  • NAPF Congratulates Organization for the Prohibition of Chemical Weapons

    The Nuclear Age Peace Foundation (NAPF) congratulates the Organization for the Prohibition of Chemical Weapons (OPCW) for receiving the 2013 Nobel Peace Prize.

    OPCW is the body that enforces the Chemical Weapons Convention, the international treaty that prohibits the development, production, acquisition, stockpiling, retention, transfer or use of chemical weapons. Since the Convention came into force in 1997, it has been ratified by 189 states and the OPCW has conducted more than 5,000 inspections in 86 countries. According to its statistics, 81.1 percent of the world’s declared stockpile of chemical agents has been verifiably destroyed.

    Syria is due to become the 190th member state to join the Chemical Weapons Convention on October 14, 2013. OPCW is the organization responsible for destroying its stockpiles of chemical weapons.

    Thorbjoern Jagland, the head of the Nobel Peace Prize committee, said in his announcement of this year’s peace laureate that the award is a reminder to other nations, including the United States and Russia, to eliminate their own stockpiles of chemical weapons, “especially because they are demanding that others do the same, like Syria.”  He added, “We now have the opportunity to get rid of an entire category of weapons of mass destruction… That would be a great event in history if we could achieve that.”

    The Norwegian Nobel Committee said, “The conventions and the work of the OPCW have defined the use of chemical weapons as a taboo under international law.” It also stated, “Disarmament figures prominently in Alfred Nobel’s will. The Norwegian Nobel Committee has through numerous prizes underlined the need to do away with nuclear weapons. By means of the present award to the OPCW, the Committee is seeking to contribute to the elimination of chemical weapons.”

    The Nuclear Age Peace Foundation’s vision is a just and peaceful world, free of nuclear weapons. The implementation of a Nuclear Weapons Convention, which would make the manufacture, testing, possession, use and threat of use of nuclear weapons illegal under international law, would build on and expand what the OPCW has accomplished in enforcing the Chemical Weapons Convention, making the world a safer place.

  • Global Survival 101

    David KriegerA missing element in the standard university curriculum is a course that provides awareness of the global nature and dangers of the world’s most serious problems and the attendant global solutions that are needed to solve these problems.

    The most serious dangers confronting humanity are those that endanger species survival.  Falling into this category are nuclear weapons with their potential for triggering an intentional or inadvertent nuclear war, and climate change resulting in global warming.  These dangers are directly affecting the survival potential of the human species and other forms of complex life on the planet.

    Other global dangers include population growth; pollution of the oceans and atmosphere; scarcity of safe drinking water; food shortages and famines; continued reliance on fossil fuels; creation of nuclear wastes; spread of communicable diseases; disparity in resource distribution; the ill-effects of poverty; international terrorism and war.

    In today’s world, all borders are permeable to people, pollution, ideas and disease.  No country, no matter how powerful militarily, can protect its citizens from the global threats confronting humanity.  Without cooperation among nations, the problems will not be resolved and people everywhere and the planet will suffer.  Destruction of civilization and extinction of the human species are within the range of possibility.

    University students need grounding in the global dangers that confront humans as a species, as well as a sense of the interconnectedness of these dangers and the ways forward to solutions that can alleviate and reverse the dangers.

    I propose the creation of a multi-disciplinary course entitled “Global Survival 101.”  The course would be a foundation for global concerns in the 21st century.  I envision this as a mandatory course for all college students regardless of discipline that would be aimed at creating an awareness of global dangers, an understanding of their interconnected nature, and what courses of action would increase or decrease global well-being and improve the odds of human survival.

    Course content could include:

    3. Species responsibilities
      a. To pass the planet on intact to new generations
      b. To take into account the rights of future generations
      c. To be good stewards of the planet for ourselves and other forms of life

  • Defining Appropriate Action in Syria

    The horrific use of chemical weapons in Syria is a crime against humanity and demands an international response. President Obama states that the United States must take appropriate action vs. doing nothing. This is absolutely true. The problem comes in defining appropriate action. There are at least two options, military vs. non-military, the latter with a host of options.

    Framing that action in military terms guarantees the loss of additional innocent lives. Choosing a military option further fuels the sectarian strife spreading across the Middle East.  This will encourage the growth of anti-American sentiment rife in the region. Our trillion dollar war in Iraq has demonstrated that war is not the answer. Iraq is on the verge of falling into the worst chaos since the beginning of that conflict.

    This crisis does demand action ― non-military action.  Doing nothing is cowardly and not in keeping with the credibility or morals of the United States or any other country that professes to support the rule of international law and morality. This includes Russia, Iran and China.

    An international response is demanded. After 9/11 there was a brief period and opportunity when the world came together with a sentiment that the “whole world was American.” That feeling was quickly lost as the U.S. opted for bombing nation after nation, including a unilateral “pre-emptive” war against Iraq, a nation that had nothing to do with 9/11. We have paid and will pay the price of that war for generations.

    Today, in a similar vein, the entire world identifies with and is sickened and horrified by the images of children and innocent victims of these cowardly gas attacks. But the military intervention being debated is not intended to end the violent conflict that has killed more than 100,000 Syrians. It won’t help the nearly two million Syrian refugees return home or get the more than 6.8 million people in need access to humanitarian aid.

    Our leaders need to show courage against the tide of war. The perpetrators of these crimes must be brought to justice. There is an international arena for these crimes against humanity to be addressed. The International Criminal Court’s mission is to prosecute individuals for genocide, crimes against humanity, war crimes and crimes of aggression. The International Court of Justice’s mission is to prosecute Nations that have committed crimes against humanity. These are just two methods by which perpetrators of these crimes can be held accountable. The United States has the opportunity to lead the way in empowering and supporting these international institutions in performing the role that they were established to do.

    This will take courage, strength, determination, vision and true international leadership―not bombs. This is the role that the United States can and must pursue if we hope to see an end to sectarian violence in this region and the world over.  We must call upon all nations and our own elected leaders complacent with arming the various sides in these conflicts to endorse and support this international peace keeping effort. This will demonstrate their true commitment to peace, international law and humanity.

    We must follow our moral compass. The United States and other world leaders should intensify their efforts to find a peaceful, political solution to end the bloodshed, not add more violence to a tragic civil war. The president needs to hear from us and be supported for his courage and willingness to pause and hear from the nation as we pursue the best hope for the ordinary men, women, and children of Syria.

  • Illegal. Immoral. Dangerous. Why Congress Needs to Say No!

    If I was really optimistic, I’d say that President Obama is hoping that Congress will follow the example of the British parliament – and vote against his proposed military strike on Syria. It would let him off the hook – he could avoid an illegal, dangerous, immoral military assault and say it’s Congress’ fault.

    But unfortunately I don’t think that much optimism is called for. Obama’s speech – not least his dismissal of any time pressure, announcing that his commanders have reassured him that their preparations to fire on command is not time-bound – gives opponents of greater U.S. intervention in Syria a week or more to mobilize, to build opposition in Congress and in the public, and to continue fighting against this new danger. As the President accurately described it, “some things are more important than partisan politics.”  For war opponents in Congress, especially President Obama’s progressive supporters, keeping that in mind is going to be difficult but crucial.

    Obama said he will “seek Congressional authorization” for a military strike on Syria.  He said he believes U.S. policy is “stronger” if the president and Congress are united, but he made clear his belief that he “has the authority to strike without” Congressional support. That’s the bottom line.  The first question shouted by the press as he left the White House Rose Garden was “will you still attack if Congress votes no?”  He didn’t answer.

    There is little question that the Obama administration was blindsided by the British parliament’s vote against the prime minister’s proposal to endorse war. They were prepared to go to war without United Nations authorization, but were counting on the UK as the core partner in a new iteration of a Bush-style “coalition of the willing.” Then NATO made clear it would not participate, and the Arab League refused to endorse a military strike. France may stay in Obama’s corner, but that won’t be enough.

    And Congress was getting restive, with more than 200 members signing one or another letter demanding that the White House consult with them.  Too many pesky journalists were reprinting Obama’s own words from 2007, when then-candidate Obama told the Boston Globe that “the President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation.”

    All of that led to the drive towards war slowing a bit. But it didn’t stop. And that’s a problem. Because whatever Congress may decide, a U.S. military strike against Syria will still be illegal, immoral and dangerous, even reckless in the region and around the world. Congress needs to say NO.

    ILLEGAL

    However frustrated U.S. presidents may be with the UN Security Council’s occasional refusal to give in to their pressure, the law is clear. The United Nations Charter, the fundamental core of international law, may be vague about a lot of things.  But it is unequivocal about when military force is legal, and when it isn’t. Only two things make an act of war legal: immediate self-defense, which clearly is not the case for the U.S.  The horrific reality of chemical weapons devastated Syrian, not American lives. This is not self-defense. The other is if the Security Council, acting under Chapter VII of the UN Charter, authorizes the use of force in response to a threat to international peace and security. That’s the authorization President Obama knows he cannot get – certainly Russia and China would veto, but right now a British veto would certainly be a possibility if Cameron wanted to respond to his public. And it’s not at all clear a U.S. resolution to use force would even get the nine necessary votes of the 15 Council members. The U.S. is thoroughly isolated internationally.

    The problem for President Obama is he still is determined to use military force, despite the requirements of international law. He says he doesn’t need that authority – that maybe he’ll use the 1999 Kosovo precedent to “go around” the Security Council. The problem, of course, is that the 1999 U.S.-NATO assault on Serbia and Kosovo was illegal – faced with a sure Russian veto, Bill Clinton simply announced he would not ask for Council permission. Instead, he would get permission from the NATO high command.  But aside from the hammer-and-nail problem (if you’re a hammer, everything looks like a nail; if you’re NATO military leaders looking for re-legitimation, everything looks like it needs a military solution), nothing in international law allows NATO to substitute for the Security Council.  The Charter was specifically designed to make it difficult to get authorization for military force – its whole raison d’etre is to stand against the scourge of war.  So any new decision to go to use military force without Council authority means that use of force is illegal.

    Right now, in Syria, that means that members of Congress have the chance to prevent another illegal U.S. war. If Congress should approve it, likely for political or partisan reasons that have nothing to do with Syria, their vote would mean direct complicity in an illegal and immoral war.

    IMMORAL

    Pentagon officials have confirmed what logic tells us all: every use of military force threatens civilian lives. More than 100,000 Syrians have been killed in this civil war so far, and hundreds more were killed in what appears to be (remember, we still don’t know for sure) a chemical strike last week – U.S. cruise missile strikes won’t bring any of them back, and more important, won’t protect any Syrian civilians from further threat. To the contrary, low-ranking conscript troops and civilians are almost certain to be injured or killed. Reports out of Syria indicate military offices and more being moved into populated areas – that shouldn’t come as a surprise given the nature of the Syrian regime. But the knowledge makes those contemplating military force even more culpable.

    DANGEROUS

    A U.S. military strike on Syria will increase levels of violence and instability inside the country, in the region, and around the world. Inside Syria, aside from immediate casualties and damage to the already shattered country, reports are already coming in (including from al Jazeera, known for its strong support of the Syrian opposition) of thousands of Syrian refugees returning from Lebanon to “stand with their government” when the country is under attack. It could lead to greater support to the brutal regime in Damascus. In Kosovo, more Kosovars were forcibly expelled from their homes by the Serbian regime after the NATO bombing began than had happened before it started; Syrian civilians could face similar retaliation from the government.

    A U.S. strike will do nothing to strengthen the secular armed opposition, still largely based in Turkey and Jordan, let alone the heroic but weakened original non-violent democratic opposition forces who have consistently opposed militarization of their struggle and outside military intervention. Those who gain will be the most extreme Islamist forces within the opposition, particularly those such as the Jubhat al-Nusra which are closest to al Qaeda. They have long seen the U.S. presence in the region as a key recruitment tool and a great local target.

    There is also the danger of escalation between the U.S. and Russia, already at odds in one of the five wars currently underway in Syria. So far that has been limited to a war of words between Washington and Moscow, but with the G-20 meeting scheduled for next week in St Petersburg, President Putin may feel compelled to push back more directly, perhaps with new economic or other measures.

    Crucially, a military strike without United Nations authorization undermines the urgent need for serious, tough diplomacy to end the Syrian war. The U.S. just cancelled a meeting with Russia to talk about negotiations; a couple of months ago, Russia cancelled one. They both must be pushed to meet urgently to arrange and implement an immediate ceasefire and an arms embargo on all sides in Syria.

    And finally, what happens the day after?   If Syria retaliates against a U.S. missile strike – with an attack on a U.S. warship, or a U.S. base in a neighboring country, or on U.S. troops in the region, or against Israel…. do we really think the U.S. will simply stand back and say “no, this was just a one-time surgical strike, we won’t respond”?  What happens when that inevitable response pushes the U.S. closer towards direct full-scale involvement in the Syrian civil war?

    The word to Congress now must be – you got the vote.  That’s important. Because now you can use that vote to say NO to military action.

    SO WHAT SHOULD THE U.S. DO?

    First thing, stop this false dichotomy of it’s either military force or nothing.  The use of chemical weapons is a war crime, it is indeed what Secretary Kerry called a “moral obscenity.”  Whoever used such a weapon should be held accountable. So what do we do about it?

    • First, do no harm.  Don’t kill more people in the name of enforcing an international norm.
    • Recognize that international law requires international enforcement; no one country, not even the most powerful, has the right to act as unilateral cop.  Move to support international jurisdiction and enforcement, including calling for a second UN investigation to follow-up the current weapons inspection team, this one to determine who was responsible for the attack.
    • Recommend that whoever is found responsible be brought to justice in The Hague at the International Criminal Court, understanding that timing of such indictments might require adjustment to take into account ceasefire negotiations in Syria.
    • President Obama can distinguish himself powerfully from his unilateralist predecessor by announcing an immediate campaign not only to get the Senate to ratify the International Criminal Court, but to strengthen the Court and provide it with serious global enforcement capacity.
    • Move urgently towards a ceasefire and arms embargo in Syria. Russia must stop, and must push Iran to stop arming and funding the Syrian regime. The U.S. must stop, and must push Saudi Arabia, Qatar, Turkey, Jordan and others to stop arming and funding the opposition, including the extremist elements. That won’t be easy – for Washington it may require telling the Saudis and Qataris that if they don’t stop, we will cancel all existing weapons contracts with those countries.  (As my colleague David Wildman has said, why don’t we demand that the Pentagon deal with arms producers the way the Dept of Agriculture deals with farmers – pay them NOT to produce weapons. And then the money can be used to retool their factories to produce solar panels instead of Tomahawk missiles, and the workers stay on the job….)
    • Stand against further escalation of the Syrian civil war by voting NO on any authorization for U.S. military strikes.

  • Even if Assad Used Chemical Weapons, the West has no Mandate to Act as a Global Policeman

    It is true that the UN security council is not a reliable global policeman. It may be slow to take action, or paralysed because of disagreement between members. But do we want the US or Nato or “alliances of willing states” as global policemen either? Unlike George Bush in 2003, the Obama administration is not trigger-happy and contemptuous of the United Nations and the rules of its charter, which allow the use of armed force only in self-defence or with an authorisation from the security council. Yet Obama, like Bush and Blair, seems ready to ignore the council and order armed strikes on Syria with political support from only the UK, France and some others.

    Such action could not be “in self-defence” or “retaliation”, as the US, the UK and France have not been attacked. To punish the Assad government for using chemical weapons would be the action of self-appointed global policemen – action that, in my view, would be very unwise.

    While much evidence points to the guilt of the Assad regime, would not due process require that judgment and consideration of action take place in the UN security council and await the report of the inspectors that the UN has sent to Syria – at the demand of the UK and many other UN members?

    We may agree with John Kerry, the US secretary of state, that the use of gas is a “moral obscenity”, but would we not feel that “a measured and proportionate punishment”, like striking at some missile sites or helicopter bases, is like telling the regime that “you can go on with your war but do stay away from the chemical weapons”? And what is the moral weight of the condemnation by nuclear weapons states of the use of gas as a serious war crime when they themselves will not accept a norm that would criminalise any first use of their own nuclear weapons?

    It is hard to avoid the impression that the political and military developments now in overdrive stem partly from pressure exerted by the rebel side to trigger an American military intervention – by trying to hold President Obama to an earlier warning to Assad that a use of chemical weapons would alter his calculation. Equally, if not more important, may be a need felt by the Obama administration to avoid criticism for being hesitant and passive – and appearing like a paper tiger to countries such as Iran that have been warned that the US will not allow them to have nuclear weapons.

    In 2003 the US and the UK and an alliance of “friendly states” invaded Iraq without the authorisation of the security council. A strong body of world opinion felt that this constituted a violation and an undermining of the UN charter. A quick punitive action in Syria today without UN authorisation would be another precedent, suggesting that great military powers can intervene militarily when they feel politically impelled to do so. (They did not intervene when Iraq used chemical weapons on a large scale in the war with Iran in the 1980s.)

    So, what should the world reaction be to the use of chemical weapons? Clearly, evidence available – both from UN inspectors and from member states – should be placed before and judged by the security council. Even if the council could only conclude that chemical weapons had been used – and could not agree that the Assad regime alone was responsible – there would be a good chance of unanimous world condemnation. Global indignation about the use of chemical weapons is of value to strengthen the taboo.

    Condemnation is not enough. With 100,000 killed and millions of refugees, the civil war itself is a “moral obscenity”. The council must seek to achieve not just an end to chemical weapons use but an end to all weapons use, by a ceasefire. As was planned not long ago by the US and Russia, the council must seek to bring about a conference at which relevant parties and states can form an interim authority. The alternative is continued civil war in Syria and worsening international relations.

    Is the ending of active hostilities totally unrealistic? Let us be clear that the government in Syria, as well as all rebel groups, depends upon a flow of weapons, munitions and money from the outside. Much is reported to come to the rebels from Saudi Arabia, Qatar and Turkey; and much is reported to come to the government from Russia and Iran. The supplier countries have leverage. Agreement should be sought, under the auspices of the security council, that all parties that have given such support demand that their clients accept a ceasefire – or risk losing further support.

  • Nelson Mandela: The United States of America is a Threat to World Peace

    In a rare interview, the South African demands that George W. Bush win United Nations support before attacking Iraq

    Nelson Mandela, 84, may be the world’s most respected statesman. Sentenced to life in prison on desolate Robben Island in 1964 for advocating armed resistance to apartheid in South Africa, the African National Congress leader emerged in 1990 to lead his country in a transition to non-racial elections. As president, his priority was racial reconciliation; today South Africans of all races refer to him by his Xhosa clan honorific, Madiba. Mandela stepped down in 1999 after a single five-year term. He now heads two foundations focused on children. He met with NEWSWEEK’S Tom Masland early Monday morning in his office in Houghton, a Johannesburg suburb, before flying to Limpopo Province to address traditional leaders on the country’s AIDS crisis.

    Excerpts:

    NEWSWEEK: Why are you speaking out on Iraq? Do you want to mediate, as you tried to on the Mideast a couple of years ago? It seems you are reentering the fray now.

    NELSON MANDELA: If I am asked, by credible organizations, to mediate, I will consider that very seriously. But a situation of this nature does not need an individual, it needs an organization like the United Nations to mediate.

    We must understand the seriousness of this situation. The United States has made serious mistakes in the conduct of its foreign affairs, which have had unfortunate repercussions long after the decisions were taken. Unqualified support of the Shah of Iran led directly to the Islamic revolution of 1979.

    Then the United States chose to arm and finance the [Islamic] mujahedin in Afghanistan instead of supporting and encouraging the moderate wing of the government of Afghanistan. That is what led to the Taliban in Afghanistan.

    But the most catastrophic action of the United States was to sabotage the decision that was painstakingly stitched together by the United Nations regarding the withdrawal of the Soviet Union from Afghanistan. If you look at those matters, you will come to the conclusion that the attitude of the United States of America is a threat to world peace. Because what [America]is saying is that if you are afraid of a veto in the Security Council, you can go outside and take action and violate the sovereignty of other countries. That is the message they are sending to the world. That must be condemned in the strongest terms. And you will notice that France, Germany Russia, China are against this decision. It is clearly a decision that is motivated by George W. Bush’s desire to please the arms and oil industries in the United tates of America. If you look at those factors, you’ll see that an individual like myself, a man who has lost power and influence, can never be a suitable mediator.

    NEWSWEEK: What about the argument that’s being made about the threat of Iraq’s weapons of mass destruction and Saddam’s efforts to build a nuclear weapons. After all, he has invaded other countries, he has fired missiles at Israel. On Thursday, President Bush is going to stand up in front of the United Nations and point to what he says is evidence of…

    NELSON MANDELA: SScott Ritter, a former United Nations arms inspector who is in Baghdad, has said that there is no evidence whatsoever of [development of weapons of] mass destruction. Neither Bush nor [British Prime Minister] Tony Blair has provided any evidence that such weapons exist. But what we know is that Israel has weapons of mass destruction. Nobody talks about that. Why should there be one standard for one country, especially because it is black, and another one for another country, Israel, that is white.

    NEWSWEEK: So you see this as a racial question?

    NELSON MANDELA: Well, that element is there. In fact, many people say quietly, but they don’t have the courage to stand up and say publicly, that when there were white secretary generals you didn’t find this question of the United States and Britain going out of the United Nations. But now that you’ve had black secretary generals like Boutros Boutros Ghali, like Kofi Annan, they do not respect the United Nations. They have contempt for it. This is not my view, but that is what is being said by many people.

    NEWSWEEK: What kind of compromise can you see that might avoid the coming confrontation?

    NELSON MANDELA: There is one compromise and one only, and that is the United Nations. If the United States and Britain go to the United Nations and the United Nations says we have concrete evidence of the existence of these weapons of mass destruction in Iraq and we feel that we must do something about it, we would all support it.

    NEWSWEEK: Do you think that the Bush administration’s U.N. diplomatic effort now is genuine, or is the President just looking for political cover by speaking to the U.N. even as he remains intent on forging ahead unilaterally?

    NELSON MANDELA: Well, there is no doubt that the United States now feels that they are the only superpower in the world and they can do what they like. And of course we must consider the men and the women around the president. Gen. Colin Powell commanded the United States army in peacetime and in wartime during the Gulf war. He knows the disastrous effect of international tension and war, when innocent people are going to die, young men are going to die. He knows and he showed this after September 11 last year. He went around briefing the allies of the United States of America and asking for their support for the war in Afghanistan. But people like Dick Cheney’s I see yesterday there was an article that said he is the real president of the United States of America, I don’t know how true that is. Dick Cheney, [Defense secretary Donald] Rumsfeld, they are people who are unfortunately misleading the president. Because my impression of the president is that this is a man with whom you can do business. But it is the men who around him who are dinosaurs, who do not want him to belong to the modern age. The only man, the only person who wants to help Bush move to the modern era is Gen. Colin Powell, the secretary of State.

    NEWSWEEK: I gather you are particularly concerned about Vice President Cheney?

    NELSON MANDELA: Well, there is no doubt. He opposed the decision to release me from prison (laughs). The majority of the U.S. Congress was in favor of my release, and he opposed it. But it’s not because of that. Quite clearly we are dealing with an arch-conservative in Dick Cheney.

    NEWSWEEK: I’m interested in your decision to speak out now about Iraq. When you left office, you said, “I’m going to go down to Transkei, and have a rest.” Now maybe that was a joke at the time. But you’ve been very active.

    NELSON MANDELA: I really wanted to retire and rest and spend more time with my children, my grandchildren and of course with my wife. But the problems are such that for anybody with a conscience who can use whatever influence he may have to try to bring about peace, it’s difficult to say no.

    The Senior Officials of the Community of Latin American and Caribbean States (CELAC), having met on August 20, 2013 in the city of Buenos Aires, Republic of Argentina, aware of the historical commitment of the Community towards nuclear disarmament, issued the following Declaration:

    1. Highlighted the relevance and full validity of the Special Communiqué on the Complete Elimination of Nuclear Weapons adopted by the Heads of State and Government of the CELAC, on December 3, 2011 in Caracas, Bolivarian Republic of Venezuela.  In this context, they reiterated their grave concern at the threat that the ongoing existence of nuclear weapons and their potential use or threat of use poses for mankind.

    2. Highlighted also the full validity of the Declaration of the 33 Member States of the Agency for the Prohibition of Nuclear Weapons in Latin America and the Caribbean (OPANAL), adopted in September 2011, reaffirming, inter alia, the urgent need to advance towards the primary goal of nuclear disarmament and achieve complete and general elimination of nuclear weapons, and in this regard, agreed to join the efforts of the International Community in making progress towards the negotiation of a universal and legally binding instrument banning nuclear weapons.

    3. Reaffirmed that the region grants the highest priority to the achievement of a complete and verifiable nuclear disarmament and reiterated that the only guarantee against the use or threat of use of nuclear weapons is their complete elimination.

    4. Reiterated that the use or threat of use of nuclear weapons constitutes a crime against humanity and a violation of international law, including international humanitarian law, and of the Charter of the United Nations.

    5. Highlighted the importance of active participation by CELAC Member States in drafting concrete proposals to achieve universal nuclear disarmament, in accordance with a multilaterally agreed clear, irreversible, and verifiable timeframe.

    6. Identified as a legitimate interest of non-nuclear-weapon States, which includes all CELAC Member States, the unequivocal and legally binding assurance by nuclear weapon States against the use or threat to use such weapons.  CELAC Member States called for a start to the negotiation and adoption, as soon as possible, of a universal and legally binding instrument on negative security assurances.

    7. Called on all States, in particular Nuclear Weapon States, to eliminate the role of nuclear weapons in their doctrines, military strategies and security policies or as a prospective approach for the management of conflicts in order to achieve the total elimination of this armament regardless of its type or geographical location.

    8. Stressed that the establishment of Nuclear-Weapon-Free Zones strengthens international peace and security as well as the non-proliferation regime, and is an important contribution to nuclear disarmament.

    9. Expressed Latin America and the Caribbean’s pride in being the first densely populated area in the world to be declared a Nuclear-Weapon-Free Zone (NWFZ), under the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean (Treaty of Tlatelolco). Reaffirmed that the establishment of a NWFZ in the Latin American and Caribbean region has contributed to nuclear disarmament and non-proliferation, as well as to regional and global peace and security.

    10. Emphasized that the Tlatelolco Treaty and the OPANAL have constituted a political, legal and institutional reference in the establishment of other Nuclear-Weapon-Free Zones (NWFZs) in different regions of the world. Today OPANAL’s experience, together with that of the other four existing NWFZs and Mongolia as a single State unilaterally declared free of nuclear weapons, constitutes an important heritage of the international community to inspire the establishment of new NWFZs and advance towards the goal of a nuclear weapons free world.

    11. Urged nuclear powers to withdraw all interpretative declarations to the Protocols I and II of the Tlatelolco Treaty that constitute actual reservations prohibited by this Treaty, thus contributing to eliminate the possibility of the use of nuclear weapons against the countries of the region. Expressed their commitment to continue working with those States Parties to the Protocols in order to convince them to withdraw or modify such declarations.

    12. Regretted the failure to implement the agreement on the convening in 2012 of an International Conference for the establishment of a zone free of nuclear weapons and other weapons of mass destruction in the Middle East. Reiterated that the convening of this Conference is an important and integral part of the final outcome of the 2010 Review Conference of the Parties to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT). Expressed that the outcomes of this Conference will be an important contribution to achieve the nuclear disarmament goal and reiterated their firm conviction that the establishment of said Zone would represent a significant step towards the peace process in the Middle East region. Urged the convening of this Conference as soon as possible.

    13. Urged Nuclear-Weapon States to fulfill their commitments under Article VI of the NPT, and to advance towards the complete elimination of those weapons.  Urged them to fully and immediately implement the thirteen (13) practical steps towards nuclear disarmament agreed at the 2000 NPT Review Conference, as well as the Plan of Action adopted at the 2010 Review Conference.

    14. Reaffirmed the inalienable right of States to develop research, production and peaceful use of nuclear energy without discrimination and in conformity with Articles I, II, III and IV of the NPT.  Reiterated the commitment of all Parties to the Treaty to facilitate participation in the fullest possible exchange of equipment, materials and scientific and technological information for the peaceful use of nuclear energy.

    15. Expressed their total rejection to the enhancement of existing nuclear weapons and the development of new types of nuclear weapons, which is inconsistent with the obligation of complete nuclear disarmament.

    16. Called on all States to refrain from nuclear weapon test explosions, other nuclear explosions or any other relevant non-explosive experiments, including subcritical experiments, for nuclear weapons development purposes. Such actions are contrary to the object and purpose of the Comprehensive Nuclear-Test-Ban Treaty (CTBT), its spirit, if not the letter, undermining its desired impact as a nuclear disarmament measure.

    17. Reiterated the demand for a comprehensive nuclear test ban and urged those States in Annex II whose ratification are essential for the entry into force of the CTBT to accelerate the process of signing and/or ratifying this instrument, as a matter of priority and an indication of their political will and commitment to international peace and security.

    18. Reaffirmed the importance of initiating negotiations for an international legally binding instrument banning nuclear weapons and commitment towards this primary goal.

    19. Recalled that the First Special Session of the UN General Assembly on Disarmament (SSOD-I) established the Conference on Disarmament (CD) as the single multilateral negotiating body on disarmament. Urged the CD to demonstrate the necessary political will in order to ensure the commencement without delay of substantive work through the adoption and implementation of a balanced and comprehensive program of work that advances the agenda of nuclear disarmament.

    20. Recognized the work of the Open-ended Working Group established by Resolution A/RES/67/56 of the United Nations General Assembly, with the mandate to put forward proposals to foster multilateral negotiations on nuclear disarmament, as well as the proposals and contributions made in this Group by the CELAC Member Countries.

    21. Reiterated the firm commitment of the CELAC to work on convening an International High-Level Conference as soon as possible to identify ways and methods to eliminate nuclear weapons, aimed at agreeing on a phased program for the complete elimination of nuclear weapons within a specific timeframe.  This program would ban the development, production, acquisition, testing, stockpiling, transfer, use or threat of use of nuclear weapons and stipulate their destruction.

    22. Emphasized the intention of CELAC Member States to actively participate in the High-Level Meeting of the United Nations General Assembly on Nuclear Disarmament to be held in New York on September 26, 2013, as well as in the Third Session of the Preparatory Committee for the Review Conference of the parties to the Non-Proliferation Treaty, to be held in New York in 2014.

    23. Expressed their greatest concern at the humanitarian impact of vast proportions and global effects of any accidental or intentional nuclear detonation. Called upon the International Community to reiterate its concern on the humanitarian consequences of nuclear weapons whenever the debate on this type of weapons takes place. Welcomed the Oslo Conference on the Humanitarian Impact of Nuclear Weapons, held in March 2013, and, in this regard, called all States to participate in the Second International Conference on the Humanitarian Impact of Nuclear Weapons to be held in Mexico, on February 13-14, 2014.

    24. Agreed to continue coordinating positions and contributing to the implementation of practical actions as a follow-up to the above mentioned High-Level Meeting of the General Assembly, including the adoption of a resolution on the matter in the First Committee, during the 68th regular session of the United Nations General Assembly.

    25. Agreed to distribute this Declaration as an official document of the High-Level Meeting of the United Nations General Assembly on Nuclear Disarmament and as an official document of the OPANAL General Conference.

    26. Expressed appreciation to the Government and People of the Republic of Argentina for the warm hospitality and the successful organization of the Meeting.

  • A Response to the Deadly Consequences of Nuclear War

    You may ask, how can we respond to something so overwhelming, so huge, so threatening that there is nowhere to hide except in denial? We’ve been trying that for almost 70 years. The numbers of weapons are down, their accuracy and lethality are up. It is time to try something new.

    We now know that Nuclear Winter, ozone layer destruction, phytoplankton reduction and other effects of a nuclear exchange would threaten health and life  everywhere on Earth in addition to the warring peoples. The people of the world are held hostage to the passions of the nine nuclear-weapons nations. We are no longer talking about deterring a potential adversary; we are talking about poisoning or ending Life on Earth. This new knowledge potentially adds billions of people to those already determined to abolish nuclear weapons.

    After the disaster of Fukushima, several nations, including Germany, abandoned nuclear generation because of its dangers. But thirteen nations are now constructing new power reactors. The problem is that the refinement of nuclear reactor fuel, if carried further, becomes weapons grade highly enriched uranium. The operation of nuclear plants results in the byproduct of plutonium, which also can be used to make a bomb.

    Since 1970 the Non Proliferation Treaty (NPT) has succeeded in slowing the  proliferation of nuclear weapons. The original deal was that the nuclear weapons states (NWS)  would work at abolishing their weapons, while the nuclear-weapons-free states (NWFS) would refrain from obtaining them. However, the weapons-free states are growing increasingly impatient with the deal, as they realize that they are endangered and that the nuclear weapons states are making little progress toward abolition.

    The Role of the U.S.

    Since 9/11/01 the U.S. has been following a policy of expanding its influence  through military bases around the world, particularly in Central Asia,  Africa and the Pacific. This process is greatly aided by the presence of our vast stockpile of nuclear warheads and far-reaching delivery systems, a fearful “deterrent” to any potential resistance. .

    At the same time, the manufacture and maintenance of nuclear warheads and the missiles, planes and submarines to deliver them anywhere in the world has grown into a huge business. Estimated at $50 billion a year, this business, including Air Force bases, nuclear laboratories, manufacturing plants and other facilities,  employs people in almost every Congressional District. The corporations that manufacture and manage these facilities spend millions a year in campaign contributions and lobbyists persuading our Representatives in Congress not to cut the budget from any part of this huge “defense” conglomerate.

    For other nations of the Nuclear Nine, the possession of nuclear weapons supplements their limited conventional forces when compared to those of a potential enemy. They will resist relinquishing their nuclear weapons, unless there is a reduction in all military forces. But it can be managed.

    Slicing Through the Gordian Knot

    In 1996 the World Court of Justice considered nuclear weapons and concluded that their use was illegal, except as the last resort of an endangered nation. We now know that any use of these weapons threatens Life on Earth. It would be useful if the nuclear-weapons-free nations could persuade the Court to label the manufacture, maintenance, support and any and all preparations for the use of nuclear weapons to be criminal activities. It seems obvious that any activity that threatens the indiscriminate incineration or poisoning of human beings is a Crime Against Humanity. For the millions involved in this work, or profiting from it, it is high time that they face the criminal nature of their employment, management, study or investment. This potential suicide of the human race cannot be disguised as a military deterrent, a patriotic duty or an acceptable activity for any reason. It is a crime beyond all measure. It must be stopped!

    There is now a draft convention for the abolition of nuclear weapons at the United Nations, similar to those that ended chemical and germ warfare. As the step-by-step disarmament process has resulted in the current “modernization” of existing weapons, it is time  to take another approach. The more than 180 nuclear-weapons-free nations should move to finalize this convention with or without the NWS participation. In the final analysis, if the nuclear nations continue to resist abolition, they may be subject to sanctions of the NWFN.

    There is no time to hesitate on the abolition of these weapons. As more nations get nuclear plants, refined uranium fuel and basic technology, the Non Proliferation Treaty will lose its force and the number of nations having nuclear weapons will increase.

    As the United States developed nuclear weapons, is the only nation to have used them, and has one of the greatest stockpiles of warheads, it is important that we take the lead in their abolition. We have an election every two years for all of our Representatives in Congress and a third of our Senators. Can we not demand that all of these elected officials Pledge in their campaigns to Oppose any funding for any part of our nuclear weapons and delivery systems? Can we not ask all those who fund these elections to abstain from funding candidates who will not take the Pledge of Opposition? Can we not disinvest in those corporations that are active in the nuclear weapons business and support the self-perpetuating nuclear weapons lobbies in Washington?

    The choice is clear. Either we exert ourselves to achieve and enforce a Convention to Abolish Nuclear Weapons, or we leave to our children the awsome possibility that they will be poisoned by fallout or incinerated by these criminal weapons.

  • Stumbling in the Dark, Reaching for the Light

    Lord Byron’s evocative and prescient poem “Darkness” was written in 1816, the “year without a summer”, following the 1815 volcanic eruption of Mt Tambora in Indonesia. Byron “wrote it … at Geneva, when there was a celebrated dark day, on which the fowls went to roost at noon, and the candles were lighted as at midnight”. Average global cooling in 1816 from the volcanic debris blasted into the atmosphere was 0.7°C, enough to cause widespread crop failures in North America and famine across Europe and India, despite good harvests in 1815 and 1817.

    Just 100 Hiroshima-sized nuclear bombs, less than one per cent of the global nuclear arsenal, would generate more than five million tons of soot and smoke if targeted at cities. In addition to local devastation and widespread radioactive contamination, the climate impact would be catastrophic. Global cooling would be twice as large as following the Tambora explosion, and would persist not a couple of years but for over a decade, decimating global agriculture. On top of that would come the effects of price hikes; hoarding of food; food riots; intrastate and potential interstate conflicts over food supplies; the disease epidemics that inevitably spread through malnourished populations; disruption to trade and the complex international supply chains for agricultural inputs – seed, fertiliser, pesticides, fuel and machinery.

    World grain reserves currently range between 60 and 70 days supply. The 925 million people chronically malnourished today, and the additional 300+ million highly dependent on imported food, could not be expected to survive such a prolonged global food shortage.

    Famine on a scale never before witnessed would worst affect poor and malnourished people even on the other side of the world from the nuclear explosions. Such global nuclear famine is well within the capacity not only of the US and Russian arsenals, with between them more than 90 per cent of the world’s 17,300 nuclear weapons, but also the smaller arsenals of China, France, UK, India, Israel and Pakistan – in fact all the current nine nuclear-armed states except for North Korea.

    That the smaller nuclear arsenals of tens of hundreds of weapons pose not only a regional threat but a global danger has profound implications. It is not widely understood that the most acute risk of abrupt and dangerous climate change is from nuclear weapons. The extent of our collective vulnerability is illustrated by the fact that the nuclear warheads carried on a single US Ohio class submarine, if targeted on Chinese cities, could produce not 5 but 23 million tons of smoke. The US has 14 such submarines; Russia 10 similar ones.

    The fundamental realities of nuclear weapons are as profound as they are clear. Nuclear weapons are by far the most destructive, indiscriminate, persistently toxic weapons ever invented. Single nuclear weapons have been built with more destructive power than all explosives used in all wars throughout human history. In its landmark Resolution 1 of 2011, the Council of Delegates of the Red Cross and Red Crescent Movement, its highest governing body, “finds it difficult to envisage how any use of nuclear weapons could be compatible with the rules of international humanitarian law, in particular the rules of distinction, precaution and proportionality”. They cannot be used in any way compliant with international law. While they exist, there is a danger they will be used. The only way to eliminate this danger is to eradicate nuclear weapons. While some nations possess them, others will inevitably seek to acquire them, or the means to produce them in short order. These means are now readily accessible around the world, even to isolated and impoverished countries like North Korea. The lifetimes of uranium and plutonium isotopes, which can fuel bombs, are measured over tens of thousands to millions of years. Human intent, nation-states and politics can change on a dime. Hence stocks of fissile materials, the capacity to create more, and nuclear weapons themselves are the problems, irrespective of the intentions of their custodians at any point in time.

    Whatever their ostensible justification or purpose, a nuclear weapon is a nuclear weapon – once detonated, whether through accident, cyberattack, in retaliation when deterrence fails, or any other human or technical failing, the searing catastrophe they would unleash is dictated by the laws of physics alone. Even a single nuclear weapon exploded over a city would cause a humanitarian catastrophe to which no effective response capacity exists or is feasible. If nuclear weapons were used, nuclear retaliation and escalation are likely to follow. It will not matter whose nuclear weapons were used first, second or third; the weapons of our allies will kill us just as surely and indiscriminately as any others.

    Einstein reflected that “The splitting of the atom has changed everything, save our way of thinking, and thus we drift toward unparalleled catastrophe.” From any vantage, there is a massive dinosaur in the room. Tiptoeing around hoping it might go away if we ignore it is not a viable strategy for survival, for sustainability, for health, for the progressive realisation of human rights, for anything that matters in the thin shell of planet earth in which all living things known to us dwell. Since nuclear weapons entered our world, everything has changed; whether we like it or not; ready or not.

    There are three major sets of existential challenges we collectively need to navigate. These go beyond the wellbeing, life and death of individuals and populations alive at any one time, and speak to the habitability of earth; to whether there will be a place for future generations. One is collision of the earth with a large celestial body. Such collisions have been the main cause of previous major extinctions, like that of the dinosaurs. The second is environmental change, and degradation and depletion of vital resources – rampant global warming posing the greatest such challenge. The third, more acute, is the danger of nuclear war. The World Health Organization, the world’s leading health agency, has concluded that nuclear weapons “constitute the greatest immediate threat to human health and welfare”. Preventing use of nuclear weapons necessitates their eradication, a necessary, urgent and feasible precondition for securing global health and sustainability.

    Two of these great challenges are of human origin, needing human solutions. In all our evolutionary history , we are among the first generations to face such existential challenges. While the extraordinary responsibility we bear is a difficult burden, it is also a precious gift. Few people in all of human history have had as great an opportunity as we now have to avert harm and do good for humanity and for all the denizens of planet earth with whom we are intertwined.

    The last few decades have seen major progress on the elimination of other indiscriminate and inhumane weapons – chemical and biological weapons, landmines and cluster munitions. It represents a profound failure of the global community that the worst weapons of all – nuclear weapons – remain the only ones not subject to a specific legal prohibition. It is 68 years since the nuclear bombings of Hiroshima and Nagasaki, 43 years since the nuclear Non-Proliferation Treaty (NPT) entered into force, and 17 years since the judges of the International Court of Justice held unanimously that “there exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.” Yet we still have no binding, verifiable, legal framework to eradicate nuclear weapons. And we have no international controls on uranium enrichment or the reprocessing of spent nuclear reactor fuel, both of which can provide the feedstock for nuclear weapons. Meanwhile, all the nuclear-armed states are investing massively in the modernisation of their nuclear arsenals, and justifying their planned retention indefinitely.

    In addressing such momentous challenges, we need wisdom from all cultures, faiths and ethical traditions; lessons, insights, tools and perspectives from every field of human endeavor; and the recognition that whatever our core business, eradicating nuclear weapons is part of everyone’s business. Like respect for universal human rights, like addressing global warming on the scale and urgency demanded. Nuclear weapons are a critical human rights issue; the most urgent development issue; the paramount sustainability issue; potentially the most egregious violation of international humanitarian law; the most urgent environmental issue; the most profound ethical issue; the greatest blasphemy.

    Two perspectives key to progress on complex global challenges like nuclear weapons and climate change are a global view transcending tribalism of all kinds, whether cultural, religious, ethnic or nation-state based; and a long-term, ecological perspective, that recognises human dependence on ecosystem services and custodial responsibilities for the biosphere. These both have strong roots in ancient wisdoms from many traditions, particularly indigenous ones, and are also increasingly underscored by scientific evidence and the ever-growing realities of global interdependence. There are few frames as powerful in a global view of human affairs and interests as the affirmation of universal human rights.

    The right to life is, after all, the precondition for the enjoyment of all other rights. If nuclear weapons are used, everything else could become tragically irrelevant in an afternoon. Law, politics and culture have yet to fully catch up with the reality of the existential threats faced by not only those alive today but all those who might follow us. The rights of future generations and of the myriad living things other than human beings, and of the biosphere, a far more complex and wondrous thing than the sum of its parts, barely get a mention in any of the widely-accepted human rights instruments.

    Nor is prohibition and elimination of nuclear weapons high on the agenda of international human rights organisations. For example, the section on weapons and human rights on the Amnesty International website focuses only on conventional weapons, and the only specific recent Amnesty statement regarding nuclear weapons readily identifiable in a Google search is a (welcome) single sentenceaddressing the last question in a 10 April 2013 Q&A on the North Korea human rights crisis: “Amnesty International opposes the use, possession, production and transfer of nuclear weapons, given their indiscriminate nature.”

    Some recent initiatives have brought a human rights focus to nuclear issues. One is a 2012 report to the UN Human Rights Council by the Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes,
Calin Georgescu, on the ongoing recognition, care and compensation needs of Marshall Islanders harmed by US atmospheric nuclear tests on and near their islands in the 1950s, and the long-term continuing environmental monitoring and clean-up needs.

    A second is the landmark 2012 report of the Fukushima Nuclear Accident Independent Investigation Commission established by Japan’s national Diet (parliament). The Commission highlights the lack of priority given to the wellbeing and safety of all Japanese citizens, the first responsibility of any government. Among the conclusions of the Commission: the 2011 Fukushima nuclear accident accident “was the result of collusion between the government, regulators and TEPCO … They effectively betrayed the nation’s right to be safe from nuclear accidents.” “The Commission concludes that the government and regulators are not fully committed to protecting public health and safety; that they have not acted to protect the health of the residents and to restore their welfare.”

    A third is an excellent report to the UN Human Rights Council by the UN Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health, Anand Grover, who addresses the right to health for those affected by the Fukushima nuclear disaster. Grover makes recommendations to redress the various ways in which the health and safety of people has been neglected in order to reduce the eventual compensation bill.

    There are fundamental human rights dimensions to nuclear technology, whether weapons or power generation. A so-called “inalienable right” of nations to the “use of nuclear energy for peaceful purposes” articulated in Article IV of the NPT in reality means exposing people and other living things worldwide to a risk of indiscriminate, catastrophic radioactive contamination at any time. Nuclear power erodes the health and rights of future generations. Through its inevitable generation of plutonium, and the intrinsic potential of uranium enrichment plants to enrich uranium beyond reactor grade to weapons grade, it exacerbates the danger of nuclear war and its catastrophic human consequences. Nuclear power thus undermines fundamental human and biosphere rights, responsible custodianship and human security.

    Were the Universal Declaration of Human Rights being drafted today, one would hope that additional rights would be front and centre: the right to live free from the threat of indiscriminate, inhumane weapons, most of all nuclear weapons; the rights of future generations; the rights of people everywhere to access benign, renewable energy sources; and to be protected from preventable, indiscriminate, transgenerational radioactive contamination. These human rights urgently need to become prominent in the global human rights agenda.

    To quote Albert Einstein again: “There is no secret and there is no defense; there is no possibility of control except through the aroused understanding and insistence of the peoples of the world.”
