Peace Foundation (NAPF) congratulates the Organization for the Prohibition of Chemical Weapons (OPCW) for receiving the 2013 Nobel Peace Prize.

    OPCW is the body that enforces the Chemical Weapons Convention, the international treaty that prohibits the development, production, acquisition, stockpiling, retention, transfer or use of chemical weapons. Since the Convention came into force in 1997, it has been ratified by 189 states and the OPCW has conducted more than 5,000 inspections in 86 countries. According to its statistics, 81.1 percent of the world’s declared stockpile of chemical agents has been verifiably destroyed.

    Syria is due to become the 190th member state to join the Chemical Weapons Convention on October 14, 2013. OPCW is the organization responsible for destroying its stockpiles of chemical weapons.

    Thorbjoern Jagland, the head of the Nobel Peace Prize committee, said in his announcement of this year’s peace laureate that the award is a reminder to other nations, including the United States and Russia, to eliminate their own stockpiles of chemical weapons, “especially because they are demanding that others do the same, like Syria.”  He added, “We now have the opportunity to get rid of an entire category of weapons of mass destruction… That would be a great event in history if we could achieve that.”

    The Norwegian Nobel Committee said, “The conventions and the work of the OPCW have defined the use of chemical weapons as a taboo under international law.” It also stated, “Disarmament figures prominently in Alfred Nobel’s will. The Norwegian Nobel Committee has through numerous prizes underlined the need to do away with nuclear weapons. By means of the present award to the OPCW, the Committee is seeking to contribute to the elimination of chemical weapons.”

    The Nuclear Age Peace Foundation’s vision is a just and peaceful world, free of nuclear weapons. The implementation of a Nuclear Weapons Convention, which would make the manufacture, testing, possession, use and threat of use of nuclear weapons illegal under international law, would build on and expand what the OPCW has accomplished in enforcing the Chemical Weapons Convention, making the world a safer place.

  • Another War Is Not the Answer

    The actions leading toward US involvement in the civil war in Syria have been moving at a rapid pace. US officials, starting with President Obama and Secretary of State Kerry, have been strong advocates of a limited attack on Syria to punish the Assad regime for an alleged chemical attack on its own citizens. It is unlikely, though, that a limited US military attack on the Syrian regime will result in a positive outcome.  More likely, it will cause additional death and untold sorrow to Syrian civilians, make Syrian President Assad a hero in the region, increase the possibilities of a broader regional war, increase tensions between the US and Russia, further undermine respect for international law, and diminish rather than uphold US credibility in the region and beyond.

    Below is a sketch of the sequence of events leading to where we are now; important choice points for the Congress with implications for the president and the American people; and some conclusions and recommendations.

    Sequence of Events

    1. The president threatens to take military action if Syria uses chemical weapons. This was a deterrent threat — a threat meant to prevent the Syrian government from using chemical weapons.
    2. The deterrent threat apparently fails when chemical weapons are used in the Syrian civil war, although it is not known with certainty what party to the conflict actually used them.
    3. US leaders accuse the Syrian government of being the perpetrator of the chemical attack, which is believed by US leaders to have killed over 1,400 people, including over 400 children.
    4. The president indicates his intention to punish the Syrian government by initiating a missile attack on Syrian government forces. Other administration officials, including the secretary of state, publically support the president.
    5. Some commentators argue that a US attack is necessary to maintain US credibility in the world, despite the fact that in this case it will pit the US against Russia, with each country still maintaining some 1,000 nuclear warheads on hair-trigger alert. That is, when the president makes a threat, even an ill-advised and dangerous one, it must be carried out so that US threats will be credible in the future.
    6. Other commentators point out that a US military attack on Syria would be illegal under international law since it is neither a military action made in self-defense nor one authorized by the United Nations Security Council. They also point out that US law requires Congress to authorize such an act of war.
    7. The president responds by ignoring concerns about the planned attack being a breach of international law, but says he will send the matter to Congress for consideration when Congress reconvenes, even though he believes that Congressional approval is not necessary for him to act as commander-in-chief.

    Congressional Choice

    1. Congress will have to make a choice to approve or not approve the president’s plan to initiate a US military attack on Syria.
    2. Even if Congress approves US military action, a likely possibility, a US attack on Syria will not be legal under international law.  Nor will such an attack be moral, in that it would likely kill large numbers of innocent Syrians and bring more suffering to the people of Syria. Nor would such an attack be prudent, with its potential to bog the US down in yet another war in the Middle East, at the expense of the people of Syria and US citizens at home.
    3. If Congress votes against approval of US military action, an unlikely possibility, the president will have to decide whether he bends to the will of Congress and backs down, or initiates the attack on his own authority with the potential to trigger a constitutional crisis in addition to all the other negative consequences of initiating an illegal war.

    Conclusions and Recommendations

    1. The American people should speak out against US military action that could involve the US in yet another war with unknown consequences and of unknown duration.
    2. Congress should say No to authorization of the president’s proposed military action against Syria.
    3. The president should back down on his threat to attack Syria. Following through on every presidential threat with military action is a dangerous game for the US, as well as for the world, particularly on threats that violate and undermine international law.
    4. The US should work with the United Nations, and specifically with Russia, on finding a peaceful settlement of the civil war in Syria and, in general, on resolving the ongoing conflicts in the Middle East that are poisoning the well of international relations.
    5. Those responsible for the chemical attack in Syria should be referred to the International Criminal Court for prosecution under international law. The US should also sign and ratify the treaty establishing the International Criminal Court and become a member of the Court.

  • Defining Appropriate Action in Syria

    The horrific use of chemical weapons in Syria is a crime against humanity and demands an international response. President Obama states that the United States must take appropriate action vs. doing nothing. This is absolutely true. The problem comes in defining appropriate action. There are at least two options, military vs. non-military, the latter with a host of options.

    Framing that action in military terms guarantees the loss of additional innocent lives. Choosing a military option further fuels the sectarian strife spreading across the Middle East.  This will encourage the growth of anti-American sentiment rife in the region. Our trillion dollar war in Iraq has demonstrated that war is not the answer. Iraq is on the verge of falling into the worst chaos since the beginning of that conflict.

    This crisis does demand action ― non-military action.  Doing nothing is cowardly and not in keeping with the credibility or morals of the United States or any other country that professes to support the rule of international law and morality. This includes Russia, Iran and China.

    An international response is demanded. After 9/11 there was a brief period and opportunity when the world came together with a sentiment that the “whole world was American.” That feeling was quickly lost as the U.S. opted for bombing nation after nation, including a unilateral “pre-emptive” war against Iraq, a nation that had nothing to do with 9/11. We have paid and will pay the price of that war for generations.

    Today, in a similar vein, the entire world identifies with and is sickened and horrified by the images of children and innocent victims of these cowardly gas attacks. But the military intervention being debated is not intended to end the violent conflict that has killed more than 100,000 Syrians. It won’t help the nearly two million Syrian refugees return home or get the more than 6.8 million people in need access to humanitarian aid.

    Our leaders need to show courage against the tide of war. The perpetrators of these crimes must be brought to justice. There is an international arena for these crimes against humanity to be addressed. The International Criminal Court’s mission is to prosecute individuals for genocide, crimes against humanity, war crimes and crimes of aggression. The International Court of Justice’s mission is to prosecute Nations that have committed crimes against humanity. These are just two methods by which perpetrators of these crimes can be held accountable. The United States has the opportunity to lead the way in empowering and supporting these international institutions in performing the role that they were established to do.

    This will take courage, strength, determination, vision and true international leadership―not bombs. This is the role that the United States can and must pursue if we hope to see an end to sectarian violence in this region and the world over.  We must call upon all nations and our own elected leaders complacent with arming the various sides in these conflicts to endorse and support this international peace keeping effort. This will demonstrate their true commitment to peace, international law and humanity.

    We must follow our moral compass. The United States and other world leaders should intensify their efforts to find a peaceful, political solution to end the bloodshed, not add more violence to a tragic civil war. The president needs to hear from us and be supported for his courage and willingness to pause and hear from the nation as we pursue the best hope for the ordinary men, women, and children of Syria.

  • Illegal. Immoral. Dangerous. Why Congress Needs to Say No!

    If I was really optimistic, I’d say that President Obama is hoping that Congress will follow the example of the British parliament – and vote against his proposed military strike on Syria. It would let him off the hook – he could avoid an illegal, dangerous, immoral military assault and say it’s Congress’ fault.

    But unfortunately I don’t think that much optimism is called for. Obama’s speech – not least his dismissal of any time pressure, announcing that his commanders have reassured him that their preparations to fire on command is not time-bound – gives opponents of greater U.S. intervention in Syria a week or more to mobilize, to build opposition in Congress and in the public, and to continue fighting against this new danger. As the President accurately described it, “some things are more important than partisan politics.”  For war opponents in Congress, especially President Obama’s progressive supporters, keeping that in mind is going to be difficult but crucial.

    Obama said he will “seek Congressional authorization” for a military strike on Syria.  He said he believes U.S. policy is “stronger” if the president and Congress are united, but he made clear his belief that he “has the authority to strike without” Congressional support. That’s the bottom line.  The first question shouted by the press as he left the White House Rose Garden was “will you still attack if Congress votes no?”  He didn’t answer.

    There is little question that the Obama administration was blindsided by the British parliament’s vote against the prime minister’s proposal to endorse war. They were prepared to go to war without United Nations authorization, but were counting on the UK as the core partner in a new iteration of a Bush-style “coalition of the willing.” Then NATO made clear it would not participate, and the Arab League refused to endorse a military strike. France may stay in Obama’s corner, but that won’t be enough.

    And Congress was getting restive, with more than 200 members signing one or another letter demanding that the White House consult with them.  Too many pesky journalists were reprinting Obama’s own words from 2007, when then-candidate Obama told the Boston Globe that “the President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation.”

    All of that led to the drive towards war slowing a bit. But it didn’t stop. And that’s a problem. Because whatever Congress may decide, a U.S. military strike against Syria will still be illegal, immoral and dangerous, even reckless in the region and around the world. Congress needs to say NO.

    ILLEGAL

    However frustrated U.S. presidents may be with the UN Security Council’s occasional refusal to give in to their pressure, the law is clear. The United Nations Charter, the fundamental core of international law, may be vague about a lot of things.  But it is unequivocal about when military force is legal, and when it isn’t. Only two things make an act of war legal: immediate self-defense, which clearly is not the case for the U.S.  The horrific reality of chemical weapons devastated Syrian, not American lives. This is not self-defense. The other is if the Security Council, acting under Chapter VII of the UN Charter, authorizes the use of force in response to a threat to international peace and security. That’s the authorization President Obama knows he cannot get – certainly Russia and China would veto, but right now a British veto would certainly be a possibility if Cameron wanted to respond to his public. And it’s not at all clear a U.S. resolution to use force would even get the nine necessary votes of the 15 Council members. The U.S. is thoroughly isolated internationally.

    The problem for President Obama is he still is determined to use military force, despite the requirements of international law. He says he doesn’t need that authority – that maybe he’ll use the 1999 Kosovo precedent to “go around” the Security Council. The problem, of course, is that the 1999 U.S.-NATO assault on Serbia and Kosovo was illegal – faced with a sure Russian veto, Bill Clinton simply announced he would not ask for Council permission. Instead, he would get permission from the NATO high command.  But aside from the hammer-and-nail problem (if you’re a hammer, everything looks like a nail; if you’re NATO military leaders looking for re-legitimation, everything looks like it needs a military solution), nothing in international law allows NATO to substitute for the Security Council.  The Charter was specifically designed to make it difficult to get authorization for military force – its whole raison d’etre is to stand against the scourge of war.  So any new decision to go to use military force without Council authority means that use of force is illegal.

    Right now, in Syria, that means that members of Congress have the chance to prevent another illegal U.S. war. If Congress should approve it, likely for political or partisan reasons that have nothing to do with Syria, their vote would mean direct complicity in an illegal and immoral war.

    IMMORAL

    Pentagon officials have confirmed what logic tells us all: every use of military force threatens civilian lives. More than 100,000 Syrians have been killed in this civil war so far, and hundreds more were killed in what appears to be (remember, we still don’t know for sure) a chemical strike last week – U.S. cruise missile strikes won’t bring any of them back, and more important, won’t protect any Syrian civilians from further threat. To the contrary, low-ranking conscript troops and civilians are almost certain to be injured or killed. Reports out of Syria indicate military offices and more being moved into populated areas – that shouldn’t come as a surprise given the nature of the Syrian regime. But the knowledge makes those contemplating military force even more culpable.

    DANGEROUS

    A U.S. military strike on Syria will increase levels of violence and instability inside the country, in the region, and around the world. Inside Syria, aside from immediate casualties and damage to the already shattered country, reports are already coming in (including from al Jazeera, known for its strong support of the Syrian opposition) of thousands of Syrian refugees returning from Lebanon to “stand with their government” when the country is under attack. It could lead to greater support to the brutal regime in Damascus. In Kosovo, more Kosovars were forcibly expelled from their homes by the Serbian regime after the NATO bombing began than had happened before it started; Syrian civilians could face similar retaliation from the government.

    A U.S. strike will do nothing to strengthen the secular armed opposition, still largely based in Turkey and Jordan, let alone the heroic but weakened original non-violent democratic opposition forces who have consistently opposed militarization of their struggle and outside military intervention. Those who gain will be the most extreme Islamist forces within the opposition, particularly those such as the Jubhat al-Nusra which are closest to al Qaeda. They have long seen the U.S. presence in the region as a key recruitment tool and a great local target.

    There is also the danger of escalation between the U.S. and Russia, already at odds in one of the five wars currently underway in Syria. So far that has been limited to a war of words between Washington and Moscow, but with the G-20 meeting scheduled for next week in St Petersburg, President Putin may feel compelled to push back more directly, perhaps with new economic or other measures.

    Crucially, a military strike without United Nations authorization undermines the urgent need for serious, tough diplomacy to end the Syrian war. The U.S. just cancelled a meeting with Russia to talk about negotiations; a couple of months ago, Russia cancelled one. They both must be pushed to meet urgently to arrange and implement an immediate ceasefire and an arms embargo on all sides in Syria.

    And finally, what happens the day after?   If Syria retaliates against a U.S. missile strike – with an attack on a U.S. warship, or a U.S. base in a neighboring country, or on U.S. troops in the region, or against Israel…. do we really think the U.S. will simply stand back and say “no, this was just a one-time surgical strike, we won’t respond”?  What happens when that inevitable response pushes the U.S. closer towards direct full-scale involvement in the Syrian civil war?

    The word to Congress now must be – you got the vote.  That’s important. Because now you can use that vote to say NO to military action.

    SO WHAT SHOULD THE U.S. DO?

    First thing, stop this false dichotomy of it’s either military force or nothing.  The use of chemical weapons is a war crime, it is indeed what Secretary Kerry called a “moral obscenity.”  Whoever used such a weapon should be held accountable. So what do we do about it?

    • First, do no harm.  Don’t kill more people in the name of enforcing an international norm.
    • Recognize that international law requires international enforcement; no one country, not even the most powerful, has the right to act as unilateral cop.  Move to support international jurisdiction and enforcement, including calling for a second UN investigation to follow-up the current weapons inspection team, this one to determine who was responsible for the attack.
    • Recommend that whoever is found responsible be brought to justice in The Hague at the International Criminal Court, understanding that timing of such indictments might require adjustment to take into account ceasefire negotiations in Syria.
    • President Obama can distinguish himself powerfully from his unilateralist predecessor by announcing an immediate campaign not only to get the Senate to ratify the International Criminal Court, but to strengthen the Court and provide it with serious global enforcement capacity.
    • Move urgently towards a ceasefire and arms embargo in Syria. Russia must stop, and must push Iran to stop arming and funding the Syrian regime. The U.S. must stop, and must push Saudi Arabia, Qatar, Turkey, Jordan and others to stop arming and funding the opposition, including the extremist elements. That won’t be easy – for Washington it may require telling the Saudis and Qataris that if they don’t stop, we will cancel all existing weapons contracts with those countries.  (As my colleague David Wildman has said, why don’t we demand that the Pentagon deal with arms producers the way the Dept of Agriculture deals with farmers – pay them NOT to produce weapons. And then the money can be used to retool their factories to produce solar panels instead of Tomahawk missiles, and the workers stay on the job….)
    • Stand against further escalation of the Syrian civil war by voting NO on any authorization for U.S. military strikes.
