  • U.S. Military Action Undermines the Rule of Law

    When it was first announced by President Clinton that the United States would launch a military strike against Iraq, I wondered about the legality of this attack under international law. I carefully read President Clinton’s speech announcing the attack, and found a reference to a UN Security Council resolution that condemned Iraq’s defiance of the UN inspection team by a vote of 15 to zero. Upon review of the resolution, however, I found that it contained no authorization for the use of force against Iraq. Nor did any previous Security Council resolution, except for the 1991 resolution authorizing the removal of Iraqi forces from Kuwait, an issue clearly not relevant to the current situation.

    President Clinton announced that the purpose of the military action was “to attack Iraq’s nuclear, chemical and biological weapons and its military capacity to threaten its neighbors.” Clinton and his security advisors, who he announced were unanimous in their recommendation to attack, were responding to a report filed by Richard Butler, the head of the UN inspection team in Iraq.

    But this is what the Washington Post wrote about Butler’s report, “Butler’s conclusions were welcome in Washington, which helped orchestrate the terms of the Australian diplomat’s report. Sources in New York and Washington said Clinton officials played a direct role in shaping Butler’s text during multiple conversations with him Monday at secure facilities in the U.S. mission to the United Nations.”

    The article in the Washington Post also pointed out that a “companion report” by the International Atomic Energy Agency expressed “broad satisfaction with Iraq’s cooperation.”

    What this suggests is that there were reasonable differences of opinion about Iraq’s cooperation with the UN, and that there was improper collusion between Richard Butler, the head of the UN inspection team who is supposed to act in a neutral manner, and U.S. officials. If this is true, Butler was clearly acting in an improper manner and bears some of the responsibility for the military action against Iraq. If it is true, Kofi Annan should act immediately to fire Butler.

    President Clinton justified the attack as being necessary “to protect the national interest of the United States, and indeed the interests of people throughout the Middle East and around the world.” This justification raises many questions. What was the “national interest” that was being protected? How was it determined? Should any country have the right to attack another country in the name of national interest without proper authority under international law?

    The behavior of President Clinton and his “security team” sends the wrong message to the international community. It is a similar message to the one they sent when they attacked a pharmaceutical plant in Sudan, which they unconvincingly claimed was a chemical weapons factory.

    The message we are sending to the world is that we are the big boys on the block, and we are willing to throw our weight around regardless of the law. The Russian Duma referred to our attack in a nearly unanimous vote as “international terrorism.” This does not bode well for our future relations with the Russians.

    The Pakistani Parliament unanimously characterized the military action against Iraq as “an attaack on humanity and the Islamic world.” This does not bode well for our relations with other Islamic nations.

    Of the many consequences of our attack against Iraq, I believe the most serious is our undermining of the rule of law. For any use of force against Iraq, we should have had express authority from the UN Security Council, which in all of its resolutions on this matter indicated clearly that it would “remain actively seized of the matter.” By choosing not to do so, we once again demonstrated our willingness to defy international law for vague reasons of national interest.

    The bottom line is that our attack against Iraq was bullyism, and undermines international law. It did not serve the interests of the United States, nor of the world. Kofi Annan had it right when he said, “This is a sad day for the United Nations and for the world.”

  • Nuclear Weapons and Sustainability

    Nothing threatens sustainability more than nuclear weapons. And yet these weapons are rarely considered in discussions of sustainability, which tend to focus on resources and environmental degradation. The simple fact is that nuclear weapons are capable of destroying not only our most precious global resources and degrading our global environment, but of destroying civilization if not humanity itself. The possession and threat to use nuclear weapons also afflicts the souls and spirits of their possessors.

    Nuclear weapons are a holocaust waiting to occur, but this understanding is obscured by comforting though unprovable theories of deterrence. Decision makers and the public alike confuse deterrence with defense. In fact, deterrence is not defense. Deterrence is only a theory that an attack can be prevented by threatening to retaliate. It is a bad theory because deterrence cannot prevent attacks that occur by accident or miscalculation, nor attacks by terrorists or criminals who have no fixed place to retaliate against.

    National security “experts,” such as Henry Kissinger, who propound theories of deterrence, are the sorcerers of our time. The public is expected to be humble before the apparent wisdom of such self-absorbed theorists. Clearly, there has been a price to pay for accepting their rhetorical invocations in the name of national security. The price is the willingness to place in jeopardy our human future, and our own humanity.

    Nuclear weapons incinerate human beings and other forms of life on a massive scale. This lesson was not lost on the people of Japan, who experienced two attacks with atomic weapons. It was apparently lost, however, on those who used these weapons. The possessors of nuclear weapons, and particularly Americans and Russians, suffer the delusion that they are protected by these weapons.

    Obstacles to the elimination of nuclear weapons include official secrecy concerning nuclear policies, lack of public discourse on these policies, confusion and muddled thinking regarding deterrence by policy elites, and a lack of courage and imagination on the part of political leaders. All of these translate into a lack of political will to radically change nuclear policies and take bold steps toward the global elimination of nuclear weapons.

    Until the public demands the abolition of nuclear weapons, the world will remain hostage to these instruments of genocide residing in the hands of mere mortals. What will arouse the public from its stupor? This may be the most important question of our time. Moral and legal arguments have not prevailed. Arguments concerning the concentration of power and undermining of democracy have not succeeded. Not even arguments concerning the vulnerability of citizens of nuclear weapons states to others’ nuclear weapons have awakened the power of the people.

    We live at a critical time in human history, in which we share the responsibility to pass the future on intact to the generations to follow. On the shoulders of those of us now living has fallen the responsibility to end the nuclear weapons era, or to face the almost certain spread of nuclear weapons and the likely use again, by accident or design, of these instruments of genocide.

    Sustainability and a future free of nuclear weapons are inseparable. Anyone concerned with a sustainable future should embrace the abolition of nuclear weapons, and become a vocal and active advocate of this cause. Because nuclear weapons abolition affects the future as well as the present, this cause provides an important challenge to the youth of today, who are the inheritors of the future.

  • The Challenge Posed by India and Pakistan

    In a three-week period, India and Pakistan conducted nuclear tests, thus becoming new members of the nuclear weapons club. Their tests have brought forth broad, even jubilant, support among the Indian and Pakistani people. Following the Pakistani tests, one Pakistani clerk effused, “Pakistan is now a superpower.”

    It is not surprising that India and Pakistan would view nuclear weapons as a path to international security and prestige. The five original members of the nuclear weapons club – the U.S., UK, France, Russia, and China – have treated their possession of nuclear weapons this way for decades.

    The major problem is not that India and Pakistan have conducted nuclear tests. It is that they, like the other members of the nuclear weapons club, have indicated by their tests that they now choose to rely upon nuclear weapons to maintain their national security.

    The Indians and Pakistanis are doing no more – in fact, much less – than the United States and the former Soviet Union did throughout the Cold War in relying upon their nuclear arsenals for deterrence. The policy of nuclear deterrence – despite the end of the Cold War and ostensibly friendly relations – continues to be the official policy of the U.S. and Russia, as it is of the other nations in the nuclear weapons club.

    The nuclear weapons states claim that there has been no nuclear war because of their nuclear weapons rather than in spite of them. If deterrence is a viable theory, however, there should be no problem with it being adopted by all states, including India and Pakistan.

    Deterrence Is Only a Theory

    The truth is that deterrence is only a theory, and not one that is believed to work universally. If deterrence were in fact considered reliable, nuclear weapons proliferation should in theory be encouraged rather than opposed.

    I doubt if anyone believes that the Indian subcontinent is safer now that India and Pakistan have demonstrated their nuclear weapons capabilities. It is generally and rightly recognized that the region has become far more dangerous with this new capacity for nuclear annihilation.

    Imagine, for example, that the Indians decided to respond to the Pakistani threat by a pre-emptive first-strike to destroy Pakistan’s nuclear weapons and missile delivery systems. Should the Indians fail, the Pakistanis might respond with a nuclear attack. Even the fear of such pre-emptive action by the Indians might lead the Pakistanis to themselves launch a pre-emptive first-strike against India. There are many other possible scenarios that might lead to nuclear war.

    Just as the problem is not the nuclear weapons tests, but the policies that they represent, the danger is not limited to South Asia. By the Indian and Pakistani tests, we are reminded of the danger that exists from all nuclear weapons in the world – those in the hands of all nuclear weapons states. We are also reminded that nuclear weapons proliferation remains a serious threat to regional and global stability.

    There are not responsible and irresponsible nuclear weapons states. All are irresponsible because they base their national security on weapons which have the capacity to murder millions of innocent people.

    A Worst Case Scenario

    As a worst case scenario, and one that has been long understood, a large-scale nuclear exchange between the United States and Russia could result in ending human civilization, such as it is, and destroying the human species and most life on earth. Being willing to run this risk does not demonstrate a high level of responsibility – quite the opposite.

    The choice before us is whether to deal with India and Pakistan as an isolated regional problem, or whether to view their nuclear tests as a wake-up call to commence international negotiations to achieve a treaty to eliminate all nuclear weapons in the world.

    The first option is not viable. India and Pakistan will not reverse their course unless the other nuclear weapons states clearly demonstrate their commitment to achieving a world free of nuclear weapons. Following its tests, India issued a statement appealing for such a commitment in the form of a Nuclear Weapons Convention: “India calls on all nuclear weapons states and indeed the international community to join with it in opening early negotiations for a Nuclear Weapons Convention so that these weapons can be dealt with in a global, nondiscriminatory framework as other weapons of mass destruction have been, through the Biological Weapons Convention and the Chemical Weapons Convention.”

    Nuclear “Haves” and “Have-Nots”

    I have long maintained that a world with a small number of nuclear “haves” and a much larger number of nuclear “have-nots” is unstable and unrealistic. This instability has begun to manifest itself in a detrimental way through nuclear proliferation. We will continue in this direction unless the course is reversed by serious negotiations among the nuclear weapons states to eliminate all nuclear weapons in the world.

    The United States is capable of providing the leadership to attain a world free of nuclear weapons. The U.S., however, has shown no inclination to assert this leadership. In fact, U.S. policies under the current administration have all been directed toward maintaining the existing structure of nuclear “haves” and “have-nots”. This must change. It is our best hope for preventing a nuclear holocaust in the 21st century.

    One other possibility exists. It is for other nations of the world, without the U.S. but including other nuclear weapons states, to move forward on a treaty banning nuclear weapons in the way that the treaty to ban landmines was created without U.S. participation. Unless the U.S. steps forward as a leader on this issue, I would hope that other nations will proceed without us.

    At the edge of a new millennium, the nation state system is challenged on many fronts to solve global environmental and security problems. The greatest of these challenges is posed by weapons of man’s own creation, the most dangerous of which are nuclear weapons capable of destroying humankind. Will we meet this challenge? Are there leaders among us capable of picking up where Gorbachev left off that can lead the world to end the nuclear weapons era?

    Such leaders will have to pierce the illusions of security that have been created to manipulate the people, now including the people of India and Pakistan, into believing that nuclear weapons should be a source of national pride. Nuclear weapons are quite simply weapons of mass destruction, meaning mass murder, and should be viewed as a national disgrace. But where are the leaders to say this?

    Leadership from the People

    As in all great issues of social change, the leadership for a nuclear weapons free world will have to arise from the people. This grassroots leadership is already emerging from Abolition 2000, a global network working to eliminate nuclear weapons, which is now composed of nearly 1100 citizen action groups from around the world.

    The challenge posed to the world by the two new members of the nuclear weapons club is nothing less than creating a world free of nuclear weapons. It is a challenge of finding new means of achieving security and settling our differences without resorting to weapons of mass destruction.

  • Linus Pauling and the Spirit of Peace: A Tale of Two Petitions

    Linus Pauling was undoubtedly a great scientist. This is attested to by his Nobel Prize in chemistry and his many discoveries in this field. More important, from my perspective, he was also a great human being. He had an unflagging commitment to peace, which he expressed with intelligence and courage.

    I met Linus Pauling in April 1991, when he was presented with the Nuclear Age Peace Foundation’s Lifetime Achievement Award for Distinguished Peace Leadership. It was a wonderful occasion, at which we also presented the XIVth Dalai Lama with an award for Distinguished Peace Leadership.

    In April 1991 the Persian Gulf War had just ended, and Americans were in a particularly patriotic mood. Yellow ribbons abounded, and President Bush’s approval ratings were above 90 percent. In his acceptance speech, before an audience of more than 800 people, Dr. Pauling chose to address what had just happened in the Persian Gulf. He began with a syllogism:

    “To kill and maim people is immoral.
    War kills and maims people.
    War is immoral.”

    For Pauling it was that simple. On January 8th of that year he had taken out a quarter page ad in the New York Times with the heading, “Stop the Rush to War!” He paid for the ad himself. On January 18th, three days after the war began, he published another advertisement, this time in the Washington Post. It was an Open Letter to President Bush, and it contained the syllogism concluding that war is immoral. Again, Dr. Pauling paid for the ad himself.

    In his acceptance speech for our award, Pauling noted that in the military operations of the Persian Gulf War some 300,000 Iraqis had been killed while some 150 Americans had died. The ratio was 2,000 to one. He concluded from this that what happened in the Persian Gulf was not a war.

    “In a war,” he said, “you have opposing forces that fight and there are deaths on both sides and finally one side wins. In the old days perhaps this was a demonstration of the democratic process – the side with the biggest number of fighters won. This wasn’t a war. This you could call a massacre or slaughter, perhaps even murder.”

    Speaking Truth to Power

    Linus Pauling was extremely direct. He stated the truth as he saw it. He was honest and without concern that his views might be very unpopular. He spoke truth to power. He spoke truth whomever he addressed. He spoke truth in the face of overwhelming and irrational patriotic fervor.

    In 1955, Pauling was one of 11 prominent signers of the Russell-Einstein Manifesto. That document called for an end to war, and posed the problem of our powerful new weapons in this way: “Shall we put an end to the human race; or shall mankind renounce war?” The Manifesto concluded with this famous statement:

    “There lies before us, if we choose, continual progress in happiness, knowledge and wisdom. Shall we instead choose death, because we cannot forget our quarrels? We appeal, as human beings, to human beings; remember your humanity and forget the rest. If you can do so, the way lies open to a new Paradise; if you cannot, there lies before you the risk of universal death.”

    In 1958 Linus Pauling published a book entitled No More War! In this book he stated, “I believe that there will never again be a great world war, if only the people of the United States and of the rest of the world can be informed in time about the present world situation. I believe that there will never be a war in which the terrible nuclear weapons – atom bombs, hydrogen bombs, superbombs – are used. I believe that the development of these terrible weapons forces us to move into a new period in the history of the world, a period of peace and reason, when world problems are not solved by war or by force, but are solved by the application of man’s power of reason, in a way that does justice to all nations and that benefits all people.”

    The Scientists’ Petition To Stop Nuclear Testing

    Pauling described in that book the terrible consequences of nuclear war. He also described the spurious arguments of Edward Teller for a so-called “clean” nuclear bomb. He also described a petition which he had prepared and circulated to scientists calling for an international agreement to stop the testing of nuclear weapons. The petition stated:

    “We, the scientists whose names are signed below, urge that an international agreement to stop the testing of nuclear bombs be made now.

    “Each nuclear bomb test spreads an added burden of radioactive elements over every part of the world. Each added amount of radiation causes damage to the health of human beings all over the world and causes damage to the pool of human germ plasm such as to lead to an increase in the number of seriously defective children that will be born in future generations.

    “So long as these weapons are in the hands of only three powers an agreement for their control is feasible. If testing continues, and the possession of these weapons spreads to additional governments, the danger of outbreak of a cataclysmic nuclear war through reckless action of some irresponsible national leader will be greatly increased.

    “An international agreement to stop the testing of nuclear bombs now could serve as a first step toward a more general disarmament and the ultimate effective abolition of nuclear weapons, averting the possibility of a nuclear war that would be a catastrophe to all humanity.

    “We have in common with our fellow men a deep concern for the welfare of all human beings. As scientists we have knowledge of the dangers involved and therefore a special responsibility to make those dangers known. We deem it imperative that immediate action be taken to effect an international agreement to stop testing of all nuclear weapons.”

    The petition was originally prepared for American scientists, but soon it was being signed by scientists around the world. By early 1958 the petition had been signed by 9,235 scientists, including 36 Nobel Laureates. On January 15, 1958, Pauling presented the petition with these signatures to Dag Hammarskjold, the Secretary-General of the United Nations. Later the number of signatories of the petition grew to 11,021, representing 49 countries, and 37 Nobel Laureates. All of these signatures were collected on the initiative of Linus Pauling and his wife, Ava Helen, who played a very instrumental role in his life and his work for peace.

    Abolition of Nuclear Weapons

    As a result of Dr. Pauling’s efforts and those of others, a Partial Test Ban Treaty was achieved in 1963. This was far less than Pauling had worked for. The treaty banned nuclear testing in the atmosphere, the oceans, and outer space, but it allowed testing to continue underground. In reality, it was an environmental treaty rather than a disarmament treaty. The treaty ultimately stopped atmospheric nuclear testing, with all of its hazards for human health. It did not, however, stop the nuclear arms race, which continued unabated for the next 35 years and in certain respects continues today.

    Dr. Pauling’s petition called for the “ultimate effective abolition of nuclear weapons.” This great goal remains to be achieved, and it falls to us – all of us – to achieve it. This brings me to the tale of the second petition, a tale all of us can participate in completing.

    In August 1997 a few of us working on Abolition 2000, which is a global network to abolish nuclear weapons, met in Santa Barbara for a brainstorming session. We decided that we needed a vehicle to go directly to the people for the cause of nuclear weapons abolition. We developed a simple petition, with three main points:

    1. End the Nuclear Threat. End the nuclear threat by dealerting all nuclear weapons, withdrawing all nuclear weapons from foreign soil and international waters, separating warheads from delivery vehicles and disabling them, committing to unconditional no first use of nuclear weapons, and ceasing all nuclear weapons tests, including laboratory tests and “subcriticals.”

    2. Sign the Treaty. Sign a Nuclear Weapons Convention by the year 2000, agreeing to the elimination of all nuclear weapons within a timebound framework.

    3. Reallocate Resources. Reallocate resources to ensure a sustainable global future and to redress the environmental devastation and human suffering caused by nuclear weapons production and testing, which have been disproportionately borne by the world’s indigenous peoples.

    Abolition 2000 Petition, Gathering the Signatures

    A month later, I was in Japan to help commemorate the 40th anniversary of the call for the abolition of nuclear weapons issued by Josei Toda, the second president of Soka Gakkai. In speaking with an international youth group of Soka Gakkai International, I mentioned the Abolition 2000 petition and spoke of its three important points. To my great surprise, I received word the next month that the youth division of Soka Gakkai in the Hiroshima region had decided to gather signatures on this petition. They set their initial goal at one million signatures.

    About a month later, I learned that signatures were to be gathered throughout Japan and the goal was 5 million signatures. In the end, in just three months, from November 1997 to January 1998, over 13 million signatures were gathered in Japan. One out of every nine persons in Japan signed the petition.

    In April 1998 a representative sample of these signatures was presented in Geneva to Ambassador Wyzner, the chair of the 1998 preparatory committee meeting for the year 2000 Non-Proliferation Treaty Review Conference.

    The effort by the Soka Gakkai youth in Japan was highly commendable. I’m sure it would have been welcomed and applauded by both Josei Toda and Linus Pauling. But the effort must not stop there. We are continuing to gather signatures in other parts of the world, including the United States.

    In my view, it is the United States, more than any other country, that must change its position on the abolition of nuclear weapons. Until the United States becomes seriously involved in this effort, the effort cannot succeed. And I am convinced that the United States will not become the leader of this effort until the people of this country demand of their government that it do so.

    This is why this petition is so important, and why I enlist your help in reaching out to people all over this country to call for the phased elimination of all nuclear weapons. If we were to gather a number of signatures proportionate to our population as were gathered in Japan, we would need more than 25 million signatures. Can you imagine the power of presenting 25 million American signatures to the President and Congress? They would have to listen to us. They would have to act to achieve this end.

    Moral Countries Lead the Way

    Dr. Pauling concluded his speech at the Nuclear Age Peace Foundation by saying, “I hope that the Nuclear Age Peace Foundation will work in the effort to make the United States into a moral country that could lead the world into a future of morality, a future worthy of man’s intelligence.”

    We are trying to do this, and I ask you to join in the effort to make the United States a moral country that could lead the way in achieving “a future worthy of man’s intelligence.”

    To make the United States a moral country, we should take the following steps:

    1. End the nuclear threat, and work to abolish all nuclear weapons from Earth. Nothing could be more immoral than threatening to murder hundreds of millions of innocent people in the name of national security. Remember this: nuclear weapons incinerate people. They are instruments of genocide that no sane nor moral person would ever want to be faced with using. And yet, even now, more than eight years into the post-Cold War era, we continue to rely upon these weapons and our official policy states that we will do so for the indefinite future. At many international conferences connected with the Non-Proliferation Treaty that I have attended, it has been the representatives of the United States who have thrown up the greatest stumbling blocks to nuclear disarmament. If we are to have a moral country this must change.

    2. Support an Arms Trade Code of Conduct. Stop selling arms to dictators and countries that violate human rights. The United States has become the arms salesman to the world. We lead all other nations in the sale of armaments. If we are to be a moral country, we must cease this practice, and place strict limitations on the transfer of armaments to other nations.

    3. Reallocate resources from military purposes to supporting adequate nutrition, health care, shelter and education for all members of society. The United States is the undisputed world champion in military spending. We spend more than the next 13 highest spending countries combined. These include Russia, Japan, United Kingdom, France, Germany and China. We need to realize that security requires more than military power. It also requires meeting human needs. A moral nation can be judged by its compassion toward its poorest and least fortunate members.

    4. Abide by international law and work to strengthen it. On many occasions in our recent past we have chosen not to give our support to international law. We were in the minority of nations in opposing a global ban on landmines, although most of our allies supported this ban. We were again in the minority in opposing the creation of an International Criminal Court, although most of our allies supported the creation of this court – a court to hold individuals accountable for the worst violations of international law, the ones that we held the Nazi leaders accountable for at Nuremberg. Recently, we took it upon ourselves to bomb sites in Sudan and Afghanistan in retaliation for terrorist attacks rather than turning this matter over to the United Nations Security Council as we are required to do under international law. If we are to be a moral country, we cannot both fight terrorism and be terrorists ourselves.

    5. End all covert actions designed to destabilize or overthrow foreign governments. If we wish to see governments changed in other countries, we should speak out and give support to the opposition. We should not, however, be secretly providing arms, fomenting revolution, or attempting political assassinations. If we are to be a moral country, we cannot use immoral means to achieve what we believe are good ends.

    6. Work to resolve conflicts peacefully through negotiations, mediation, arbitration, and the International Court of Justice. There are many means to resolve conflicts short of violence, and to be a moral country we must support these means and use them. When a country is powerful militarily, as we are, there is a temptation to rely upon raw force rather than the power of the law. This temptation must be resisted.

    7. Apply our science and technology in constructive ways for the good of humanity rather than in destructive ways. Far too much of our government research and development budget goes into ever more sophisticated weaponry. Despite having agreed to the Comprehensive Test Ban Treaty, we are still conducting “subcritical” tests of nuclear weapons. In doing so, we violate the spirit, if not the letter, of the Treaty. If we are to be a moral country, we must shift our technological priorities to fighting infant mortality, combating disease, improving nutrition, eliminating pollution, and eradicating poverty.

    8. Be honest with the American people. Stop hiding information under the guise of national security. Pursue a policy of informed consent. Without honesty and full information from the officials we elect, we cannot make informed decisions about the kind of future we choose for ourselves, our children and grandchildren. If we are to have a moral country, we must have an honest and open government.

    There is, of course, more we must do to be a moral country, but these steps would set us on the right road. They are steps that I feel certain Linus Pauling would support with all his energy, and I encourage you to endorse them and work for them as well.

    In the concluding chapter of his book, Linus Pauling wrote: “I believe that there is a greater power in the world than the evil power of military force, of nuclear bombs – there is the power of good, of morality, of humanitarianism.” He also wrote: “I believe in the power of the human spirit.”

    There is no greater force than the power of the people when moved to action. The power of the people brought independence to India. It ended the war in Vietnam. It brought down the Berlin Wall. It ended the Cold War. It brought democracy to Eastern Europe and to Russia. It ended the Duvallier regime in Haiti, the Marcos regime in the Philippines, and the Suharto regime in Indonesia. It brought down the regime based on apartheid in South Africa, and brought forth a leader like Nelson Mandela who has lived with the spirit of forgiveness.

    If the American people are moved to action, we can create a moral country. Our first step must be to end the intolerable threat that nuclear weapons pose for humanity. We must complete the task that Linus Pauling and other peace leaders began more than four decades ago. We stand on the threshold of a new century. Let us commit ourselves to crossing this threshold with a treaty in place to eliminate all nuclear weapons.

    There is great power for both good and evil in the human spirit. Let us choose good, let us choose life, let us choose hope, let us choose peace. Let us work, as Linus Pauling did, to make our country “a moral country that could lead the world into a future of morality, a future worthy of man’s intelligence.” This was the challenge that Linus Pauling worked for during his life, and the legacy he has left to us.

  • Humanity at a Crossroads

    In response to the nuclear tests conducted by India and Pakistan, Henry Kissinger provided new insights into his “realist” view of rationality. Referring to Indian and Pakistani tests, he said: “They live in a rough neighborhood. They don’t think the number of bombs makes war more likely. In a perfectly rational world, you’d think more nuclear weapons makes war less likely.”Self-proclaimed “realists,” including Henry Kissinger, have argued that nuclear weapons cannot be eliminated. But these same realists have been responsible for creating and maintaining some basic nuclear fictions that have been with us for decades. The first of these, a legal fiction, was written into the Nuclear Non-Proliferation Treaty in 1968. This fiction said that the only states to be considered nuclear weapons states were those that had detonated a nuclear device prior to January 1, 1967; in other words, the only nuclear weapons states were the US, USSR, UK, France, and China.

    The fiction proclaimed by the “realists” was that only these five states were nuclear weapons states. Israel, India, and Pakistan, all widely understood to have nuclear weapons, were referred to as “threshold” states, meaning states with the capacity to develop nuclear weapons.

    Another fiction of the “realists” was that it would be possible to simultaneously promote the peaceful atom and prevent the proliferation of nuclear weapons. In fact, nuclear programs for supposedly peaceful purposes have served as the cover for efforts to develop nuclear weapons in Argentina, Brazil, India, Iran, Iraq, Israel, North Korea, South Africa and elsewhere. These efforts succeeded in India, Israel, South Africa, and possibly North Korea.

    With the nuclear tests carried out by India and Pakistan, it has become far more difficult to maintain these fictions. It cannot be denied that India and Pakistan are nuclear weapons states, regardless of the date set forth in the Non-Proliferation Treaty. Conducting nuclear weapons tests is a solid indicator that a state has nuclear weapons. And Israel, as has been adequately revealed, is a nuclear weapons state with or without tests.

    So where does this leave us? On one level, we are in an Alice in Wonderland world of “realists” who create fictions to serve their view of reality. On another level, most people in the world can now clearly see that the number of nuclear weapons states is growing.

    We have reached a crossroads. The choice before us is to continue to live in the world of make believe, as the “realists” would encourage us to do, or to work for an unequivocal commitment from all nuclear weapons states to eliminate their nuclear arsenals under strict and effective international controls.

    The unrealistic dream that the “realists” profess to believe in is that the nuclear weapons states can keep their arsenals forever without these weapons ever being used by accident or design. This view was implicitly criticized by the prestigious Canberra Commission on the Elimination of Nuclear Weapons, which stated in its 1996 report, “The proposition that nuclear weapons can be retained in perpetuity and never used – accidentally or by decision – defies credibility. The only complete defence is the elimination of nuclear weapons and assurance that they will never be produced again.”

    The good news is that the Indians have made clear that they would prefer a world with no nuclear weapons states, and that they are willing to work for this. The Chinese have also made this commitment. Leadership is lacking primarily from the three Western nuclear weapons states and Russia. It is in these countries that the so-called “realists” have maintained their grip on the national security apparatus.

    What is real for the twenty-first century is what we will make real. If we choose to continue to maintain the fiction that nuclear weapons provide for our security, this will be our reality right up until the time a nuclear weapon explodes in one of our major cities or until a nuclear war breaks out.

    On the other hand, if we choose to accept the reality that a nuclear weapons-free world is possible, we will take the necessary steps to achieve such a world. We will begin the good faith negotiations for nuclear disarmament promised in the Non-Proliferation Treaty. We will negotiate a plan for the phased elimination of all nuclear weapons on Earth, and we will begin “systematic and progressive efforts” to implement this plan.

    Moving ahead to achieve this new reality are eight nations, led by Ireland, calling themselves the New Agenda Coalition. They have urged us to enter the third millennium with an unequivocal commitment in place to achieve total nuclear disarmament. The call of the New Agenda Coalition is in line with the goal of the more than 1100 citizen organizations around the world supporting the Abolition 2000 Global Network’s goal of a treaty banning nuclear weapons by the year 2000.

    There is no doubt that this path is the one that humanity must choose to assure its future. The choice should be easier now that the fictions of so-called “realists” have been exploded along with the detonations by India and Pakistan.

  • The Legal Case for Nuclear Weapons Abolition

    The legal case for abolishing nuclear weapons is only one of many that can and should be made. Nuclear weapons place the future of humanity, indeed of all life, in jeopardy. They are not even weapons in any traditional sense. They kill indiscriminately. They cause unnecessary suffering that affects present and future generations. They have no legitimate use in warfare. They are instruments of genocide that no sane person or society would contemplate using.

    The questions that I will address are these: Is the threat or use of nuclear weapons illegal under international law? Is the United States under a legal obligation to eliminate its nuclear arsenal? The answer to both questions is Yes, and it seems to me remarkable that the U.S. media has been nearly silent with regard to these issues.

    A small breakthrough in this area occurred in June 1998 when Max Frankel, the distinguished columnist and former editor of the New York Times, wrote in the New York Times Magazine: “If I and other observers had resisted the nuclear club’s double standard and exposed its hollow assumptions about human nature, the world might by now have devised more effective international controls over atomic weapons. The have-nots might have been appeased if they had been given a major voice in a strong international inspection agency and the right to pry even into the monopolists’ stockpiles — including ours. Instead we have wasted the half century since Hiroshima and provoked a chain reaction that is truly prolific.”

    Let me offer a syllogism, an expression of logic: All states are subject to international law. The United States is a state. Therefore, the United States is subject to international law.

    Unfortunately, not everyone agrees with the logic that our country is subject to international law. Senator Alfonse D’Amato, for example, was recently quoted in the Los Angeles Times as stating, “To hell with international law….You’ve got a choice to make. You’re either with us or against us, and I only hope for your sake you make the right choice.”

    One choice is the rule of law. The other is the rule of force. I would argue that the right choice is international law. It is in the interests of our country and all countries to abide by the rule of law. Either way, we can be assured that other countries will follow our lead.

    International law is made in two ways — by treaties, which require the agreement of nations, and by such widespread agreement on issues of law that the law is accepted as customary international law. Both means carry the force of law in the international system.

    The treaty which is most relevant to the abolition of nuclear weapons is the Nuclear Non-Proliferation Treaty (NPT), which was opened for signatures in 1968 and entered into force in 1970. This treaty seeks to prevent the proliferation of nuclear weapons to states which did not possess them prior to January 1, 1967. The five permanent members of the United Nations Security Council (U.S., Russia, UK, France and China) are the states recognized in the NPT as possessing nuclear weapons prior to this date.

    In return for the non-nuclear weapons states promising not to acquire nuclear weapons, the five nuclear weapons states promised in Article VI of the NPT to pursue good faith negotiations for a cessation of the nuclear arms race at an early date and for nuclear disarmament.

    When the NPT was extended indefinitely in 1995, the nuclear weapons states promised the “determined pursuit…of systematic and progressive efforts” to achieve nuclear disarmament. For most states in the world, as reflected in their votes in the UN General Assembly, the efforts of the nuclear weapons states in this regard have been far from satisfactory.

    The customary international law most relevant to the legality of the threat or use of nuclear weapons is international humanitarian law. This is part of the law of armed conflict, and was developed to set limits on the use of force in armed conflict for humanitarian purposes. The basic premise is that the means of injuring the enemy are not unlimited. Put another way, all is not fair (or legal) in warfare.

    Under international law, a state cannot use weapons that fail to discriminate between civilians and combatants. Nor can a state use weapons that cause unnecessary suffering to combatants such as dum-dum bullets.

    In December 1994 the United Nations General Assembly asked the International Court of Justice, the highest judicial body in the world on matters of international law, for an advisory opinion on the legality of the threat or use of nuclear weapons. The exact question asked was: “Is the threat or use of nuclear weapons in any circumstance permitted under international law?”

    The United States, joined by the UK, France, and Russia, argued to the Court that it should not hear the case because this was a political rather than legal issue. The Court, turning aside these arguments, issued its historic opinion on July 8, 1996. It was an opinion of great significance for humanity, but to date it has been largely ignored by the U.S. and its NATO allies. It has also been largely ignored by the U.S. media.

    The Court began by unanimously finding that international law does not provide specific authorization of the threat or use of nuclear weapons. On the other hand, the Court found that international law did not contain “any comprehensive and universal prohibition of the threat or use of nuclear weapons as such.” Three of the 14 judges — Judge Koroma of Sierra Leone, Judge Shahabuddeen of Guyana, and Judge Weeramantry of Sri Lanka — voted against this position, and issued powerful dissenting opinions.

    The Court then went on to state unanimously that any threat or use of nuclear weapons for purposes other than self-defense, in accord with articles 2(4) and 51 of the United Nations Charter, was prohibited. It followed this statement with the unanimous conclusion that a threat or use of nuclear weapons must also meet the requirements of the principles and rules of international humanitarian law.

    Earlier in its opinion, the Court had referred to “cardinal principles” of humanitarian law as follows: “The first is aimed at the protection of the civilian population and civilian objects and establishes the distinction between combatants and non-combatants; States must never make civilians the object of attack and must consequently never use weapons that are incapable of distinguishing between civilian and military targets. According to the second principle, it is prohibited to cause unnecessary suffering to combatants: it is accordingly prohibited to use weapons causing them such harm or uselessly aggravating their suffering. In application of that second principle, States do not have unlimited freedom of choice of means in the weapons they use.” The Court also made clear that if a use would be unlawful, the threat of such use would also be unlawful.

    Based upon its findings with regard to the application of international law to nuclear weapons, the Court reached an unusual two-paragraph conclusion that began, “the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law.”

    The Court continued with a second paragraph stating that the current state of international law and the elements of fact at its disposal did not allow the Court to “conclude definitively whether the threat or use of nuclear weapons would be lawful or unlawful in an extreme circumstance of self-defence, in which the very survival of a state would be at stake.” This indetermination by the Court when “the very survival of a state would be at stake,” must be read in connection with the absolute prohibition of violating international humanitarian law. Thus, even in an extreme circumstance of self-defense, it would be necessary to avoid injuring a civilian population and causing unnecessary suffering to combatants. This would not be possible by means of using nuclear weapons for retaliation against a civilian population.

    The vote on this two-paragraph conclusion was 7 to 7, with the President of the Court casting the deciding vote, according to the rules of the Court. However, when you analyze who voted against the conclusion you find that the three judges from Western nuclear weapons states were joined by the three judges who found an absolute prohibition on nuclear weapons. The Japanese judge also voted against this conclusion because he opposed the issue coming before the Court. Thus, a better reading of this vote would have ten supporting the conclusion or going further and arguing for an absolute prohibition, and only the judges from the U.S., UK and France opposing it because they found that the threat or use of nuclear weapons would not be “generally” illegal.

    The Court went on to state unanimously: “There exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.” In 1996 and 1997 the United Nations General Assembly passed resolutions urging the nuclear weapons states to fulfill this obligation.

    In issuing the Court’s opinion, Judge Bedjaoui, the then president of the Court, referred to nuclear weapons as “the ultimate evil” and declared, “Nuclear weapons can be expected — in the present state of scientific development at least — to cause indiscriminate victims among combatants and non-combatants alike, as well as unnecessary suffering among both categories. The very nature of this blind weapon therefore has a destabilizing effect on humanitarian law which regulates discernment in the type of weapon used.”

    Judge Bedjaoui also argued that it would be “quite foolhardy…to set the survival of a State above all other considerations, in particular above the survival of mankind itself.”

    I will conclude with a few observations.

    First, the threat or use of nuclear weapons is illegal in any conceivable circumstance. Therefore, current U.S. and NATO policies relying upon nuclear weapons are illegal under international law.

    Second, the U.S. has not been fulfilling its obligation under international law to negotiate the complete elimination of nuclear weapons under strict and effective international control.

    Third, the likely outcome of this failure of leadership by the U.S. is the breakdown of the Non-Proliferation Treaty at its year 2000 Review Conference. The nuclear testing by India and Pakistan can be linked to India’s strong opposition to what it has termed “nuclear apartheid,” that is the continued reliance on nuclear weapons by a small group of states that have failed to fulfill their obligations under international law.

    Fourth, the U.S. media has not played a constructive role in analyzing this situation, and reporting on it to the American people.

    Fifth, current U.S. policies make the American people and the U.S. media unwitting accomplices in policies that threaten the mass murder of hundreds of millions of innocent people. If these weapons are used ever again, by accident or design, history — if there is a history — will judge the American people harshly for not demanding the abolition of these weapons when the opportunity to do so presented itself with the end of the Cold War.

    At the outset, I said that the legal case for abolishing nuclear weapons is only one of many that can be made. The legal case is important, but the most important case that can be made is the moral case. To abolish nuclear weapons is to uphold the sanctity of life. I will conclude by quoting Lee Butler, a former commander of the U.S. Strategic Command and an eloquent spokesman for abolishing these weapons. General Butler stated: “We cannot at once keep sacred the miracle of existence and hold sacrosanct the capacity to destroy it. It is time to reassert the primacy of individual conscience, the voice of reason and the rightful interests of humanity.” This cannot be done without the active participation of the media in analyzing and communicating the case for nuclear weapons abolition to the American people.

  • India’s Nuclear Testing is a Wake-up Call to the World

    India’s nuclear tests are a wake-up call to the world, and particularly to the nuclear weapons states. The meeting of the parties to the Nuclear Non-Proliferation Treaty (NPT) in Geneva, which concluded on May 8th, attracted near zero press attention and achieved near zero results. It was virtually a non-event. On the other hand, India’s tests three days later immediately got the world’s attention.

    The message of India’s tests is that we can have a world in which many countries have nuclear weapons or a world in which no countries have nuclear weapons, but we will not have a world in which only the five permanent members of the UN Security Council plus Israel retain nuclear weapons in perpetuity. India has long argued that it is unwilling to give up its nuclear weapons option so long as the current nuclear weapons states fail to make a commitment to eliminate their nuclear arsenals within a timebound framework. The Indians underlined this position in 1996 when they refused to sign the Comprehensive Test Ban Treaty (CTBT).

    Following their recent nuclear tests, however, the Indians have offered to sign the CTBT, but only if the nuclear weapons states agree to eliminate their nuclear arsenals within a timebound framework and cease all subcritical and laboratory nuclear weapons testing. The Indian position is reasonable. They are calling for a world in which no state, including themselves, has nuclear weapons.

    What is not reasonable is the way in which the nuclear weapons states and their allies have treated India’s position as non-negotiable. The nuclear weapons states have consistently failed to this day to show the good faith in seeking nuclear disarmament that they promised in 1968 in Article VI of the NPT.

    Ironically, the only nuclear weapons state to consistently call for nuclear weapons abolition is China, but it, too, has been rebuffed by the other nuclear weapons states. It is ironic because India’s testing was, at least in part, a response to China’s possession and improvement of its nuclear arsenal.

    Despite their promises in 1995 for the determined pursuit of systematic and progressive efforts to achieve nuclear disarmament, the nuclear weapons states have been largely impeding nuclear disarmament. If they are serious about stopping India, Pakistan and other states from becoming full fledged nuclear powers, they had better reverse their course of action and begin serious and good faith negotiations to rid the world of nuclear arms. This is the only course of action with a chance of success to prevent nuclear weapons proliferation.

    The knee-jerk reaction of the U.S., Japan and other industrialized states to impose economic sanctions on India will not stop the Indians from developing a nuclear arsenal. It will only result in greater hostility in a world divided not only between rich and poor, but also between nuclear “haves” and “have-nots.”

    India’s testing is not only an Indian problem. It is a problem of the international system that leads the country of Gandhi to follow a nuclear weapons path. There is only one way out of the dilemma, and that is a commitment by all nuclear weapons states SQ now including India SQ to the abolition of their nuclear arsenals. According to a 1996 unanimous opinion of the International Court of Justice, the complete elimination of their nuclear arsenals is the legal obligation of the nuclear weapons states under international law.

    Nuclear weapons abolition is also the solution called for by military and civilian leaders and citizen action groups throughout the world. The Abolition 2000 Statement of over 1000 citizens organizations around the world calls upon the nuclear weapons states to “Initiate immediately and conclude by the year 2000 negotiations on a nuclear weapons abolition convention that requires the phased elimination of all nuclear weapons within a timebound framework with provisions for effective verification and enforcement.”

    In crisis there is opportunity. If India’s nuclear tests lead to sufficient pressure on the nuclear weapons states to reverse their course and become serious about ending the nuclear weapons era, we may still be able to enter the 21st century with a treaty in place to accomplish this goal. If the nuclear weapons states hold firm to their present positions, however, India may be only the first of many states to become new members in the nuclear weapons club.

  • A Break in the Clouds

    It is a great joy for my wife and I to return to Nagasaki. It has been more then 30 years since we last visited your beautiful city.

    I have often thought of the irony that Nagasaki should have entered the Nuclear Age as the second city to be bombed by an atomic weapon. When the U.S. B-29, Bock’s Car, left Tinian Island carrying its deadly cargo in the early morning hours of August 9, 1945, it was headed to another target, the city of Kokura. Were it not for the weather conditions that day — specifically, the cloud cover over Kokura — it would have been that city and not Nagasaki on which the bomb would have been dropped.

    Not being able to bomb Kokura, the pilot of the B-29 headed toward his secondary target, Nagasaki. Even here, there was cloud cover, and only a small opening in the clouds allowed the pilot to release that second atomic bomb, causing such destruction to your city and its people. Were it not for the clouds over Kokura and the small opening in the clouds over Nagasaki, your city would have been spared, at least for that day. I can’t help thinking that even gentle, ephemeral clouds could prevent an atomic bombing from occurring. We humans are not so powerful as we might think — when we compare ourselves with the power of nature. Yet, we are capable of doing great harm to each other — as we have witnessed at Nagasaki and on occasions too numerous to mention.

    The bombings of both Nagasaki and Hiroshima have taught us a simple lesson, perhaps the most basic lesson of the Nuclear Age: This must never happen again. Cloud cover must never again be the sole factor to save a city, or a break in the clouds provide an opening for nuclear devastation. Today’s missile technology, in fact, makes cloud cover irrelevant. Our task must be to make nuclear weapons — and all weapons of mass destruction — irrelevant. The only way to do this is to ban these weapons and abolish them forever.

    The evil that occurred at Nagasaki and Hiroshima must never be repeated. No city and its people must ever again be subjected to attack with a nuclear weapon. Such an attack would exceed all bounds of morality. It would undermine every precept of human decency and human dignity.

    Nuclear weapons, in the words of a former president of the International Court of Justice, are “the ultimate evil.” The description echoes Josai Toda’s reference to them more than forty years ago as “an absolute evil.”

    In the past few years there has been a growing chorus of voices to abolish nuclear weapons. When a former commander of the U.S. Strategic Command, General Lee Butler, can join the call for abolition, we are making progress. General Butler, who retired from the U.S. Air Force in 1994, has stated, “I think that the vast majority of people on the face of this earth will endorse the proposition that such weapons have no place among us. There is no security to be found in nuclear weapons. It’s a fool’s game.”

    General Butler is not alone among military leaders calling for nuclear weapons abolition. Many generals and admirals from around the world have done so as well. In 1996 some 60 retired generals and admirals from 17 countries joined General Butler in stating:

    “We have been presented with a challenge of the highest possible historic importance: the creation of a nuclear-weapons-free world. The end of the Cold War makes it possible.

    “The dangers of proliferation, terrorism, and new nuclear arms races render it necessary. We must not fail to seize our opportunity. There is no alternative.”

    The Canberra Commission on the Elimination of Nuclear Weapons, composed of a distinguished group of experts, including General Butler, Joseph Rotblat and the late Jacques Cousteau, issued a report in 1996 that said: “The proposition that nuclear weapons can be retained in perpetuity and never used — accidentally or by decision — defies credibility. The only complete defence is the elimination of nuclear weapons and assurance that they will never be produced again.”

    The International Court of Justice has also spoken on the issue of eliminating nuclear weapons. In issuing an opinion on the illegality of these weapons in 1996, the Court made clear that there is an obligation under international law to proceed with good faith negotiations for their elimination.

    At the end of 1996 and again at the end of 1997 the United Nations General Assembly called upon all states to commence negotiations on a treaty to eliminate nuclear weapons.

    In February 1998 a statement calling for the elimination of nuclear weapons was released at the National Press Club in Washington, D.C. The statement was signed by 117 leaders from 46 countries, including 47 past or present presidents or prime ministers. Among the signers were former U.S. President Jimmy Carter, former Soviet President Mikhail Gorbachev, and five former prime ministers of Japan. The Statement concluded: “The world is not condemned to live forever with threats of nuclear conflict, or anxious fragile peace imposed by nuclear deterrence. Such threats are intolerable and such a peace unworthy. The sheer destructiveness of nuclear weapons invokes a moral imperative for their elimination. That is our mandate. Let us begin.”

    The governments of some nuclear weapons states have been moving slowly in the direction of reducing the nuclear threat, but they have not yet demonstrated that they are committed to eliminating their nuclear arsenals. They treat their nuclear arsenals like security blankets when, in fact, they provide no security — only threat.

    There is no security in threatening the mass annihilation of civilians. In truth, it is not only cowardly, but foolish beyond words. It places the population of the country possessing nuclear weapons in danger of retaliation.

    It is important to keep in mind, that nuclear holocaust could occur not only by intention, but by accident or miscalculation as well. As recently as 1995 the Russians were poised to launch a nuclear response when they mistakenly believed that a missile launched from Norway was a nuclear attack aimed at Russia.

    Nuclear holocaust could also occur if terrorists came into possession of a nuclear weapon, and we know that some nuclear weapons are small enough to be carried by a single individual in a large backpack.

    We will be free of the threat of nuclear holocaust only when we are free of nuclear weapons. No group of people knows this better than the people of Nagasaki and Hiroshima. It is the hibakusha, the survivors of Nagasaki and Hiroshima, that remind us that the pain of nuclear weapons lingers. Radiation causes pain and suffering that continues to kill for decades, and genetically affects new generations.

    I am convinced that if we want a world at peace, we must create it. There is no other choice. Governments will not succeed on their own in creating such a world. The power of the people must push governments — or, more accurately, the power of the people must lead governments. We will have a peaceful and just world when enough people are willing to commit themselves to creating such a world, and will make their voices heard.

    The same is true of a world free of the threat of nuclear holocaust. We will have such a world when the people demand it. This process has begun. Here in Japan you have raised your voices, and the chorus of your voices will be heard around the world. I am overwhelmed that more than 13 million signatures for nuclear weapons abolition have been gathered in Japan in only a few months time. These signatures represent the power of an idea whose time is now. They also demonstrate the power of the people when they join together in common cause.

    These signatures represent 13 million voices of hope for a world free of the threat of nuclear annihilation. These voices of hope have unleashed a power that will not be stopped until the goal of a world free of nuclear weapons is achieved.

    I congratulate you on what you have accomplished. These signatures are enough to inspire, enough to move people everywhere to greater commitment. President Ikeda must be very proud of you, and I can only imagine how proud Josai Toda would be to know that you are working to carry out his vision of a nuclear weapons free world.

    The more than 13 million signatures you have gathered are an important step on the road to abolition. But we must not rest. We must commit ourselves to continuing our activities to achieve the abolition of nuclear weapons until the goal is accomplished and the last nuclear weapon in the world is destroyed. Will you join me in making this commitment?

    The Abolition 2000 International Petition calls for three outcomes. First, ending the threat. Second, signing a treaty to eliminate nuclear weapons. Third, reallocating resources from military purposes to assuring a sustainable future.

    Isn’t it crazy that the Cold War ended many years ago, and yet the nuclear weapons states continue to keep their nuclear arsenals on hair-trigger alert? There is no reason to continue this threat. These weapons must be taken off alert status immediately! There must be time to sort through all the facts, to consider the full consequences of what is being contemplated, and to avoid acting in a moment of passion.

    Warheads can be separated from delivery vehicles. A no-first-use agreement can be achieved, in which each nuclear weapons state agrees that it will never under any circumstance be the first to use nuclear weapons. These steps will make the world far safer. They can be taken immediately, and will have a profound effect on the way nuclear weapons are viewed by their possessors.

    The petition calls for signing a treaty by the year 2000 to eliminate all nuclear weapons within a fixed time period. This is the treaty called for by Abolition 2000, by the World Court, and by most nations in the world. It is absolutely reasonable that we should enter the 21st century with such a commitment in place.

    The petition calls for reallocating resources from military purposes to meeting human needs. It says a great deal about our priorities that we are spending more for military forces in our world than we do for healthcare and education of our youth. We live in a world in which many thousands of children under the age of five die daily from starvation and preventable diseases. This totals to millions of children a year. It is outrageous, unacceptable, and must be ended. We must change our priorities.

    What is at stake is no less than the future of humanity. Each of you who has signed the petition has taken a first step, but you must not stop with this step. You must continue to speak out and demand greater action from your own government, and from other governments of the world.

    You can also help by asking the council of the municipality where you live or the student government where you go to school to support an Abolition 2000 Resolution. There are currently over 185 municipalities that have gone on record in support of Abolition 2000, but we need to increase this number to thousands around the world.

    I urge you to continue to press the Japanese government to take a more responsible position on eliminating nuclear weapons. The Japanese government has not kept faith with the people of Japan on this issue. The government has placed Japan under the U.S. nuclear umbrella, and reached secret nuclear agreements with the U.S. The Japanese government has also imported many tons of reprocessed plutonium 239, material suitable for making nuclear weapons. In fact, Japan could become a major nuclear weapons state in only a matter of days or weeks if it chose to do so.

    The future of humanity demands that we succeed in ridding the world of nuclear weapons. If these weapons remain in the arsenals of the nuclear weapons states, there will be a time in the future when they will be used again. The retention of these horrible weapons provides an example that other states will look to and that will eventually lead to the proliferation of nuclear weapons. This, too, will make the world more dangerous.

    Because we must succeed, we will succeed. But it will not be easy. There are still many obstacles to overcome. We must be strong in our dedication, unwavering in our commitment. I am heartened to know of your dedication and commitment. I will let others throughout the world know of your great accomplishment, and your continuing efforts.

    I plan to inform the top leadership of the United Nations of your achievement. The United Nations Charter begins, “We, the Peoples….” We must put the people back into the United Nations. The elimination of nuclear weapons is too important to be left only to politicians and diplomats. They must hear the voices of the people — your voices.

    In April, I will share with the delegates to the Non-Proliferation Treaty Conference in Geneva your achievement in gathering more than 13 million signatures for nuclear weapons abolition. I will also do everything I can to bring your message to President Clinton, who has the power — but thus far has lacked the vision — to lead the way to fulfilling the goals of the petition. I will also work with other citizens groups in Abolition 2000 to see that your message is brought to the leaders of all nuclear weapons states.

    Let me conclude with a story about the sunflower. When Ukraine gave up the last of the nuclear weapons that it had inherited when the former Soviet Union split apart, there was an unusual celebration. The defense ministers of the U.S., Russia and Ukraine met at a former Ukrainian missile base that once housed 80 SS-19 nuclear armed missiles aimed at the United States. The defense ministers celebrated the occasion by planting sunflowers and scattering sunflower seeds. Former U.S. Secretary of Defense William Perry said, “Sunflowers instead of missiles in the soil will ensure peace for future generations.”

    Later I learned that protesters in the United States many years before had illegally entered missile sites in the U.S. and planted sunflowers above the missile silos. These protesters had been imprisoned for their courage.

    Sunflowers have become the symbol of a nuclear weapons free world. They are bright, beautiful, natural, and even nutritious. They stand in stark contrast to nuclear armed missiles, which are costly, manmade instruments of genocide. Let us choose what is natural and healthy. Let us restore our Earth, our decency, our humanity.

    We need to control our darker impulses. Nothing could be more representative of this than replacing missiles with sunflowers. If Ukraine can accomplish this, so can the rest of the world.

    Please make the sunflower your symbol of a world free of nuclear weapons. In doing so, you will also make it a symbol of a better humanity, of bringing forth a greater humanness in each of us. Let the sunflower also symbolize your own deeper humanity as you continue to work for the elimination of nuclear weapons.

    Thank you for caring. Thank you for what you have done. Thank you for all you will do in the future to create a safer and more decent world. I look forward to sharing the day with you when we have succeeded in creating a world without nuclear weapons. Please never lose hope that such a world is possible, and never stop working and speaking out to create such a world.

  • Countless Voices of Hope

    It is with profound appreciation and gratitude that I return to this city of peace, this sacred city of Hiroshima. This city was made sacred not by the tragedy which befell it, but by the rebirth of hope which emerged from that tragedy. From the ashes of Hiroshima, flowers of hope have blossomed, bringing forth a renewed spirit of possibility, of peace, to a world in which hope has been too often crushed for too many.

    The massive destruction that was visited upon this city on August 6, 1945 gave birth to the Nuclear Age, an age in which our species would move from the too often practiced power of genocide to the potential of omnicide, the destruction of all humanity and perhaps all life. The devastating power of nuclear weapons, as manifested first at Hiroshima and then at Nagasaki, has made peace not only desirable but imperative.

    Through the memories of the survivors, the hibakusha, we may learn of the horror they experienced so that we may act to prevent that horror from ever recurring anywhere again. The scenes etched in their memories can pierce us to the marrow of our bones. Sumie Mizukawa, a young girl at the time of the bombing, remembered the sight of a blinded young mother. She wrote:

    Her eyes blinded

    her dead infant in her arms

    with tears streaming

    from those sightless eyes

    that would never see again.

    I saw this in my childhood

    as my mother led me by the hand.

    That image will never leave

    my memories of that dreadful time.

    Kosaku Okabe described a scene of misery with “countless bodies of men, women, and children” floating in the river. “It was then,” he wrote, “that I first began to understand the brutality of war.” He continued, “Burned into my memory is the sight of a young mother, probably in her twenties, a baby on her back and a three- or four-year-old child clasped tightly in her arms. Caught against a girder on a bridge her body bobbed idly in the gentle current.”

    How could these images not be seared into memory? And how vitally important it is that such images be shared with others throughout the world so that this pain will not again be inflicted on young mothers and their children in other cities at other times. As Akihiro Takahashi, a former director of the Hiroshima Peace Culture Center, wrote, “‘Hiroshima’ is not merely a historic fact in the past. It is an alarm bell for the future of humankind.”

    I have had the great privilege of knowing Miyoko Matsubara, who was a twelve year old child when the bomb fell on Hiroshima. Miyoko struggled to learn English so that she could tell the story of what she witnessed and experienced — including her own injury, pain and disfigurement — to young people throughout the world. She was only a child, but she has carried the pain throughout her life. She also carries hope, and her courage gives hope to others.

    Miyoko’s message is the message of Hiroshima: “Never again! We shall not repeat the evil.” This message is a clarion call to sanity. It is a cry to the human species to remember our humanity. If we fail to do so, the consequences will be severe. We run the risk of destroying ourselves and much of life. Our capacity for destruction tests our wisdom. The most important issue of our time, although not widely viewed as such, is that of assuring that the evil is not repeated.

    I would like you to know that the message of your city awakened me. I first visited Hiroshima when I was 21 years old. At the Hiroshima Peace Memorial Museum, I learned of the human cost of nuclear destruction, of the tragedy and suffering caused by that single bomb. The spirit of Hiroshima entered my soul. I had no choice but to find a way to work for peace and an end to the threat of future nuclear holocausts.

    A second experience solidified my commitment to peace. Returning from Japan in 1964, I found that I had been called into the army. Not realizing the full range of my options, I joined a reserve unit rather than serve on active duty. However, four years later this reserve unit was called to active duty, and I received orders to go to Vietnam as an infantry officer. At that time I believed, and continue to believe today, that this was a war both immoral and illegal. I knew that if I went to Vietnam I would be forced to kill and order others to do so. I, therefore, as a conscientious objector, refused the order to go to Vietnam, and ended up fighting the army in federal court.

    It was a great awakening for me to realize that my power as an individual was greater than that of the United States Army. The army had the power to give me an order, but I had the power to say No to their order. I might have gone to jail for doing so, but that was my choice. I had a choice, as we all do, to do what I believed was right. To exercise that choice is tremendously empowering. It is the power of conscience, which is a defining human characteristic, one that separates us from all other forms of life.

    Above all else, I consider myself to be a citizen of Earth. I believe that the bonds of our common humanity uniting us are far stronger than the artificial boundaries that divide us. I am also a citizen of the United States, having been born in Los Angeles three years before the Nuclear Age began. Speaking as a single individual, but I’m sure representing millions of others throughout the world, I deeply regret the crime against humanity that occurred here. As an American, I apologize to you, although I know from Miyoko and other hibakusha that your forgiveness came long ago.

    I apologize because my government has not yet done so. I apologize because my government has not yet heard the message of Hiroshima, nor learned its foremost lesson — “Never again!” I apologize because my government still bases its national security on the threat to use nuclear weapons. I apologize because your pain and your suffering should not be borne by you alone.

    What happened here affects us all. If we can find it in ourselves to share in your tragedy — a tragedy that for most people on Earth today is only of historical memory — we may be capable of sharing in your hope. And, if we can do that, we may be capable of bringing forth a new world in which the ever present threat of nuclear holocaust is ended for all time.

    Just over 40 years ago, Josei Toda, your second president, called for the abolition of all nuclear weapons, and called upon the youth of Soka Gakkai to help lead the way. Five months ago I was in Tokyo and Yokohama for the commemoration of that fortieth anniversary. In the short time since that fortieth anniversary, the youth of Soka Gakkai, beginning here in Hiroshima, have gathered over 13 million signatures for the abolition of nuclear weapons. I am in awe of your effort and your accomplishment. I know that President Ikeda is as well. I can only imagine how proud Josei Toda would have been to know of your effort. Your effort inspires and motivates. It is a source of hope.

    In your effort to gather signatures you have become educators and activists. You have brought this critical issue of nuclear weapons abolition to the attention of over 13 million people, and have obtained their affirmation of the need to end this nuclear weapons era which threatens the future of humanity and, indeed, all life.

    The petition on which you gathered signatures was prepared by Abolition 2000, which is a global network of over 1000 citizens organizations in some 75 countries working for the abolition of nuclear weapons. Abolition 2000 draws its strength from the grassroots, from the people. In this respect, it is similar to the International Campaign to Ban Landmines. When the landmines campaign succeeded in having a treaty banning anti-personnel landmines signed in Ottawa, Jody Williams, the coordinator of the campaign, said, “Together we are a superpower. It’s a new definition of superpower. It’s not one of us; it’s all of us.” In Abolition 2000, as in the landmines campaign, we are not alone, and together we can become the most powerful grassroots movement in the history of humankind.

    The Abolition 2000 International Petition asks for three actions. First, end the nuclear threat by such reasonable steps as withdrawing all nuclear weapons from foreign soil and international waters, separating warheads from delivery vehicles, and committing to unconditional no-first-use of nuclear weapons. Second, sign an international treaty — a Nuclear Weapons Convention — by the year 2000, agreeing to eliminate all nuclear weapons within a fixed period of time. Third, reallocate resources from military purposes to assuring a sustainable global future.

    Each signature you have gathered represents a voice of hope. Together they represent a chorus of hope that can move the world. We don’t know with certainty what forces you have set in motion by your effort, but we do know that you have touched many lives and that they in turn will touch more lives. If other concerned citizens throughout the world will follow your lead, we can achieve our goal of a world free of nuclear weapons.

    You have concluded your petition campaign, but please don’t consider your task finished until the last nuclear weapon is removed from the world. This will not happen overnight. It will take sustained effort and commitment. It will require the often under-appreciated virtue of perseverance. All that is truly worth achieving requires perseverance — loving relationships, healthy communities, and a decent world.

    I will take the message of your achievement to the leaders of the United Nations, to the delegates preparing for the Non-Proliferation Treaty Review Conference, to non-governmental organizations working for nuclear weapons abolition throughout the world, and to the leaders of my own country and other nuclear weapons states.

    I urge you to take the message of these 13 million voices to your own government, which has not been true to the people of Japan in its nuclear policies. Your government has not only been content to rely upon the U.S. nuclear umbrella, but — by its accumulation of reprocessed plutonium — has become a virtual nuclear weapons power capable of assembling hundreds of nuclear weapons in days or weeks. If we are to have a world free of nuclear weapons, we must convince our respective governments to change their policies. You must help to convince your government and I must help to convince mine that reliance upon nuclear weapons for defense is an act of folly that endangers our future and undermines our decency as well as our security.

    Sometimes we cannot see the full fruits of our efforts during our lifetimes. This has been true of many great peace leaders, including Mahatma Gandhi and Martin Luther King, Jr. It is also true of Josei Toda whose vision forms the foundation for your effort. It is true for all of us — if our vision is great enough. I believe, however, that a world free of nuclear weapons can and will be achieved within our lifetimes.

    I urge you to dream of what can be, and to always hold fast to your dreams. I beseech you never to lose the dream of a world free from the threat of nuclear holocaust. I implore you to listen to your conscience, and to act courageously upon it. I encourage you to walk the path of peace, which is also the path of justice. I call upon you to follow President Ikeda’s sage advice, “Continue to advance, step-by-step! Never, ever, give up hope.”

    If we follow our dreams, if we listen to our consciences, if we act courageously, if we walk the path of peace, if we never give up hope, we will rise to our full stature as human beings. We will live lives that are rich and full. We will make a difference and, by our examples, we will influence others to live such lives. I promise you that I will do my utmost to join you in living such a life and will encourage others to join us as well.

    I would like to conclude by sharing with you a poem of hope written by Sadako Kurihara just after the bombing of Hiroshima.

    WE SHALL BRING FORTH NEW LIFE

    It was night in the basement of a broken building.

    Victims of the atomic bombing

    Crowding into the candleless darkness,

    Filling the room to overflowing —

    The smell of fresh blood, the stench of death,

    The stuffiness of human sweat, the writhing moans —

    When, out of the darkness, came a wondrous voice

    “Oh! The baby’s coming!” it said.

    In the basement turned to living hell

    A young woman had gone into labor!

    The others forgot their own pain in their concern;

    What could they do for her, having not even a match

    To bring light to the darkness?

    Then came another voice: “I am a midwife.

    I can help her with the baby.”

    It was a woman who had been moaning in pain only moments before.

    And so a new life was born

    In the darkness of that living hell.

    And so, the midwife died before the dawn,

    Still soaked in the blood of her own wounds.

    We shall give forth new life!

    We shall bring forth new life!

    Even to our death.

    To find such hope in the darkness of that awful night is a triumph of the human spirit. In remembering Hiroshima, let us dedicate ourselves to bringing forth new life. Let us dedicate ourselves to building a world in which even the threat of nuclear devastation is not a possibility. Let us dedicate ourselves to bringing forth a new world in which no child ever again must suffer the pain of war or hunger or abandonment. Let us dedicate ourselves to building a world in which there is liberty, justice and dignity for all who share this extraordinary planet that gave birth to life. Let us walk the path of peace, and be active participants in the pursuit of peace!

     

  • Security and Sustainability in a Nuclear Weapons Free World

    There is a danger that the contemplation of security and sustainability in a nuclear weapons free world will imply to some readers that nuclear weapons have in some way provided security and even sustainability. It is not my intention to imply this. I believe that nuclear weapons have never at any time provided security for their possessors, and that they make no contribution to sustainability.

    The world that we currently live in — a world divided between a small number of states possessing nuclear weapons and a large number of states that do not — is neither secure nor sustainable. If nuclear weapons in fact provided security, logic would suggest that an effort be made to spread these weapons to other states. In fact, the opposite viewpoint has prevailed. Most states, including those currently in possession of nuclear weapons, support policies of non-proliferation.

    The Non-Proliferation Treaty (NPT), which has been in force since 1970, requires a trade-off from the nuclear weapons states. In exchange for the non-nuclear weapons states agreeing not to develop or otherwise acquire nuclear weapons, the nuclear weapons states agreed in Article VI to negotiate in good faith to achieve nuclear disarmament. When the NPT was extended indefinitely in 1995, the nuclear weapons states promised the determined pursuit of “systematic and progressive efforts” to achieve nuclear disarmament.

    The failure of the nuclear weapons states to make significant progress toward nuclear disarmament may result in undermining the NPT, and in the proliferation of nuclear weapons to additional states beyond the five declared and three undeclared nuclear weapons states. Such proliferation would further bolster the insecurity and unsustainability of the current international system.

    Security

    Security has two critical dimensions: protection from physical harm, and access to resources to meet basic needs. It also has a third dimension, an illusory psychological dimension, that operates at the level of belief systems. Nuclear arsenals do not provide security from physical harm. The only security they provide is in this psychological dimension, rooted in a belief in the efficacy of deterrence. The threat of retaliation with nuclear weapons is not physical protection; the protection provided is only psychological. An opponent’s fear of retaliation may or may not prevent that opponent from launching a nuclear attack based upon irrationality, faulty information, human error, or mechanical or computer malfunction.

    A world without nuclear weapons would be one in which the threat of cataclysmic nuclear holocaust would be removed. Achieving such a world will require careful planning to assure that some states do not secretly retain nuclear weapons or clandestinely reassemble them. As states reduce their nuclear arsenals toward zero, an agreed upon plan will be required to assure transparency, accurate accounting of nuclear weapons and weapons-grade materials, effective procedures for verification of dismantlement and the controlled and safeguarded immobilization of nuclear materials and the production facilities to create them. The process of reducing nuclear arsenals to zero will be challenging both technically and politically, but it is a challenge that can be accomplished with determination and political will.

    The process of nuclear weapons abolition will demand the creation of stronger systems of international security. Thus, achieving abolition will, by the nature of the process, coincide with strengthened international security arrangements. In order to have a security system that assures maximum protection against physical harm and access to resources to meet basic needs, it will be necessary to go even further in system design than the elements required to maintain security in a world without nuclear weapons. The main components of this security system would be:

    • All states would be allowed to maintain only weapons for defence against territorial invasion, and no weapons with offensive capabilities.
    • Each state would be subject to regular and challenge inspections by international teams to assure that it is neither maintaining nor creating any offensive weapons systems, particularly weapons of mass destruction.
    • All states would be required to make periodic public reports of the types and numbers of weapons in their arsenals.
    • An International Criminal Court would be responsible for holding individual leaders responsible for the most serious crimes under international law (crimes against humanity, war crimes, genocide, and international aggression), and for violations of the conditions specified in points 1 to 3 above.
    • A United Nations Inspection Force would be created to conduct inspections and monitor states for violations of points 1 to 3 above.
    • The United Nations Security Council would be responsible for enforcement of points 1 to 3 above, for apprehending serious violators of international law, and for assuring cooperation with the United Nations Inspection Force.
    • The United Nations system — including the General Assembly, the World Bank, the UN Development Programme and other specialized agencies, and a UN Disaster Relief Force — would be charged with assuring that all peoples of all states have access to the necessary resources to meet their basic needs.

    Sustainability

    Sustainability is the protection of the resources required to meet basic needs for present and future generations, and the upholding of the quality of these resources. Sustainability requires environmental protection to ensure the quality of the air, the water, and the earth. It is no longer possible to ensure sustainability in any state anywhere in the world if all states do not cooperate in protecting the Earth’s resources and the common heritage of the planet — the atmosphere, the oceans and the land. Clean air and water and unpolluted topsoil to grow healthy crops must be maintained if we are to have a sustainable future.

    Over 1000 nuclear weapons tests in the atmosphere and a roughly equal number of underground tests have already made a heavy assault upon the environment, as have thousands of tons of nuclear wastes, large quantities of which have already leaked into the earth, air and water. Sustainability will require not only a nuclear weapons free future, but a future in which nuclear wastes are also not generated by civilian nuclear reactors. Present and future generations are already burdened with enormous problems from the nuclear wastes created by both military and civilian nuclear reactors. Some of this waste will be a threat to life for tens of thousands, even hundreds of thousands, of years.

    It is unfair to burden future generations with still more dangerous radioactive wastes. What has been produced to date has been the product of ignorance, arrogance, and blind faith, sadly, by some of the best minds of our time. Sustainability requires having an answer to the problem of dangerous wastes before they are produced rather than burdening future generations with these problems.

    Beginning the Process

    A world that is divided between nuclear “haves” and “have nots” is neither secure nor sustainable. Nuclear weapons pose a threat to humanity and to all forms of life. If they continue to be relied upon, at some point in the future they will again be used. It is a strong lesson of history that weapons once created will be used — as indeed nuclear weapons have already been used at Hiroshima and Nagasaki.

    The challenge of the highest magnitude before humanity today is to ban forever these weapons which constitute such a serious threat to humanity’s future. The opportunity is before us with the Cold War ended. The nuclear weapons states have promised to negotiate in good faith to achieve nuclear disarmament. The International Court of Justice has stated its opinion that the nuclear weapons states are obligated to complete negotiations leading to nuclear disarmament in all its aspects. In fulfilling this mandate, these states must consider the issues of security and sustainability in a nuclear weapons free world.

    A secure and sustainable world order without nuclear weapons is achievable. It cannot occur, however, so long as the nuclear weapons states are wedded to their nuclear arsenals. The first step in breaking their addiction is to begin negotiations in good faith to achieve their elimination. If they are to complete the journey, they must first begin and thus far serious negotiations to eliminate nuclear arsenals have not begun.

    An international consortium of lawyers, scientists and disarmament experts led by the Lawyers Committee on Nuclear Policy (LCNP) with technical assistance from the International Network of Engineers and Scientists Against Proliferation (INESAP) has prepared a draft Nuclear Weapons Convention that has been introduced by Costa Rica to the United Nations General Assembly. This Convention — which draws upon previous international treaties including the Chemical Weapons Convention — provides indicators of the issues that the nuclear weapons states will have to resolve to achieve a treaty they can support. It provides a good starting point for the nuclear weapons states to begin the process of negotiations for abolishing their nuclear arsenals.

    What is missing now is the political will to begin the process. Many actions of the nuclear weapons states suggest that they are more interested in “systematic and progressive efforts” to impede rather than achieve nuclear disarmament. There is only one way that this can change, and that is by the people making their voices heard. When the people of the world understand the extent to which their security and a sustainable future for their children and grandchildren is threatened by the continued reliance of the governments of the nuclear weapons states upon nuclear arsenals, they will demand that the promises of nuclear disarmament be kept. It is our job to bring about that understanding.
