    Sort of a Treaty, But Not Really

    Nuclear weapons were the greatest threat to humanity’s future before 9/11, and remain the greatest threat after 9/11. They are the only weapons capable of destroying major cities and even ending human life on Earth. Given the dangers that these instruments of genocide pose to humanity, it is baffling why we’re not doing more to end this threat.

    I attribute the lack of action primarily to the myopic leadership in the United States, where the short-sightedness of U.S. political leadership on this issue is bipartisan. During its eight-year tenure, the Clinton administration made little progress to make good on the formal U.S. commitment in the 1970 Nuclear Non-Proliferation Treaty (NPT) to undertake good-faith efforts to achieve nuclear disarmament.

    At the 2000 NPT Review Conference, the nuclear-weapons states clarified their treaty commitments by pledging to pursue the total elimination of their nuclear arsenals. Promises also were made for “[t]he early entry into force and full implementation of START II and the conclusion of START III as soon as possible while preserving and strengthening the ABM Treaty as a cornerstone of strategic stability and as a basis for further reductions of strategic offensive weapons.”

    Instead of fulfilling these promises, however, the newly installed Bush dministration announced its opposition to the ABM Treaty, and later withdrew from it. It then foisted a fraudulent Strategic Offensive Reductions Treaty (SORT) on the Russians, a treaty so problematic that it accomplishes little more than mislead the public into thinking that some progress is being made toward nuclear disarmament.

    SORT will lead only to the reduction of the number of actively deployed strategic (long-range) nuclear weapons to between 1,700 and 2,200 by year 2012, with no timetable other than the endpoint and no procedures for verification. And the U.S. has announced that it will not be destroying most of the weapons taken off active deployment: It plans merely to place them on a shelf for retrieval in case they are deemed to be needed again in the future. The treaty has no effect on tactical (shorter-range) nuclear weapons.

    When this fraudulent treaty, which the U.S. Senate still must ratify, is combined with the U.S. Nuclear Posture Review presented to Congress earlier this year, the clear indication is that the U.S. is committed to keeping its nuclear arsenal, and to lowering the political and military thresholds of its possible use.

    The portions of the secret Nuclear Posture Review that were leaked to the press indicate that the U.S. is developing new, more usable nuclear weapons, as well as plans for their use against at least seven countries (Iraq, Iran, North Korea, Syria, Libya, Russia and China). This is hardly the stance of a country seeking to provide leadership toward fulfilling its NPT obligations to eliminate its nuclear weapons.

    Terrorism is the threat to injure or kill innocent people for political ends. The terrorist acts that targeted the United States on September 11 last year were despicable, and condemnable as crimes against humanity. But isn’t planning to use nuclear weapons, which would kill not 3,000 people but hundreds of thousands (in a small-scale use) to millions of people (in a larger scale use), terrorism too?

    It is past time for the United States and the other nuclear-weapons states to recognize their own terrorist threats against humanity. These states have existing obligations under international law to achieve the total elimination of their nuclear arsenals, including under the NPT and the 1996 Advisory Opinion of the nternational Court of Justice, which ruled that the use and threat of use of nuclear weapons would violate international law under nearly all conceivable circumstances.

    Fulfilling their international law obligations with respect to nuclear disarmament is also in the self-interest of these states. By eliminating nuclear weapons and strengthening non-proliferation regimes, these states would diminish the risk that such weapons would fall into the hands of terrorist groups, like those that targeted the United States last September.

    Opposing the President’s Call for ‘Relentless War’

    In an article reflecting on the anniversary of September 11, President Bush wrote, in an instant, America was transformed from a nation at peace to a country at war. We were called to defend liberty against tyranny and terror. And we have answered that call with the might of our military and the spirit of a nation inspired by acts of heroism.

    I am in complete accord on two issues. Yes, there was a horrendous attack on two major structures that symbolize our country s economic and military power, the World Trade Center and the Pentagon, costing thousands of innocent lives. And yes, there was genuine heroism shown by those who resisted the terrorist attacks and by the emergency workers who sacrificed selflessly for the victims of September 11.

    But was America, as Bush claims, instantly transformed from a nation at peace to a country at war? If it was transformed in this way, it is because this is the direction in which Bush and his advisors transformed it. Becoming a country at war meant to the Bush administration an opportunity to expand US military forces while constricting civil liberties for ordinary Americans. Starting with his candidacy, Bush has pressed for increasing funding for the military. The September 11 attacks, along with a frightened and compliant Congress and American public, provided the opportunity to do so.

    We responded to September 11 with the might of our military, which pummeled Afghanistan and attacked al Qaeda training camps, leading to a regime change in Afghanistan. But all of this military might has failed to apprehend Osama bin Laden, the individual purported to be responsible for the attacks. Has the use of this military might against Afghanistan truly made us any more secure?

    There are few signs that Americans are more secure now than they were before the terrorist attacks. Our airports and other potential targets remain penetratable by terrorists, and virtually nothing has been done to address the root causes of terrorism. Our policies on the Middle East have become less even-handed, and we no longer seem to have sufficient respect in the region to play the role of honest broker in a peace process. Our dependence on foreign oil has not diminished. We have been an obstacle to upholding and strengthening international law in virtually all areas.

    Bush and his military team have not spent much time addressing the reasons that the terrorists chose to attack symbols of American economic and military power. They have simply used the blunt instrument of military force to strike out at a regime viewed as dangerous. The United States under the Bush administration appears more like a helpless flailing giant than a country basing its responses on reason, law and morality. The Bush administration seems oblivious to the decent respect for the opinions of Mankind referred to by the founders of our nation in the Declaration of Independence.

    Our attacks against Afghanistan have resulted in the deaths and injuries of thousands of innocent Afghanis due to our high-altitude bombing. Our response to September 11 has probably killed more innocent Afghanis than the number of innocent persons who died in the terrorist attacks. But our President tells us we are a country at war, and dismisses the deaths of the innocent people we kill as collateral damage.

    This will be a long war, Mr. Bush tells the American people, and unprecedented challenges await us. It will be a long war because we are failing to take necessary steps to achieve peace. It will be a long war because we are led by an administration that has no vision of peace or of a better world for others. It has no vision and few resources for alleviating poverty, or for building schools instead of tanks. It has no vision of preserving the environment and natural resources for future generations because it is intently focused on goals that merely serve corporate interests. It has no vision of halting arms sales, an area where the US remains indisputably number one in the world. Nor does it have a vision of bringing nuclear and other weapons of mass destruction under control. We are an empire and empires require double standards. Thus, this will be a long war.

    The concepts of war and defense have often been confused in the minds of Americans, and appear particularly confused in the minds of Bush and his advisors. Through most of our nation s history, we had a War Department, but in 1947 the name of this department was changed to the Department of Defense, one suspects largely for purposes of public relations. Commenting on this change, novelist Joseph Heller astutely observed that since switching the name to Department of Defense, we have never again been in danger of war, only of defense.

    Now we are in danger of perpetual war. The United States under the Bush administration is leading the world in exactly the wrong direction, away from international law and toward increasing reliance on military force. Although no connection has been found between Iraq and the terrorist acts of September 11, Bush and Cheney are eager to wage war against Iraq to overthrow Saddam Hussein because Hussein may have weapons of mass destruction. But other countries, including dictatorships, actually have weapons of mass destruction. Possession of weapons of mass destruction has never been the litmus test for launching a pre-emptive and aggressive war. If we considered the elimination of nuclear weapons truly important, perhaps we would model the behavior we seek for others.

    It is highly unlikely that Saddam Hussein would attempt to inflict injury on citizens of the United States even if he had weapons of mass destruction unless, of course, he was attacked by the United States. Such an attack would put American soldiers in harm s way of Hussein s arsenal, and give Hussein the right under international law to act in self-defense. This right would still not include using weapons of mass destruction, although he might still choose to use them illegally when confronted by overwhelming US force.

    Bush has called for our government to wage an effective and relentless war against terrorists. Perhaps we should think instead of waging peace against the terrorists, acting with such justice and decency in the world that we would again be viewed as a positive model.

    How does a country wage peace? There are some seeds of an answer in Bush’s advice to the American people: Overcome evil with acts of goodness. Love a neighbor. Reach out to somebody in need. Feed someone who is hungry, teach a child to read&. These were Bush s suggestions for what Americans can do to help in the war on terror. But imagine if these suggestions were followed by our country in our policies toward the rest of the world. What if America sought to overcome evil with acts of goodness, rather than military might? What if America reached out to people everywhere who were in need of food, shelter, health care and education?

    Americans must choose the direction they wish to take. If left to make the choice itself, the Bush administration will lead the United States into a potentially devastating war against Iraq, which will undoubtedly increase the already simmering hatred toward the United States in most of the poorer areas of the world. The only way that Mr. Bush can be derailed from the perpetual war he seeks to wage is if the American people make their voices heard so clearly and persistently that Congress will have no alternative but to stand up to the President and say No! If the American people choose to docilely follow Mr. Bush into war against Iraq, we should not be surprised when the next front of the war returns to America in the form of increased terrorism.

    Looking Back at September 11th

    As we approach the first anniversary of the terrorist attacks of September 11, it is worth reflecting on how little has been accomplished and how much has been lost in the past year. We have demonstrated that our military machine is powerful and can smash poor countries farther back into the stone age, but we are not capable of finding Osama bin Laden, nor of putting an end to terrorism. We have demonstrated that civil liberties can be curtailed in the effort to combat terrorism, but our airports seem no safer today than they were on the day of the terrorist attacks.

    We have an administration committed to perpetual war, an administration busy seeking new targets for attack. We have a new doctrine of “pre-emption,” one that the Bush administration is pushing to engage in “regime change” in Iraq, with little regard for the consequences. In the past year, the Bush administration has become even more disdainful of international law than it was previously. The administration seeks cooperation only on its own terms, and primarily for our wars on terrorism, on drugs and on the Bush-designated “axis of evil.” When it comes to arms control and disarmament, sustainable development and environmental protection, and support for human rights, the Bush administration is AWOL.

    Some wonder how September 11 may be remembered in American history. I think it is likely to be remembered, at least shorter term, as the day that Americans were forced to face their own vulnerability, the same vulnerability that most of the world experiences daily. It may also be remembered as the day that opened the door to Orwell’s 1984 becoming the American reality the day that the Bush administration assumed the role of Big Brother. September 11 may be remembered as the day that initiated a headlong thrust towards trading our civil liberties for vague promises of security, and the day we received in return only the prospects of a permanent state of war.

    Longer term, how posterity will remember September 11 will depend entirely on our ongoing response to it. If we continue attempting only to seek out terrorists to pound with our military force, the events of September 11 will mark a turning to ultimate disaster, to the undermining of global security and the security of the American people. September 11 brought out an immense display of American nationalism and flag-waving, and the anniversary of the attacks will undoubtedly bring out more of the same. This hyper-nationalism and its militaristic manifestations are dangerous reflections of our national insecurity.

    Following September 11, the world was at first tremendously sympathetic to America for our loss, but that sympathy has by now mostly been replaced by apprehension and anger. The administration’s reliance on military force, its undermining of international law in treaty after treaty, and its failure to provide leadership toward a more peaceful and equitable world have demonstrated arrogance and disrespect for the world’s people. If the United States does not change its policies and use its enormous power to build a more equitable world, there are likely to be more tragedies like September 11 in our future.

    If, on the other hand, the events of September 11 were to result in Americans realizing the need for our leadership to achieve a new cooperative global order, rooted in international law, to solve the vast array of critical problems in our world such as poverty, environmental devastation, human rights abuses and the threat of weapons of mass destruction then these terrorist attacks will be remembered as a terrible but critical wake-up.

    Judging from our approach to date, there are few signs that America has awakened to the need for this kind of positive leadership. We have not yet begun to explore diplomatic and cooperative paths to change, nor the deeper question of why the attacks occurred. Rather, we have become more isolationist and unilateralist, more focused on ourselves to the exclusion of the rest of the world.

    The “regime change” that is needed most in the world is not by war in Iraq, but by peaceful means in the United States. This regime change, by means of the ballot, would bring far more security to the American people and the people of the world than toppling Saddam.

    The American people are challenged as never before to bring an end to terrorism by supporting policies fulfilling the promises of democracy and dignity for all in our troubled world. This will require not only regime changes, but also sea changes in our thinking and actions. It must begin with ordinary citizens having the courage to speak out clearly, forcefully and repeatedly about the dangerous militaristic and authoritarian direction that our country is taking under the Bush administration.

    Policies Rooted In Arrogance Are Certain To Fail

    These are difficult times for peace. Since the Bush administration assumed power in the United States, there has been a steady beating on the drums of war accompanied by a systematic undermining of the foundations of international law. The September 11th terrorist attacks against the World Trade Center and the Pentagon bolstered the Bush administration’s plans to secure US global military dominance through increased military budgets, deployment of missile defenses, development of more usable nuclear weapons and the weaponization of space. Congress has largely acquiesced in supporting these plans.

    The United States has always held to a double standard with regard to nuclear weapons. This double standard was given legal form in the 1970 Nuclear Non-Proliferation Treaty (NPT), in which five countries were designated as nuclear weapons states (United States, Soviet Union, United Kingdom, France and China), and the rest were designated as non-nuclear weapons states. The latter agreed in the treaty not to develop or acquire nuclear weapons in exchange for a promise by the nuclear weapons states to pursue good faith negotiations to achieve nuclear disarmament.

    Throughout the life of the NPT, the non-nuclear weapons states have called for more tangible signs of progress toward achieving the nuclear disarmament promise of the nuclear weapons states. They were successful in 2000 in getting the nuclear weapons states to commit unequivocally to undertake the elimination of their nuclear arsenals. However, the nuclear weapons states, and particularly the United States, have broken this promise as well as a string of other promises with regard to their NPT obligations.

    Now the United States has gone even further. It has developed policies for the preemptive use of nuclear weapons. In its secret 2001 Nuclear Posture Review, which was leaked to the media in March 2002, the United States outlined its intention to develop contingency plans for the use of nuclear weapons against seven countries (Iraq, Iran, Libya, Syria, North Korea, Russia and China). Five of these are non-nuclear weapons states, which at a minimum contradicts the spirit of the NPT as well as previous US security assurances to non-nuclear weapons states.

    President Bush, flush with popularity from his war against Afghanistan, continues to threaten war against Iraq. The principal reason he gives for attacking Iraq is to replace its leader, Saddam Hussein, and to preemptively strike Iraq for its refusal to allow UN inspectors to assess whether or not it is developing weapons of mass destruction.

    Prior to the Bush administration, the US had a policy of nuclear deterrence, far from a policy that provided the United States with security from nuclear attack. The Bush administration has criticized deterrence policy but yet maintained it, while at the same time promoting policies of preemption.

    Preemption is the new catch-word of Bush’s nuclear policy. It is a means of assuring that a nuclear double standard continues to exist. It is a policy of nuclear apartheid in which select states are bestowed (or bestow upon themselves) nuclear privilege while others are attacked for seeking to enter the elite club of nuclear powers.

    Ironically, Bush’s nuclear policy makes it more likely that terrorists will obtain nuclear weapons or materials. The fraudulent arms control agreement that was signed in May 2002 by Bush and Putin, the Strategic Offensive Reductions Treaty (SORT), allows thousands of nuclear warheads to be put in storage rather than destroying them. These stored nuclear warheads will be tempting targets for terrorists as will be the thousands of tons of nuclear materials available throughout the world that could be fashioned into nuclear or radiological weapons. The Bush administration is spending only approximately one-third of the three billion dollars per year called for by the US blue ribbon commission to prevent Russian nuclear materials from falling into the hands of terrorists.

    Bush’s withdrawal from the Anti-Ballistic Missile (ABM) Treaty and his advances toward deployment of missile defenses are compelling China to substantially strengthen its nuclear forces aimed at the United States, as China forewarned it would do in these circumstances. Under Bush’s leadership, US allies in Europe and Asia will be brought in as “partners” in a global missile defense system that will be hugely expensive, unlikely to be effective and provide no protection against terrorists who would initiate their attacks, nuclear and otherwise, without launching missiles.

    Mr. Bush is squandering US leadership potential for global cooperation under international law, and instead pursuing policies that are based on military dominance, uncertain technology and nuclear apartheid. They are policies rooted in arrogance and certain to fail. They are, in fact, already failing by their allocation of resources to increasing the militarization of the planet rather than to meeting existing basic human needs that would help eradicate the fertile breeding grounds for continued terrorism and hatred of the United States.

    Peace Declarations From Hiroshima and Nagasaki

    Hiroshima and Nagasaki are the two most important places in the world where memory is preserved about what nuclear weapons do to people and to cities. Each year on August 6th and 9th respectively, the anniversaries of the bombings, the mayors of Hiroshima and Nagasaki deliver the Peace Declarations for their cities. These statements provide a pulse of the status of efforts to eliminate the nuclear weapons threat to humanity and all life.

    On the 57th anniversary of the bombing of Hiroshima, Mayor Tadatoshi Akiba lamented that the painful experience of those who survived the bombings “appears to be fading from the collective memory of humankind,” and that consequently “the probability that nuclear weapons will be used and the danger of nuclear war are increasing.”

    Mayor Akiba noted that the “path of reconciliation…has been abandoned.” He called for “conscientious exploration and understanding of the past.” To achieve this end, he called for establishing a “Hiroshima-Nagasaki Peace Study Course in colleges and universities around the world,” and indicated that plans for this are already in progress. He also urged President Bush to visit Hiroshima and Nagasaki to “confirm with his own eyes what nuclear weapons hold in store for us all.” Thus far, no American president has visited either city.

    Mayor Akiba called upon the government of Japan “to reject nuclear weapons absolutely and to renounce war.” The Japanese government, he said, “has a responsibility to convey the memories, voices, and prayers of Hiroshima and Nagasaki throughout the world, especially to the United States, and for the sake of tomorrow’s children, to prevent war.”

    Mayor Iccho Itoh of Nagasaki condemned the United States for its withdrawal from the Anti-Ballistic Missile (ABM) Treaty; its rejection of the Comprehensive Test Ban Treaty; and its plans to move forward with missile defenses, to develop a new generation of nuclear weapons, and to use preemptive nuclear strikes. “We are appalled,” he said, “by this series of unilateral actions taken by the government of the United States, actions which are also being condemned by people of sound judgment throughout the world.”

    Mayor Itoh called for the government of Japan to confirm in law the three non-nuclear principles that have guided Japan (that it will not possess, manufacture or allow nuclear weapons into the country). He also called for the Japanese government to help create a Northeast Asian Nuclear Weapons Free Zone, to cease its reliance on the US “nuclear umbrella,” and “to enhance the welfare of aging atomic bomb survivors residing both within and outside Japan.”

    Mayor Itoh announced that the City of Nagasaki would be hosting in 2003 a second worldwide gathering of civil society organizations to add impetus to efforts to eliminate nuclear weapons. The City of Nagasaki, he said, will also be reaching out to youth by promoting the Nagasaki Peace Education Program.

    “The abolition of nuclear arms through mutual understanding and dialogue,” said Mayor Itoh, “is an absolute precondition for the realization of a peaceful world. It is up to us, ordinary citizens, to rise up and lead the world to peace.”

    Ordinary citizens of the United States must soon come to understand the critical message of Hiroshima and Nagasaki being conveyed by the mayors of these cities on behalf of those who perished and those who survived the atomic bombings. Without such understanding, and with such enormous power left in the hands of men like George W. Bush and many of his advisors shaping nuclear policy, the world moves closer to the day when more cities will share the fate of Hiroshima and Nagasaki.

    Peace And Sustainable Development Will Rise or Fall Together

    It is not likely that peace can be maintained in the longer term without sustainable development. Similarly, it is unlikely that sustainable development can take place in a climate dominated by war and the preparations for war.

    In order to assess the prospects for both peace and sustainable development, we must take into account the broad global trends of our time: political, economic, military and cultural. I will attempt to provide some perspective on these trends.

    Political

    In the aftermath of the Cold War, there was a breakdown of the post World War II bipolar balance of power. The United States emerged as the dominant global power, while the Russians have struggled to maintain their economy and their influence. Instead of extending a gracious hand of support to the Russians, as the United States did for Western Europe, including the vanquished nations, and Japan after WWII, the US has sought to extend its global reach and, in general, forced the Russians to accept compromising positions, such as the expansion of NATO into Eastern Europe.

    At the same time, the United States has generally opposed the expansion of international law, including human rights law, and has withdrawn its support from many key treaty commitments, including the Anti-Ballistic Missile Treaty, the Comprehensive Test Ban Treaty, the International Criminal Court, the Kyoto Accords on Climate Change, and the Protocol to verify the Biological Weapons Convention. Almost daily there are reports of new US assaults on international law.

    As the United States has sought to extend its power unilaterally, it has undermined the international political process established after World War II that operates through the United Nations. The US has withheld economic support from the United Nations and only sought to use it when the US perceived that its own interests could be directly advanced, as in the cases of the Persian Gulf War and the more recent US-led war on terrorism.

    In the past, new coalitions have formed to provide a check on one country asserting global dominance. It is perhaps too early to see clearly the shape of a new coalition that might arise in response to US dominance, but if history is a guide there will be one. Even without any major coalition of forces arising, however, the US will remain challenged by terrorists seeking to avenge themselves against the US for policies that have adversely affected their lives, cultures and countries.

    Economic

    The US has promoted the forces of globalization that have opened the doors for capital to move freely to countries where the costs of labor are cheapest and the environmental regulations are most lax. Despite claims by Western leaders that benefits would accrue to the neediest, this “globalization from above” has continued to shift economic benefit from the poor to the wealthy, and has not provided substantial increased benefit to the poor of the world. Nearly half the world’s population continues to live in conditions of poverty, characterized by inadequate food, water, shelter and health care. These conditions create a fertile breeding ground for terrorists committed to the destruction of US dominance and its imperial outreach.

    Further, global military expenditures are approximately $800 billion per year. These funds are largely used to repress and control the poor, when in actuality, for a small fraction of these global expenditures, the conditions of poverty could be largely eliminated. Of the $800 billion spent worldwide on military forces, the US spends approximately one-half of the total. This trend has been on a steady rise since the Bush administration came into power.

    The rich countries of the world have done little to alleviate the crushing burdens of poverty or to aid in redressing the indignities and inequities still existing after long periods of colonial rule. There is much cause for unease throughout the developing world, which is giving rise to continued low intensity warfare as exemplified by the Palestinian struggle against the Israelis and events such as the September 11th attacks against the United States.

    Military

    In the post-Cold War period, the US has pulled far ahead of the other nations of the world in terms of military dominance. The US is able to control NATO policy and has used NATO as a vehicle for its pursuit of military domination. In addition to dramatically increasing its military budget in recent years, the US has announced plans for high-tech developments that include missile defense systems, more usable nuclear weapons and the weaponization of space.

    Despite its push for global military dominance, however, the nature of today’s weapons limit the possibility of any country having unilateral dominance. Nuclear weapons, for example, are capable of destroying cities, and there is an increased likelihood in the aftermath of the Cold War that these weapons could fall into the hands of terrorists capable of attacking largely, if not completely, with impunity. Thus, the most powerful weapons that have been created have greater utility for the weak (if they can get their hands on them) than they do for the strong (who may be reluctant to exercise such power and also unable to if they cannot identify and locate the source of the attack).

    Cultural

    The world is definitely experiencing a clash of cultures, but not along the fault lines of civilizations as Samuel Huntington has suggested. The opposing cultural trends that are most dominant are between those who define the world in terms of the value of massive accumulation and immediate use of resources (powerful individuals, corporations and the national governments that provide a haven for them) and those who define the world in terms of shared rights and responsibilities for life and future generations (most of the world’s people). The former values, reflected predominantly by the economic elites in the United States and many other countries and constantly on display through various forms of media, do not promote sustainable development, wreak havoc on the poor of the world and invite retaliation. The latter values are reflected in the Universal Declaration of Human Rights and the growing body of international human rights law that has developed since World War II.

    Dominant Trends

    The dominant world trends today are:

    • Unilateralism by the United States and a downplaying of collective political responsibility;
    • Growing and increasingly desperate economic disparity between the world’s rich and poor;
    • A push for military dominance by the United States in particular and the Western states through NATO more generally, offset by the flexibility of terrorists who may obtain nuclear and other weapons of mass destruction; and
    • The cultural dominance of greed and selfishness portrayed by global media on a broad screen for all, including the poor, to see from throughout the world.

    These trends are destabilizing and unsustainable. They can change by democratic means from within democratic states or they can continue until the world is embroiled in conflagration. That is a choice that is available to us for a relatively short period of time as the trends are already quite advanced. The changes needed are:

    • A shift to multilateralism, involving all states, through a reformed and strengthened United Nations;
    • Implementation of a plan to alleviate poverty and economic injustice throughout the world;
    • A shift from US and NATO military dominance to the implementation of the post World War II vision of collective security; and
    • A shift toward implementation of international law in which all states and their leaders are held to high standards of protecting human rights and the dignity of the individual.

    The United Nations World Summit on Sustainable Development, set to take place in Johannesburg, South Africa in August 2002, will fail dramatically unless it takes into account these dominant trends and the need to shift them in more sustainable and peaceful directions.

    We are gathered in community at this beautiful garden, as others are gathered in Hiroshima and throughout the world, to remember the horror and consequences of the use of nuclear weapons so that we may help assure that there are not future Hiroshimas and Nagasakis.

    Sadako Peace Garden, named for Sadako Sasaki, a young victim of the Hiroshima bombing, is dedicated to all who work for peace and a nuclear weapons free world.

    On this occasion, I would like to offer three suggestions.

    First, believe in your dreams. No dream is impossible, even a world at peace, even a world free of nuclear weapons. Eleanor Roosevelt once said, “The future belongs to those who believe in the beauty of their dreams.” The world and future generations badly need for us to believe in these dreams and to keep hope alive.

    Second, dedicate yourself to making your dreams become reality. Einstein said, “The world is a dangerous place to live, not because of the people who are evil, but because of the people who don’t do anything about it.” I urge you to act upon your dreams, act for a better, more peaceful world, free of the threat of nuclear holocaust.

    Third, never give up. Here is what the Dalai Lama says about never giving up.

    NEVER GIVE UP

    No matter what is going on
    Never give up
    Develop the heart
    Too much energy in your country
    Is spent developing the mind
    Instead of the heart
    Be compassionate
    Not just to your friends
    But to everyone
    Be compassionate
    Work for peace
    In your heart and in the world
    Work for peace
    And I say again
    Never give up
    No matter what is going on around you
    Never give up

    In concluding, I’d like to share a recent poem about Einstein, one of my heroes, a great scientist and even greater humanitarian, a man who never gave up.
    EINSTEIN’S REGRET

    Einstein’s regret ran deep
    Like the deep pools of sorrow
    That were his eyes.

    His mind could see things
    That others could not,
    The bending of light,

    The slowing of time,
    Relationships of trains passing
    In the night, and power,

    Dormant and asleep,

    From Hiroshima to Hope

    August 6th. Hiroshima Day. A time for reflection, for listening to the sounds of birds and water, the rustling leaves, for remembering who we are.

    We remember Hiroshima not for the past, but for the future. We remember Hiroshima so that its past will not become our future. Hiroshima is best remembered with the plaintive sounds of the bamboo flute, the Shakuhachi. It conjures up the devastation, the destruction, the encompassing emptiness of that day. The Shakuhachi reveals the tear in the fabric of humanity that was ripped opened by the bomb. Through that tear we could all be sucked as into a black hole in the universe of decency.

    Nuclear weapons are not weapons at all. They are a symbol of an imploding human spirit. They are a fire that consumes the crisp air of decency. They are a crossroads where science joined hands with evil and apathy. They are a triumph of academic certainty wrapped in the arrogance and convoluted lies of deterrence. They are Einstein’s regret. They are many things, but not weapons — not instruments of war, but of genocide and perhaps of omnicide.

    Those who gather to retell and listen to the story of Hiroshima and of Sadako are a community, a community committed to a human future. We may not know one another, but we are a community. And we are part of a greater community gathered throughout the world to commemorate this day, seeking to turn Hiroshima to Hope.

    If we succeed, the child Sadako of a thousand cranes, who would have been an older woman now, will be remembered by new generations. She will be remembered long after the names and spirits of those who made and used and celebrated the bomb will have faded into the haunting sounds of the Shakuhachi.

    Law vs. Force

    An important marker of civilization has always been the ascendancy of law over the unbridled use of force. At the outset of the 21st century, we are faced with a pervasive dilemma. Reliance on force given the power of our destructive technologies could destroy civilization as we know it.

    The trials at Nuremberg and Tokyo following World War II were an attempt to elevate the force of law over the law of force. The newly created International Criminal Court, which will bring the Principles of Nuremberg into the 21st century, is supported by all major US allies. Unfortunately US leaders are opposing the Court and seem to fear being held to the same level of accountability as they would demand for other leaders.

    Of course, law does not prevent all crime. It simply sets normative standards and provides that those who violate these standards will be punished. In the case of the most heinous crimes, the remedies of law are inadequate. But even inadequate remedies of law are superior to the unbridled use of force that compounds the injury by inflicting death and suffering against other innocent people. Perpetrators of crime must be brought before the bar of justice, but there must also be safeguards that protect the innocent from being made victims of generalized retribution.

    When an individual commits a crime, there should be clear liability. When a state commits a crime, however, who is to be held to account? According to the Principles of Nuremberg that were applied to the Axis leaders after World War II, it should be the responsible parties, whether or not they were acting in the service of the state. At Nuremberg, it was determined that sovereignty has its limits, and that leaders of states who committed serious crimes under international law would be held to account before the law. These crimes included crimes against peace, crimes against humanity and war crimes.

    Without the international norms that are established by law, the danger exists of reverting to international anarchy, in which each country seeks its own justice by its own means. Only established legal norms, upheld by the international community and supported by the most powerful nations, can prevent such chaos and the ultimate resort to war to settle disputes. International legal norms are essential in a world in which violence can have even more fearful results than were first experienced at Hiroshima and Nagasaki.

    International law is needed if we are to abolish war before war abolishes us. We cannot have it both ways. If we choose law, the nations of the world must join together in a common effort to support and enforce the law. Albert Einstein, the great 20th century scientist and humanitarian, wrote, “Anybody who really wants to abolish war must resolutely declare himself in favor of his own country’s resigning a portion of its sovereignty in favor of international institutions: he must be ready to make his own country amenable, in case of a dispute, to the award of an international court. He must in the most uncompromising fashion support disarmament all around….”

    In recent years, the United States has pulled away from international law by disavowing treaties, particularly in the area of disarmament, and by withdrawing its support from the International Criminal Court. Without US leadership in support of international law, force rather than law will gain strength as the international norm. Relying on force may be tempting to the most powerful country on the planet, but it portends disaster, not least for the United States itself.

    Unusual Courage from 31 Members of Congress

    Thirty-one courageous members of Congress, led by Rep. Dennis Kucinich (D-OH), are challenging the president’s unilateral withdrawal from the Anti-Ballistic Missile (ABM) Treaty. These representatives deserve our appreciation for taking action to prevent Mr. Bush from trampling on the Constitution in his continuing effort to undermine international law and expand US military domination.

    This is a critical challenge to the abuse of presidential authority. A lot is riding on it. If the president can unilaterally voids our laws, which ones will be the next to go? Perhaps the first and fourth amendments? If your congressional representative is not one of the 31 parties to this lawsuit, he or she should be asked why not and urged to join the lawsuit and support it in the Congress.

    Not a single US Senator has had the courage to join this lawsuit. Sen. Russell Feingold (D-WI) initially indicated his intention to join the lawsuit, but then backed off when his request to receive pro bono legal services was not approved by the Senate Ethics Committee. All US Senators should also be urged to join in this challenge.

    The ABM Treaty required a two-thirds vote of the Senate in 1972 for ratification to enter into force and to become US law. Now the 100 members of the Senate appear content to sit on the sidelines as the president unilaterally nullifies the law they made.

    Rep. Lynn Woolsey (D-CA), a plaintiff in the lawsuit, recently wrote: “The ABM Treaty is the cornerstone of international arms control. Now that more countries have nuclear weapons, international treaties are even more important. International cooperation is the way to peace and international security; not increased military build-up. Over the past 30 years, the ABM Treaty has been a vital link to working with the international community and it is more important than ever that we not turn our back on it.”

    Meanwhile, at Fort Greely, Alaska, the Bush administration has broken ground on six underground missile interceptor silos, is spending more than $7 billion on missile defense this year, and continues to move ahead with its plans to weaponize outer space in order to protect US interests and investments throughout the world.

    Meanwhile, the Russians have withdrawn their ratification of the START II Treaty in response to the US withdrawal from the ABM Treaty. This opens the door for the Russians to use multiple independently targeted warheads (MIRVs) on their missiles.

    Meanwhile, the leaders of India and Pakistan, following the example of US leaders, act as though nuclear deterrence will prevent a nuclear war between them as they confront each other over Kashmir.

    Thank you, Representatives Kucinich and Woolsey and your colleagues in this lawsuit for demonstrating unusual courage at a difficult time.
