  • Iran’s Nuclear Program: Diplomacy, War and (In)security in the Nuclear Age

    richard_falkPerhaps, Netanyahu deserves some words of appreciation, at least from the Israeli hard right, for the temporary erasure of the Palestinian ordeal from national, regional, and global policy agendas. Many are distracted by the Republican recriminations directed at Obama’s diplomatic initiative to close a deal that exchanges a loosening of sanctions imposed on Iran for an agreement by Tehran to accept intrusive inspections of their nuclear program and strict limits on the amount of enriched uranium of weapons grade that can be produced or retained.

    We can only wonder about the stability and future prospects of the United States if 47 Republican senators can irresponsibly further jeopardize the peace of the Middle East and the world by writing an outrageous Open Letter to the leadership of Iran. In this reckless political maneuver the government of Iran is provocatively reminded that whatever agreement may be reached by the two governments will in all likelihood be disowned if a Republican is elected president in 2016, or short of that, by nullifying actions taken by a Republican-controlled Congress. Mr. Netanyahu must be smiling whenever he looks at a mirror, astonished by his own ability to get the better of reason and self-interest in America, by his pyrotechnic display of ill-informed belligerence in his March 2nd address to Congress. Surely, political theater of sorts, but unlike a performance artist, Netanyahu is a political player whose past antics have brought death and destruction and now mindlessly and bombastically risk far worse in the future.

    What interests and disturbs me even more than the fallout from Netanyahu’s partisan speech, are several unexamined presuppositions that falsely and misleadingly frame the wider debate on Iran policy. Even the most respected news sites in the West, including such influential outlets as the NY Times or The Economist, frame the discourse by taking three propositions for granted in ways that severely bias our understanding:

    –that punitive sanctions on Iran remain an appropriate way to prevent further proliferation of nuclear weapons in the Middle East, and enjoyed the backing of the United Nations;

    –that Iran must not only renounce the intention to acquire nuclear weapons, but their renunciation must be frequently monitored and verified, while nothing at all is done about Israel’s arsenal of nuclear weapons;

    –that there is nothing intrinsically wrong about Irael’s threats to attack Iran if it believes that this would strengthen its security either in relation to a possible nuclear attack or in relation to Iran’s support for Hezbollah and Hamas.

    SANCTIONS

    Sanctions are a form of coercion expressly imposed in this case to exert pressure on Iran to negotiate an agreement that would provide reassurance that it was not seeking to acquire nuclear weaponry. Supposedly, Iran’s behavior made such a reinforcement of the nonproliferation treaty regime a reasonable precaution. Such measures had never been adopted or even proposed in relation to either Germany and Japan, the two main defeated countries in World War II, who have long possessed the technical and material means to acquire nuclear weapons in a matter of months. Iran has repeatedly given assurances that its nuclear program is peacefully aimed at producing energy and for medical applications, not weapons, and has accepted a willingness to have its nuclear program more regulated than is the case for any other country in the world.

    It should be appreciated that Iran has not been guilty of waging an aggressive war for over 275 year. Not only has it refrained in recent years from launching attacks across its borders, although it has itself been severely victimized by major interventions and aggressions. Most spectacularly, the CIA-facilitated coup in 1953 that restored the Shah to power and overthrew a democratically elected government imposed a dictatorial regime on the country for over 25 years. And in 1980 Iraq invaded Iran with strong encouragement of the United States. Additionally, Iran has been subject over the years to a variety of Western covert operations designed to destabilize its government and disrupt its nuclear program.

    Despite their UN backing, the case for sanctions seems to be an unfortunate instance of double standards, accentuated by the averted gaze of the international community over the years with respect to Israel’s process of acquisition, possession, and development of nuclear weaponry. This is especially irresponsible, given Israel’s behavior that has repeatedly exhibited a defiant attitude toward international law and world public opinion. I would conclude that Iran the imposition of harsh sanctions on Iran is discriminatory, more likely to intensify that resolve conflict. The proper use of international sanctions is to avert war or implement international law, and not as here to serve as a geopolitical instrument of hard power that seeks to sustain a hierarchical nuclear status quo in the region and beyond.

    NUCLEAR WEAPONS OPTION

    Iran is expected not only to forego the option to acquire nuclear weapons, but to agree to a framework of intrusive inspection if it wants to be treated as a ‘normal’ state after it proves itself worthy. As indicated, this approach seems discriminatory and hypocritical in the extreme. It would be more to the point to acknowledge the relative reasonableness of Iran’s quest for a deterrent capability given the extent to which its security and sovereignty have threatened and encroached upon by the United States and Israel.

    It is relevant to note that the Obama presidency, although opting for a diplomatic resolution of the dispute about its nuclear program, nevertheless repeatedly refuses to remove the military option from the negotiating table. Israel does little to hide its efforts to build support for a coercive approach that threatens a preemptive military strike. Such an unlawful imprudent approach is justified by Israel’s belief that Iran poses an emerging existential threat to its survival if it should acquire weapons of mass destruction. Israel bases this assessment on past statements by Iranian leaders that Israel should not or will not exist, but such inflammatory rhetoric has never been tied to any statement of intention to wage war against Israel. To assert an existential threat as a pretext for war is irresponsible and dangerous.

    From Iran’s perspective acquiring a nuclear weapons capability would seem a reasonable response to its security situation. If deterrence is deemed a security necessity for the United States and Israel, given their military dominance in conventional weaponry, it should be even more so for Iran that is truly faced with a genuine, credible, and dangerous existential threat. Few countries would become safer and more secure if in possession of nuclear weapons but Iran is one state that likely would be. Again what is at stake most fundamentally is the challenge to the nuclear oligopoly that has been maintained since the early stages of the Cold War when the Soviet Union broke the American nuclear monopoly. More immediately threatened if Iran were to acquire nuclear weapons at some future point is Israel’s regional nuclear weapons monopoly that serves both as a deterrent to others and helps clear political space for Israel’s expansionist moves in the region. I would not argue that Iran should acquire nuclear weapons, but rather that it has the strongest case among sovereign states to do so, and it is a surreal twist of realities to act as if Iran is the outlier or rogue state rather than the nuclear weapons states that refuse to honor their obligation set forth in Article VI of the NPT to seek nuclear disarmament in good faith at a time. The most urgent threat to the future in this period arises from the increasing risk that nuclear weapons will be used at some point to resolve an international conflict, and thus it should be a global policy imperative to demand efforts to achieve nuclear disarmament rather than use geopolitical leverage to sustain the existing hierarchy of states with respect to nuclear weaponry.

    MILITARY THREATS

    Israel’s military threats directed at Iran clearly violate the international law prohibition contained in Article 2(4) of the UN Charter that prohibit “threats or uses” of force except for self-defense against a prior armed attack or with an authorization by the Security Council. Despite this threat to international peace in an already turbulent Middle East, there is a widespread international acceptance of Israel’s behavior, and in fact, the most persuasive argument in favor of the sanctions regime is that it allays the concerns of the Israeli government and thus reduces the prospect of a unilateral military strike on Iran.

    Conclusion

    Overall, this opportunistic treatment of Iran’s nuclear program is less indicative of a commitment to nonproliferation than it is a shortsighted expression of geopolitical priorities. If peace and stability were the true motivations of the international community, then we would at least expect to hear strident calls for a nuclear free Middle East tied to a regional security framework. Until such a call is made, there is a cynical game being played with the complicity of the mainstream media. To expose this game we need to realize how greatly the three presuppositions discussed above misshape perceptions and discourse.

  • Remembering 2014 (Badly)

    richard_falkConsidering the year that is about to end is a time to pause long enough to take stock of what went wrong. In the United States not much went right aside from Barack Obama’s surprising initiative to normalize relations with Cuba after more than 60 years of hostile and punitive interaction. Although the sleazy logic of domestic politics kept this remnant of the worst features of Cold War diplomacy in being for a couple of extra decades, it is still worth celebrating Obama’s move, which when compared to the rest of his record, seems bold and courageous. As well, Obama exhibited a strong commitment to doing more than previously on climate change, using his executive authority to circumvent Congressional unwillingness to act responsibly. Obama’s immigration reform proposals also seem on balance to be positive, although whether they will be implemented remains an open question.

    Drifting Toward Cold War II: Remembering World War I

    There are several signs of a worsening global setting that seemed to gain an ominous momentum during 2014. Perhaps, worst of all, is a steady drumbeat of anti-Russian rhetoric backed up by Western sanctions, that seems almost designed to produce Cold War II. No less a figure than Mikhail Gorbachev, speaking at the Brandenburg Gate an event observing the 25th anniversary of the collapse of the Berlin Wall, warned of a renewed Cold War, and wonder aloud as to whether it had already started. There is little reason to praise Vladimir Putin, but there is far less reason to transform the tensions generated by the confusing and contradictory happenings in the Ukraine into a renewal of high profile geopolitical rivalry, replete with crises and confrontations that pose world-shattering threats that could be actualized by accident, miscalculations, or the over-reactions of extremists bureaucrats and leaders.

    In this year when the 100th anniversary of the start of World War I is being observed in many countries it is helpful to remember that this ‘Great War’ was started rather frivolously and proclaimed to be “the war to end all wars.” Instead, it is better remembered as the war that helped produced political extremism in Europe, unleashed forces that led to an even more devastating Second World War, and created the conditions that brought the nuclear age to the world. Perversely, as well, the origins of the contemporary turmoil in the Middle East today can be traced back to the world war one diplomacy that produced both the Sykes-Picot Agreement carving up the region by establishing artificial states to satisfy the greedy appetites of British and French colonial ambitions and the Balfour Declaration that committed the British Foreign Office and the League of Nations to the Zionist Project of establishing a Jewish homeland in the heart of historic Palestine without ever bothering to consult the indigenous population. Although some of the mistakes associated with the punitive aspects of the peace imposed on Germany by the Versailles Peace Treaty were corrected after World War II, these colonialist moves converted the collapse of the Ottoman Empire into an ongoing regional catastrophe that shows no signs of abating in the near future. We cannot rewind the reel of Middle Eastern history to learn if things would have turned out better if things had been handled more in accord with Woodrow Wilson’s premature advocacy of a self-determination ethos as the foundation of legitimate political communities deserving of membership in international society as sovereign states. These developments of a century ago are to an extent lost in the mists of time, but we should at least be alert about the roots of the present ordeal of chaos, strife, and oppression.

    Torture Revelations

    On December 9th after months of delay and controversy, the 500 page Executive summary of the 6,000 page Senate Intelligence Committee Report on CIA Torture was released. It contained some grizzly additional information and interpretations to what had been known previously, adding such practices as ‘rectal re-hydration’ to the repertoire of state terrorists, and indicating that there were at least 26 individuals tortured by the CIA who were improperly treated as suspects.

    Perhaps, the most disturbing feature of this phase of the controversy about the treatment of terrorist suspects is the absence of remorse on the part of those associated with the policies relied upon during the Bush presidency in the period of hysteria following the 9/11 attack. Dick Cheney was particularly out front about his readiness to do it all over again, and refused even to lament the abuse of those detained by mistake.

    The former Deputy Director of the CIA, Mike Morrell, has attempted to insulate the CIA from blame by suggesting the reasonableness of CIA’s reliance on the ‘torture memos’ prepared by John Yoo and Jay Bybee that encouraged the CIA to think that their forms of coercive interrogation were ‘legal,’ and argued the reasonableness of the post-9/11 inclination to take exceptional measures to gain information given the fears that abounded at the time within the U.S. Government of further attacks, including according to him, of a credible threat of al-Qaida’s access to a nuclear weapon within national borders. George W. Bush, never one bothered by nuance, assures us that the CIA torturers were ‘patriots’ who were engaged in doing the good work of protecting the security of the country. Bush seems to be saying that patriotism wipes clean the slate of individual criminal accountability.

    Morrell, and his colleagues, conveniently ignore the fact that the Nuremberg Judgment concluded that even ‘superior orders’ are no defense for someone charged with violating fundamental rules of international humanitarian law. If we stop for the briefest of moments, and consider how we would view the interrogation practices of the CIA if roles were reversed, and white American males were seen as the victims rather than dark Muslim men from the Middle East, it would seem clear beyond a reasonable doubt, that the label ‘torture’ would fit, and the description ‘enhanced interrogation techniques’ (further euphemized as EITs) is a malicious evasion of reality.

    Even liberal centers of opinion, including the ever cautious New York Times, have reacted to the Senate Report with calls for criminal investigations leading to probable indictments of those responsible for implementing torture, with the ladder of responsibility leading up at least as high as Cheney as Vice President, and conceivably to George W. Bush. [See editorial, “Prosecute Torturers and Their Bosses,” Dec. 22, 2014] The even more cautious American president, Barack Obama, has disconcertedly combined his repudiation of EIT culture and practices with a steadfast refusal to besmirch the reputation of the CIA or to look backward in time. Obama’s strange view, which is entirely destructive of any notion of governmental accountability ever, is that with respect to torture allegations the effort should be to prevent such behavior in the future, but not to investigate or impose any accountability for what was done in the past. I am led to wonder why he does not apply a similar logic to the leaks associated with such well-intentioned whistleblowers as Julian Assange, Chelsea Manning, and above all, Edward Snowden! Perhaps somewhere in the dark recesses of Obama’s mind he distinguishes between crimes of government (deserving impunity) and crimes against government (deserving severe punishment).

    It is not that Obama is necessarily wrong in his disposition to overlook the past when it comes to torture revelations, although he supplied the citizenry with no appropriate justification for this de facto conferral of impunity. It is not at all certain that the United States political system could manage such self-scrutiny without experiencing such a deep polarization as to put domestic and world peace at risk. It is evident that the country is split down the middle, and the risks of strife and a surge of support for the extreme right in the event of arrests and prosecutions are far from being paranoid excuses of the timid. We need to face the reality, with all of its shortcomings in relation to law and justice, that we live in a world of pervasive double standards when it comes to the official treatment of criminal accountability for international state crime, whether perpetrated within the American domestic legal structure or at black sites around the world. It is plausible to hold defeated dictators like Milosevic, Saddam Hussein, and Qaddafi, accountable, but quite another matter to indict Bush, Cheney, and Tony Blair, although both groupings have been responsible for heinous crimes.

    Part of the liberal concept of legality is to overlook what it is not feasible to do and focus on what can be done. From this perspective it was good to prosecute surviving German and Japanese leaders at Nuremberg and Tokyo because those charged were associated with vicious behavior and it was important to discourage and deter in the future. The fact that the indiscriminate bombing of German and Japanese cities by the victorious democracies, and the unleashing of atomic bomb attacks on Hiroshima and Nagasaki, would also by any criminal court be deemed as crimes is true but irrelevant. It is better not to go there, and leave it to dissident anti-imperialist scholars to whine about ‘victors’ justice’ and ‘double standards.’ “We liberals do what we can to make the world better, and to fight against the nihilistic nationalism of the extreme right.” Such is the liberal credo.

    What liberalism ignores is the relevance of structure and the organic connectedness of equality with the rendering of justice. If we are unwilling to prosecute the most dangerous perpetrators of state crime, is it not hypocritical to go after only those whose behavior appalls or angers the reigning hegemon? Does it not make the rule of law susceptible to dismissal as a cynical exercise in the demonization of ‘the other,’ whether belonging to an adversary religion, ethnicity, a marginalized class, or defeated nation? The experience of the International Criminal Court during its first thirteen years of operation is illustrative of this two-tier discriminatory approach to individual accountability. This parallels the more overtly discriminatory approach to nuclear weaponry adopted via the profound shift away from the initial concern about apocalyptic dangers posed by the weaponry to anxiety about its spread to certain unwanted others.

    Although these questions about criminal accountability are rhetorical, the prudential dilemma posed is genuinely challenging. I am not convinced that it would on balance be constructive in the present national atmosphere to attempt the punishment of political leaders in the United States who in the past authorized the practice of torture. The potential costs and risks seem too high compared to the benefits. The related question is whether or not to create some kind of equivalence at lower levels of expectations. If ‘well-intentioned’ torturers are given a free pass why not do the same for ‘idealistic and responsible whistleblowers’? It would seem almost beyond debate that the whistleblowers should not be prosecuted if the torturers are beneficiaries of such a pragmatic form of impunity. I would make the case that Assange, Manning, and Snowden deserve an honorific form of pardon, namely, the application of a doctrine of ‘principled impunity” as distinct from the notion of ‘pragmatic impunity.’ Here I think the social system in the United States would benefit despite producing some severe political strains that would almost certainly follow. I would argue that the highest pragmatic virtue of prudence would mandate taking such steps, namely, protecting one of the few safety valves available to citizens living in a modern national security state, which when added to the principled recognition of selfless and virtuous citizenship makes an overwhelming case for decriminalization. If we cannot have accountability for certain categories of abhorrent state crime, at least we should encourage transparency, making whistleblowing integral to the preservation of political democracy.

    It would be a mistake not to connect the torture revelations to related issues of police brutality associated with the police killing of Michael Brown in Ferguson, Missouri and of Eric Garner in Staten Island New York. Beyond this, the militarization of American political culture has been reaffirmed at the level of the citizenry by polls confirming the highest level of support for gun rights in the history of the country. It is little wonder that the elected leadership, as reinforced by the entrenched bureaucracy, cannot think much outside the military box when it comes to conflict resolution. Above all the resources of the moral and legal imagination have been degraded for so long as to be virtually irrelevant, which of course satisfies the comfort zone on ‘political realists’ who continue to distort our perceptions of 21st century realities.

    Multiple Atrocities

    More than in previous years, 2014 seemed to be a time of multiple atrocities, events that went beyond the ordeals of warfare and massive poverty, to shock the conscience by their violent aggression against the purest forms of innocence—deliberate brutality directed at young children, exhibiting depraved political imaginaries. By calling attention I have no intention of downplaying the widespread suffering associated with such continuing struggles at those taking place in Syria, Yemen, Iraq, Kashmir, and many other places on our tormented planet.

    ISIS or Daesh: This extremist movement, claiming an Islamic identity, emerged suddenly in the early part of 2014 as an occupying force in Iraq and Syria, proclaiming a new Sunni caliphate under its authority, and representing a sociopathic and sectarian response to the failed American occupation of Iraq. Initially welcomed by many Sunni Iraqis living in the northeastern parts of the country as liberation from Shiite abusive domination that resulted from American policies of debathification following the 2003 regime change in Baghdad, ISIS outraged the world by its televised beheadings of Western journalists, by its uprooting and slaughter of Shiite males belonging to the mainly Kurdish-speaking minority Yazidi community, and its alleged practice of turning Yazidi girls and women into sex slaves. Yazidis are considered an old religious sect that adheres to a pre-Muslim syncretist beliefs drawn from Zoroastrianism and ancient Mesopotamian religions, and drawing on other later religions as well. It would seem that the American-led response to ISIS is proceeding by way of yet another military intervention mainly in the form of air strikes. Although the political impact are yet to be clear, this does not a constructive path to restore peace and order.

    Boko Harem: Another manifestation of sociopathetic extremist politics gained world attention in April by the kidnapping in Nigeria of some 200 schoolgirls who were later abused in various ways, including being sold into slavery. Boko Harem has controlled parts of northern Nigeria since 2009, and has continued to engaged in behavior that constitutes crimes against humanity, and a total disregard of the innocence of Nigerian children, repeatedly engaging in kidnappings and wholesale destruction of villages. As recently as December 18th, Boko Harem forces kidnapped at least 185 young men, women, and children from a village in northern Nigeria. Its political goals, to the extent evident, are to protect Muslims in the country and establish a strict version of sharia law for areas under their control.

    Pakistani Taliban: The mid-December attack on Peshawar’s Army Public School by the Pakistani Taliban produced the massacre of an estimated 134 children and 14 others. The writer, Pervez Hoodbhoy, says that the Taliban, in ways that he believes parallel the ambitions of the Afghani Taliban, Boko Haram, and ISIS, are “fighting for a dream-to destroy Pakistan as a Muslim state and recreate it as an Islamic state.” The implication is a radical transformation from some kind of religious normalcy into a fearsome embodiment religious fanaticism.

    Israel’s Military Operation ‘Protective Edge’ Against Gaza: For the third time in less than six years Israel launched a vicious attack against Gaza that continued for 51 days, with the resulting humanitarian crisis caused accentuated by imposing a punitive ceasefire that has hampered recovery. The entire viability of Gaza is at severe risk. The attacks, known by the IDF code name of Operation Protective Edge, produced heavy civilian casualties (over 2,100 Palestinians killed including 519 childen, about 11,000 wounded, and as many as 520, 000 displaced, many homeless; on the Israeli side 70 were killed, 65 of whom were IDF, and one child) including among children, and traumatized the entire population locked into Gaza, with no exit available even for women, children, and disabled seeking sanctuary from the attack.

    Identified above are just a few highlights from this year’s catalogue of atrocities. It is also evident that there exists a pattern of numbed response around the world that amounts to a collective condition of ‘atrocity fatigue.’ Beyond this these incidents and developments illustrate the inability of many governments in Africa and the Middle East to exert effective sovereign control over their own territory, as well as the inability of the United Nations to protect peoples faced with threats underscoring their acute vulnerability. Account must also be taken of geopolitical priorities that accords attention to ISIS and Pakistan’s Taliban but much less to Boko Haram and none at all to Israel’s IDF. If there is any hope for effective responses it is a result of national and transnational activations of civil society that do their best to fill these normative black holes.

    Climate Change and Nuclear Weapons

    Without dwelling on these familiar issues threatening the future of the entire human species, it is worth noticing that little of a constructive nature took place during the year. A notable exception, which may make a difference, was the U.S./China agreement in November to regulate emissions and to cooperate in an effort to prevent the global buildup of greenhouse gasses. These two dominant states are responsible for almost 50% of this buildup, and suggest that geopolitical cooperation may produce more positive results than the dilatory movements of unwieldy UN mechanisms that involve the more than 190 states that make up its membership. On its surface the agreement was not impressive with the U.S. agreeing to cut emissions by 26-28% by 2025 and China agreeing to peak its emissions in 2030, and by meet its energy needs by relying for 20% on zero emissions sources, but the very fact of such an agreement was looked upon as ‘a game changer’ by some. I would be more skeptical, especially of the American side of the commitment, given the possibility that a Republican could become president in 2016, and might well ignore such an agreed target, especially if it is perceived as slowing economic growth. The UN Conference in Peru a month later ended up doing little more than issuing the Lima Call for Climate Action was one more disappointment. The bickering among states pursuing their distinct national interests was manifest and a resulting race to the bottom. It does not generate any confidence that the hope for a 2015 breakthrough in Paris will actually address climate change in a manner that heeds the warnings of climate scientists. Relying on voluntary guidelines so as to circumvent domestic debate, especially in the United States, is not an encourage feature of what is expected.

    As for nuclear weapons, the less said the better. Obama’s Prague visionary statement in 2009 has been swept aside by the nuclear weapons establishment, not only in the United States, but in all the nuclear weapons states. And even the possibility of bringing a measure of stability to the Middle East by eliminating nuclear weapons from the region has been taboo because of Israeli sensitivities. Instead the United States is embarked upon an expensive program on its own to upgrade its arsenal of nuclear weaponry. There is no serious initiative evident within international society to move toward the one solution that has long been obvious and yet unattainable—phased and verified nuclear disarmament as a prelude to a wider demilitarization of the global security system.

    What is at stake, above all, is whether the species as a species can manifest a collective will to survive in strong enough forms to meet these mounting unprecedented challenges of global scope. The species will to survive has never been seriously challenged previously, with all past survival collapses being of civilizational or sub-species scope. Humanity has been facing something new since the advent of nuclear weaponry, but has responded managerially rather than either with moral clarity or prudential wisdom.

    Conclusion

    Despite all, we can look to 2015 with some measure of hope, almost exclusively because there seems to be a slow awakening of civil society, at least in the domains of the BDS Campaign relating to Palestinian rights and in the form of the separate emergence of a transnational movement that takes global warming as seriously as the realities suggest. As for the future, we see, if at all, through a glass darkly, and thus have no excuse for refraining from a dedication to the struggle for global justice in its many shapes and forms. A posture of cynical hopelessness or despair worsens prospects for positive future developments, however empirically based such a negative assessment seems. All of us should recall that those who struggle for what seems ‘impossible’ today often turn out to be the heroes of tomorrow.

  • Contra Attack Syria (Excerpt)

    The rationale for an American-led attack on Syria is mostly expressed as follows:

    –America’s credibility is at stake after Obama ‘red line’ was crossed by launching a large-scale lethal chemical weapons attack; doing nothing in response would undermine U.S. global leadership;

    –America’s credibility makes indispensable and irreplaceable contributions to world order, and should not jeopardized by continued passivity in relation to the criminal conduct of the Assad regime; inaction has been tried for the past two years and failed miserably [not clearly tried—Hilary Clinton was avowed early supporter of rebel cause, including arms supplies; recent reports indicate American led ‘special forces operations’ being conducted to bolster anti-Assad struggle];

    –a punitive strike will deter future uses of chemical weapons by Syria and others, teaching Assad and other leaders that serious adverse consequences follow upon a failure to heed warnings posted by an American president in the form of ‘red lines;’

    –even if the attack will not shift the balance in Syria back to the insurgent forces it will restore their political will to persist in the struggle for an eventual political victory over Assad and operate to offset their recently weakened position;

    –it is possible that the attack will unexpectedly enhance prospects for a diplomatic compromise, allowing a reconvening of the U.S.-Russia chaired Geneva diplomatic conference, which is the preferred forum for promoting transition to a post-Assad Syria.

    Why is this rationale insufficient?

    –it does not take account of the fact that a punitive attack of the kind evidently being planned by Washington lacks any foundation in international law as it is neither undertaken in self-defense, nor after authorization by the UN Security Council, nor in a manner that can be justified as humanitarian intervention (in fact, innocent Syrian civilians are almost certain to loom large among the casualties);

    –it presupposes that the U.S. Government rightfully exercises police powers on the global stage, and by unilateral (or ‘coalition of the willing’) decision, can give legitimacy to an other unlawful undertaking; it may be that the United States remains the dominant hard power political actor in the region and world, but its war making since Vietnam is inconsistent with the global public good, causing massive suffering and widespread devastation; international law and the UNSC are preferable sources of global police power than is reliance on the discretion and leadership of the United States at this stage of world history even if this results in occasional paralysis as evidenced by the UN’s failure to produce a consensus on how to end the war in Syria;

    –U.S. foreign policy under President Barack Obama has similarities to that of George W. Bush in relation to international law, despite differences in rhetoric and style: Obama evades the constraints of international law by the practice of ‘reverential interpretations,’ while Bush defied as matter of national self-assertion and the meta-norms of grand strategy; as a result Obama comes off  as a hypocrite while Bush as an outlaw or cowboy; in an ideal form of global law both would be held accountable for their violations of international criminal law;

    –the impacts of a punitive strike could generate harmful results: weakening diplomatic prospects; increasing spillover effects on Lebanon, Turkey, elsewhere; complicating relations with Iran and Russia; producing retaliatory responses that widen the combat zone; causing a worldwide rise in anti-Americanism.

    There is one conceptual issue that deserves further attention. In the aftermath of the Kosovo NATO War of 1999 there was developed by the Independent International Commission the argument that the military attack was ‘illegal but legitimate.’[1] The argument made at the time was that the obstacles to a lawful use of force could not be overcome because the use of force was non-defensive and not authorized by the Security Council. The use of force was evaluated as legitimate because of compelling moral reasons (imminent threat of humanitarian catastrophe; regional European consensus; overwhelming Kosovar political consensus—except small Serbian minority) relating to self-determination; Serb record of criminality in Bosnia and Kosovo) coupled with considerations of political feasibility (NATO capabilities and political will; a clear and attainable objective—withdrawal of Serb administrative and political control—that was achieved). Such claims were also subject to harsh criticism as exhibiting double standards (why not Palestine?) and a display of what Noam Chomsky dubbed as ‘military humanism.’

    None of these Kosovo elements are present in relation to Syria: it is manifestly unlawful and also illegitimate (the attack will harm innocent Syrians without achieving proportionate political ends benefitting their wellbeing; the principal justifications for using force relate to geopolitical concerns such as ‘credibility,’ ‘deterrence,’ and ‘U.S. leadership.’ [For an intelligent counter-argument contending that an attack on Syria at this time would be ‘illegal but legitimate,’ see Ian Hurd, “Bomb Syria, Even if it is Illegal,” NY Times, August 27, 2013; also “Saving Syria, International Law is not the answer,” Aljazeera, August 27, 2013]

  • On Bradley Manning and America

    I am posting on this blog two important texts that deserve the widest public attention and deep reflection in the United States and elsewhere. I would stress the following:

    –the extraordinary disconnect between the impunity of Bush, Cheney, Rumsfeld, Yoo, and others who authorized and vindicated the practice of torture, were complicit in crimes against humanity, and supported aggressive wars against foreign countries and the vindictive rendering of ‘justice’ via criminal prosecutions, harsh treatment, and overseas hunts for Snowden and Assange, all individuals who acted selflessly out of concern for justice and the rights of citizens in democratic society to be informed about governmental behavior depicting incriminating information kept secret to hide responsibility for the commission of crimes of state and awkward diplomacy; a perverse justice dimension of the Manning case is well expressed in the statement below of the Center of Constitutional Rights “It is a travesty of justice that Manning who helped bring to light the criminality of U.S. forces in Iraq and Afghanistan, is being punished while the alleged perpetrators are not even investigated.” And “We fear for the future of our country in the wake of this case.”

    –the vindictive punishment of Bradley Manning, a historically stiff imprisonment for the unlawful release of classified documents, a dishonorable discharge from military service that is a permanent stain, a demotion to the lowest rank, and imprisonment for 35 years;

    –the failure of the prosecution or the military judge or the national leadership to acknowledge the relevance of Manning’s obviously ethical and patriotic motivations and the extenuating circumstance of stress in a combat zone that was producing observable deteriorations in his mental health;

    –an increasingly evident pattern of constructing a national security state that disguises its character by lies, secrecy, and deception, thereby undermining trust between the government and the people, creating a crisis of legitimacy; it is part of the pattern of ‘dirty wars’ fought on a global battlefield comprehensively described in Jeremy Scahill’s book with that title;

    –the mounting challenge directed at President Obama to grant Manning’s request for a presidential pardon, and to reverse course with respect to the further authoritarian drift that has occurred during his time in the White House; ever since Obama’s Nobel Prize acceptance speech when he claimed American adherence to the rule of law, it has been evident that such a commitment does not extend to high level governmental violators at home (“too important to prosecute”) or to the sovereign rights of foreign countries within the gunsights of the Pentagon or the CIA or to the crimes of America’s closest allies; international law is reserved for the enemies of Washington, especially those who resist intervention and occupation, or those who dare to be whistle-blowers or truth-tellers in such a highly charged atmosphere that has prevailed since the 9/11 attacks; the opening of Manning’s statement below suggests the relevance of such a context to the evolution of his own moral and political consciousness;

    –read Bradley Manning’s statement and ask yourself whether this man belongs in prison for 35 years (even granting eligibility for parole in seven years), or even for a day; imagine the contrary signal sent to our citizenry and the world if Manning were to be awarded the Medal of Freedom! It is past time that we all heeded Thomas Jefferson’s urgent call for ‘the vigilance’ of the citizenry as indispensable to the maintenance of democracy.

    STATEMENT BY BRADLEY MANNING ON BEING SENTENCED

    The decisions that I made in 2010 were made out of a concern for my country and the world that we live in. Since the tragic events of 9/11, our country has been at war. We’ve been at war with an enemy that chooses not to meet us on any traditional battlefield, and due to this fact we’ve had to alter our methods of combating the risks posed to us and our way of life.

    I initially agreed with these methods and chose to volunteer to help defend my country. It was not until I was in Iraq and reading secret military reports on a daily basis that I started to question the morality of what we were doing. It was at this time I realized in our efforts to meet this risk posed to us by the enemy, we have forgotten our humanity. We consciously elected to devalue human life both in Iraq and Afghanistan. When we engaged those that we perceived were the enemy, we sometimes killed innocent civilians. Whenever we killed innocent civilians, instead of accepting responsibility for our conduct, we elected to hide behind the veil of national security and classified information in order to avoid any public accountability.

    In our zeal to kill the enemy, we internally debated the definition of torture. We held individuals at Guantanamo for years without due process. We inexplicably turned a blind eye to torture and executions by the Iraqi government. And we stomached countless other acts in the name of our war on terror.

    Patriotism is often the cry extolled when morally questionable acts are advocated by those in power. When these cries of patriotism drown our any logically based intentions [unclear], it is usually an American soldier that is ordered to carry out some ill-conceived mission.

    Our nation has had similar dark moments for the virtues of democracy—the Japanese-American internment camps to name a few. I am confident that many of our actions since 9/11 will one day be viewed in a similar light.

    As the late Howard Zinn once said, “There is not a flag large enough to cover the shame of killing innocent people.”

    I understand that my actions violated the law, and I regret if my actions hurt anyone or harmed the United States. It was never my intention to hurt anyone. I only wanted to help people. When I chose to disclose classified information, I did so out of a love for my country and a sense of duty to others.

    If you deny my request for a pardon, I will serve my time knowing that sometimes you have to pay a heavy price to live in a free society. I will gladly pay that price if it means we could have country that is truly conceived in liberty and dedicated to the proposition that all women and men are created equal.

    STATEMENT OF THE CENTER FOR CONSTITUTIONAL RIGHTS

    August 21, 2013 – Today, in response to the sentencing of Pfc. Bradley Manning, the Center for Constitutional Rights issued the following statement.

    We are outraged that a whistleblower and a patriot has been sentenced on a conviction under the Espionage Act. The government has stretched this archaic and discredited law to send an unmistakable warning to potential whistleblowers and journalists willing to publish their information. We can only hope that Manning’s courage will continue to inspire others who witness state crimes to speak up.

    This show trial was a frontal assault on the First Amendment, from the way the prosecution twisted Manning’s actions to blur the distinction between whistleblowing and spying to the government’s tireless efforts to obstruct media coverage of the proceedings. It is a travesty of justice that Manning, who helped bring to light the criminality of U.S. forces in Iraq and Afghanistan, is being punished while the alleged perpetrators of the crimes he exposed are not even investigated.  Every aspect of this case sets a dangerous precedent for future prosecutions of whistleblowers – who play an essential role in democratic government by telling us the truth about government wrongdoing – and we fear for the future of our country in the wake of this case.

    We must channel our outrage and continue building political pressure for Manning’s freedom. President Obama should pardon Bradley Manning, and if he refuses, a presidential pardon must be an election issue in 2016.

  • The Iraq War: 10 Years Later

    After a decade of combat, casualties, massive displacement, persisting violence, enhanced sectarian tension and violence between Shi’ias and Sunnis, periodic suicide bombings, and autocratic governance, a negative assessment of the Iraq War as a strategic move by the United States, United Kingdom, and a few of their secondary allies, including Japan, seems near universal. Not only the regionally destabilizing outcome, including the blowback effect of perversely adding weight to Iran’s overall diplomatic influence, but the reputational costs in the Middle East associated with an imprudent, destructive, and failed military intervention make the Iraq War the worst American foreign policy disaster since its defeat in Vietnam in the 1970s, and undertaken with an even less persuasive legal, moral, and political rationale.

    Most geopolitical accounting assessments do not bother to consider the damage to the United Nations and international law arising from an aggressive use of force in flagrant violation of the UN Charter, embarked upon in the face of a refusal by the Security Council to provide a legitimating authorization for the use of force despite great pressure mounted by the United States. The UN further harmed its own image when it failed to reinforce its refusal to grant authorization to the United States and its coalition, by offering some kind of support to Iraq as the target of this contemplated aggression. This failure was compounded by the post-attack role played by the UN in lending full support to the unlawful American-led occupation, including its state-building mission. In other words, not only was the Iraq War a disaster from the perspective of American and British foreign policy and the peace and stability of the Middle East region, but it was also a severe setback for the authority of international law, the independence of the UN, and the quality of world order.

    In the aftermath of the Vietnam War, the United States was supposedly burdened by what policymakers derisively called ‘the Vietnam Syndrome.’ This was a Washington shorthand for the psychological inhibitions to engage in military interventions in the non-Western world due to the negative attitudes towards such imperial undertakings that were supposed to exist among the American public and in the government, especially among the military who were widely blamed for the Vietnam disaster. Many American militarists at the time complained that the Vietnam Syndrome was a combined result of an anti-war plot engineered by the liberal media and a response to an unpopular conscription or ‘draft’ that required many middle class Americans to fight in a distant war that lacked both popular support, a convincing strategic or legal rationale, and seemed to be on the wrong side of history, which as the French found out in their own Indochina War favored anti-colonial wars of liberation. The flag-draped coffins of dead young Americans were shown on TV, leading defense hawks to contend somewhat ridiculously that ‘the war was lost in American living rooms.’ The government made adjustments that took these rationalizations serious: the draft was abolished, and reliance  henceforth was placed on an all-volunteer professional military complemented by large-scale private security firms; also, intensified efforts were made to assure media support for subsequent military operations by ‘embedding’ journalists in combat units and more carefully monitoring news reporting.

    President, George H.W. Bush told the world in 1991 immediately after the Gulf War that had been successfully undertaken to reverse the Iraqi annexation of Kuwait that “we have finally kicked the Vietnam Syndrome.” In effect, the senior President Bush was saying to the grand strategists in the White House and Pentagon that the role of American military power was again available for use to do the work of empire around the world. What the Gulf War showed was that on a conventional battlefield, in this setting of a desert war, American military superiority would be decisive, could produce a quick victory with minimal costs in American lives, and bring about a surge of political popularity at home. This new militarist enthusiasm created the political base for recourse to the NATO War in 1999 to wrest Kosovo from Serb control. To ensure the avoidance of casualties, reliance was placed on air attacks conducted from high altitudes. The war took more time than expected, but was interpreted as validating the claim of war planners that the United States could now fight and win ‘zero casualty wars.’ There were no NATO combat deaths in the Kosovo War, and the war produced a ‘victory’ by ending Serbian control over Kosovo as well as demonstrating that NATO could still be used and useful even after the Cold War and the disappearance of the Soviet threat that had explained the formation of the alliance in the first place.

    More sophisticated American war planners understood that not all challenges to United States interests around the world could be met with air power in the absence of ground combat. Increasingly, political violence involving geopolitical priorities took the form of transnational violence (as in the 9/11 attacks) or was situated within the boundaries of territorial states, and involved Western military intervention designed to crush societal forces of national resistance. The Bush presidency badly confused its new self-assurance about the conduct of battlefield international warfare where military superiority dictates the political outcome and its old nemesis from Vietnam War days of counter-insurgency warfare, also known as low-intensity or asymmetric warfare, where military superiority controls the battlefield but not the endgame of conflict which depends on winning the allegiance of the territorial population.

    David Petraeus rose through the ranks of the American military by repackaging counterinsurgency warfare in a post-Vietnam format relying upon an approach developed by noted guerrilla war expert David Galula, who contended that in the Vietnam War the fatal mistake was made of supposing that such a war would be determined 80% by combat battles in the jungles and paddy fields with the remaining 20% devoted to the capture of the ‘hearts and minds’ of the indigenous population. Galula argued that counterinsurgency wars could only be won if this formula was inverted.  This meant that 80% of future U.S. military interventions should be devoted to non-military aspects of societal wellbeing: restoring electricity, providing police protection for normal activity, building and staffing schools, improving sanitation and garbage removal, and providing health car and jobs.

    Afghanistan, and then Iraq, became the testing grounds for applying these nation-building lessons of Vietnam, only to reveal in the course of their lengthy, destructive and expensive failures that the wrong lessons had been learned by the militarists and their civilian counterparts. These conflicts were wars of national resistance, a continuation of the anti-colonial struggles against West-centric  domination, and regardless of whether the killing was complemented by sophisticated social and economic programs, it still involved a pronounced and deadly challenge by foreign interests to the national independence and rights of self-determination that entailed killing Iraqi women and children, and violating their most basic rights through the unavoidably harsh mechanics of foreign occupation. It also proved impossible to disentangle the planned 80% from the 20% as the hostility of the Iraqi people to their supposed American liberators demonstrated over and over again, especially as many Iraqis on the side of the occupiers proved to be corrupt and brutal, sparking popular suspicion and intensifying internal polarization. The truly ‘fatal mistake’ made by Petraeus, Galula, and all the counterinsurgency advocates that have followed this path, is the failure to recognize that when the American military and its allies attack and occupy a non-Western country, especially in the Islamic world, when they start dividing, killing and policing its inhabitants, popular resistance will be mobilized and hatred toward the foreign ‘liberators’ will spread. This is precisely what happened in Iraq, and the suicide bombings to this day suggest that the ugly patterns of violence have not stopped even with the ending of America’s direct combat role.

    The United States was guilty of a fundamental misunderstanding of the Iraq War displayed to the world when George W. Bush theatrically declared on May 1, 2003 a wildly premature victory from the deck of an American aircraft carrier USS Abraham Lincoln, with the notorious banner proclaiming ‘mission accomplished’ plainly visible behind the podium as the sun sank over the Pacific Ocean. Bush reveled in this misunderstanding by assuming that the attack phase of the war was the whole war, forgetting about the more difficult and protracted occupation phase. The real Iraq War, rather than ending, was about to begin, that is, the violent internal struggle for the political future of the country, one made more difficult and protracted by the military presence of the US and its allies. This counterinsurgency sequel to occupation would not be decided on the kind of battlefield where arrayed military capabilities confront one another, but rather through a war of attrition waged by hit and run domestic Iraqi forces, abetted by foreign volunteers, opposed to the tactics of Washington and to the overall aura of illegitimacy attached to American military operations in a Third World setting. Such a war has a shadowy beginning and a still uncertain ending, and is often, as in Iraq, as it proved to be earlier in Vietnam and Afghanistan, a quagmire for intervening powers. There are increasing reasons to believe that the current Iraqi leader, Nouri al-Maliki, resembles the authoritarian style of Saddam Hussein more than the supposed constitutional liberal regime that the United States pretends to leave behind, and that the country is headed for continuing struggle, possibly even a disastrous civil war fought along sectarian line. In many respects, including the deepening of the Sunni/Shi’a divide the country and its people are worse off that before the Iraq War without in any way questioning allegations about the cruelty and criminality of the regime headed by Saddam Hussein.

    The Iraq War was a war of aggression from its inception, being an unprovoked use of armed force against a sovereign state in a situation other than self-defense. The Nuremberg and Tokyo War Crimes Tribunals convened after World War II had declared such aggressive warfare to be a ‘crime against peace’ and prosecuted and punished surviving political and military leaders of Germany and Japan as war criminals. We can ask why have George W. Bush and Tony Blair not been investigated, indicted, and prosecuted for their roles in planning and prosecuting the Iraq War. As folk singer Bob Dylan instructed us long ago, the answer is ‘blowin’ in the wind,’ or in more straightforward language, the reasons for such impunity conferred upon the American and British leaders is one more crude display of geopolitics—their countries were not defeated and occupied, their governments never surrendered and discredited, and such strategic failures (or successes) are exempted from legal scrutiny. These are the double standards that make international criminal justice a reflection of power politics more than of evenhanded global justice.

    There is also the question of complicity of countries that supported the war with troop deployments, such as Japan, which dispatched 1000 members of its self-defense units to Iraq in July 2003 to help with non-combat dimensions of the occupation. Such a role is a clear breach of international law and morality. It is also inconsistent with Article 9 of the Japanese Constitution. It was coupled with Tokyo’s diplomatic support for the U.S./UK-led Iraq War from start to finish. Should such a record of involvement have any adverse consequences? It would seem that Japan might at least review the appropriateness of its complicit participation in a war of aggression, and how that diminishes the credibility of any Japanese claim to uphold the responsibilities of membership in the United Nations. At least, it provides the people of Japan with a moment for national soul-searching to think about what kind of world order will in the future best achieve peace, stability, and human dignity.

    Are there lessons to be drawn from the Iraq War? I believe there are. The overwhelming lesson is that in this historical period interventions by the West in the non-West, especially when not authorized by the UN Security Council, can rarely succeed in attaining their stated goals. More broadly, counterinsurgency warfare involving a core encounter between Western invading and occupying forces and a national resistance movement will not be decided on the basis of hard power military superiority, but rather by the dynamics of self-determination associated with the party that has the more credible nationalist credentials, which include the will to persist in the struggle for as long as it takes, and the capacity to capture the high moral ground in the ongoing legitimacy struggle for domestic and international public support. It is only when we witness the dismantling of many of America’s 700+ acknowledged foreign military bases spread around the world, and see the end of repeated US military intervention globally, that we can have some hope that the correct lessons of the Iraq War are finally being learned. Until then there will be further attempts by the U.S. Government to correct the tactical mistakes that it claims caused past failures in Iraq (and Afghanistan), and new interventions will undoubtedly be proposed in coming years, most probably leading to costly new failures, and further controversies as to ‘why?’ we fought and why we lost. American leaders will remain unlikely to acknowledge that the most basic mistake is itself militarism and the accompanying arrogance of occupation, at least until this establishment consensus is challenged by a robust anti-militarist grassroots political movement not currently visible.

  • Envisioning a World Without Nuclear Weapons

    Book Review

    ZERO: THE CASE FOR NUCLEAR WEAPONS ABOLITION by David Krieger (published in 2013 by the Nuclear Age Peace Foundation); $14.95

    I have known David Krieger for the past twenty-five years, and he has never wavered, even for a day, from his lifelong journey dedicated to ridding the world of nuclear weapons and the threat of nuclear war. If I were given to categorization, I would label such an extraordinary engagement with a  cause as an instance of ‘benign fanaticism.’ Unfortunately, from the perspective of the human future, it is a condition rarely encountered, posing the puzzle as to why Krieger should be so intensely inclined, given his seemingly untraumatized background. He traces his own obsession back to his mother’s principled refusal to install a nuclear bomb shelter in the backyard of their Los Angeles home when he was 12 years old. He comments in the Preface to ZERO that even at the time he “hadn’t expected” her to take such a stand, which he experienced as “a powerful lesson in compassion,” being especially moved by her unwillingness “to buy into saving herself at the expense of humanity.” (xiv). Nine years later after Krieger graduated from college his mother was again an instrumental force, giving him as a graduation present a trip to Japan to witness first-hand “what two nuclear weapons had done to the cities of Hiroshima and Nagasaki.” (xiv) The rest is, as they say, ‘history.’ Or as Krieger puts it in characteristic understatement, “[t]hose visits changed my life.” (xiv)

    On a psychological level, I remain perplexed by two opposite observations: we still lack the key that unlocks the mystery of Krieger’s unwavering dedication and why so few others have been similarly touched over the years. What ZERO does better than any of Krieger’s earlier books on nuclear weapons, and indeed more comprehensively and lucidly than anyone else anywhere, is to provide the reader with the reasons for thinking, feeling, and acting with comparable passion until the goal of abolishing the totality of nuclear weaponry is finally reached. Krieger himself extensively explores and laments the absence of widespread anti-nuclear dedication and tries to explain it by calling attention to a series of factors: ignorance, complacency, deference to authority, sense of powerlessness, fear, economic advantage, conformity, marginalization, technological optimism, tyranny of experts. (90-92) The argument of the book, concisely developed in a series of short essays is reinforced by some canonical documents in the struggle over the decades to rid the world of nuclear weaponry, including Obama’s Prague Speech of 2009, the Einstein/Russell Manifesto of 1955, and Joseph Rotblat’s Nobel Prize Acceptance Speech of 1995.

    Krieger’s approach as an author is multi-layered, and includes analytic critiques of conventional strategic wisdom that finds a security role for nuclear weapons, a worked out conception of how a negotiated international treaty could safely by stages move the world toward the zero goal of abolition, poems that seek to recapture the various existential horrors of nuclear war, essays of appreciation for the courage, commitment, and insight of the hibakusha (Japanese survivors of the 1945 atomic attacks), and a concerted inquiry into what needs to happen to make nuclear disarmament a viable political project rather than nothing more than a fervent hope. For a short book of 166 pages this is a lot of ground to cover, but Krieger manages to do it with clarity, a calm demeanor, and an impressive understanding and knowledge of all aspects of this complex question of how best to deal with nuclear weapons given the realities of the early 21st century.

    Krieger is not afraid to take on critics, even those who tell him that his quest is ‘silly’ because the nuclear genie, a favorite metaphor of liberal apologists for the status quo, is out of the bottle, and cannot be put back. Krieger acknowledges that the knowledge is now in the public domain, and cannot be eliminated, but makes a measured and informed case for an assessment that the nuclear disarmament process poses far fewer risks than does retaining the weaponry, and that retaining the weaponry exposes humanity to what he believes to be the near certainty that nuclear weapons will be used in the future with likely apocalyptic results. For Krieger the stakes are ultimate: human survival and the rights of future generations. In other words, given his strongly held opinion that the weaponry will be used at some point in the future with disastrous results, there is for him no ethically, politically, and even biologically acceptable alternative to getting rid totally of nuclear weapons. Krieger argues both from a worldview that regards nuclear weapons as intrinsically wrong because of the kind of suffering and devastation that they cause and consequentially because of their threat to civilization and even species survival.

    Ever since I have known David Krieger he has been deeply influenced by Albert Einstein’s most forceful assertion: “The unleashed power of the atom has changed everything save our modes of thinking, and thus we drift toward unparalleled catastrophe.” Krieger even gifts his readers with an imagined dialogue between Einstein and the most celebrated interrogator of all time, Socrates. In their exchange, Socrates is convinced by Einstein that the necessary adjustments “won’t come from our leaders.”(85) Socrates gets the point in a manner that unsurprisingly resonates with Krieger: “Then the people must be awakened, and they must demand an end to war, and a world free of nuclear weapons.” (85) There is a certain ambiguity in this statement when placed in the larger context of Krieger’s thought and work: is it necessary to end war as a social institution in order to get rid of nuclear weapons? In one way, most of Krieger’s efforts seem to separate nuclear weapons from the wider context of war making, but from time to time, there is a fusion of these two agendas.

    Krieger realizes that changing our modes of thinking is a necessary step toward zero but it is not sufficient. He also believes that we cannot achieve a world without nuclear weapons unless we act “collectively and globally” (97) to create a sustainable future. In the end, there is some ground for hope: “We have the potential to assert a constructive power for change that is greater than the destructive power of the weapons themselves.”  In effect, Krieger is telling us that what we can imagine we can achieve, but not without an unprecedented popular mobilization of peace minded people throughout the entire planet. Above all, Krieger wants to avoid a counsel of despair: “We must choose hope and find a way to fight for the dream of peace and the elimination of nuclear weapons. Achieving these goals is the great challenge of our time, on their success rests the realization of all other goals and for a more and decent world.” (105). Certainly Krieger has founded and brilliantly administered the Nuclear Age Peace Foundation over the course of more than 25 years maintaining faith of its growing band of followers with this uplifting vision. Such single mindedness is probably essential to motivate people of good will to support the endeavor, and to keep his own compass fixed over time, even in the face of many discouragements, on the destination he has identified as the one sanctuary capable of ensuring a desirable future for humanity. Although sharing all of Krieger’s assessments, values, and visions, I am both less hopeful and not as focused, being committed to other indispensable policy imperatives (addressing the global challenge of climate change) and to more proximate ends that involve current injustices (seeking realization of the inalienable rights of the Palestinian people; seeking a UN Emergency Peace Force to intervene to protect vulnerable people facing humanitarian or natural catastrophes), but I would not for a minute encourage Krieger to dilute his anti-nuclear posture. This country and the world needs his message and dedication, and at some point, there may emerge a conjuncture of forces that is unexpectedly receptive to the vision of a world without nuclear weapons and even entertains the prospect of ending the war system as the foundation of national and global security. I can only pray that it will not emerge in the aftermath of some intended or accidental use of nuclear weapons, which seems sadly to be the only alarm bell that is loud enough to have an awakening effect for the sleeping mass of humanity.

    From my vantage point such an anti-nuclear moment is not yet visible on the horizon of possibilities. After all, the Kissinger, Shultz, Nunn, and Perry call a few years ago for abolition, emanating from these high priests of political realism, despite being widely noticed at the time, had no lasting impact on the pro-nuclear consensus that guides the policymaking elites of the nine nuclear weapons states, and most of all the American establishment. And then Barack Obama’s 2009 call in Prague for a world without nuclear weapons, although qualified and conditional, was essentially abandoned even in the recent articulation of the president’s goals for his second term. Presumably, Obama’s advisory entourage pushed him to concentrate his energy on attainable goals such as immigration and tax reform, protecting entitlements, and retreating from the several fiscal cliffs, and not waste his limited political capital on the unattainable such as nuclear disarmament and a just peace between Israel and Palestine. Short-term political calculations within the Beltway almost always trump long-term visionary goals, “and so it goes,” as Kurt Vonnegut taught us to say in our helplessness in the face of the unyielding cruelty of human experience.

    In the end, after this adventure of response to the life and work of a dear friend, admired collaborator, and inspirational worker for peace and justice, I can only commend David Krieger’s ZERO to everyone with the slightest interest in what kind of future we are bestowing upon our children and grandchildren.   • Kenneth Waltz is not Crazy, but he is Dangerous: Nuclear Weapons in the Middle East

    Richard FalkIt seems surprising that the ultra-establishment journal, Foreign Affairs, would go to the extreme of publishing a lead article by the noted political scientist, Kenneth Waltz, with the title “Why Iran Should Get the Bomb” in its current issue. It is more the reasoning of the article than the eye-catching title that flies in the face of the anti-proliferation ethos that has been the consensus lynchpin of nuclear weapons states, and especially the United States. At the same time, Waltz takes pain to avoid disavowing his mainstream political identity. He echoes without pausing to reflect upon the evidence undergirding the rather wobbly escalating assumption that Iran is seeking nuclear weapons at this time. Waltz does acknowledge that Iran might be only trying to have a ‘breakout’ capability of the sort long possessed by Japan and several other countries, that is, the technological capacity if facing a national emergency to assemble a few bombs in a matter of months. Nowhere does Waltz allude to the recently publicized agreement among the 14 American intelligence agencies that there is no evidence that Iran has decided to resume its military program that had been reportedly abandoned in 2003. In other ways, as well, Waltz signals his general support for the American approach to Israeli security other than in relation to nuclear weapons, and so, it should be clear, Waltz is not a political dissenter, a policy radical, nor even a critic of Israel’s role in the region.


    Waltz’s Three Options


    Waltz insists that aside from the breakout option, there are two other plausible scenarios worth considering: sanctions and coercive diplomacy to induce Iran “to abandon its pursuit of nuclear weapons,” which he deems unlikely to overcome a genuine appetite for the bomb, or Iran defies the pressures and acquires nuclear weapons, which he regards as the most desirable of the three options. It seems reasonable to wonder ‘why.’ In essence, Waltz is arguing that experience and logic demonstrate that the relations among states become more stable, less war-prone, when a balance is maintained, and that there is no reason to think that if Iran acquired nuclear weapons it would not behave in accordance with the deterrence regime that has discouraged all uses of nuclear weapons ever since 1945, and especially during the Cold War confrontation between the United States and the Soviet Union. In this regard, Waltz is expressing what I regard to be a wildly exaggerated faith in the rationality and prudence of leaders who make decisions on matters of war and peace.


    He does make a contextual argument that I mostly agree with, namely, that Israel alone possessing a regional nuclear monopoly is more dangerous and undesirable than Iran becoming a second nuclear weapons state in the region. In effect, a regional nuclear monopolist is worse than a regional system of balance that incorporates deterrence logic. For Israel to be deterred would contribute to peace and security in the region, and this seems likely to reduce somewhat, although at a level of risk far short of zero, the prospect of any use of nuclear weapons and other forms of aggression in the Middle East. But to say that A (Iran gets the bomb) is better than B (breakout capability but no bomb) and C (sanctions and coercive diplomacy induce Iran to forego bomb) is to forget about D, which is far better than A, B, and C in relation to sustainable stability, but also because it represents an implicit acknowledgement that the very idea of basing security upon the threat to annihilate hundreds of thousand, if not more, innocent persons is a moral abomination that has already implicated the nuclear weapons states in a security policy, which if ever tested by threat and use, would be genocidal, if not omnicidal, and certainly criminal. This anti-nuclear posture was substantially endorsed by a majority of judges in a groundbreaking Advisory Opinion of the International Court of Justice on 8 July 1996, although these strong findings as to international law were, not surprisingly, cast aside and ignored by the nuclear weapons states, most defiantly by the United States.


    The Case for Option D


    What then is Option D? Option D would involve the negotiation and implementation of a nuclear weapons free zone throughout the Middle East (MENFZ), reinforced by non-aggression commitments, normalization of economic and political relations, and ideally accompanied by genuine progress toward a just and sustainable Palestine/Israel peace accord. Significantly, Waltz does not even pause to consider it as in all likelihood he regards such an approach as completely inconsistent with the hard power realities of global diplomacy, making it foolish and irrelevant to take the possibility of a MENFZ seriously. Needless to say, D is also not in the Netanyahu playbook, and quite likely no future Israeli leader will be prepared to give up the nuclear weapons arsenal that Israel has been consistently acquiring and developing over the last four decades. And it seems fair to conjecture that anyone who proposes a MENFZ would be at odds with the realist camp in international relations, and such a piece would almost certainly be rejected by the editors of Foreign Affairs, among the most ardent guardians of the realist status quo.


    Waltz’s preference for A, favoring an Iranian bomb, is an extension of his long-standing belief that proliferation as actually desirable based on a view of global security that depends on sustaining power balances. In my judgment this carries confidence in the logic of deterrence (that is, the rationality of not using the bomb because of a fear of nuclear retaliation) to absurd degrees that go well beyond even the extreme rationality relied upon by the most influential war thinkers during the Cold War era. In this sense, Waltz is correct to equate the Middle East with the rest of the world, and not engage in the widespread practice of ethno-religious profiling: that is, Israel’s bomb is okay because it is a rational and ‘Western,’ while Iran’s bomb would be a world order disaster as it is irrational and governed by Islamic zealots that have declared their implacable hostility to Israel. If such distinctions are to be made, which is doubtful, it should be appreciated that Israel is the antagonist that has been threatening war and pushing for coercive diplomacy, while it is Iran that has so far peacefully tolerated a variety of severe provocations, acts of war, such as the assassination of several of its nuclear scientists, the infecting of its enrichment centrifuges with the Stuxnet virus, and verified violent covert acts designed to destabilize the Tehran regime. Had such incidents been reversed, it is more than 100% likely that Israel would have immediately gone to war against Iran, quite likely setting the entire region on fire.


    Objections to Option A


    My basic objection to the Waltz position is a disagreement with two of his guiding assumptions: first, with respect to the region, that other countries would not follow Iran across the nuclear threshold, an assessment he bases largely on their failure to acquire nuclear weapons in response to Israel’s acquisition of the capability. Surely Saudi Arabia and Turkey would not, for reasons of international status and perceived security, want to be non-nuclear states in a neighborhood in which both Israel and Iran had the bomb. Such an expansion of the regional nuclear club would become more prone to accident, miscalculation, and the sort of social and political pathology that makes nuclear weaponry generally unfit for human use in a conflict, whatever the region or occasion. In this respect, the more governments possess the bomb, the more likely it becomes that one of those horrible scenarios about a nuclear war will become history.


    And secondly, Waltz does not single out nuclear weapons for condemnation on either ethical or prudential grounds. In fact, he seems to hold the view that we can be thankful for the bomb as otherwise the Cold War would likely have resulted in a catastrophic World War III. In my view to have sought the bomb and then used it against the helpless Japanese at the end of World War II was certainly one of the worst instances of Promethean excess in human history, angering not only the gods but exhibiting a scary species death wish. Leaders have acknowledged this moral truth from time to time, most recently by Barack Obama in his 2009 Prague speech calling for a world without nuclear weapons, but politicians, including Obama, seem unable and unwilling to take the heat that following through would certainly entail. In the end, anti-nuclearism for leaders seems mainly an exercise in rhetoric, apparently persuasive in Norway where the Nobel Prize committee annually ponders the credentials of candidates, but without any behavioral consequences relating to the weaponry itself.  To be sure nuclear policies are challenged from time to time by a surge of anti-nuclear populism. In this regard, to favor the acquisition of the bomb by any government or political organization is to embrace the nuclearist fallacy relating to security and the absurd hubris of presupposing an impeccable rationality over long stretches of time, which has never been the case in human affairs.


    The secrecy surrounding policy bearing on nuclear weapons, especially the occasions of their possible use, also injects an absolutist virus into the vital organs of a democratic body politic. There is no participation by the people or even their representatives in relation to this most ultimate of political decisions, vesting in a single person, and perhaps including his most intimate advisors, a demonic capability to unleash such a catastrophic capability. We now know that even beyond the devastation and radiation, the smoke released by the use of as few as 50 nuclear bombs would generate so much smoke as to block sunlight from the earth for as long as a decade, dooming much of the agriculture throughout the world, a dynamic that has been called ‘a nuclear famine.’ As disturbing as such a possibility should be to those responsible for the security of society, there is little evidence that such a realization of the secondary effects of nuclear explosions is even present in political consciousness. And certainly the citizenry is largely ignorant of such a dark eventuality bound up with the retention of nuclear weapons.


    It is for these reasons that I would call Kenneth Waltz dangerous, not crazy. Indeed, it is his extreme kind of instrumental rationality that is dominant in many influential venues, and helps explain the development, possession, and apparent readiness to use nuclear weapons under certain conditions despite the risks and the immorality of the undertaking. If human society is ever to be again relatively safe, secure, and morally coherent, a first step is to renounce nuclear weapons unconditionally and proceed with urgency by way of an agreed, phased, monitored, and verified international agreement to ensure their elimination from the face of the earth. It is not only that deterrence depends on perfect rationality over time and across space, it is also that the doctrine and practices of deterrence amounts to a continuing crime against humanity of unprecedented magnitude and clarity!   

  • Nuclear Weapons as Instruments of Peace?

    Richard FalkA few days ago I was a participant in a well-attended academic panel on ‘the decline of violence and warfare’ at the International Studies Association’s Annual Meeting held this year in San Diego, California. The two-part panel featured appraisal of the common argument of two prominent recent publications: Steven Pinker’s best-selling The Better Angels of our Nature: Why Violence has Declined and Joshua Goldstein’s well-researched, informative, and provocative Winning the War on War: The Decline of Armed Conflict Worldwide. Both books are disposed to rely upon quantitative data to back up their optimistic assessments of international and domestic political behavior, which if persuasive, offer humanity important reasons to be hopeful about the future. Much of their argument depends on an acceptance of their interpretation of battlefield deaths worldwide, which according to their assessments have declined dramatically in recent decades. But do battlefield deaths tell the whole story, or even the real story, about the role and dangers of political violence and war in our collective lives?


    My role was to be a member of the Goldstein half of the panel. Although I had never previously met Joshua Goldstein I was familiar with his work and reputation as a well regarded scholar in the field of international relations.  To offer my response in the few minutes available to me I relied on a metaphor that drew a distinction between a ‘picture’ and its ‘frame.’ I found the picture of war and warfare presented by Goldstein as both persuasive and illuminating, conveying in authoritative detail information about the good work being doing by UN peacekeeping forces in a variety of conflict settings around the world, as well as a careful crediting of peace movements with a variety of contributions to conflict resolution and war avoidance. Perhaps, the most enduringly valuable part of the book is its critical debunking of prevalent myths about the supposedly rising proportion of civilian casualties in recent wars and inflated reports of casualties and sexual violence in the Congo Wars of 1998-2003. These distortions, corrected by Goldstein, have led to a false public perception that wars and warfare are growing more indiscriminate and brutal in recent years, while the most reliable evidence points in the opposite direction.


    Goldstein is convincing in correcting such common mistakes about political violence and war in the contemporary world, but less so when it comes to the frame and framing of this picture that is conveyed by his title ‘winning the war on war’ and the arguments to this effect that is the centerpiece of his book, and accounts for the interest that it is arousing. For one thing the quantitative measures relied upon do not come to terms with the heightened qualitative risks of catastrophic warfare or the continued willingness of leading societies to anchor their security on credible threats to annihilate tens of millions of innocent persons, which if taking the form of a moderate scale nuclear exchange (less than 1% of the world’s stockpile of weapons) is likely to cause, according to reliable scientific analysis, what has been called ‘a nuclear famine’ resulting in a sharp drop in agricultural output that could last as long as ten years and could be brought about by the release of dense clouds of smoke blocking incoming sunlight.  <http://www.nucleardarkness.org/index2.php>


    Also on the panel were such influential international relations scholars as John Mearsheimer who shared with me the view that the evidence in Goldstein’s book did not establish that, as Mearsheimer put it, ‘war had been burned out of the system,’ or that even such a trend meaningfully could be inferred from recent experience. Mearsheimer widely known for his powerful realist critique of the Israeli Lobby (in collaboration with Stephen Walt) did make the important point that the United States suffers from ‘an addiction to war.’ Mearsheimer did not seem responsive to my insistence on the panel that part of this American addiction to war arose from role being played by entrenched domestic militarism a byproduct of the permanent war economy that disposed policy makers and politicians in Washington to treat most security issues as worthy of resolution only by considering the options offered by thinking within militarist box of violence and sanctions, a viewpoint utterly resistant to learning from past militarist failures (as in Vietnam, Iraq, Afghanistan, and now Iran). In my view the war addiction is real, but can only be treated significantly if understood to be a consequence of this blinkering of policy choice by a militarized bureaucracy in nation’s capital that is daily reinforced by a compliant media and a misguided hard power realist worldview sustained by high paid private sector lobbyists and the lure of corporate profits, and continuously rationalized by well funded subsidized think tanks such as The Hoover Institution, The Heritage Foundation, and The American Enterprise Institute. Dwight Eisenhower in his presidential farewell speech famously drew attention to the problem that has grown far worse through the years when he warned the country about ‘the military-industrial complex’ back in 1961.


    What to me was most shocking about the panel was not its overstated claims that political violence was declining and war on the brink of disappearing, but the unqualified endorsement of nuclear weapons as deserving credit for keeping the peace during Cold War and beyond. Nuclear weapons were portrayed as if generally positive contributors to establishing a peaceful and just world, provided only that they do not fall into unwanted hands (which means ‘adversaries of the West,’ or more colorfully phrased by George W. Bush as ‘the axis of evil’) as a result of proliferation. In this sense, although not made explicit in the conversation, Obama’s vision of a world without nuclear weapons set forth at Prague on April 5, 2009 seems irresponsible from the perspective of achieving a less war-prone world. I had been previously aware of Mearsheimer’s support for this position in his hyper-realist account of how World War III was avoided in the period between 1945-1989, but I was not prepared for Goldstein and the well regarded peace researcher, Andrew Mack, blandly to endorse such a conclusion without taking note of the drawbacks of such ‘a nuclear peace.’ Goldstein in his book writes on p.42, “[n]uclear deterrence may in fact help to explain why World War III did not occur during the Cold War—certainly an important accomplishment.” Goldstein does insist that this role of nuclear weapons has problematic aspects associated with some risk of unintended or accidental use and cannot by itself explain other dimensions of the decline of political violence, which rests on a broader set of developments that are usefully depicted elsewhere in the book. These qualifications are welcome but do not offset a seeming willingness to agree that nuclear weapons seemed partly responsible for the avoidance of World War III or the liberal internationalist view, perhaps most fully articulated by Joseph Nye, that an arms control approach is a sufficient indication that the threat posed by the possession and deployment of nuclear weaponry is being responsibly addressed.     Steven Pinker in his book takes a more nuanced position on nuclear weapons, arguing that if it were indeed correct to credit nuclear weapons with the avoidance of World War III, there would be grounds for serious concern. He correctly asserts that such a structure of peace would be “a fool’s paradise, because an accident, a miscommunication, or an air force general obsessed with precious bodily fluids could set off an apocalypse.”  Pinker goes on to conclude that “[t]hankfully, a closer look suggests that the threat of nuclear annihilation deserves little credit for the Long Peace.” (p.268) Instead, Pinker persuasively emphasizes the degree to which World War III was discouraged by memories of the devastation experienced in World War II combined with the realization that advances in conventional weaponry would make a major war among leading states far more deadly than any past war even if no nuclear weapons were used.


    Pinker also believes that a ‘nuclear taboo’ developed after World War II to inhibit recourse to nuclear weapons in all but the most extreme situations, and that this is the primary explanation of why the weapons were not used in a variety of combat settings during the 67 years that have passed since a single atomic bomb was dropped on Nagasaki. But Pinker does not raise deeply disturbing questions about the continued possession and threat to use such weaponry that is retained by a few of the world’s states. Or if the taboo was so strong, why this weaponry remains on hair trigger alert more than 20 years after the collapse of the Berlin Wall, and why on several occasions a threat to use nuclear weapons was used to discourage an adversary from taking certain actions. (see for instance, Steven Starr, “On the overwhelming urgency of de-alerting US & Russian missiles, http://ifyoulovethisplanet.org/?p=3358) And it the taboo was so valued, why did the United States fight so hard, it turns out unsuccessfully, to avoid having the International Court of Justice pronounce on the legality of nuclear weapons? (see ICJ Advisory Opinion, 8 July 1996; < http://www.icj-cij.org/docket/files/95/7495.pdf>) And why has the United States, along with some of the other nuclear weapons states, refused to declare ‘a no first use policy.’ The taboo exists, to be sure, but it is conditional and has been contested in times of international crisis, and its strength rests on the costs associated with any further use of nuclear weapons, including creating a precedent that might work against future interests.


    Most surprising than these comments on how the presence of nuclear weapons dissuaded the United States and the Soviet Union from going to war, was the failure of my co-panelists to surround their endorsement of the war-avoiding presence of nuclear weapons with moral and prudential qualifiers. At minimum, they might have acknowledged the costs and risks of tying strategic peace so closely to threatened mass devastation and civilizational, and perhaps species, catastrophe, a realization given sardonic recognition in the Cold War by the widely used acronym MAD (mutually assured destruction). The questions put by the audience also avoided this zone of acute moral and prudential insensitivity, revealing the limits of rational intelligence in addressing this most formidable challenge if social and political construction of a humane world order was recognized as a shared goal of decent people. It is unimaginable to reach any plateau of global justice without acting with resolve to rid the world of nuclear weaponry; the geopolitical ploy of shifting attention from disarmament to proliferation does not address the moral depravity of relying on genocidal capabilities and threats to uphold vital strategic interests of a West-centric world (Chinese nuclear weapons, and even those few possessed by North Korea, although dangerous and morally objectionable, at least seem acquired solely for defensive and deterrent purposes).


    I doubt very much that such a discussion of the decline of war and political violence could take place anywhere in the world other than North America, and possibly Western Europe and Japan. Of course, this does not by itself invalidate its central message, but it does raise questions about what is included and what is excluded in an Americans only debate (Mack is an Australian). Aside from the U.S. being addicted to war I heard no references in the course of the panel and discussion to the new hierarchies in the world being resurrected by indirect forms of violence and intervention after the collapse of colonialism, or of structural violence that shortens life by poverty, disease, and human insecurity. I cannot help but wonder whether some subtle corruption has seeped into the academy over the years, especially at elite universities whose faculty received invitations to work as prestigious consultants by the Washington security establishment, or in extreme cases, were hosts to lucrative arrangements that included giving weapons labs a university home and many faculty members a salary surge. Princeton, where I taught for 40 years, was in many respects during the Cold War an academic extension of the military-industrial complex, with humanists advising the CIA, a dean recruiting on behalf of the CIA, a branch of the Institute for Defense Analysis on campus doing secret contract work on counterinsurgency warfare, and a variety of activities grouped under the anodyne heading of ‘security studies’ being sponsored by outside financing. Perhaps, such connections did not spillover into the classroom or induce self-censorship in writing and lecturing, but this is difficult to assess.


    The significance of this professional discussion of nuclear weaponry in 2012, that is, long after the militarized atmosphere of the Cold War period has happily passed from the scene, can be summarized: To witness otherwise perceptive and morally motivated scholars succumbing to the demons of nuclearism is a bad omen; for me this nuclearist complacency is an unmistakable sign of cultural decadence that can only bring on disaster for the society, the species, and the world at some indeterminate future point. We cannot count on our geopolitical luck lasting forever! And we Americans, cannot possibly retain the dubious advantages of targeting the entire world with these weapons of mass destruction without experiencing the effects of a profound spiritual decline, which throughout human history, has always been the prelude to political decline, if not collapse.     Richard FalkIn his important article in the New York Times, March 17, 2012, James Risen summarized the consensus of the intelligence community as concluding that Iran abandoned its program to develop nuclear weapons in 2003, and that no persuasive evidence exists that it has departed from this decision. It might have been expected that such news based on the best evidence that billions spent to get the most reliable possible assessments of such sensitive security issues would produce a huge sigh of relief in Washington, but on the contrary it has been totally ignored, including by the highest officers in the government. The president has not even bothered to acknowledge this electrifying conclusion that should have put the brakes on what appears to be a slide toward a disastrous regional war. We must ask ‘why’ such a prudent and positive course of action has not been adopted, or at least explored.
     
    Given that the American debate proceeds on the basis of the exact opposite assumption– as if Iran’s quest for nuclear weapons is a virtual certainty.  This contrary finding that it is a high probability that iran gave up its quest of nuclear weapons almost a decade ago is quite startling. Listening to the Republican presidential candidates or even to President Obama makes it still seem as if Iran is without doubt hell bent on having nuclear weapons at the earliest possible time. With such a misleading approach the only question that seems worth asking is whether to rely on diplomacy backed by harsh sanctions to achieve the desired goal or that only an early attack to stop Iran from crossing the nuclear threshold.
     
    It seems perverse that this public debate on policy toward Iran should be framed in such a belligerent and seemingly wrongheaded manner. After all the United States was stampeded into a disastrous war against Iraq nine years ago on the basis of deceptive reports about its supposed stockpile of weapons of mass destruction, trumped up exile allegations, and media hype. I would have assumed that these bad memories would make Washington very cautious about drifting toward war with Iran, a far more dangerous enemy than Saddam Hussein’s Iraq. It would seem that at present the politicians are distrustful of reassuring intelligence reports and completely willing to go along with the intelligence community when it counsels war as ‘a slam dunk.’
     
    Reinforcing this skepticism about Iran’s nuclear intentions is a realistic assessment of the risk posed in the unlikely event that the intelligence community’s consensus is wrong, and Iran after all succeeds in acquiring nuclear weapons. As former heads of Mossad and others have pointed out the existential threat to Israel even then would still be extremely low. It would be obvious that Iran’s few bombs could never be used against Israel or elsewhere without producing an annihilating response. There is no evidence that Iran has any disposition to commit national suicide.
     
    There is a further troubling aspect of how this issue is being addressed. Even in the Risen article it is presumed that if the evidence existed that Iran possesses a nuclear weapons program, a military attack would be a permissible option. Such a presumption is based on the irrelevance of international law to a national decision to attack a sovereign state, and a silent endorsement of ‘aggressive war’ that had been criminalized back in 1945 as the principal conclusion of the Nuremberg Judgment.
     
    This dubious thinking has gone unchallenged in the media, in government pronouncements, and even in diplomatic posturing. We need to recall that at the end of World War II when the UN was established states agreed in the UN Charter to give up their military option except in clear instances of self-defense. To some extent over the years this prohibition has been eroded, but in the setting of Iran policy it has been all but abandoned without even the pressure of extenuating circumstances.
     
    Of course, it would be unfortunate if Iran acquires nuclear weapons given the instability of the region, and the general dangers associated with their spread. But no international law argument or precedent is available to justify attacking a sovereign state because it goes nuclear. After all, Israel became a stealth nuclear weapons state decades ago without a whimper of opposition from the West, and the same goes for India, Pakistan, and even North Korea’s acquisition of weapons produced only a muted response that soon dropped from sight.
     
    There are better policy options that are worth exploring, which uphold international law and have a good chance of leading to regional stability. The most obvious option is containment that worked for decades against an expansionist Soviet Union with a gigantic arsenal of nuclear weapons. A second option would be to establish a nuclear weapons free zone for the Middle East, an idea that has been around for years, and enjoys the endorsement of most governments in the region, including Iran. Israel might seem to have the most to lose by a nuclear free zone in the Middle East because it alone currently possesses nuclear weapons, but Israel would benefit immensely by the reduction in regional tensions and probable economic and diplomatic side benefits, particularly if accompanied by a more constructive approach to resolving the conflict with the Palestinian people. The most ambitious option, given political credibility by President Obama in his Prague speech of 2009 expressing a commitment to a world without nuclear weapons, would be to table a proposal for complete nuclear disarmament on a step-by-step basis. Each of these approaches seem far preferable to what is now planned, are prudent, accord with common sense, show respect for international law, a passion for the peaceful resolution of conflict, and at minimum deserve to be widely discussed and appraised.
     
    As it is there is no legal foundation in the Nonproliferation Treaty or elsewhere for the present reliance on threat diplomacy in dealing with Iran. These threats violate Article 2(4) of the UN Charter that wisely prohibits not only uses of force but also threats to use force. Iran diplomacy presents an odd case, as political real politik and international law clearly point away from the military option, and yet the winds of war are blowing ever harder. Perhaps even at this eleventh hour our political leaders can awake to realize anew that respect for international law provides the only practical foundation for a rational and sustainable foreign policy in the 21st century.

  • Afghanistan: The War Turns Pathological – Withdraw!

    The latest occupation crime in Afghanistan is a shooting spree on March 11 by a lone American soldier in the village of Balandi in the Panjwai District of Kandahar Province of Afghanistan. 16 Afghan civilians, including women and children, were shot in their homes in the middle of the night without any pretense of combat activity in the area. Such an atrocity is one more expression of a pathological reaction by one soldier to an incomprehensible military reality that seems to be driving crazy American military personnel on the ground in Afghanistan. The main criminal here is not the shooter, but the political leader who insists on continuing a mission in face of the evidence that it is turning its own citizens into pathological killers.


    American soldiers urinating on dead Taliban fighters, Koran burning, and countryside patrols whose members were convicted by an American military tribunal of killing Afghan civilians for sport or routinely invading the privacy of Afghan homes in the middle of the night: whatever the U.S. military commanders in Kabul might sincerely say in regret and Washington might repeat by way of formal apology has become essentially irrelevant.


    These so-called ‘incidents’ or ‘aberrations’ are nothing of the sort. These happenings are pathological reactions of men and women caught up in a death trap not of their making, an alien environment that collides lethally with their sense of normalcy and decency. Besides the desecration of foreign lands and their cultural identities, American political leaders have unforgivably for more than a decade placed young American’s in intolerable situations of risk, uncertainty, and enmity to wage essentially meaningless wars. Also signaling a kind of cultural implosion are recent studies documenting historically high suicide rates among the lower ranks of the American military.


    Senseless and morbid wars produce senseless and morbid behavior. Afghanistan, as Vietnam 40 years earlier, has become an atrocity-generating killing field where the ‘enemy’ is frequently indistinguishable from the ‘friend,’ and the battlefield is everywhere and nowhere. In Vietnam the White House finally speeded up the American exit when it became evident that soldiers were murdering their own officers, a pattern exhibiting ultimate alienation that became so widespread it give birth to a new word ‘fragging.’


    Whatever the defensive pretext in the immediacy of the post-9/11 attacks, the Afghanistan War was misconceived from its inception, although deceptively so. (to my lasting regret I supported the war initially as an instance of self-defense validated by the credible fear of future attacks emanating from Afghanistan) Air warfare was relied upon in 2002 to decimate the leadership ranks of Al Qaeda, but instead its top political and military commanders slipped across the border. Regime change in Kabul, with a leader flown in from Washington to help coordinate the foreign occupation of his country, reverted to an old counterinsurgency formula that had failed over and over again, but with the militarist mindset prevailing in the U.S. Government, failure was once again reinterpreted as an opportunity to do it right the next time! Despite the efficiency of the radical innovative tactic of target killing by drones, the latest form of state terror in Afghanistan yields an outcome that is no different from earlier defeats.


    What more needs to be said? It is long past time for the United States and its NATO allies to withdraw with all deliberate speed from Afghanistan rather than proceed on its present course: negotiating a long-term ‘memorandum of understanding’ that transfers the formalities of the occupation to the Afghans while leaving private American military contractors—mercenaries of the 21st century—as the outlaw governance structure of this war torn country after most combat forces withdraw by the end of 2014, although incredibly Washington and Kabul, despite the devastation and futility, are presently negotiating a ten-year arrangement to maintain an American military presence in the country, a dynamic that might be labeled ‘re-colonization by consent,’ a geopolitical malady of the early 21st century.


    As in Iraq, what has been ‘achieved’ in Afghanistan is the very opposite of the goals set by Pentagon planners and State Department diplomacy: the country is decimated rather than reconstructed, the regional balance shifts in favor of Iran, of Islamic extremism, and the United States is ever more widely feared and resented, solidifying its geopolitical role as the great malefactor of our era.


    America seems incapable of grasping the pathologies it has inflicted on its own citizenry, let alone the physical and psychological wreckage it leaves behind in the countries it attacks and occupies. The disgusting 2004 pictures of American soldiers getting their kicks from torturing and humiliating naked Iraqi prisoners at Abu Ghraib should have made clear once and for all to the leaders and the public that it was time to bring American troops home, and keep them there if we cared for their welfare.  Instead punishments were inflicted on these hapless young citizens who were both perpetrators and victims, and their commanders resumed their militarist misadventures as if nothing had happened except an unwelcome ‘leak’ (Donald Rumsfeld said as much) What this pattern of descretation exhibits is not only a criminal indifference to the wellbeing of ‘others’ but a shameful disregard of the welfare of our collective selves. The current bellicose Republican presidential candidates calling for attacks on Iran amounts to taking another giant step along the road that is taking American over the cliff. And the Obama presidency is only a half step behind, counseling patience, but itself indulging war-mongering, whether for its own sake or on behalf of Israel is unclear.


    President Obama recently was quoted as saying of Afghanistan “now is the time for us to transition.”  No, it isn’t. “Now is the time to leave.”  And not only for the sake of the Afghan people, and surely for that, but also for the benefit of the American people Obama was elected to serve.
